General presentation of the judicial organisation and position of the administrative jurisdictional order In Hungary, justice is administered by the Curia of Hungary, the regional appellate courts, the high courts, the district courts, as well as the administrative and labour courts. The Curia of Hungary is at the top of the judicial hierarchy. The Curia guarantees the uniform application of law, its uniformity decisions are binding on all other courts of the country. The Curia a) examines appeals submitted against the decisions of the high courts and the regional appellate courts in cases defined by law, b) reviews final decisions if they are challenged through an extraordinary remedy, c) adopts uniformity decisions which are binding on all other courts, d) analyses final decisions to examine and explore the courts’ practice, e) publishes decisions and rulings of principle, f) passes decisions in cases where local government decrees violate legal rules, and g) passes decisions in cases where the local government fails to legislate as laid down in the Act on Local Governments. At the Curia, adjudicating, uniformity, municipality and publication panels operate within three different departments (criminal, civil as well as administrative and labour), in addition, jurisprudence-analysing working groups may be set up. 2. There are five regional appellate courts between the level of the high courts and that of the Curia. Appeals may be lodged against the decisions of the high courts with the regional appellate courts. The latter may also act as a court of third instance in criminal cases in which the second instance decision was rendered by a high court. At the regional appellate courts, adjudicating panels operate within one of their two departments (criminal and civil). Regional appellate courts, on the other hand, are not entitled to hear administrative cases. 3. The high courts may act either as first or as second instance courts, depending on the relevant pieces of procedural legislation. At the high courts, adjudicating panels and groups operate within four different departments (criminal, civil, economic as well as administrative and labour). As of 1 January 2018, the High Court of Budapest shall have exclusive competence and territorial jurisdiction over first and second instance cases which would otherwise fall within the high courts’ competence. 4/a. There are altogether 112 district courts (106 in the countryside and 6 in the 23 districts of the capital city of Budapest) in Hungary. District courts act as courts of first instance in civil and criminal cases. 4/b. In Hungary, there are 20 administrative and labour courts which act as courts of first instance in administrative and labour disputes. As of 1 January 2018, the majority of new cases are to be dealt with by eight regional administrative and labour courts. The latter are entrusted with the tasks of reviewing the legality of administrative decisions and providing legal protection against those actions and omissions of the administrative bodies which have as their object or effect the change of the legal status of the person bringing an action to court. 1.2. Key dates in the evolution of the administrative jurisdictional order and the control of administrative acts 1. Act no. XXVI of 1896: establishment of the Royal Administrative Court of Hungary – a court with organisational independence and general competence. 2. Act no. II of 1949: dissolution of the Royal Administrative Court of Hungary. 3. Act no. IV of 1957 on the General Rules of Administrative Proceedings: it made it possible, under exceptional circumstances, to request the court review of a limited range of administrative decisions. 4. As of the year 1973, the court review of administrative decisions had been regulated by the Code of Civil Procedure (Chapter XX of Law Decree no. 26 of 1972): the courts’ competence had been expanded to enable them to review the legality of administrative decisions both in litigious and non-litigious proceedings. 2 5. Act no. I of 1981: it gave citizens the right to request the courts to review administrative decisions in the event of infringements committed by the authorities (violations of the citizens’ constitutional rights and other fundamental personal, family and pecuniary rights). The scope of administrative decisions susceptible to court review was defined by Council of Ministers Decree no. 63/1980 of 5 December 1980. 6. 23 October 1989: modification of Act no. XX of 1949 on the Constitution of the Republic of Hungary. According to its modified section 50, subsection (2), the courts shall review the legality of administrative decisions. 7. Act no. XXVI of 1991 on the Extension of the Possibility of the Court Review of Administrative Decisions: it aimed at implementing the provisions of section 50, subsection (2) of the Constitution, but did not result in the establishment of a separate system of administrative justice (no independent administrative courts, no separate code of administrative litigation, the rules of administrative court proceedings were set forth in the Code of Civil Procedure). 8. Act no. CLXI of 2011 on the Organisation and Administration of the Courts of Hungary: administrative and labour courts were established within a single judicial system. 9. 1 January 2018: entry into force of Act no. I of 2017 on the Code of Administrative Litigation – a separate procedural code to regulate administrative court proceedings (instead of some specific provisions in the Code of Civil Procedure). 10. 6 November 2018: submission of Bill no. T/3353 on Administrative Courts and Bill no. T/3354 on Some Transitional Arrangements Related Thereto; the aforementioned bills aim at setting up a separate system of administrative justice with the introduction of administrative high courts and the Higher Administrative Court. 1.3. Criteria of competence of the administrative jurisdiction A legal action for the court review of an administrative decision may be brought before an administrative court. The term “administrative decision” includes the followings: any decision rendered by an administrative authority or by the head of such authority in an administrative action, any ruling for ordering enforcement in the event of any breach of an obligation contained in an administrative agreement, any decision adopted by a local government as specified by law, as well as any other decision susceptible to court review as specified by law. Administrative decisions may be reviewed before court under the following cumulative statutory conditions: - the impugned decision is (allegedly) unlawful, - the party has exhausted all legal remedies within the system of administrative authorities, and - the decision’s court review is not excluded by law. Unlawfulness means any violation of substantive or procedural legal provisions. An administrative decision is deemed unlawful if it does not comply substantially with the applicable pieces of legislation, if it has been delivered on the basis of the wrong legal provisions, or if the applicable pieces of legislation have been misinterpreted. An administrative decision that has been rendered in violation of the procedural requirements may be reviewed before court only if the procedural infringement has been significant and has affected the very substance of the administrative decision. A decision cannot qualify as an administrative decision rendered in an administrative law relationship if there is no hierarchical order, but a civil law based interdependence (e.g. the administrative body acts as an owner) between the parties. In the latter case, such decision may not be subject to court review by an administrative court. Similarly, the administrative courts have no competence to review the administrative authority’s actions related to employment and service relationships. 3 2. One such preliminary event is the FIDE Doctoral Student Conference which gives young scholars an opportunity to actively prepare for and to present their own research relating to the main topics of the congress in the framework of a half-day event.

