On the other hand, the law enforcement of intellectual property rights, both substantive factor (the statutory rules) and cultural factors of community law (the law of consciousness), the role of law enforcers is also important in achieving the effectiveness of a rule in the framework of the statutory copyright law enforcement of songs in Denpasar which is, in fact, hijacking song copyright works seems that it cannot be prevented successfully. So it should be questioned what factors are causing the law enforcers, in this case the resort police investigators of Denpasar less able to prevent infringement of copyright songs in the region of Denpasar. Through the methods of empirical data collected through the questionaries‘ and interviews then analyzed and finally a conclusion was drawn which states that the mechanism of Denpasar police resort in tackling piracy in copyrighted songs in Denpasar was conducted pre-emptively, preventively and repressively, but because some factors are not met in an effort to track copyright piracy prevention, the legal protection of copyrighted songs can not be achieved optimally.     ARC Federation Fellowship ‘Islam and Modernity: Syari'ah, Terrorism and Governance in South-East Asia’ Professor Tim Lindsey Background Paper #1 Anti-Terrorism Law and Criminal Process in Indonesia By Simon Butt1 1 The author thanks Professor Tim Lindsey, Director of the Asian Law Centre and ARC Federation Fellow at the University of Melbourne, for helpful advice in the preparation of this paper. 1 This paper describes and analyses Indonesia’s Anti-terrorism Law (ATL) of 2002 – a statute that has caused significant legal controversy in Indonesia. The ATL was signed into law by Indonesia’s then President Megawati Soekarnoputri on 18 October 2002, six days after the Bali bombings took place. The Law had first been drafted in April 2002, in response to the September 11 incident in New York in 2001,2 but clearly the Bali bombing accelerated its finalisation. The ATL has been used to investigate and convict those involved in the bombing of the Marriot Hotel in Jakarta in August 2003, the Australian Embassy in Jakarta in September 2004, and the second round of Bali bombings in October 2005. More controversially – for reasons discussed below – the ATL was also used to convict many of those involved in the October 2002 Bali bombings. It has also relied on to investigate, prosecute and convict in cases arising in regional conflict settings, such as in Poso and Maluku.3 At the time of the ATL’s enactment, then President Megawati Soekarnoputri announced that Indonesia lacked a ‘legal basis to act quickly and strongly to handle terrorism’.4 In a similar vein, the then Minister for Justice and Human Rights, Yusril Izra Mahendra, announced that the perpetrators of the 2002 Bali bombings could not be effectively pursued under the then existing laws.

ADI Journal on Recent Innovation (AJRI), 1(2), 98-106 DOI : https://doi.org/10.34306/ajri.v1i2.29 Abstract Tattoos in the realm of Indonesian culture has now entered the realm of the tourism industry. Bali in particular, the tattoo is a promising industry, especially in tourist destinations. The presence of rapid tourism development and support of information technology provides opportunities for the enrichment of works in tattoos. Previous influence of outer style on a tattoo in Bali give the effect of shifting perspective to tattoo phenomenon during this time. Changes also occur in ornaments that penetrate the art or tradition ornaments because previously this is a taboo to do. The first step is to collect the data purposively so that it can be interpreted and described in a qualitative comparative analysis. The existence of commodities makes an indication of commodification in the practice of tattoo Balinese script, and there is the hidden motivation behind it. The meaning that can be extracted in this phenomenon is the symbolization that is understood only by the artist and his collector. This situation is symbiotic with the market changing the value that exists in the object and also emerges a creative effort that impacts on the sustainability of traditional Balinese script.

Professor Lindsey will research “Islam and Modernity: Syari’ah, Terrorism and Governance in South-East Asia”. Terrorism in Southeast Asia responds to challenges that western- derived modernity poses for Islam, including market economies, democracy and nation states. Professor Lindsey will examine the different responses to these challenges through research in regional Muslim communities, institution building, mentoring young scholars and community engagement in the Southeast Asian ARC region. The Fellowship also aims to help strengthen the University of Melbourne’s Federation new Centre for Islamic Law and Society as a hub for research and public Fellowship engagement on issues related to Islam and law in our region.     Chapter 20 The Bali Bombing, East Timor trials and the Aceh Human Rights Court – retrospectivity, impunity and constitutionalism Ross Clarke When the Second Amendment to Indonesia’s 1945 Constitution was passed in 2000, it appeared the fledgling democracy was taking a significant step away from the repression and violence of the New Order and embracing a new era of human rights protection. While the gains were significant, particularly as they appeared on paper, one provision was to have a profound impact on steps to hold accountable per- petrators of crimes against humanity. The prohibition of retrospective1 prosecution stipulated in Art 28I(1) (and especially the fact that the provision ‘cannot be limited under any circumstances’) became a thorn in the side of attempts to bring to justice both senior TNI (Tentara Nasional Indonesia, Indonesian National Army) officers, and some of the perpetrators of the Bali Bombing. Because legislation drafted to prosecute the perpetrators in both cases was enacted after the alleged crimes occurred, it appeared that Art 28I(1) could render trials based on retrospective pro- secution invalid. Similar arguments were made by lawyers for military and militia defendants charged with human rights offences in trials in the Ad Hoc Human Rights Court for East Timor. At the trial level, judges dismissed these arguments and convicted defen- dants under retrospective legislation. Cases then made their way up the appeal chain and one case came before Indonesia’s newly-established Constitutional Court. On appeal, Bali bomber Masykur Abdul Kadir argued that his conviction breached the Constitution as the legislation he was prosecuted under operated retrospectively.
