G-9, Sub 781; G-9, Sub 786; G-9, Sub 722 Dear Ms. Dunston: Pursuant to the May 17, 2021 Order Scheduling Investigation and Hearings, Establishing Intervention and Testimony Due Dates and Discovery Guidelines, and Requiring Public Notice (“May 17 Order”), Piedmont Natural Gas Company, Inc. (“Piedmont” or the “Company”) hereby submits its Affidavits of Publication for the Company’s Notice of Hearings in the above-referenced proceedings. Pursuant to ordering paragraph 6 of the May 17 Order, Piedmont was required to publish the Notice of Hearings in newspapers in its service area once a week for two consecutive weeks, at least 30 days in advance of the July 14, 2021 hearing, i.e. by June 14, 2021. Piedmont took timely and complete action to publish the Notice of Hearings in compliance with the May 17 Order and published the Notice of Hearings in 42 publications. However, due to circumstances outside of the Company’s control, 15 of the 42 publications were not in strict compliance with the May 17 Order. Specifically, in each of the 15 publications that did not meet the requirements of the May 17 Order, earlier insertion dates were missed by the publisher that caused the Notice of Hearings to be published less than 30 days in advance of the July 14, 2021 hearing. The first insertions of all 15 tardy publications were published between June 9, 2021, and June 13, 2021. The second insertions were published between June 14, 2021, and June 27, 2021. Piedmont notes that 9 of these 15 publications were not in compliance with the May 17 Order’s directive that the publications run once a week for two consecutive weeks. Of these 9 publications, 6 were printed less than one week apart and 3 were printed more than one week apart. Piedmont notes that it began working with each of these 42 publications immediately upon the Commission’s issuance of the May 17 Order. Piedmont also notes that while it is not required to publish the Notice of Hearings in all 42 publications, it has been the Company’s long-standing practice to print notices of hearings in as many publications in Piedmont’s service territory as possible. Publishing the Notice of Hearings in all 42 publications by June 14, 2021, was a significant undertaking and, ultimately, delays by the publishers led to late insertions for 15 of the 42 publications. Although we do not think these publication issues are material deviations from the directives in the May 17 Order, Piedmont nonetheless wanted to inform the Commission and provide an explanation.
