It argues that these works fell into a moral, legal, and commercial ‘grey zone’ in this period between the categories of the legitimate and the obscene, and that battles over these works’ publication fostered a concomitant development of sexual science and pornography. Medical and scientific publishing were unruly fields in nineteenth-century Britain, open to many different players, including fringe publishers interested in exploiting medical and scientific eroticism. This dissertation establishes for the first time how the obscenity trade, a precursor to the modern pornography industry, comprised an important route of sexual-scientific dissemination in the period. Nineteenth-century publishers of obscenity exploited the ‘grey zone’ into which medical and scientific works about sex fell to market them as erotica, bringing them into circulation alongside explicit fiction in both the popular and elite literary spheres. Such fringe publishing activity motivated rising cultural movements to situate the legitimacy of explicit representations in relation to their contexts of publication and circulation, a paradigm that this dissertation argues had a far greater impact on both literary and scientific production than previously recognized. Examining a range of social-scientific studies, translations of Eastern works, and anonymous obscene literature, it shows how new discourses and reading practices, evolving around culturally imagined links between publication context and obscenity, encouraged cross influences between emerging social-scientific disciplines and the developing genre of pornography. The first sustained study of overlaps between scientific and obscene print cultures, this thesis provides a compelling new material and discursive history which contextualizes surprising historical intersections of science and pornography that challenge current understandings of the culture of scientific knowledge during a period associated with the medicalization of sex, and makes the case for bringing publishing history and historical methods of interpretation to bear on the historiography of nineteenth-century sexual culture. While I have registered some minor disappointments with these essays, they result from the inevitable limitations of the discrete essay format and of the book's brevity. This limitation is in itself valuable, in that it points to the need for scholarship focussed squarely on the print culture of eighteenth-century Scotland, as opposed to studies such as Robert Crawford's Devolving English Literature and Leith Davis's Acts of Union: Scotland and the Literary Negotiation of the British Nation, z7o7-183o, which have made us aware of Scottish contributions to the formation of British cultural institutions. It is to be hoped that Volume II: z7o7-18oo of the projected four-volume History of the Book in Scotla~nd will further address this gap. In the interim, this handsome, well-written collection and catalogue is admirable in what it does accomplish, in putting both the Scottish culture of the book, and Canadian contributions to the study of that culture, into the hands of readers. Donahue This dissertation traces the origins of the League of Nations movement during the First World War to a coalescent international network of ecumenical figures and Protestant politicians. Its primary focus rests on the World Alliance for International Friendship Through the Churches, an organization that drew Protestant social activists and ecumenical leaders from Europe and North America. The World Alliance officially began on August 1, 1914 in southern Germany to the sounds of the first shots of the war. Within the next three months, World Alliance members began League of Nations societies in Holland, Switzerland, Germany, Great Britain and the United States. The World Alliance then enlisted other Christian institutions in its campaign, such as the International Missionary Council, the Y.M.C.A., the Y.W.C.A., the Blue Cross and the Student Volunteer Movement.     Chapter 3 Such privileges as were imported by the adoption of the Bill of Rights 3.1 Statutory recognition of the freedom of speech for members of the Parliament of New South Wales The most fundamental parliamentary privilege is the privilege of freedom of speech. In Australia, there is no restriction on what may be said by elected representatives speaking in Parliament. Freedom of political speech is considered essential in order to ensure that the Parliament can carry out its role of scrutinising the operation of the government of the day, and inquiring into matters of public concern. The statutory recognition of this privilege is founded in the Bill of Rights 1688 . Article 9 provides: The freedome of speech and debates or proceedings in Parlyament ought not to be impeached or questioned in any court or place out of Parlyament. Apart from the absolute protection afforded to statements made in Parliament, other privileges which flow from the Bill of Rights include: the right to exclude strangers or visitors; the right to control publication of debates and proceedings; and the protection of witnesses etc. before the Parliament and its committees. 1 Article 9 is in force in New South Wales by operation of the Imperial Acts Application Act 1969.2 Members are protected under this Act from prosecution for anything said during debate in the House or its committees. Despite this, in 1980 Justice McLelland expressed doubts about the applicability of Article 9 to the New South Wales Parliament in Namoi Shire Council v Attorney General. He stated that “art 9 of the Bill of Rights does not purport to apply to any legislature other than the Parliament at Westminster” and therefore, the supposed application of the article, does not extend to the Legislature of New South Wales.

