Path Matters

Elsewhere in this Area News is a table of changes to rights of way in the last eighteen months. These changes have come about by various legal means and in the interests of various parties. The Ramblers (you and me) try to ensure that changes are either in the interest of the walking public or at least are not too adverse to that interest. So we have to watch out for planning applications that might affect our paths as well as more straight forward changes. Many of the path additions in the table have come about because somebody has blocked or put up a notice on a path that local people have been using for at least 20 years without challenge. The only option then is for somebody to gather evidence and apply to Norfolk County Council to add the path to the Definitive Map of public rights of way. This can be evidence from users of a path or documentary evidence. From 2026 any documentary evidence from before 1949 will be inadmissible. This may not prove fatal to a claim for a right of way but such material often strengthens a case. That is why there is a rush to get claims to the Highway Authority before 2026 – it may seem a long way off, but the procedures are lengthy and time is in reality quite short. Part of the Deregulation Bill, before Parliament at the time of writing, is designed to help Authorities deal with these claims. Many walkers will have noticed a lack of maintenance of paths in recent years due to reduced County Council expenditure. The Council split paths into those which it called Norfolk Trails that it would continue to maintain to a good standard (about 400 miles of rights of way) and the rest (about 2000 miles) which would come under Highways and would have to share a budget with the roads. The Council cannot frequently check on most rights of way but relies on parish councils, voluntary path wardens and members of the public to report problems to them. Reporting can be done by phone on 0344 800 8020 or by email, but for those on-line the best way is to bring up the Council’s interactive map by entering: http://localview.norfolk.gov.uk/lv_external/Sites/countryside/ (note there is a base-line hyphen in the gap). Then the map can be enlarged and centred on the parish by entering "place" and "parish name" in the boxes top left. The map tends to enlarge too much and the plus and minus controls should be adjusted until you can see something you recognise. The map can also be scrolled around. The definitive paths are represented by lines coloured according to their status shown in the key on the left. Moving the cursor around the map changes a grid reference at the bottom of the key. A note should be made of the grid reference of the site of the problem. Clicking the cursor on the coloured line with the problem brings up a box with the parish name and the path number. A click on the "here" in the box brings up the options for reporting problems on the path:
