PUBLIC TO BE HEARD: Father Justin Miller – thinks it is good that the Governor and NYS hear the county’s opinion and in fact thinks locally the support would probably be overwhelmingly against the Reproductive Health Act.

Rebecca Fuentes is an organizer with the Workers Center of Central . They are here because they want to give information in regards to the driver’s license and privacy act resolution. She says agricultural immigrant workers a lot of them are undocumented and are in the area. She says they are helping the economy of this community.

Marty Fefer has worked in public safety for 30 plus years on the private industry side. He says he cannot imagine not having people qualified to do dangerous acts. He says to drive it requires certifications, vision tests, and understand the rules of the road. He says they are just asking for people who want to get a driver’s license that they are allowed to do so. He says they are not asking for citizenship just the opportunity to take the driver’s test.

Rebecca Fuentes says in rural and suburban areas that do not have public transportation like Cayuga County driving is a necessity. She says about 20% of NYS land area is farmland with nearly 36,000 family farms. She says according to Farm Credit East without undocumented and migrant farm workers New York agricultural production will likely be reduced by more than 1.37 billion. She says the Green light New York legislation will ensure all drivers are insured, registered, and licensed. She says on average the state that allows undocumented immigrants access to drivers licenses have less traffic fatalities and decrease in the number of uninsured drivers on the road.

Sue Dwyer - County Clerk thinks the legislation as presented is not on a fair playing field. She says US citizens have to have many different forms of documents and a non-citizen only needs one document and it could be a foreign document. She says that our DMV staff is not qualified to validate any of that, but they do not have to be because according to the legislation anything would be acceptable. She says yet everyday she has US citizens turned away because they do not have enough documentation. She says if they are going to change all of that they need to change it for US citizens too. She says she is not against immigrants, but wants this to be fair.

Resolution from the Town Planning Board of the Town of Aurelius determining Environmental Significance of Proposed Subdivision of parcel located on River Road 2. Resolution from the Town of Moravia memorializing the intent of the Town Board of the Town of Moravia, County of Cayuga, regarding the need to maintain the existing alignment of Interstate 81 through Syracuse 3. Resolution from Town of Locke memorializing the intent of the Town Board of the Town of Locke County if Cayuga, regarding the need to maintain the existing alignment if Interstate 81 through Syracuse 4. Resolution from Orange County Legislature calling from New York State Legislative Action to classify as Controlled Substances certain Fentanyl “Analogues” that are responsible for opioid overdose deaths. 5. Letter from NYSAC regarding their receipt of Cayuga County Legislature Resolution 72-19.

CCC REPORT: Brian Durant Durant says the college has been doing a national search for a provost and have recently identified four finalist. They are hoping to bring a candidate for the trustees to consider in April or May. The Falcon Park project continues to be on time and hopeful it will be finished in the next month or so, that way the baseball team will be able to play on it. They have reached a formal agreement for a space to create a culinary arts center. Lattimore says he likes culinary, but the revolution that’s upon us now is cloud based and one of our greatest assets is the IAGT.

COMMITTEE REPORTS & INDIVIDUAL LEGISLATORS’ REPORTS: McNabb-Coleman reports as member of the Steering Committee for the Owasco Lake Watershed Rules and Regulations announces that Thursday, March 28th, 6:00PM at City Hall they will talk about the public process of rolling out the draft form of the watershed rules and regulations. She reports as Vice Chair of the Owasco Lake Watershed Management Council on the new Executive Director and he has hit the ground running. She will invite him to next month’s legislature meeting.

Dennison says he did his ride along with the Sheriff’s Department and would recommend everyone on this body do it.

Foley went to Owasco - Emerson Park presentation for the developers that are looking to develop Emerson Park facilities. He thought they did an excellent job and had a ton of public involvement. He also attended the United Way banquet, which was well attended. He says they serve a very magnificent purpose in our community and do a lot of good.

Didio says last week the Inter County of Western NY had a meeting at Del Lago and Batman was present. He says Cayuga County will hold the Inter County of Western NY meeting at Springside on June 21st at 9AM.

COUNTY ADMINISTRATOR’S REPORT: J. Justin Woods Woods discusses the CGI video project and reminds the legislature in case they get questions about contact that have been made to local businesses. He says there is no requirement that anybody purchase anything for them to produce the videos for us. He says the videos are being produced for free as a partnership through our membership with NACo. He says they will be trying to sell advertisements to local businesses and asking them to partner with us to try and help promote the county. There are several recruitments going on for vacancies in Emergency Management and Human Resources. He says they are in process of reviewing applications and identifying candidates to meet with the interview committees. They have also advertised for the CIO position for Information Technology. They will also be bringing a resolution forward next month for a Purchasing Director.

RESOLUTION NO. 75-19 3/26/2019 TRE Appoint Deputy Treasurer RESOLUTION TO APPOINT DEPUTY TREASURER AND ABOLISH TEMPORARY POSITION OF ACTING DEPUTY TREASURER By: Patrick Mahunik, Chair, Ways & Means Committee WHEREAS, Resolution No. 218 passed on the 26th day of June 2018, authorized the position of Acting Deputy Treasurer (position control no. 08050) to be created and filled due to an approved leave of the Deputy Treasurer (position control no. 06303); and WHEREAS, the Deputy Treasurer exhausted all available leave on February 28, 2019 and is now separated from Cayuga County leaving the position of Deputy Treasurer vacant; and WHEREAS, the County Treasurer desires to appoint the Acting Deputy Treasurer to Deputy Treasurer and eliminate the position of Acting Deputy Treasurer; now therefore be it RESOLVED, that the County Treasurer be authorized to appoint the Acting Deputy Treasurer to Deputy Treasurer effective March 1, 2019, at a salary of $85,000 with no stipend; and be it further RESOLVED, that the position be filled in accordance with the Civil Services Rules and Regulations and the policies of the County of Cayuga; and be it further RESOLVED, that the position of Acting Deputy Treasurer be abolished and the Cayuga County Compensation Plan be updated accordingly. RESOLUTION NO. 76-19 3.26.19 RPS Fill Supervising GIS Specialist Rev 2 Authorize fill of Supervising GIS Specialist position (01819) in the Office of Real Property Tax Services By: Hon. Patrick Mahunik, Chair, Ways and Means. WHEREAS, the Office of Real Property Tax Services supervises, coordinates and oversees the maintenance and update of various real property tax and assessment records throughout the county, and WHEREAS, the duties of the Supervising GIS Specialist position are essential to supporting and maintaining GIS software and website necessary to create, update and publish tax maps, tax bills and other related records accessible to the organization and public; and WHEREAS, filling this vacant position is not intended to increase the total staff in the department, but serves to properly align the duties and responsibilities of the work being done under the appropriate job title, and WHEREAS, the additional cost of this position in 2019 is estimated at $4,608 in salary and $1,078 in fringes which will be covered by an increase in revenue to the real property budget, and WHEREAS, after a review of the complete list of filled and vacant positions within the department, the Director of Real Property Tax Services recommends abolishing the positions Data Entry Machine Operator (position 001822) and Supervising Real Property Tax Services Specialist (position 006404), and NOW THEREFORE BE IT RESOLVED, that the County Treasurer transfer funds as follows: Increase/Decrease Account Code Description Amount Increase Revenue A 13550.42210 Assessment – Tax Services $5,686 Increase Expense A 13551.51001 Assessment – Salaries FT $4,608 Increase Expense A 13551.58002 Assessment – State Retirement $599 Increase Expense A 13551.58005 Assessment – Workers Comp $129 Increase Expense A 13551.58001 Assessment – Social Security $350 and be it further RESOLVED, that the Director of Real Property Tax Services be authorized to fill the position of Supervising GIS Specialist (position 01819) in accordance with Cayuga County Civil Services Rules and Regulations and the policies of Cayuga County, and be it further RESOLVED, that the following positions be abolished Data Entry Machine Operator (position 001822) and Supervising Real Property Tax Services Specialist (position 006404). RESOLUTION NO. 77-19 3.26.19 IT RPS Image Mate Outpost Agreement REV 1 Authorizing the Upgrade and Renewal of Image Mate Online and Purchase of Outpost Anywhere Software By: Hon. Patrick Mahunik, Chair, Ways and Means WHEREAS, the County requires annual maintenance and support for Image Mate Online; and WHEREAS, Systems Development Group, Inc. is the provider and licensor of the software and maintenance, and WHEREAS, the software now requires an upgrade which will provide the county with enhanced functionality, as well as the option to purchase Outpost Anywhere – a mobile data collection tool that is widely used across NYS by municipalities and revaluation appraisal contractors because it seamlessly integrates and updates the Real Property System database and parcel images in real time from the field; and WHEREAS, great efficiencies are gained from utilizing Image Mate Online and Outpost Anywhere together with the existing RPS database software in a way that improves the consistency and accuracy of assessment data as it is collected, and WHEREAS, this initiative is part of the county shared services plan in that once Outpost Anywhere is deployed, towns will have the opportunity to access the mobile data collection solution through the county at a greatly reduced price by having it hosted at the County organization level, with the option to use it on their own or contract with County Real Property to collect the information for them, and WHEREAS, the software upgrade and maintenance is funded in line item A16104 54018 in an amount not to exceed $4,500, while the Outpost Anywhere server/devices and licensing will be funded through a one-time prorated chargeback to the towns at a cost of $2,500 for the server/devices, and a one-time licensing fee of $950 per participating town, and NOW THEREFORE BE IT RESOLVED, that the support and license agreement be approved and effective April 1, 2019 through March 31, 2020, and be it further RESOLVED, that the County Treasurer be authorized and directed to make the necessary journal and accounting entries to accomplish the same. RESOLUTION NO. 78-19 3/26/19 HR CS Hire Interim HR Admin Authorizing the Cayuga County Civil Service Commission to hire an Interim Human Resources Administrator BY: Mr. Patrick Mahunik, Chairman Ways and Means WHEREAS, the current Human Resources Administrator will retire effective 3/30/19; and WHEREAS, it is necessary for the duties of the HR Administrator to be executed during the recruiting and hiring process of a new HR Administrator; and WHEREAS, funding for the Interim HR Administrator exist in the 2019 HR/CS budget; and WHEREAS, the current Human Resources Administrator has agreed to fulfill the role as Interim Human Resources Administrator to ensure a smooth transition; NOW THEREFORE BE IT, RESOLVED, that the Cayuga County Civil Service Commission be hereby authorized to fill the Interim HR Administrator position; and be it further RESOLVED, that the salary and health insurance benefit for the Interim HR Administrator position remain the same as it is currently in the Cayuga County Compensation plan at $63,131, prorated on an hourly basis for hours worked; and be it further RESOLVED, that the appointment be made in accordance with the Cayuga County Civil Service Rules and Regulations and the policies of the County of Cayuga. RESOLUTION NO.79-19 3/26/19 MH Therapy Contracts-2019 AUTHORIZE THE CHAIR OF THE CAYUGA COUNTY LEGISLATURE AND THE DIRECTOR OF COMMUNITY SERVICES TO ENTER INTO TWO CONTRACTS FOR MENTAL HEALTH COUNSELING By: Elane Daly, Chair, Health and Human Services Committee, and Patrick Mahunik, Chair, Ways and Means Committee. WHEREAS, the Cayuga County Mental Health Center needs additional mental health counseling services to meet the needs of Cayuga County residents; and WHEREAS, Tanya Lutz, MSW, and Bridgette Cool, MSW have both expressed a willingness to provide services to the County on a contractual basis for therapy sessions defined by Medicaid and Managed Medicaid regulations for a maximum of 21 hours per week at the rates of $65 per 45-minute sessions, $45 per 30-minute sessions, and $20/hour for supervision and meeting attendance; and WHEREAS, there are sufficient funds available in budget line A43104-54059 Professional Services; and WHEREAS, contracted services do not incur additional costs for time off resulting in lost revenue for the department, fringe benefits, or legacy retirement costs; now therefore, be it RESOLVED, that the Chair of the Legislature and the Director of Community Services be authorized to enter into an agreement with Tanya Lutz, MSW, and enter into an agreement with Bridgette Cool, MSW, for the provision of mental health counseling services, each to be reimbursed at the above-noted rates. RESOLUTION NO. 80-19 3/26/19 MH 2019 BUD ADJ STATE AID Amending the Mental Health 2019 Budget to adjust State Aid funding for Contract Agencies By: Elane Daly, Chair, Health and Human Services Committee, and Patrick Mahunik, Chair, Ways and Means Committee. RESOLUTION NO. 81-19 3/26/19 MH Grant Asst-2019 AUTHORIZE THE FILLING OF A VACANT GRANT ASSISTANT POSITION AT THE CAYUGA COUNTY MENTAL HEALTH CENTER DUE TO A RESIGNATION By: Elane Daly, Chair, Health and Human Services Committee, and Patrick Mahunik, Chair, Ways and Means Committee. WHEREAS, there will be a vacant full time Grant Assistant position, code 7836, at the Cayuga County Mental Health Center as the result of a resignation; and WHEREAS, this position serves a critical role in managing the SAMHSA (Substance Abuse Mental Health Services Administration) grant that was awarded to the Mental Health Center; and WHEREAS, the position is reflected in the 2019 County Budget, line A43101 51001 salary account and is funded by the SAMHSA grant; now therefore, be it RESOLVED, that the Director of Community Services be authorized and is hereby directed to fill one full time Grant Assistant position in accordance with the Cayuga County Civil Service Rules and Regulations and the policies of the County of Cayuga with the understanding that said position will be eliminated when the SAMHSA grant funding ceases. RESOLUTION NO. 82-19 3/26/19 MH Fill MHTA-2019 AUTHORIZE THE FILLING OF ONE VACANT PART-TIME MENTAL HEALTH THERAPY AIDE POSITION AT THE CAYUGA COUNTY MENTAL HEALTH CENTER DUE TO A RESIGNATION By: Elane Daly, Chair, Health and Human Services Committee, and Patrick Mahunik, Chair, Ways and Means Committee. WHEREAS, there will be one vacant part time Mental Health Therapy Aide position, code 2131, at the Cayuga County Mental Health Center as the result of a resignation; and WHEREAS, this position serves an important paraprofessional role in the continuum of mental health outpatient care and is necessary to the operation of the Mental Health Center; and WHEREAS, the position is reflected in the 2019 County Budget, line A43101-51002, and is funded through state aid and revenues generated by the Mental Health Clinic; now therefore, be it RESOLVED, that the Director of Community Services be authorized and is hereby directed to fill one part time Mental Health Therapy Aide position in accordance with the Cayuga County Civil Service Rules and Regulations and the policies of the County of Cayuga. RESOLUTION NO. 83-19 3/26/19 HD Purchase Vehicle Authorizing the Public Health Director to Purchase Vehicle for the Health Department BY: Elane Daly, Chairman of the Health & Human Service Committee Patrick Mahunik, Chairman of the Ways & Means Committee WHEREAS, the Health Department is in need of two new vehicles due to the age of the existing fleet; and WHEREAS, these vehicles are used on a daily basis to make community based visits, environmental field visits, Early Intervention visits and other department business; and WHEREAS, Cayuga County will request bids for the vehicles through a mini bid process with NYS; and WHEREAS, funds are available within the 2019 Health Department budget in order to make this purchase; NOW, THEREFORE, BE IT RESOLVED, that the Public Health Director be authorized to purchase the two vehicles per the County Purchasing Policy utilizing funds of $44,000 in account A40102 52001 . RESOLUTION NO. 84-19 3/26/19 HD Outside Attorney Contract Authorizing the Chairman of the Legislature and the Public Health Director to enter into a contract with an outside attorney to assist with legal issues. BY: Elane Daly, Chairman of the Health & Human Services Committee Patrick Mahunik, Chairman of the Ways & Means Committee WHEREAS, the Health Department has a need to contract with an outside attorney to assist with ongoing legal matters that arise from non-compliance with Board of Health orders; and WHEREAS, the Health Department wishes to contact with Charles Thomas, outside attorney, to assist with these legal matters as they arise; and WHEREAS, Charles Thomas is able to assist the County with these legal matters for an hourly rate not to exceed $100 per hour; and WHEREAS, applicable work performed may receive 36% state aid reimbursement; NOW THEREFORE, BE IT RESOLVED, that the Chairman of the Legislature and the Public Health Director be authorized to enter into a contract with Charles Thomas, outside attorney, for assistance with on-going legal matters arising from non- compliance with Board of Health orders; and be it further RESOLVED, that funds will be pulled from the Professional Services account A40104 54059 of the Health Department budget. RESOLUTION NO. 87-19 3/26/19 HD Amend Res. 312-18 CBI Facilitator Funding Amending resolution 312-18 that authorized the contract between the Cayuga County Health Department and Consensus Building Institute, Inc., BY: Elane Daly, Chairman of the Health & Human Service Committee Patrick Mahunik, Chairman of the Ways & Means Committee WHEREAS, the Owasco Lake Watershed Rules & Regulations (“WSRR”) Project is an important water quality initiative with the project goal to update and revise the 1984 Owasco Lake Watershed Rules and Regulations, through a thoughtful and engaged public participation process resulting in effective and equitable watershed regulations that will help to improve, protect and preserve water quality within Owasco Lake and its 205-square mile watershed for the benefit of current and future generations; and WHEREAS, the WSRR Project is being undertaken by the Owasco Lake Watershed Management Council (“OLWMC”) with the assistance of County Departments and Agencies involved in efforts to protect the public water resource of Owasco Lake, including the Cayuga County Health Department; and WHEREAS, the effort to update the 35-year old existing rules and regulations in a way that effectively improves and protects the environmental attributes of Owasco Lake, while also being equitable to a range of interested and affected parties, will require the County to conduct a considerable public and stakeholder outreach and participation process when presenting the proposed new rules and regulations to stakeholders and residents in the 205-square mile watershed; and WHEREAS, securing the services of a trusted and independent facilitator with a reputation for helping parties achieve constructive and durable results to assist with the public roll-out of these complex and sensitive environmental issues is the best means of managing the process and building an effective bridge between those holding different perspectives on the proposed watershed rules and regulations; and WHEREAS, County staff prepared and circulated a scope of services for professional facilitator services for this effort that includes facilitating ten or more Steering Committee, Stakeholder and General Public meetings over a 4-5 month period; and WHEREAS, a Letter of Interest, qualifications and fee proposal from the Consensus Building Institute (“CBI”), a firm that has direct relevant experience to the issues being considered in the WSSR process (including being the firm that recently facilitated four one or two-day regional Summits convened by New York State on Harmful Algal Blooms) was received by staff and found to be the most qualified in terms of experience, capacity and cost; and WHEREAS, the Health Department wishes to amend the originally proposed contract by an additional $14,000, resulting in a not to exceed at total contract cost of $30,000; and WHEREAS, the Health Department will be willing to utilize $20,000 of performance incentive funding; and WHEREAS, it is anticipated the Owasco Lake Management Council will contribute $10,000 toward this facilitation cost; NOW, THEREFORE BE IT RESOLVED, The Chair of the Cayuga County Legislature and the Public Health Director are hereby authorized and directed to execute an amendment the contract for professional services between the Cayuga County Health Department and the Consensus Building Institute, Inc. RESOLUTION NO. 95-19 3/26/2019 COA Amend Mun Coop Agmt AUTHORIZING AN AMENDMENT TO THE MUNICIPAL COOPERATION AGREEMENT WITH CITY OF AUBURN, CAYUGA COUNTY SOIL AND WATER CONSERVATION DISTRICT AND THE CAYUGA COUNTY COMMUNITY COLLEGE By: Joseph DeForest, Chair Government Operations Committee Patrick Mahunik, Chair, Ways & Means Committee WHEREAS, the Cayuga County Legislature authorized the creation of a County Health Consortium; and WHEREAS, the purpose of the County Health Consortium are as follows: 1. Article 5G of the General Municipal law authorizes municipalities and the County Health Consortium to enter into cooperative agreements for the performance of those functions or activities in which they could engage individually; 2. Section 92-a and 119-o of the General Municipal Law authorizes municipalities and the County Health Consortium to purchase a single health insurance policy, enter into group health plans, and establish a joint body to administer a health plan; 3. Section 119-n of the General Municipal Law defines the term “municipal corporation” to include a county, city, town, village, school district and Board of Cooperative Educational Services; 4. The County of Cayuga Legislature has agreed by a duly authorized Resolution 81-256 to allow the Cayuga County Soil and Water Conservation District and Cayuga County Community College to participate in the Cayuga County Health Insurance Program; 5. The Participants in this Agreement have determined to their individual satisfaction that furnishing the health benefits for their eligible officers, eligible employees (as defined by the Internal Revenue Service codes, rules and regulations for federal tax purposes, such definition does not include independent contractors and/or consultants), eligible retirees, and the eligible dependents of eligible officers, employees and retirees (referred to collectively as “enrollees”) through a Consortium by acting in concert with one another is in their best interests as it is more cost-effective and efficient. Eligibility requirements are determined by each Participant’s collective bargaining agreements and/or their personnel policies and procedures; 6. The Participants desire to reflect the current relationship of the municipal corporation and the current terms of their participation in the Cayuga County Health Insurance Consortium; the County and the other participating municipalities are executing this agreement restating the terms of the existing Cayuga County Health Insurance Consortium, clarifying certain terms of previous Agreements they signed, amending the previous agreement to reflect changes required through compliance with certain New York State Law; 7. RESOLUTION NO. 99-19 3/26/19 BOE Electronic Poll books Resolution urging New York State to fund the purchase of electronic poll books for County Boards of Elections By: Joseph DeForest, Chair Government Operations Committee Patrick Mahunik, Chair Ways & Means Committee WHEREAS, Counties, through local Boards of Elections, are responsible for managing election operations, and paying for all or most of the costs of these operations; and WHEREAS, in January, State Lawmakers have passed and the Governor has signed into law series of voting reforms to the New York State Election Law; and WHEREAS, these reforms include early voting, voter registration transfers, same day voter registrations, and pre- registering 16 and 17 year olds to vote; and WHEREAS, implementing these reforms will require counties to purchase and use electronic polling books, estimated to cost up to $1 million per county; and WHEREAS, despite their desire to improve voter turnout, state leaders have not invested in our voting system infrastructure in more than a decade; now, therefore, be it RESOLVED, The Cayuga County Legislature calls upon Governor Andrew M. RESOLUTION NO. 100-19 3/26/19 BOE Voting Reforms Resolution urging New York State to fund all costs associated with new state-enacted voting reforms implemented at the county level BY: Joseph DeForest, Chair government Operations Committee Patrick Mahunik, Chair, Ways & Means WHEREAS, New York State has some of the lowest voter turnout rates in the nation; and WHEREAS, State Lawmakers have passed and the Governor has enacted a series of reforms to state election law and the voting process, including early voting, consolidating the federal and state primary dates, voter registration transfers, and same day voter registrations; and WHEREAS, Counties, through local Boards of Elections, are responsible for managing election operations, and paying for all or most of the costs of these operations; and WHEREAS, the State’s new early voting law requires counties to open polling sites for early voting for 10 days prior to any primary or general election, starting during the 2019 general election; and WHEREAS, another state proposal would allow for same day voter registration, which would enable voting-age residents to register to vote and vote on Election Day, and WHEREAS, these reforms will likely require counties to purchase and use electronic polling books, and make other investments in their election systems; now, therefore, be it RESOLVED, The Cayuga County Legislature calls upon Governor Andrew M. Cuomo, and the New York State Legislature to create a task force of state and local officials to determine the costs associated with implementing these voting reforms; and further RESOLVED, that the state fund the costs associated with the new reforms; and further RESOLVED, that the Clerk of the Cayuga County Legislature shall forward certified copies of this Resolution to Governor Cuomo, Senate Majority Leader Andrea Stewart-Cousins, Senate Minority Leader John Flanagan, Speaker of the New York State Assembly Carl Heastie, Assembly Majority Leader Crystal D. RESOLUTION NO. 108-19 3/26/19 BLD Linstar Security Equipment Service Agree 3 19 Authorization to enter into a Service Agreement with LINSTAR for Security Equipment including printers, cameras, controllers, card readers and other related equipment BY: Joseph Bennett, Chair, Public Works Committee Patrick Mahunik, Chair, Ways & Means Committee WHEREAS, the service agreement that covers much of the County Security System is with LINSTAR; and WHEREAS, the agreement requested by Buildings and Grounds in cooperation with Information Technology and the Health Department is scheduled to expire on April 23, 2019; and WHEREAS, the Superintendent of Buildings and Grounds requested a proposal from LINSTAR for another year April 24, 2019-April 23, 2020; and WHEREAS, LINSTAR provided the attached proposed agreement with a cost of $15,575.93; and WHEREAS, the Information Technology Department will review the proposal to determine if coverage is necessary on all of the equipment; and WHEREAS, for the last few years some of the funding for this agreement has come from a grant administered by the Health Department with the remainder funded by the IT Department and the Buildings and Grounds Department; and WHEREAS, the Health Department has again requested grant funding for a portion of this service agreement; and WHEREAS, if the Health Department is not successful in obtaining grant funds in an amount sufficient to pay for the LINSTAR service agreements then in that event the funding for the agreements would need to come from the following Information Technology and Buildings and Grounds Accounts: IT Machine Maintenance A16104-54045 not to exceed $1,155.00 COB Building Maintenance A16204-54012 not to exceed $8,212.52 Hard. STATE OF NEW YORK. RESOLUTION NO. 114-19 3-26-19 LEG oppose undoc. driver license rev RESOLUTION OPPOSING DRIVER’S LICENSE ACCESS AND PRIVACY ACT CONCERNING UNDOCUMENTED INDIVIDUALS By Honorable Tucker Whitman, Chairman of the Cayuga County Legislature: WHEREAS, holding a driver’s license in New York State is a privilege, not a right; and WHEREAS, the Driver’s License Access and Privacy Act, if passed, would permit undocumented persons who are present in the United States illegally under federal law to obtain a driver’s license; and WHEREAS, New York State presently suspends or revokes driver’s licenses for various illegal acts, including non- payment of child support, delinquent taxes, and refusal to submit to a breath test, yet this Act would reward entry into the United States with a driver’s license; and WHEREAS, New York State REAL ID compliant documents cannot be issued to an undocumented individual under federal law; and WHEREAS, adoption of the Act would create unacceptable security risks because:  There is no guarantee the identity of undocumented individuals can be properly verified by the State of New York if the federal government has not issued a green card or visa, and the Act’s proposed privacy protections may frustrate federal immigration enforcement efforts.  Local DMV Offices do not have the considerable expertise needed to determine the authenticity of foreign birth certificates, foreign passports, or consular cards, nor to verify evidence of undocumented individual’s residency in the state.  Driver Licenses can be used to obtain additional official identification documents intended only for United States citizens. WHEREAS, there is no guarantee that passage would make New York State roads safer; and WHEREAS, upon recommendation of the Government, Courts, of this body; now therefore be it RESOLVED, that this Legislature hereby opposes the adoption of the Driver’s License Access and Privacy Act as it concerns issuance of licenses to undocumented individuals, because of security risks and because driving is a privilege, not a right, and be it further RESOLVED, that the Clerk of the Legislature shall send a copy of this resolution to the Governor of the State of New York, State Senator Pamela Helming, Senator Robert Antonacci, Senator James Seward, Assemblyman Gary Finch, Assemblyman Brian Manktelow, Speaker of the Assembly Carl Heastie, and Majority Leader of the Senate Andrea Stewart-Cousins.

Motion by Foley to amend to take out all the Whereas’s and the first Resolved and insert one Whereas, that states the Cayuga County legislature hereby requests for the purpose of issuing drivers licenses that all transactions and documentation of undocumented people be handled at the state level due to the many complexities of verifying documentation locally, 2nd by McNabb-Coleman.

Foley says that from what he has heard from Dwyer is her concern is how her office will be able to verify documents when they come into her office. He says it is a county issue, but the current resolution deals with more federal immigration policy which this county has no control over. He says maybe we can narrow it down to concerns that are limited to our county.

Dwyer says unless the state DMV plans to expand their offices and their procedures in a way she cannot imagine then we will be dealing with this on a local level and it says so in the legislation. She says she does not see them not wanting the county to do it.

RESOLUTION NO. 115-19 3/26/2019 LEG Amend Compliance Plan rev AUTHORIZING THE ELIMINATION OF INDIVIDUAL DEPARTMENTAL CORPORATE COMPLIANCE PLANS AND ADOPTION OF A SINGLE COUNTY-WIDE CORPORATE COMPLIANCE PLAN By: Mr. Joseph DeForest, Chair, Government Operations Committee Mr. Patrick Mahunik, Chair, Ways & Means Committee WHEREAS, the Cayuga County Legislature (“Legislature”) is committed to preventing fraud, waste, abuse and improper conduct in Medicare, Medicaid, and other health care programs; and WHEREAS, by Resolution No. 499 passed on the 10th day of November 2010, the Legislature adopted Compliance Plans for the Health Department, Human Services, Nursing Home and Community Mental Health Center and appointed a compliance committee to implement said plans; and WHEREAS, in its continuing effort to update and improve the County’s oversight of the Compliance Program, the Compliance Committee requested an external legal review of the Compliance Plans; and WHEREAS, counsel has recommended that the Compliance Plans for Human Services and Nursing Home be eliminated as no longer necessary and the Compliance Plans for the Health Department and Community Mental Health Center be combined into one county-wide Compliance Plan; and WHEREAS, based upon the recommendations of said review, the Legislature wishes to replace the Compliance Plans for individual departments with the adoption of a single Corporate Compliance Plan for Cayuga County; now therefore be it RESOLVED, that the Corporate Compliance Plans for the Health Department, Human Services, Nursing Home and Community Mental Health Center are hereby eliminated; and be it further RESOLVED, that the Legislature adopt a single county-wide Corporate Compliance Plan, as appended to this Resolution; and be it further RESOLVED, that this change take effect immediately upon adoption. RESOLUTION NO. 116-19 3/26/19 LEG Amazon Headquarters REQUESTING AMAZON TO CONSIDER WHITE PINE COMMERCE PARK LOCATED IN ONONDAGA COUNTY, NEW YORK FOR THE NEW AMAZON HEADQUARTERS By: Cayuga County Legislature WHEREAS, Onondaga County, located in Central New York, enjoys a low cost of living as well as a highly educated and skilled workforce; and WHEREAS, Onondaga County is centrally located at the crossroads of Interstate 81 and the New York State Thruway (Interstate 90), providing convenient access to all east coast markets; and WHEREAS, Onondaga County has all modes of transportation readily available, including existing FedEx and UPS air transportation, easily accessible and convenient railroad transportation, extensive tractor-trailer shipping facilities, plus a deep-water port on Lake Ontario located within 35 miles; and WHEREAS, the Greater Central New York region is home to one million people, with nearly 500,000 in Onondaga County and another 500,000 or more located within 30-45 minutes of Onondaga County; and WHEREAS, White Pine Commerce Park is a business park owned by Onondaga County, consisting of 339 acres of vacant land with ready access to excellent water, sewer, power and natural gas services, as well as a convenient railroad spur; and WHEREAS, White Pine Commerce Park is the largest publicly controlled business park in the region, and it would serve as an excellent site for the next Amazon Headquarters; and WHEREAS, Onondaga County and the Central New York Region represents an extremely business-friendly community with an abundant ready, willing and hard-working workforce; and WHEREAS, Onondaga County has lively, expansive and extremely varied and attractive recreational end entertainment venues, including professional and collegiate sporting teams; and WHEREAS, Onondaga County and Central New York is home to a wide array of well-respected educational institutions; and WHEREAS, Onondaga County is home to many cutting-edge businesses and industries and is quickly becoming the leader in remotely controlled aerial vehicle technology; now, therefore be it RESOLVED, that this Cayuga County Legislature hereby requests that the chief executive officers of Amazon consider White Pine Commerce Park, located within Onondaga County, as the next Amazon Headquarters; and, be it further RESOLVED, that the Clerk of the Cayuga County Legislature shall forward certified copies of this Resolution to Governor Cuomo, Senate Majority Leader Andrea Stewart-Cousins, Senate Minority Leader John Flanagan, Speaker of the New York State Assembly Carl Heastie, Assembly Majority Leader Crystal D. RESOLUTION NO. 117-19 3/26/19 LEG Opposing Reproductive Health Act Resolution opposing Reproductive Health Act By: Tucker Whitman, Chairman Cayuga County Legislature Whereas, the Reproductive Health Act was signed into law by Governor on January 22, 2019; and Whereas, the Reproductive Health Act strips abortion from the state’s criminal code and places it under the realm of public health law; and Whereas, abortion is now allowed up until the full term of pregnancy; and Whereas, the killing of a fetus in the third trimester of pregnancy is now no longer considered murder; and Whereas, the undersigned Legislators urge the Governor, the New York State Senate and the New York State Assembly to reconsider the Reproductive Health Act and to repeal the same; now therefore be it Resolved, that the Cayuga County Legislature questions the unintended consequences of the Reproductive Health Act and urges the Governor, the New York State Senate and the New York State Assembly to reconsider the Reproductive Health Act and to repeal the same Reproductive Health Act; and be it further Resolved, that a certified copy of this Resolution be sent to Governor Cuomo, State Legislators, Senator Pamela Helming, Senator James L. Seward, Senator Robert E. Antonacci, Assemblyman Gary Finch, and Assemblyman Brian Manktelow.

Discussion: McNabb-Coleman feels the resolution as written has no direct impact on county operations. She says at this point she feels it is not relevant to Cayuga County government. She says we are currently facing an Emergency Management need. We need to fill some critical roles in the county including HR, IT, IT financial needs, Board of Election financial needs and these are all unanticipated. She believes as a body we need to resume our own duties as representatives to the residents of this county and do all we can to solve our own current deficiencies. She is a no vote on this based on the fact that it has no relevance on our operations of this county.

Dennison respects McNabb-Coleman for her comments, but as far as saying it has no effect on our county he has had numerous constituents email and call him. He says because it is not necessarily a day to day operation it does still effect our constituents.

Discussion: McNabb-Coleman brings forward new business and introduces a resolution to raise awareness about hiring within the community for the critical roles the county needs to fill. She says the resolution establishes a residency preference for recruiting and hiring department heads.

Discussion: Dennison says we need to give local residents a chance and the need to advertise in the Citizen the local newspaper.

Petrus thanks McNabb-Coleman and Dennison for the initiative and will support this.

Bennett says he has a few issues with the resolution. He says nowhere does it say that a current employee regardless if they are a county resident or not are considered for any position. He says there could be an employee who has been here for 20 years, but they would not be considered because they are not a county resident. Motion by Mahunik to amend the 2nd Resolved to state, “Preference will be given to candidates currently living in Cayuga County or employed by Cayuga County or contiguous counties.” 2nd by McNabb-Coleman, all in favor.

Foley says in the future he would also like to see a resolution come forward that we increase our preference of hiring people of color and minorities. He says at this county we have a very low rate of hiring minorities.

RESOLUTION NO. 118-19 3/26/19 LEG Hiring Preference Rev 2 ESTABLISHING A RESIDENCY PREFERENCE FOR RECRUITING AND HIRING OF DEPARTMENT HEADS BY: Aileen McNabb-Coleman, Legislator, District 6 Andrew Dennison, Legislator, District 2 WHEREAS, Department Heads occupy a critical role in county government and require both a strong skill set in their areas of management as well as a strong bond with the community; and WHEREAS, the Cayuga County Legislature finds it to be in the best interests of the county to recruit and hire future Department Heads from within the county, specifically because of their connection to, and familiarity with Cayuga County - its geography, populations, schools, and communities; now, therefore, be it RESOLVED, that the Cayuga County Legislature directs that all recruitment efforts for Department Head positions be carried out in such a way so as to maximize exposure within Cayuga County, including, but not limited to advertising prominently in local media, internet sites, and County social media; and be it further RESOLVED, in order to convey the Legislature’s commitment to hire locally, recruitment material for Department Head positions shall contain a notice stating: Preference will be given to candidates currently living in Cayuga County or employed by Cayuga County or contiguous counties. and be it further RESOLVED, that currently constituted hiring committees, or hiring committees established from this point forward, have at least one legislator as a member of such committee and that such committee place value and preference on those candidates who reside within Cayuga County in bringing selections forward to the Legislature.

DeForest discusses the redistricting plan asks that anyone with questions or concerns get them to him. He says Government Operations is coming up, but it keeps getting sidelined.
