    In Diplomatic Banquet of Treaty: Islamic Sharī‘ah and International Laws Share the Attires of Pacta Sunt Servanda Hamzah Adesola Dawood Abstract The importance of treaties in international relations cannot be overemphasized especially now that the contemporary world has radically changed to a global village’. It has been observed as far back as 1960s that “modern international law can hold the allegiance of the world at large only by establishing its claim to continuing acceptance as a synthesis of the legal thought of widely varying tradition and culture.”1including Islamic law. Hugo Grotius drew most of his ideas of modern international law from the Bible and from the St. Augustine’s just war theory. It is not surprising, therefore, that treaties under modern international law are based on good faith. “The ideal of law in Islam is based on good faith. .”2 This is an indication that Islamic law and modern international law must have come from the same source. Treaties, therefore provide a veritable opportunity to attempt a harmony and a communality between the two legal regimes with a view to achieve, despite the complexity and diversity of human society, a common universal understanding that ensures peace and cooperation across the globe. Many analysts would think that it is strange because the polytheists’ ideology is completely different than the Islamic creed. That is why many people would think the concept of coexistence between both communities is impossible. The facts about the Prophet's (SAWS) life show his true wish to coexist peacefully with communities around him no matter what their creed was. He wished to coexist even with worshippers of idols, stars, trees or anything else. The most important type of peaceful coexistence is in the form of treaties, conventions and even alliances at times for the sake of achieving an interest for common cause. That concept, built on the love and design of peace, was not a result of experiencing the scourges of wars or disasters of battles. It was a result of the philosophy of the Prophet (SAWS) which he was keen to implement from the emergence of the Islamic state. Books about the Prophet's (SAWS) biography refer to numerous treasured examples of treaties and alliances. One of them was the treaty which the Prophet (SAWS) signed with the tribe of Banu- Damorah[1], whose leader at the time was Makhshy Ibn-Amr al-Damory. It was narrated[2] that the Prophet (SAWS) "reconciled" them. Plague in the early Islamic era was a part of pandemic invaded the Mediterranean region for more than two centuries, but it owned special local characteristics derived from the interaction of the virulence of the disease and the teachings of Islam. Besides the deaths of important Muslim men by plague, it is suggested that the endemic nature of plague during the early Islamic Empire may have significantly retarded population growth and debilitated Muslim society in Syria and Iraq during the Umayyad Period. Thus, it played an important role in the history of the Islamic Empire. In addition, these epidemics provoked medical and religious explanations and prescriptions, which strongly influenced the attitudes and behavior of the Muslim community toward the disease. In our treatise, we tried to conduct a comprehensive study of this phenomenon, trying to pay attention to its diverse sides, and its significant consequences on the Islamic community.

The moment the Prophet saw Suhayl coming, he predicted that the Quraysh wanted to resolve the stand-off peacefully. Suhayl approached the Prophet and talked diplomatically. The two spent time in lengthy negotiations before coming to an agreement. Q.1. What were the main terms of the Treaty of Al-Hudaybiyah? Ans:The main terms of the Treaty of Al-Hudaybiyah were as follows: (1) Prophet Muhammad and the Muslims would withdraw that year but they would be permitted to visit Makkah next year and perform their Umrah and stay in Makkah for three days. (2) The Quraysh and the Muslims would commit to a truce for ten years. (3) The Muslims and the Quraysh would be free to sign alliance treaties with any tribes around Arabia. (4) The Muslims would reject any person from the Quraysh defecting to Madinah to become a Muslims. But the Quraysh would be free to receive any Muslim wishing to change his religion. Q.2.     The Life of the Prophet Muhammad (Peace and blessings of Allah be upon him) ِب ۡس ِبي ِبٱ ٱ َّرل ۡس َم ٰـ ِب ٱ َّرل ِب ِبي In the name of Allah, the most Beneficent, the most Merciful All Praise is due to Allah, the Lord of the Worlds, the [One Who] Sustains the Heavens and Earths, Director of all that is created, who sent the Messengers (may the peace and blessings of Allah be upon all of them) to rational beings, to guide them and explain the religious laws to them with clear proofs and undeniable arguments. I praise Him for all of His bounties. I ask Him to increase His Grace and Generosity. I bear witness that there is none worthy of worship except Allah alone, who has no partner, the One, Who Subdues, the Generous, the Forgiving. I bear witness that our leader Muhammad is His servant and Messenger, His beloved and dear one, the best of all creation. He was honoured with the Glorious Qur’an that has been an enduring miracle throughout the years. He was also sent with his guiding Sunnah that shows the way for those who seek guidance. Our leader Muhammad has been particularised with the characteristic of eloquent and pithy speech, and simplicity and ease in the religion. May the peace and blessings of Allah be upon him, the other Prophets and Messengers, all of their families and the rest of the righteous. NO Copyrights!!!     warm and welcoming atmosphere. In the eyes of those who looked at him with bitter hatred until just yesterday, were now looks of mercy and compassion. What is more, they felt deep shame for all that they had done. Even if God's Messenger forgave them with their coming to him and in their new found realization, they could not forgive themselves, and exerted themselves to a baffling degree to make up for what they did. In the warmth of mercy, God's Messenger brought out into the open the precious metals that lay latent, and was now building a brand new civilization with them. SECTION THREE THE INEVITABLE END OF HATRED AND ENMITY So what, then, was the outcome of all this hostility and hatred? If we are to take the conquest of Mecca as a basis, who were the winners or losers of this twenty-one year struggle? Who laughed and whose efforts were in vain? Let us look at the picture together: Family of Abu Jahl Without a doubt, the most important figure leading the Qurayshi opposition in hatred and hostility was Abu Jahl. He possessed an ambition that deemed the ends as justifying any and every means. It was he who dragged the people into the Badr undertaking and who was responsible for the downfall and ruin of both himself and all those he dragged along with him as the victims of his unbridled ambition.