INTRODUCTION Parliamentary sovereignty has proved a topic of fascination to scholars of constitutional law for many years, as the volume of literature on the subject well demonstrates. Admittedly, the interest has been greater in Commonwealth countries other than Canada. In this country, students of constitutional law have focussed their attention on the division of powers between federal and provincial governments, since federalism has presented problems requiring immediate solution. Yet even here, the question of parliamentary sovereignty has been given consideration, and it is increasingly attracting discussion as interest increases in the patriation of the constitution and statutory protection for individual and minority rights. Within a study of parliamentary sovereignty, reference is normally made to the enrolled bill principle or rule. This precept, regarded by some as an aspect of sovereignty and by others simply as a rule of evidence, states that the parliamentary roll is conclusive - an Act passed by Parliament and en- rolled must be accepted as valid on its face and cannot be challenged in the courts on grounds of procedural irregularity.

INTRODUCTION Prior articles have asserted that English criminal law is very fragmented and that a considerable amount of the older law - especially the common law - is badly out of date.1 The purpose of this article is to consider the crime of public nuisance (also called common nuisance), a common law crime. The word 'nuisance' derives from the old french 'nuisance' or 'nusance' 2 and the latin, nocumentum.3 The basic meaning of the word is that of 'annoyance';4 In medieval English, the word 'common' comes from the word 'commune' which, itself, derives from the latin 'communa' - being a commonality, a group of people, a corporation.5 In 1191, the City of London (the 'City') became a commune. Thereafter, it is usual to find references with that term - such as common carrier, common highway, common council, common scold, common prostitute etc;6 The reference to 'common' designated things available to the general public as opposed to the individual. For example, the common carrier, common farrier and common innkeeper exercised a public employment and not just a private one.

    CHAPTER 4 E.T. BELLHOUSE AND CO. ENGINEERS AND IRON FOUNDERS Edward Taylor Bellhouse (1816 – 1881), eldest son of David Bellhouse junior (1792 – 1866), was one of the leading engineers in Manchester during the nineteenth century.1 He began work as an apprentice to Messrs. Wren and Bennett beginning in about 1830. This firm was one of the leading millwright-engineering concerns in Manchester, especially in the area of cotton factories. After six and a half years with Wren and Bennett, Edward Bellhouse worked for a year as a journeyman millwright at the Coloa Mills and at the St. Helens’ Union Plate Glass Works. Another year was spent at Sir William Fairbairn’s works in the Isle of Dogs, Millwall. His last year as an employee was spent working for the Liverpool Grand Junction Railway. Bellhouse’s grandfather intended that Edward take over the foundry. His education has every appearance of having been planned by his father, using the father’s connections with Fairbairn and the glass company, for example. The Bellhouses seem to have had a continuing professional relationship with William Fairbairn. In 1832, David Bellhouse and Son built the cabin and deck for the iron canal packet boat “The Lancashire Witch constructed by Fairbairn and Lillie.2 David Bellhouse junior and Fairbairn jointly reported on the fall of the mill at Oldham in 1845.3 That same year David Bell- house and Fairbairn were corresponding about the loading of cast iron beams.4 In 1854, when Edward Bellhouse constructed a prefabricated iron customhouse for the town of Payta in Peru, Fairbairn visited the building while it was on display in Manchester.5 Curiously, Edward Bell- house made no reference to his family’s professional connections with Fairbairn when Bellhouse read a paper, entitled “On Pole’s Life of the Late Sir William Fairbairn,” to the Manchester As- sociation of Employer, Foremen and Draughtsmen in 1878.6 The intentions of the grandfather were fulfilled on July 1, 1842, when the firm of E.T.
