Report Highlights: Japan’s National Tax Agency approved 139 European Union (EU)-proposed geographical indications for wine, spirits and other alcoholic beverages on January 19, 2018. The 139 protections will become effective on the date the Japan-EU Economic Partnership Agreement enters into force (currently anticipated to occur in 2019).

General Information: Following the announcement of the Economic Partnership Agreement (EPA) between the European Union (EU) and Japan in early July 2017, Japan’s National Tax Agency (NTA) published a list of 139 proposed geographical indications (GIs) for wine, spirits, and other alcoholic beverages for which the EU sought protections in Japan (see JA7098, and JA7111).

After the conclusion of a three-month public comment period, and after an agreement on mutual protections between Japan and the EU was finalized on December 8, 2017, the NTA released its final decision on the EU’s request on January 19, 2018 1 (see the NTA’s website at: https://www.nta.go.jp/shiraberu/senmonjoho/sake/yushutsu/pdf/chiritekihyouji.pdf [in Japanese only] – an unofficial translation follows in Attachment 1).

The 139 GI protections that Japan granted for EU wine, spirits, and other alcoholic beverage products will become effective on the date the Japan-EU EPA enters into force (currently anticipated to occur in 2019). In comments to FAS/Tokyo, the NTA maintained that—in Japan— none of the terms for which the EU sought protections were viewed as generic or semi-generic; nor were any of those terms considered to represent varietals.2

The NTA also clarified that distributors (known as prior users) that began to sell any GI-protected item(s) before the EU’s GI requests were notified AND that were actively distributing these products on July 12, 2017, (the date the EU’s requests were notified) in Japan can continue to sell product(s) using the name(s) of the product(s) for five years after the EPA’s effectuation.

The NTA informed FAS/Tokyo that these distributors have already been contacted and informed of the “prior user” provision. Nevertheless, U.S. stakeholders that believe they or their importer/distributor qualify as a prior user, and have not been contacted by the NTA, are encouraged to notify the NTA at earliest convenience.

Additionally, the EU agreed to protect four terms for Japanese spirits, one for , and three for Japanese sake in the EU market upon effectuation of the Japan-EU EPA (see Attachment 1).

An agreement on mutual protections between Japan and the EU was finalized as Japan and the EU concluded the negotiation of the Economic Partnership Agreement on December 8, 2017. After the Japan-EU EPA is effectuated, the following alcoholic beverage GIs (8 Japanese GI products, 139 EU GI products) will be mutually protected.

1 – The translated description of the GI, and the description used with the description such as “type,” “model,” “style,” “imitation,” etc. will be subject to protection, based on the “Labeling Standard regarding Liquor GI (2015 October NTA Notification No.19. Hereafter, “Labeling Standard”)” Clause 9. Also, among GIs which consist of multiple factors, only the description with an underlined potion will also be the subject to protection.
