Contaminant Concentrations A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, ESA Information has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. QP Profile Information The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. Certification Statement As of 2012/12/18, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, QP Certification Statement there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property Owner Certification Statement will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the Supporting Documents supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2012/12/18, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2012/12/18, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 2012/12/18. PHASE TWO CONCEPTUAL SITE MODEL The Phase Two Conceptual Site Model consists of this text and the following drawings:

The RSC property (herein referred to as the subject site) is a rectangular shaped parcel of land with an area of approximately 0.1 hectares (0.28 acres) located approximately 360 m east of and 80 m north of in the City of Toronto. For the purposes of this report Queen Street is assumed to be oriented in an east-west direction and Beverley Street is assumed to be oriented in a north-south direction. Based on the findings of the Phase One ESA completed by SPL, the property was historically utilized for residential purposes since the 1960s. The 1939 aerial photograph indicated the property was developed with residential dwellings and the surrounding properties appear to be developed with residential and commercial land uses. Fire Insurance Plans depict the RSC property as constructed with residential buildings, with some commercial and industrial land uses as part of the surrounding properties. The potentially contaminating activities on the subject site include: fill material of unknown environmental quality, de-icing agents for maintenance of roadways on the property, gasoline and associated products storage in fixed tanks, known exceedances based on previous reports. Potentially contaminating activities within the phase one study area include: gasoline and associated products storage in fixed tanks and waste disposal and waste management. As a result of the Phase One Environmental Site Assessment conducted by SPL Consultants Limited, the potentially contaminating activities were assessed to be: o Importation of fill material of unknown quality, gasoline and associated products storage in fixed tanks, use of de-icing agents for winter maintenance of roadways on the Phase One Property. o The north and west adjoining properties and east and west neighbouring properties were identified as having a potentially contaminating activity resulting from gasoline and associated products storage in fixed tanks and waste disposal and waste management, including thermal treatment, landfilling and transfer of waste, other than use of biosolids as soil conditioners. Contaminants of potential concern as a result of the potentially contaminating activities on the subject site and neighbouring properties include: metals & organics, PCBs, PAHs, PHCs and VOCs. Underground utilities were present on the Phase Two Property. However, during excavation activities as part of the development they were subsequently decommissioned with the demolition of the on-site buildings. The findings of the Phase Two ESA indicate that the RSC property generally has a layer of fill material ranging from 0.8 to 1.0 m. The fill material is heterogeneous and consisted of loose to compact gravelly sand, clayey silt and silty sand. Trace to some inclusions of organics and brick fragments were noted in the fill. Below the fill material upper native soil consisting of clayey silt was encountered overlying silty sand and silty clay in places. Occasional to frequent seams of sand were present in clayey silt deposits. Below the clayey silt, silty sand deposits were encountered overlying silty clay. Below silty sand or clayey silt till, silty clay followed by silty clay till was encountered overlying shale bedrock. Inferred bedrock was encountered at depths varying from 11.6 to 13.7 m below grade. Based on the Ontario Base Map, ground surface elevations on the RSC Property is approximately 89-91 masl. The depth to bedrock on the RSC is approximately 76 to 78 masl. Surficial geology maps for the area (OGS Earth website published by the Ontario Ministry of Northern Development, Mines and Forestry) show surficial soils on the RSC Property as stone-poor carbonate- derived sand to silty clay till. The bedrock geology maps (OGS Earth website, published by the Ontario Ministry of Northern Development, Mines and Forestry) show bedrock in the area of the RSC Property is the Georgian Bay Formation, that generally consists of shale, limestone, dolostone and siltstone. The RSC property is neither an environmentally sensitive area nor is it located within an area of natural and scientific interest. During the Phase Two study, soil samples were collected and analyzed for pH. The results show that pH is within the acceptable range for the application of the MOE Table 3 Standards. The RSC property is not a shallow soil property as defined in Section 43.1 of the regulation; nor does it include all or part of a water body; is adjacent to a water body; or, includes land that is within 30 m of a water body. No soils have been imported or placed on, in or under the RSC property during SPLs Phase Two ESA. Based on topographical maps the groundwater flow direction is expected to be in a south westerly