Introductions/Announcements A. Chairman Ron Mears called the council meeting to order at 9:32 a.m. and the Council members introduced themselves. B. Ron Breeding provided an overview of the meeting and explained the role of the Council stating that they serve in an advisory capacity to the Governor and the Department. He stated each Council member was provided a copy of all written comments, in advance of the meeting, for review. C. Greg Abbott and Wayne Kline made a presentation regarding surf fishing and permit sales. On behalf of the Division, Greg proposed limiting the number of surf permits issued annually and increasing the cost of surf fishing permits. D. The Council heard public comment and Division staff answered questions from the public. The following individuals made public comment: Mike Mathisen, Marcie Rosario, John McDaniel, Adam Hynson, Harry Aiken, Charles Turnbaugh, Chris Connolly, Michael Magee, Floyd Morton, Bruce West, Jim Haug, Bill Justis, Gary Rudden, Chistopher Oster, Dave Pitcher, Chad Bayless, Christopher Permar, Eric Burnley. Public comments indicated both support of and opposition to the Division’s proposal with both sides agreeing that the Division needs additional enforcement staff at the beach parks. -

Fort Miles Military Reservation, DE FACT SHEET as of March 2, 2018 AUTHORIZATION: Defense Environmental Restoration Program TYPE OF PROJECT: Formerly Used Defense Site (FUDS) PROJECT PHASE: Military Munitions Response Program (MMRP) Feasibility Study, Proposed Plan, Removal Actions, Design and Implementation of Land Use Controls CONGRESSIONAL INTEREST: Senators Carper and Coons (DE) and Representative Blunt (DE-At Large) BACKGROUND: The former Fort Miles Military Reservation (FMMR), originally called Cape Henlopen Military Reservation, consisted of 2,011.25 acres located in Lewes, Sussex County, Delaware. The Post was formally named Fort Miles in 1938.The FMMR served primarily as a Coast Artillery Installation during World War I and World War II, providing for the defense of Delaware’s Atlantic coast line and protection of the entrance to Delaware Bay. In 1941, the Department of the Navy established the Harbor Entrance Control Post and placed mines in the channel leading to the Delaware Bay. A fortress with gun emplacements, ammunition dumps, and living quarters was constructed. Several small arms firing ranges and a 3.5-inch rocket range were also established. Approximately 60 percent of the site was used for military training. During World War II, Fort Miles was also used as a prisoner of war camp for German and Italian prisoners. Following World War II, the site remained an active Army installation and was used as a training post during the Korean War. The FMMR closed in 1958. In 1961, any remaining land was transferred to the Department of Navy, which was subsequently transferred to the State of Delaware in 1996. -

BOARD OF WARDENS FOR PORT OF PHILADELPHIA - PILOTAGE RATES Act of Nov. 4, 2016, P.L. 1148, No. 148 Cl. 74 Session of 2016 No. 2016-148 HB 2291 AN ACT Amending the act of May 11, 1889 (P.L.188, No.210), entitled "A further supplement to an act, entitled 'An act to establish a board of wardens for the Port of Philadelphia, and for the regulation of pilots and pilotage, and for other purposes,' approved March twenty-ninth, one thousand eight hundred and three, and for regulating the rates of pilotage and number of pilots," further providing for rates of pilotage and computation, for pilotage fees and unit charge and for charges for services. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Sections 3.1 and 3.2 of the act of May 11, 1889 (P.L.188, No.210), entitled "A further supplement to an act, entitled 'An act to establish a board of wardens for the Port of Philadelphia, and for the regulation of pilots and pilotage, and for other purposes,' approved March twenty-ninth, one thousand eight hundred and three, and for regulating the rates of pilotage and number of pilots," amended May 15, 1998 (P.L.447, No.62) and June 10, 2013 (P.L.40, No.12), are amended to read: Section 3.1. For services rendered on and after January 1, 1990, retroactively, the rates of pilotage for conducting a vessel from the Capes of the Delaware to a place on the Delaware River or Bay no further upriver than the Delair Railroad Bridge between Philadelphia, Pennsylvania, and Delair, New Jersey, or from a place on the river Delaware no further upriver than the Delair Railroad Bridge between Philadelphia, Pennsylvania, and Delair, New Jersey, to the Capes of the Delaware, in either case, shall be computed as follows: (a) A charge, to be known as a unit charge, will be made for each pilotage, determined by length overall (in feet) multiplied by the extreme breadth (in feet) of the vessel, divided by one hundred. -

Principal Fortifications of the United States (1870–1875) uring the late 18th century and through much of the 19th century, army forts were constructed throughout the United States to defend the growing nation from a variety of threats, both perceived and real. Seventeen of these sites are depicted in a collection painted especially for Dthe U.S. Capitol by Seth Eastman. Born in 1808 in Brunswick, Maine, Eastman found expression for his artistic skills in a military career. After graduating from the U.S. Military Academy at West Point, where offi cers-in-training were taught basic drawing and drafting techniques, Eastman was posted to forts in Wisconsin and Minnesota before returning to West Point as assistant teacher of drawing. Eastman also established himself as an accomplished landscape painter, and between 1836 and 1840, 17 of his oils were exhibited at the National Academy of Design in New York City. His election as an honorary member of the academy in 1838 further enhanced his status as an artist. Transferred to posts in Florida, Minnesota, and Texas in the 1840s, Eastman became interested in the Native Americans of these regions and made numerous sketches of the people and their customs. This experience prepared him for his next five years in Washington, D.C., where he was assigned to the commissioner of Indian Affairs and illus trated Henry Rowe Schoolcraft’s important six-volume Historical and Statistical Information Respecting the History, Condition, and Prospects of the Indian Tribes of the United States. During this time Eastman also assisted Captain Montgomery C. Meigs, superintendent of the Capitol Brevet Brigadier General Seth Eastman. -

The Vietnam War dragged on, filling the defense of Cape Henlopen’s the 6 o’clock news with death and destruction, and no end was in sight. The previous month, the Army had imperiled dunes charged 14 officers with suppressing the truth about the horrific My Lai massacre in Vietnam, where as many as 500 essentially unarmed civilians had been murdered by U.S. troops. The hopeful Apollo 13 moon mission had suffered an oxygen tank explosion a few days before, forcing its hasty retreat to Earth. The Cold War with the communist USSR was tense and dispiriting, and Paul McCartney had just announced the breakup of the Beatles. To many Americans, the future seemed dismal and hundreds of thousands had taken to the streets and college cam - puses to protest the nation’s various problems. Among those concerns was the environment. Decades of hellbent-for-leather industrial develop - ment with little regard for the land, oceans and air was taking an ever-greater toll. To a growing number of people, this threat trumped all others: If you can’t breathe the air, can’t eat the food, and can’t drink the water, little else mattered. Scientists and other con - cerned individuals were beginning to sound the alarm, and people were beginning to listen. -