Besides providing an in-depth analysis of the relevant legal provisions, it also aims to shed light on their broader socio-political context. In conclusion, this paper argues that the selection of constitutional court justices qualitatively differs from that of ordinary judges. In the case of judges, mostly professional requirements prevail, while the appointment of constitutional court justices is deeply pervaded by political motives. Therefore, it can be argued that the political preferences of the government could certainly distort the selection of the members of the constitutional court, whilst professionalism is certainly a value of the ordinary judiciary. Lastly, it should also be mentioned that the representation of social and political diversity is definitely not a main criterion of judicial selection in general.     ICL Journal © Verlag Österreich Hungarian Constitutional Court: Transparency and Business Activities of the State1 Judgments of 31 March 2016, Decisions of 7/2016 (IV 6) and 8/2016 (IV 6) Emese Szilágyi The Constitutional Court of Hungary recently delivered two important decisions concerning freedom of information. In both cases, the National Assembly attempted to curtail the transparency of the Central Bank and the Hungarian Mail, and the President of the Republic requested for an ex ante constitutional review. The decisions contain pivotal argu- ments concerning legal certainty and freedom of information, and can be read as proof that in the most crucial cases the Constitutional Court of Hungary still stands up against the majority of the parliament. However, it is worth mentioning that in the more straightforward case – the decision about the modification of the Act on the Central Bank of Hungary – there was a wide professional consensus on the unconstitutionality of the new rules. This consensus was supported by the opinion of the National Authority for Data Protection and Freedom of In- formation. The reasoning of the other decision which examines the new rules of the Postal Service Act could arguably be read two different ways, as will also be elaborated in this paper. I. Preliminary Remarks The National Assembly of Hungary on 1 March 2016 approved amendments to the Act on the Central Bank of Hungary2 (hereinafter: MNBtv) and to the Postal Service Act.3 These amendments intended to limit the avail- ability of public data4 related to the operations of the Central Bank of Hungary (hereinafter: MNB) and the Hun- garian Mail.

    FlashNews | Transfer Pricing Decision of the Curia of Hungary: cash pool transactions in focus March 26th, 2021 Background The group provided liquidity to the group members using the cash pool method. Multicurrency financing transactions were conducted by the members of the group through the taxpayer. The balance of the group members' monthly short positions was transferred to the Parent Company’s main account at the end of each month as a long-term loan between the Parent Company and the respective member company. As a member of the scheme, the examined taxpayer also deposited funds into the main account of the Parent Company and received funds from the main account. The taxpayer's transactions were partly short-term (up to 1 month) and partly longer-term positions. Some transactions were classified as “deposit placements” by the taxpayer in its transfer pricing documentation, and when applying the transfer pricing rules, it considered the deposit interest rates of HUF 1-12 monthly current accounts available in the Reuters database. The findings of the Hungarian tax authority • The tax authority conducted an audit of the taxpayer for the years 2012-2014 covering all taxes. • The tax authority has argued that the Parent Company is not a credit institution, however, according to the Hungarian laws on Credit Institutions and Financial Undertakings, only a credit institution is entitled to collect deposits. • The Parent Company was not a credit institution, so in its case the level of risk will obviously be higher. According to the tax authority, the risk of return borne by the taxpayer is not comparable to the risk taken by deposits placed at a credit institution.

