In doing so, I advance a new understanding of how the Bavli was composed, namely as a book written by its own readers in the act of transmission. In the latter half of the twentieth century, Bavli scholarship focused on the role of the Stam (the collective term for those people responsible for the anonymous voice of the Bavli) in the construction of individual Bavli passages (sugyot). Stam theory details how sugyot were crafted out of pre-existing sources and how the Stam works to control those sources in the service of a particular worldview. This dissertation locates a different force at work in the construction of the Bavli as a single unified book, an authorship that is above and against the work of the Stam—a Superstam. By examining the effect of the Bavli's use of rare and ambiguous terminology, I expand the unit of inquiry from the individual Bavli passage (sugya) to the Bavli in its entirety. I argue that, for the Bavli's implied reader, meaning is not found in the work of the Stam. While the Stam conveys meaning for a local reader, the global reader I explore does not artificially divide the Bavli into its constituent parts. For this reader, the Superstam acts to subvert the controlling work of the Stam through the placement of key words throughout the book. These words, when rare or ambiguous, direct the reader to other sugyot in which they appear. These sugyot, when read simultaneously, work to convey, for the reader, an expression of ambivalence on the part of the Superstam toward those moments of Stammaitic certainty. I conclude that Super-stammaitic activity itself is the result and product of readers who are trained how to read by the Bavli's own expectations. Should rabbis offer rabbinic supervision to bakeries which are open on Shabbat? i1 ~, '(l) l'\ (1) The food itself is indeed kosher after Shabbat, once the time required to prepare it has elapsed. 1 The halakhah is according to Rabbi Yehudah and not according to the Mishnah which is Rabbi Meir's opinion. (2) While a Jew who does not observe all the mitzvot is in some instances deemed trustworthy, this is never the case regarding someone who flagrantly disregards the laws of Shabbat, especially for personal profit. Maimonides specifically excludes such a person's trustworthiness regarding his own actions.2 Moreover in the case of n:nv 77n~ (a violator of Shabbat) Maimonides explicitly rejects his trustworthiness. 3 No support can be brought from Moshe Feinstein who concludes, "even if the proprietor closes his store on Shabbat, [since it is known to all that he does not observe Shabbat], we assume he only wants to impress other observant Jews so they will buy from him."4 Previously in the same responsum R. Feinstein emphasizes that even if the person in The Committee on Jewish Law and Standards of the Rabbinical Assembly provides guidance in matters of halakhah for the Conservative movement.

The approximately 930 MSS from Qumran were penned from the 3rd c. BC through the 1st c. AD. The Masada texts include Jewish scrolls from the time leading up to the Roman conquest (AD 73) and subsequent Roman documents. The finds at Naal ever and Murabbaat include documents from the time of the Bar Kokhba revolt (AD 132–135). Aumann l. A Bankruptcy Problem A man dies, leaving debts totaling more than his estate. How should the estate be divided among the creditors? A frequent solution in modern law is proportional division. The rationale is that each dollar of debt should be treated in the same way; one looks at dollars rather than people. Yet it is by no means obvious that this is the only equitable or reasonable system. For example, if the estate does not exceed the smallest debt, equal division among the creditors makes good sense. Any amount of debt to one person that goes beyond the entire estate might well be considered irrelevant; you cannot get more than there is. A fascinating discussion of bankruptcy occurs in the Babylonian Talmud2 (Ketubot 93a). There are three creditors; the debts are 100, 200 and 300. Three cases are considered, corresponding to estates of 100, 200 and 300. The Mishna stipulates the divisions shown in Table 1.

THE INTERSECTION OF GENDER AND MITZVOT DR. RABBI ARYEH COHEN TO START WITH A COUPLE alakhah, or Jewish Law, it has been often noted, is as much a pedagogical system as a legal system. The goal of the Hmitzvot as codified and explicated in the halakhic system is to create a certain type of person. Ideally this is a person who is righteous and God fearing, a person who feels and fulfills their obligation towards God as well as towards their fellows. Embedded into this goal, of necessity, is an idea or conception of what a person is. On the most basic level, the mitzvot “construct” people as masculine and feminine. This means that the halakhic system, or the system of mitzvot as practiced, classically define certain behaviors as masculine and others as feminine. The mitzvot themselves are then grouped into broad categories which are mapped onto male and female. Let’s start with a couple of examples. The (3rd century CE) tractate Kiddushin of the Mishnah begins with the following law: “A woman is acquired in three ways, with money, with a contract and with sex.” The assumption here is that a man “acquires” a woman in marriage and not the reverse.

