Report of Executive Director to Annual Council – 17th May 2012

Constitutional Arrangements and Allocation of Seats to Party Groups – 2012/13

1. Introduction

Under the Council’s Constitution it falls to this meeting to approve the constitutional arrangements and the allocation of seats to party groups for this municipal year. As there have been all out borough council elections this year, the overall political composition of the council has changed from last year and this affects executive arrangements and the allocation of seats to the party groups under the proportional representation system.

2. Leader of the Council

Due to the necessity of having an all out election following the boundary review the leader of the Council automatically relinquishes his position. The constitution requires the Council to appoint a Leader. It is convention for the Leader of the Council to be the Leader of the largest political group on the Council.

3. Cabinet

The Constitution requires the Council to appoint a Cabinet of between two and nine councillors plus the leader. Cabinet will be chaired by the Leader of the Council who will, along with the Deputy Leader and the Cabinet Portfolio Holders, be appointed by the Council. The Cabinet is not subject to the proportional representation of party groups.

In light of the above is recommended that:

(a) Councillor Humphrey be appointed Leader of the Council; and subject to this appointment ; (b) a Cabinet of 6 councillors be appointed; (c) Councillor Poole be appointed Deputy Leader of the Council; (d) the following councillors be appointed to the Cabinet with the portfolios indicated below:

Councillor Mrs Timms – Economy, Development & Culture Councillor Cranham – Resources & Corporate Governance Councillor Dr Mark Williams – Sustainable Environment Councillor Leigh Hunt – Sustainable Inclusive Communities

The Leader and Deputy Leader will take specific responsibility for quality and performance. They will liaise with other portfolio holders and panel chairman. With the election of a Police and Crime Commissioner in November 2012 and the formation of a Police and Crime Panel for Warwickshire, Councillor Poole as Deputy Leader will take responsibility for all crime, disorder and police issues.

3. Standards

The Localism Act 2011 has brought some fundamental changes to the Standards regime including the abolishment of the overseeing body, Standards for England. New regulations will set out criteria for a new code of conduct. In conjunction with other Authorities within Warwickshire, officers are looking at a borough wide code of conduct for Councillors and options for investigation and deciding on complaints. One consideration is that Standards Committee is amalgamated with the Audit Committee to become and Audit and Ethics Committee. A further report will be taken to Council in July. Until the start of the new standards regime following the publication of the new regulations it is recommended that the current Code of Conduct applies and any complaints received in connection with the Code are dealt with as necessary by the Monitoring Officer.

4. Audit Committee

The Audit Committee consists of six non-Cabinet members, two of whom will be independent of the Council and who will be the Chairman and Vice Chairman. It is proposed that four Councillors be appointed to the Committee as set out in the Appendix to the report, which will be circulated separately. It is also proposed that Paul Dudfield and John Eves continue in their roles as chairman and vice chairman respectively of the Committee.

5. Overview and Scrutiny and Regulatory Committees

The Council has the following four Overview and Scrutiny committees:

 Overview and Scrutiny Management Board  Corporate Performance Committee  Customer and Partnerships Committee  Crime and Disorder Committee

The Constitution provides for three Regulatory Committees – Planning Committee, Licensing and Safety Committee and the Appeals Committee. Their terms of reference are set out in the Constitution.

The Committees have the number of seats indicated below:

2 It is for Council to allocate these seats to party groups and for party groups to then nominate councillors for appointment to these seats.

There are three political groups on the Council. These are:

 the Conservative Group, which has 25 councillors;  the Labour Group, which has 10 councillors;  and the Liberal Democrat Group, which has 6 councillors.

There is also 1 independent Councillor.

I have consulted the Group Leaders on the allocation of seats to Groups and the members to be nominated by them for appointment.

On the basis of a Council of 42, the Conservative Group with 25 councillors is entitled to 42 seats; the Labour Group with 10 councillors is entitled to 17 seats; and the Liberal Democrat Group with 6 councillors is entitled to 10 seats. The independent Councillor is entitled to 1 seat.

In applying these figures to Committees it is not possible to make identical allocations to each committee. After following the Council’s procedure for the allocation of seats it is proposed to allocate the 70 seats as follows:

The independent Councillor has been allocated a seat on the Appeals Committee giving the total of 70 seats allocated.

Party Group Leaders have notified me of their provisional allocation of seats and these are set out in the Appendix to this report. The Committees have been summoned to meet immediately following the conclusion of this meeting to appoint their Chairman and Vice-Chairman.

The Executive Director recommends that:

(1) Councillor Humphrey be appointed Leader of the Council;

(2) A Cabinet of 6 seats be appointed;

(3) Councillor Poole be appointed Deputy Leader of the Council;

APPOINTMENTS TO OUTSIDE BODIES – BY VIRTUE OF OFFICE AND MISCELLANEOUS APPOINTMENTS

1. BACKGROUND In order that appointments can be made as soon as possible to many key outside bodies, a schedule of appointments is attached for consideration. Appendix 1 details appointments by virtue of office. Appendix 2 shows miscellaneous appointments. Appendix 3 lists the organisations that no longer exist or for which representation is no longer required. These schedules have been brought forward to this meeting so that the Council is not disadvantaged by any delay in making the appointments.

The current title and status of each outside body has been checked together with contact details.

There are two terms of office for Bilton Poor’s Land and Other Charities which have expired. These are included at appendix 2 to the report. Mr B Shields has confirmed he is willing to serve a further term of four years and one vacancy exists since the current representative, Councillor I Mistry, is unable to fulfil a further term of office because their meetings are held during the day.

A vacancy exists for Sustainable Rugby Group. The current representative, Councillor Cranham has been unable to attend their meetings.

Some vacancies exist where members are no longer councillors. These are marked with an asterisk in appendices 1 and 2.

2. RECOMMENDATION

(1) Council consider the attached schedules of appointments making any amendments as appropriate;

(2) a representative be appointed to Bilton Poor’s Land and Other Charities;

(3) a representative be appointed to Sustainable Rugby Group; and

(4) representatives be appointed to the positions made vacant where members are no longer councillors.