    ADMINISTRATIVE JUSTICE IN EUROPE - Report for Hungary - by dr Péter Darák INTRODUCTION (History, purpose of the review and classification of administrative acts, definition of an administrative authority) 1. Main dates in the evolution of the review of administrative acts The „October Diploma”, a Habsburg imperial decree allowing Hungary independence in internal affairs, brought a structural reform to the judiciary. The Royal Hungarian Curia regained its lawful powers and reputation. First the Royal Financial Court as a separate public law court was set up in 1883. Then, by Act XXVI of 1896, the Royal Administrative Court was set up as a single-instance special court, of which the Financial Court was made part. The Royal Administrative Court adjudicated both general and financial cases in non-litigation process. Following the extension of the powers of public law courts, the Court of Competence was created for settling disputes of competence between ordinary and administrative courts or public administration authorities. After the Second World War, formalised law was applied in civil and administrative cases but no separate administrative courts existed. Hungary turned from a liberated country into a newly occupied one where state administration was controlled by the Communist (later Socialist) Party. The introduction of the reforms in the 1970s and 1980s launched changes that proved to be irrevocable. Ordinary courts were granted competence to review more than twenty kinds of administrative cases (taxes, land registry) in non-litigation process. Law and jurisprudence became more liberal. The 1989-90 regime change created a rule of law state in Hungary and gave rise to a gradually evolving reform in the judiciary.

    Report on the fact-finding mission of the EAJ to Hungary 1. Request, Constitution of the Task Force, Performance On request of the Association of Hungarian Judges (Magyar Bírói Egyesület – MABIE) and of the National Judicial Council of the Hungarian Judiciary (Országos Bírósági Tanacs -OBT)1 the EAJ Working Group on the Situation of Member Associations was commissioned by the EAJ Assembly in Marrakech in 2018, to carry out a “fact finding mission” with the Hungarian Judiciary in Budapest. A committee was appointed. The EAJ- committee (hereinafter referred to as “the Committee”) consisted of • the President of the EAJ-Working Group On the Situation of Member Associations, Judge Stephan Gass, • the Member of the EAJ-WG and Honorary President of the IAJ, Judge Gerhard Reissner • and the Honorary President of the IAJ, Judge Günter Woratsch. The mission to Budapest was accomplished from April 24th to 26th 2019. 2. Mandate of the Mission The Association of Hungarian Judges asked the EAJ to conduct an investigation into the following points: 1. The ineffectiveness and consequences of the interim election of missing members of the National Judicial Council (NJC), lacks in collaboration between the National Office for the Judiciary (NOJ) and the National Judicial Council (NJC). 2.     BALOGH-BEKESI Nóra Pázmány Péter Catholic University Budapest, Hungary The Realisation of the Principle of a Fair Procedure in Hungary1 Abstract The paper aims to present the realisation of one of the most important procedural principle – the principle of a fair procedure – regulated in the Fundamental Law of Hungary, which entered into force on 1st January 2012. The principle of fair procedure can be considered the basis of all procedural rights. In its nature it resembles more the principle of human dignity. In its kind it is an absolute right, but the rights derived from it – such as the right to legal remedy – are rights which can be restricted in case of the conditions specified by the Fundamental Law of Hungary. The principle of fair procedure is regulated as the right to good administration in paragraph 1 of Article XXIV. of the Fundamental Law of Hungary as follows: “Everyone shall have the right to have his or her affairs handled impartially, fairly and within a reasonable time by the authorities. Authorities shall be obliged to give reasons for their decisions, as provided for by an Act.” The other one is regarding court proceedings, where the principle of fair procedure is named as the right to a fair trial and regulated in paragraph 1 of XXVIII. of the Fundamental Law of Hungary as follows: “Everyone shall have the right to have any charge against him or her, or his or her rights and obligations in any litigation, adjudicated within a reasonable time in a fair and public trial by an independent and impartial court established by an Act.” We should note that the quoted paragraphs of the Fundamental Law of Hungary mention the requirement of a decision within a reasonable time and several other requirements as the part of the principle of fair procedure.

Introduction While Hungary has been touted as an example of successful transition from authoritarian communist regime to constitutional democracy, the rise of Fidesz power and re-elections of Prime Minister Victor Orbán have cast serious doubts on the strength and continuity of Hungary’s democratic institutions. As Prime Minister elected in 1998, reelected in 2010, and for a third term in 2018, Orbán and the Fidesz party have been able to rewrite the constitution by parliamentary vote, wielding the two-thirds majority needed under Hungarian constitutional law.1 The political sphere of Hungary currently operates much like an authoritarian government,
