In re: Alleged violation of Title 45, Chapter 4 of the Revised Statutes of 1950, as amended, by failing to register with, or notify the Louisiana Public Service Commission of appropriate Interstate Commerce Commission authority for vehicles being operated interstate in Louisiana as required by the Commission's General Order dated September 7, 1972, as amended.

On motion of Commissioner Dixon, seconded by Commissioner Owen, with Commissioners Blanco and Schwegmann concurring, and Commissioner Powell absent, the Commission voted to accept the Staff recommendation and found the Company not guilty and ordered the $500.00 bond returned to Martin Trucking.

T-20769 - Louisiana Public Service Commission vs. International Proteins Corp. (Fairfield, New Jersey). In re: Alleged violation of Title 45, Chapter 4 of the Revised Statutes of 1950, as amended, and the Commission's General Order dated September 7, 1972, as amended, by being PARTY TO transportation performed by another person in violation of said provisions.

On motion of Commissioner Blanco, seconded by Commissioner Schwegmann, and unanimOUsly adopted, the Commission voted to open a docket to develop the telecommunications regulatory framework for the Governor's Telecommunication Task Force, including specifically a State Telecommunications Modernization Plan (STMP).

FERC Order 636 - In re: Consideration of General Order assuring flow-through of capacity release revenues by Louisiana gas distribution companies.

On motion of Commissioner Blanco, seconded by Commissioner Dixon, with Commissioners Schwegmann and Powell concurring, and Commissioner Owen momentarily absent, the Commission voted to accept the staff recommendation and publish the proposed General Order in its Official Bulletin for the receipt of comments. This matter will be placed on the May Agenda.

~roposed General Order - In re: Commission Approval Required of Sales, Leases, Mergers, Consolidations, Stock Transfers, and all other Changes of Ownership or Control of Public Utilities Subject to Commission Jurisdiction.

On motion of Commissioner Owen, seconded by Commissioner Dixon, and unanimously approved, the Commission voted to adopt the Staff's General Order. The Staff is instructed to undertake a study of the procedures to be employed in implementing this General Order and report back to the Commission if necessary.

U-20710 - Louisiana Public Service Commission, ex parte. In re: Generic hearing to clarify the pricing/imputation standard set forth in Commission Order No. U-17949-N on a prospective basis only, as the standard relates to LEC competition toll offerings.

On motion of Commissioner Owen, seconded by Commissioner Blanco, and unanimously approved, the Commission voted to adopt Special Counsel's report.

On motion of Commissioner Owen, seconded by Commissioner Dixon, and unanimously adopted, the Commission voted to accept the Staff recommendation and found the Company guilty, imposed a fine of $1,000.00, with $500.00 suspended contingent upon no further violations.

On motion of Commissioner Blanco, seconded by Commissioner Dixon, and unanimously adopted, the Commission voted to accept the Staff recommendation and found the Company not guilty and ordered the $115.00 bond returned.

,-19993 - Louisiana Payphone Association, Inc., ex parte. In re: Petition for implementation of intrastate "Dial-Around" compensation for 1~800, 950, 10XXX calls placed from COCOTs ' pay telephone. Re: Motion for Reconsideration filed by Louisiana Payphone Assoc. On motion of Commissioner Dixon, seconded by Commissioner Schwegmaon, with Commissioners Blanco and Powell concurring, and Commissioner Owen dissenting, the Commission voted to approve the motion for reconsideration.

On motion of Commissioner Blanco, seconded by Commissioner Schwegmaon, and unanimously adopted, the Commission voted to postpone a decision on this reconsideration for six months contingent on the IXCs having the technology in place to determine the amount of dial around traffic on an individual phone basis. This matter will be on the Commission's October Agenda.

In re: Adoption of a policy statement by the Commission dealing with (i) the Commission's jurisdiction over all companies and ent~ties, including alternative access providers, that intend to provide or otherwise provide local or other intrastate telephone service in Louisiana, (ii) the intent of the Commission to develop rules and regulations for such companies and entities, and (iii) to that end, the authorization of a generic docket and issuance of Notice of Proposed Rulemaking for the development of such rules and regulations.

Request of Paramount Wireless Limited Partnership for declaration of policy or declaratory order on initiation of competitive local, intrastate and I interstate telecommunication service. On motion of Commissioner Dixon, seconded by Commissioner Blanco, and unanimously adopted, the Commission voted to accept the staff recommendation to open a docket on the request of Paramount but to stay all proceedings until its generic hearing is completed.

Impact of utility rates on economic development. In reI Amite Foundry & Machine, Inc. (at reque~t of Commissioner Schwegmaon) Action deferred. Commissioner Schwegmaon will chair a meeting between Amite Foundry &Machine and Louisiana Power &Light Company in an attempt to resolve this matter.

Reserve Telephone Company - In reI Use of a portion of the prior approved loan for the installation of fiber optic cable.
