Dec. 2017 (no author named) Appendix 15 Financial Assurance WaterLegacy PTM Objections Page 1 of 10 Exhibit 41 Legacy Permitting/Financial Assurance for Change in Assignment Former LTV Steel Mining Company (LTVSMC) Tailings Basin and Plant Site Ann Foss, Metallic Mining Sector Director December 12, 2017 This memo addresses MPCA ' s views on the State ' s potential liability for closure of the Cliffs Erie/NorthMet ferrous tailings basin under a very specific scenario described in detail in section II below. I. Background/Site History I.A. LTV Steel Mining Company (LTVSMC} LTVSMC owned a taconite processing facility and associated tailings basin near Hoyt Lakes , mining areas near Hoyt Lakes , Dunka mine , a railroad from Hoyt Lakes to Taconite Harbor , a dock and ship loading/unloading facility at Taconite Harbor , a power plant at Taconite Harbor , and real estate. LTV Corporation , the parent company to LTVSMC , filed for bankruptcy in 2000 and in January 2001 operations at the LTVSMC facilities ceased. As a result of subsequent bankruptcy proceedings , the State of Minnesota entered into a Master Agreement with the purchasers of the property (Cliffs Natural Resources , FKA Cleveland Cliffs , and Minne sota Power) and LTV. The Bankruptcy court approved the sale and closing occurred in October 2001. One goal of the Master Agreement was to preserve the assets for future use. In addition , under the 2001 Master Agreement , Cliffs Natural Resources provided a Corporate Guarantee as financial assurance under the DNR Ferrous Permit to Mine. Cliffs Natural Resources has successfully transferred a portion of the property to Steel Dynamics , which owns the Mesabi Nugget plant and the neighboring mine area. MPCA and DNR perm its covering this portion of the property were transferred /assigned to Steel Dynamics. As part of the Ferrous Permit to Mine, Steel Dynamics provided financial assurance

    2016 Election Overview The outcome of the 2016 elections has definitely altered the landscape for transportation policy and funding initiatives. From the Presidency down to state legislative races, we face a new legislative dynamic and many new faces. What hasn’t changed: the huge need for resources to increase the nation’s and the state’s investment in the transportation system and bipartisan agreement on that fact. Prior to the outcome of Tuesday’s election we were hearing from candidates on both sides of the aisle that increasing investments in infrastructure was an area of agreement. We were hearing more from candidates about transportation than we have in previous election cycles. As we head into 2017, transportation advocates have a huge opportunity to capitalize on the widespread support for infrastructure improvements. However, it will take the involvement of transportation advocates across the state making their voices heard to rise above partisan squabbling and the many other issues that will be on the table. National Presidential Election Results Electoral Votes Needed to Win: 270 *Remaining: 16 Trump (R) Electoral Votes 290 Popular Vote 60,375,961 Clinton (D) Electoral Votes 232 Popular Vote 61,047,207 Minnesota Clinton (D) percent 46.9% votes 1,366,676 Trump (R) percent 45.4% votes 1,322,891 The race for the White House defied the polls and expectations as Donald Trump won more than the needed 270 votes in the electoral college while Hillary Clinton narrowly won the popular vote.

NAMI knows that the stigma surrounding mental illness isolates children and adults whose lives have been touched by mental illness, often leaving them alone, with little hope. Touching hearts. When people call the NAMI office for information, attend an education class or join a support group their hearts are touched by the comforting words of understanding, hope and encouragement. Through learning about mental illness, what services are available, and about how to cope – people are given hope. Hope fuels our spirit. Deb, one of the thousands of people who contact the NAMI office every year wrote to say “thank you so much for responding to our call for help…you have touched my heart.” Healing minds. Recovery is possible, but treatment and supportive services must be available and affordable. NAMI brings information to people about the service system and where to go for help. NAMI informs people of evidence based practices and new research. Advocating at the legislature, through the Mental Health Action Group and to the various state depart- ments, NAMI seeks increased funding for effective services and works to create a seamless and understandable system for both children and adults. Connecting people. After attending NAMI’s new one-day education class for family members held in northern Minnesota, a woman approached the teacher and said “thank you - I thought I was the only one.” Breaking the isolation by bringing people together is powerful.

Furthermore, AMC appreciates the opportunity to outline our perspective on how various proposals impact county government, and for your consideration of this input as you move forward. PROVISIONS SUPPORTED: • Use of Proceeds from Sales of Tax-Forfeited Lands (Senate: Art. 2, Sec. 132): Counties are charged with the management of tax-forfeited properties and incur the costs required to clean-up and maintain these properties until they are returned to their best use. Addressing these costs is one of AMC’s priorities this session. This language gives counties the option to use receipts from sale of forfeited lands for clean-up efforts, mitigating some of the financial impact and benefiting to the whole community. • Ordinary High-Water Designations (Senate: Art. 2, Sec. 94-95): Ordinary High-Water Levels (OHW) have impacts on local government infrastructure, water management and land use. This proposal does not impact the DNR’s current process for OHW designations. It would require a notice to local governments of new OHW’s and allow for additional evidence, important to setting an accurate OHW, to be submitted for consideration by the DNR.
