SUMMARY The Department of Commerce is conducting an administrative review of the countervailing duty (CVD) order on crystalline silicon photovoltaic cells, whether or not assembled into modules (solar cells) from the People’s Republic of China (China), covering the period of review (POR) January 1, 2017 through December 31, 2017. The mandatory respondents are JA Solar Technology Yangzhou Co., Ltd. (JA Solar) and Risen Energy Co., Ltd. (Risen Energy). This is the sixth administrative review of the CVD order on solar cells from China. We preliminarily find that JA Solar and Risen Energy received countervailable subsidies during the POR. If these preliminary results are adopted in the final results of this review, we will instruct U.S. Customs and Border Protection (CBP) to assess countervailing duties on all appropriate entries of subject merchandise during the POR. Interested parties are invited to comment on these preliminary results. Unless the deadline is extended pursuant to section 751(a)(3)(A) of the Tariff Act of 1930, as amended (the Act), we will issue the final results of this review by no later than 120 days after the publication of these preliminary results in the Federal Register.

Using the country’s solar PV industry, I seek to explain the impact of proportions of these different types of shareholding (and within the state category shareholding by central, provincial, and municipal governments) on innovative capacity. This capacity is measured by firms’ rates and qualities of patenting. As Chinese economic growth falters, amid the “re-shoring” of certain manufacturing capabilities, the role of the state, and whether it is helping or hindering its economy’s – and Chinese firms’ – technological upgrading, is a vital question. This is particularly true in high-tech sectors, including solar PV, which the Chinese government deems essential for the country’s continuing economic growth. Through the solar PV industry, we investigate the role of the state, and how it is helping or hindering Chinese companies’ innovation.

    FACT SHEET Commerce Preliminarily Finds Dumping of Crystalline Silicon Photovoltaic Cells, Whether or Not Assembled into Modules from the People’s Republic of China • On May 17, 2012, the Department of Commerce (Commerce) announced its affirmative preliminary determination in the antidumping duty (AD) investigation of imports of crystalline silicon photovoltaic cells, whether or not assembled into modules (solar cells) from the People’s Republic of China (China). • For the purpose of AD investigations, dumping occurs when a foreign company sells a product in the United States at less than fair value. • Commerce preliminarily determined that Chinese producers/exporters sold solar cells in the United States at dumping margins ranging from 31.14 percent to 249.96 percent. • Mandatory respondents in this investigation are the collapsed entities Wuxi Suntech Power Co., Ltd., Luoyang Suntech Power Co., Ltd., Suntech Power Co., Ltd. and Wuxi Sun-Shine Power Co., Ltd. (collectively “Wuxi Suntech”) and the collapsed entities Changzhou Trina Solar Energy Co., Ltd. and Trina Solar (Changzhou) Science & Technology Co., Ltd. (collectively “Trina Solar”). • Wuxi Suntech and Trina Solar received preliminary dumping margins of 31.22 and 31.14 percent, respectively. • Fifty-nine other exporters qualified for a separate rate of 31.18 percent. • All other Chinese producers/exporters received a preliminary dumping margin of 249.96 percent. • Commerce preliminarily determined that critical circumstances exist. As a result of this preliminary determination, Commerce will instruct U.S. Customs and Border Protection to require a cash deposit or bond based on these preliminary rates, applicable to all entries of Chinese solar cells made up to 90 days prior to the date of publication of the preliminary determination notice.