direction towards Lake Ontario. Groundwater levels may be influenced by subsurface utility trenching, however no utilities are present on the property. Groundwater flow direction can only be confirmed with longer term monitoring. Groundwater levels measured onsite were in the native soil at depths ranging from 4.41 and 6.82 m below ground surface. Groundwater samples were collected from the upper groundwater unit in the overburden. The hydraulic gradient calculated based on the groundwater levels measured during the investigation ranged between 0.055 and 0.067. The groundwater flow direction is in a southwesterly direction. The Phase Two investigation consisted of soil and groundwater sampling on the subject site. Some of the boreholes were converted to monitoring wells for water level monitoring and the collection of groundwater samples. Soil samples were collected for the analyses of metals and inorganics, VOCs, PHCs, PAHs and PCBs. Groundwater samples were collected for the analyses of metals and inorganics, VOCs, PAHs and PHCs. Soil and groundwater analyses on the property were compared to the Table 3 Standards for residential/parkland/institutional land use in a non-potable groundwater condition with coarse-grained soils from the Ministry of the Environment (MOE) document “Soil, Ground Water and Sediments Standards for Use Under Part XV.1 of the Environmental Protection Act” (2011). Chemical analyses were conducted by AGAT Laboratories and ALS Environmental. AGAT and ALS are members of the Canadian Association for Laboratory Accreditation (CALA) and meet the requirement of Section 47 of O.Reg. 153/04 certifying that the analytical laboratory be accredited in accordance with the International Standards ISO/IEC 17025 and with standards developed by the Standards Council of Canada. A review of the chemical testing results indicated that soil with concentrations of parameters exceeding the 2011 MOE Table 3 Standards were identified along the eastern limits of the RSC property. The contaminants identified include boron (hot water extractable), mercury, Electrical conductivity (EC) and Sodium Adsorption Ratio (SAR). The sources of the contaminants are likely attributed to the quality of the fill material on the property and winter de-icing agents applied to the adjacent roadways. The impacts were only identified in soil as groundwater testing demonstrated no parameters had concentrations at or above the applicable Standards. Migration from the source area into the surrounding area is not expected. Utilities were present on the property. However, during excavation activities as part of the development they were subsequently decommissioned with the demolition of the on-site buildings. Due to the type of contaminants encountered and the depths of the exceedances it is unlikely that the utilities would act as a pathway for migration of the contaminants. The impacts were identified on the RSC property at a maximum depth of 2.5 m below grade. Since the groundwater levels encountered during the Phase Two ESA in the areas of the exceedances are below the zone which there is impacted soils, it is unlikely that groundwater would act as a migration pathway for contaminants. It is unlikely that groundwater fluctuations due to meteorological or climatic conditions would affect the migration of contaminants on the property as all groundwater samples met the applicable Standards. The locations where soil was identified to be above the MOE Table 3 Standards on the RSC property were removed during bulk excavation activities for the property. Confirmatory samples were taken of the floor of the excavation. As shoring walls were installed along the entire limits of the property no sidewall samples could be retrieved. A review of the chemical analysis for the confirmatory samples indicated that all remaining soils met the MOE Table 3 Standards for residential/parkland/institutional property uses. As part of the development, soils were removed from the property. Approximately 1,500 m3 was removed prior to the confirmatory samples. Exposure to impacted soils is expected to be minimal as the impacted soil was removed from the property by excavation equipment as part of the remedial activities. The primary exposure pathway for the soil impacts would be dermal contact and inhalation. As no significant ecological habitat is present on-site it is expected that the risk to ecological receptors is minimal. Workers may have come into contact with soil during construction, but this is expected to be minimal as heavy equipment is typically used to remove soil from the property. All groundwater samples analyzed as part of the Phase Two ESA had concentrations of the parameters tested below the MOE Table 3 Standards. As no groundwater impacts were identified and the soil impacts were above the water table and subsequently removed, it is not expected that the impacts observed present a significant migration risk. Due to the types of exceedances encountered on the property information regarding the soil vapour intrusion of the contaminants of concern into buildings and subsurface structures is not warranted. In conclusion, after remediation, all soil and groundwater samples submitted for analysis as part of this investigation met the MOE Table 3 RPI Standards released in 2011. An assessment of meteorological conditions that may have affected distribution and migration of contaminants was deemed not applicable. As there are no remaining soil or groundwater impacts, human health risks are not anticipated.
