I do not cast these tales in an educational, religious, or aca- demic light but, rather, present them as texts that have the power to move people. That is, I present them as literature. The Talmud contains hundreds of stories about rabbinic sages and other historical fi gures who lived during the late Second Temple and rabbinic periods, which spanned the fi rst few centuries of the Common Era. The stories were recorded long after the events they recount, and thus they are literary rather than historical accounts. For generations these stories were neglected by literary audiences and were considered the province of rabbis and academics alone. But this is no longer the case. In the past decades readers of diverse backgrounds have devel- oped an openness and a willingness to engage this literature on their own terms. -
Introduction
INTRODUCTION Hanne Trautner-Kromann n this introduction I want to give the necessary background information for understanding the nine articles in this volume. II start with some comments on the Hebrew or Jewish Bible and the literature of the rabbis, based on the Bible, and then present the articles and the background information for these articles. In Jewish tradition the Bible consists of three main parts: 1. Torah – Teaching: The Five Books of Moses: Genesis (Bereshit in Hebrew), Exodus (Shemot), Leviticus (Vajikra), Numbers (Bemidbar), Deuteronomy (Devarim); 2. Nevi’im – Prophets: (The Former Prophets:) Joshua, Judges, Samuel I–II, Kings I–II; (The Latter Prophets:) Isaiah, Jeremiah, Ezek- iel; (The Twelve Small Prophets:) Hosea, Joel, Amos, Obadiah, Jonah, Micah, Nahum, Habakkuk, Zephania, Haggai, Zechariah, Malachi; 3. Khetuvim – Writings: Psalms, Proverbs, Job, The Song of Songs, Ruth, Lamentations, Ecclesiastes, Esther, Daniel, Ezra, Nehemiah, Chronicles I–II1. The Hebrew Bible is often called Tanakh after these three main parts: Torah, Nevi’im and Khetuvim. The Hebrew Bible has been interpreted and reinterpreted by rab- bis and scholars up through the ages – and still is2. Already in the Bible itself there are examples of interpretation (midrash). The books of Chronicles, for example, can be seen as a kind of midrash on the 10 | From Bible to Midrash books of Samuel and Kings, repeating but also changing many tradi- tions found in these books. In talmudic times,3 dating from the 1st to the 6th century C.E.(Common Era), the rabbis developed and refined the systems of interpretation which can be found in their literature, often referred to as The Writings of the Sages. -

What Sugyot Should An Educated Jew Know? Jon A. Levisohn Updated: May, 2009 What are the Talmudic sugyot (topics or discussions) that every educated Jew ought to know, the most famous or significant Talmudic discussions? Beginning in the fall of 2008, about 25 responses to this question were collected: some formal Top Ten lists, many informal nominations, and some recommendations for further reading. Setting aside the recommendations for further reading, 82 sugyot were mentioned, with (only!) 16 of them duplicates, leaving 66 distinct nominated sugyot. This is hardly a Top Ten list; while twelve sugyot received multiple nominations, the methodology does not generate any confidence in a differentiation between these and the others. And the criteria clearly range widely, with the result that the nominees include both aggadic and halakhic sugyot, and sugyot chosen for their theological and ideological significance, their contemporary practical significance, or their centrality in discussions among commentators. Or in some cases, perhaps simply their idiosyncrasy. Presumably because of the way the question was framed, they are all sugyot in the Babylonian Talmud (although one response did point to texts in Sefer ha-Aggadah). Furthermore, the framing of the question tended to generate sugyot in the sense of specific texts, rather than sugyot in the sense of centrally important rabbinic concepts; in cases of the latter, the cited text is sometimes the locus classicus but sometimes just one of many. Consider, for example, mitzvot aseh she-ha-zeman gerama (time-bound positive mitzvoth, no. 38). The resulting list is quite obviously the product of a committee, via a process of addition without subtraction or prioritization. -

A MATHEMATICAL ANALYSIS OF THE DIVISION OF THE TRIBES AND THE ROLE OF THE LEVIYES ON GRIZIM AND AVAL IN DEUTERONOMY 27 INTRODUCTION This article provides a mathematical analysis of the division of the tribes and the role of the Levites as described in Deuteronomy 27:11-14. These verses state: 11. And Moses commanded the people on the same day, saying. 12. These shall stand upon Mount Grizim to bless the people, when they pass over the Jordan: Shimon, Levi, Yehuda, Issachar, Yosef and Binyamin. 13. And these shall stand upon Mount Aval for the curse; Reuven, Gad, Asher, Zevulun, Dan and Naphtali. 14. And the Levites shall call out, and say unto all the people of Israel, with an exalted voice. i. The Bible in verses 12 and 13 divides the nation of Israel into two groups. One group consists of six tribes (Shimon, Levi, Judah, Issachar, Yosef, and Benjamin) standing on Mount Grizim. The other group of six tribes (Reuven, Gad, Asher, Zevulun, Dan, and Naphtali) stand on Mount Ava!. Levi is thus apparently counted among the 12 tribes on the mountain, with Yosef counted as only one tribe (instead of separately counting each of Yosef's component members, Ephraim and Menashe). -

THE CONTRIBUTION OF SPANISH JEWRYTO THE WORLD OF JEWISHLAW* Menachem Elon Spanish Jewry's contribution to post-Talmudie halakhic literature may be explored in part in The Digest of the Responsa Literature of Spain and North Africa, a seven-volume compilation containing references to more ? than 10,000 Responsa answers to questions posed to the authorities of the day. Another source of law stemming from Spanish Jewrymay befound in the community legislation (Takanot HaKahal) enacted in all areas of civil, public-administrative, and criminal law. Among themajor questions con sider edhere are whether a majority decision binds a dissenting minority, the nature of a majority, and the appropriate procedures for governance. In doing so, I advance a new understanding of how the Bavli was composed, namely as a book written by its own readers in the act of transmission. In the latter half of the twentieth century, Bavli scholarship focused on the role of the Stam (the collective term for those people responsible for the anonymous voice of the Bavli) in the construction of individual Bavli passages (sugyot). -

Myers The Talmud records the following discussion: Our Rabbis taught: Who wrote Megilot Ta'anit (the scrolls of fasting containing lists of days on which fasting is proscribed)? They said: Hananiah b. Hezekiah and his companions, who cherished their troubles (she-hayu mehabevin et ha-tsarot). R. Shimon bar Gamliel observed: We too cherish our troubles, but what can we do? For if we come to write (them down), we are inadequate.l In tracing the echoes of the Crusades in Jewish historical writing and consciousness, one is anested by the phrase "they cherish their troubles." Does it not appear to be a poignant, even shocking, epigram for the Jewish historical experience, or at least for the "lach4mose conception" of that experience according to which suffering assumes pride of place? Here, as elsewhere in Jewish literature, the gates of interpretation were open to various and diverse travelers. Rashi, the great French commentator who was a contemporary of the first Crusaders and who lost relatives and friends to their anti-Jewish excesses, understood "they cherished their troubles" to mean that Jews cherished not their troubles, but rather their liberation from such troubles. Jews were compelled to recall their troubles, he claimed, so as to praise God for His miraculous intervention.2 Moreover, the sense of inadequacy in recording these travails stemmed, in part, from their sheer ubiquity. Persecutions were so regular a feature of Jewish history as to exhaust even the most practiced hand. -
