EUROPEAN COMMISSION Brussels, C(2012) Draft COMMISSION DECISION of amending Decision C(2008) 1058 adopting the programme "Bulgaria- Serbia IPA cross- border programme" for Community assistance from the Instrument for Pre-Accession Assistance for the Cross-border Co-operation component between Bulgaria and Serbia CCI 2007 CB 16 IPO 006 (ONLY THE BULGARIAN TEXT IS AUTHENTIC) EN EN Draft COMMISSION DECISION of amending Decision C(2008) 1058 adopting the programme "Bulgaria- Serbia IPA cross- border programme" for Community assistance from the Instrument for Pre-Accession Assistance for the Cross-border Co-operation component between Bulgaria and Serbia CCI 2007 CB 16 IPO 006 (ONLY THE BULGARIAN TEXT IS AUTHENTIC) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Council Regulation (EC) No 1085/2006 of 17 July 2006 establishing an Instrument for Pre-Accession Assistance (IPA)1, and in particular Article 14(2)(a), thereof, Whereas: (1) On 12 October 2011, Bulgaria on behalf of Bulgaria and Serbia submitted a request for the revision of the "Bulgaria- Serbia IPA cross-border programme" for assistance from the Instrument for Pre-Accession Assistance (IPA), adopted by Commission Decision C(2008)1058 of 25 March 2008, as last amended by Decision C(2010) 4142. (2) The Council has adopted an European Partnership for Serbia2. (3) On 14 October 2009, the Commission adopted the multi-annual indicative financial framework (MIFF) for 2011 to 20133. (4) On 26 April 2011, the Commission adopted the Multi-annual Indicative Planning Document (MIPD) 2011-2013 for the IPA Cross-border cooperation component. (5) The proposed revision of the cross-border programme is justified by the update of the financing plan, according to the revision of the MIFF. (6) In accordance with Article 8(1) of Regulation (EC) No 718/2007, this Decision meets the requirements of Article 90 of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of 1 OJ L 210, 31.7.2006, p. 82. 2 Council Decision 2008/213/EC of 18 February 2008, OJ L 80, 19.3.2008, p.46 3 COM(2009)543 final of 14 October 2009. EN 2 EN Council Regulation No 1605/20024 and constitutes thus a financing decision within the meaning of Article 75(2) of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities5. (7) Pursuant to Article 110(5)(h) of Regulation (EC) No 718/2007 by written procedure, on 03 October 2011, the joint monitoring committee considered and approved the proposal to amend the content of Decision C(2008)1058, as regards the text of the operational programme and its financing plan. (8) The measures provided for by this Decision are in accordance with the opinion of the IPA Committee. (9) The proposed cross-border programme should therefore be amended, HAS ADOPTED THIS DECISION: Article 1 Decision C(2008)1058 is amended as follows: 1. In Article 3, paragraphs 1 to 3 are replaced by the following: "1. The maximum amount of assistance granted from the IPA under the cross-border programme, as calculated with reference to the total eligible expenditure, is set at EUR 31,369,936. In the budget year 2007, a maximum amount of EUR 2,524,310 may be committed on budget line 13 05 03. In the budget year 2008, a maximum amount of EUR 4,312,780 may be committed on budget line 13 05 03. In the budget year 2009, a maximum amount of EUR 4,714,194 may be committed on budget line 13 05 03. In the budget year 2010, a maximum amount of EUR 4,808,474 may be committed on budget line 13 05 03. In the budget year 2011, a maximum amount of EUR 4,904,646 may be committed on budget line 13 05 03. In the budget year 2012, a maximum amount of EUR 5,002,738 may be committed on budget line 13 05 03. In the budget year 2013, a maximum amount of EUR 5,102,794 may be committed on budget line 13 05 03, subject to the availability of appropriations and the approval of Budget 2013. 4 OJ L 357, 31.12.2002, p. 1. 5 OJ L 248, 16.9.2002, p.1. EN 3 EN 2. The national counterpart of EUR 5,535,871 may be partly met by loans from the European Investment Bank and other lending instruments. 3. The total amount of the assistance and the resulting co-financing rate for each priority axis under the cross-border programme shall be as set out in the second, third and fourth subparagraphs of this paragraph. The total amount of the contribution for priority axis “Development of small scale infrastructure” is set at EUR 17,253,465 and the resulting co-financing rate is set at 85%. The total amount of the contribution for priority axis “Enhancing capacity for joint planning, problem solving and development” is set at EUR 10,979,478 and the resulting co-financing rate is set at 85%. The total amount of the contribution for priority axis “Technical Assistance” is set at EUR 3,136,993 and the resulting co-financing rate is set at 85%." 2. Annex I is replaced by the text set out in Annex I to this Decision. 3. Annex II is replaced by the text set out in Annex II to this Decision.