    Vayigash Vayigash, 7 Tevet 5776 “Sending Everyone Out” Harav Yosef Carmel Before Yosef revealed his identity to his brothers, he commanded the members of his court: “Send everyone out from before me” (Bereishit 45:1). We will try to explain why it was so important to Yosef to be alone with his brothers. The midrash (Sechel Tov, Bereishit 45) explains that this was done for the needs of modesty. As Yosef was going to prove his identity by showing he was circumcised, he did not want his assistants to see what was not necessary for them to see. The simple explanation, of course, is that Yosef wanted to protect his brothers from embarrassment at the awkward situation that was to occur, which would include no small amount of explicit or implicit rebuke. Rishonim put stress on the rebuke, including practical ramifications, stemming from it, other than the brothers’ simple embarrassment. The Ramban says that upon hearing of Yosef’s sale, the Egyptians would view the brothers as betrayers and would reason that if that is the way they treated their own brother, they certainly could not be trusted to live in Egypt and visit in its palace. The Da’at Zekeinim echoes this idea but also extends it, in showing how the matter of the sale was a bigger secret than we might assume. They claim that not only did Yaakov not know about the sale, but even Binyamin, who was not with his brothers at the time, did not know about it. In fact, they claim that Yosef broke his speech of revelation into two.

I do not cast these tales in an educational, religious, or aca- demic light but, rather, present them as texts that have the power to move people. That is, I present them as literature. The Talmud contains hundreds of stories about rabbinic sages and other historical fi gures who lived during the late Second Temple and rabbinic periods, which spanned the fi rst few centuries of the Common Era. The stories were recorded long after the events they recount, and thus they are literary rather than historical accounts. For generations these stories were neglected by literary audiences and were considered the province of rabbis and academics alone. But this is no longer the case. In the past decades readers of diverse backgrounds have devel- oped an openness and a willingness to engage this literature on their own terms.

    By Tamar Kadari* Abstract This article is a biography of the prominent scholar of Aggadic literature, Rabbi Dr Julius Theodor (1849–1923). It describes Theodor’s childhood and family and his formative years spent studying at the Breslau Rabbinical Seminary. It explores the thirty one years he served as a rabbi in the town of Bojanowo, and his final years in Berlin. The article highlights The- odor’s research and includes a list of his publications. Specifically, it focuses on his monumental, pioneering work preparing a critical edition of Bereshit Rabbah (completed by Chanoch Albeck), a project which has left a deep imprint on Aggadic research to this day. Der folgende Artikel beinhaltet eine Biographie des bedeutenden Erforschers der aggadischen Literatur Rabbiner Dr. Julius Theodor (1849–1923). Er beschreibt Theodors Kindheit und Familie und die ihn prägenden Jahre des Studiums am Breslauer Rabbinerseminar.     INTRODUCTION Hanne Trautner-Kromann n this introduction I want to give the necessary background information for understanding the nine articles in this volume. II start with some comments on the Hebrew or Jewish Bible and the literature of the rabbis, based on the Bible, and then present the articles and the background information for these articles. In Jewish tradition the Bible consists of three main parts: 1. Torah – Teaching: The Five Books of Moses: Genesis (Bereshit in Hebrew), Exodus (Shemot), Leviticus (Vajikra), Numbers (Bemidbar), Deuteronomy (Devarim); 2. Nevi’im – Prophets: (The Former Prophets:) Joshua, Judges, Samuel I–II, Kings I–II; (The Latter Prophets:) Isaiah, Jeremiah, Ezek- iel; (The Twelve Small Prophets:) Hosea, Joel, Amos, Obadiah, Jonah, Micah, Nahum, Habakkuk, Zephania, Haggai, Zechariah, Malachi; 3. Khetuvim – Writings: Psalms, Proverbs, Job, The Song of Songs, Ruth, Lamentations, Ecclesiastes, Esther, Daniel, Ezra, Nehemiah, Chronicles I–II1. The Hebrew Bible is often called Tanakh after these three main parts: Torah, Nevi’im and Khetuvim. The Hebrew Bible has been interpreted and reinterpreted by rab- bis and scholars up through the ages – and still is2. Already in the Bible itself there are examples of interpretation (midrash). The books of Chronicles, for example, can be seen as a kind of midrash on the 10 | From Bible to Midrash books of Samuel and Kings, repeating but also changing many tradi- tions found in these books. In talmudic times,3 dating from the 1st to the 6th century C.E.(Common Era), the rabbis developed and refined the systems of interpretation which can be found in their literature, often referred to as The Writings of the Sages.
