C_lT _<:~~H 11111111111111111111111111111 0106800008 L -· 3 MARS 2014 1 I - ~ - -- - ----:J j I N .... , 'f)2.JY ~ Regulations on Selection of the Nomination list for the Intangible Cultural Heritage of Humanity Cultural Heritage Ad ministration's Regul ation No. 109, April 17, 2012 Article 1 (Purpose) The purpose of this regu lation is to enhance rationality and efficiency in selecting the nomination list of Intangible Cultural Heritage of Humanity by defining the necessary procedures and measures to select properties for nomination to the Representative Li st of the Intangible Cultural Heritage of Humanity (h ereinafter referred as the "Intangible Cu ltural Heritage of Humanity") pursuant to Article 19 of the Cultural Heritage Protection Act and the UNESCO Convention for the Safeg uarding of Intangible Cul tural Heritage. Article 2 (Definition) 1) For the purpose of this regulation, the "state inventory" means the list of intangible cu ltural heritage of high value falling under any one of the following subparagraphs as potential candidates for the nomination to the Intangible Cu ltural Heritage of Humanity among the intangible cu ltural heritag e items referred to in Article 2 Paragraph 1 Subparagraph 2 of the Cultural Heritage Protection Act (hereinafter referred as the "Act"). 1. Important Intangible Cultural Heritage des ignated un der Article 24 of the Act; 2. Intangible Cultural Heritage of Cities and Provinces designated under Article 70 of the Act; 3. Preliminary list prepared under Paragraph 2 of th is regulation. 2) For the purpose of this regulation, the "preliminary list" means the intangible cultural heritage items selected pursuant to Article 4 of this reg ulation among those not designated by th e cen tral government or local autonomous bodies. Article 3 (Research on the prel iminary list) 1) Concerning an intangible cultural heritage deemed invaluable as an Intangible Cultural Heritage of Humanity, the Administrator of the Cultural Herita ge Administration may conduct a survey by himself/herself on the item's value or entrust it with an agency or organization falling under any one of the following subparagraphs. L Incorporated bodies or organizations estab lish ed with the pu rpose of investigation, res earch, ed ucation or acad emic activities relevant to intangible cu ltural heri tag e; 2. Affil iated research institutes or industry-academic cooperation centers relevant to cul tural heritage pursuant to Article 2 of the Higher Education Act. 2) In the case of conducting a survey pursuant to the above Paragrap h 1, the survey results shal l include the facts and ideas falling un der each of the following subparagraphs. L The nam e of the intangible cultural heritage concerned; 2. Th e scope of the intangible cultural heritage concerned; 3. The concept and definition of the intangible cultural heritage concerned; 4. The co mmunities for transmission and their scope of the intangible cultural heritage co ncerned; 5. Th e conditions of transmission and the ways of perform ance of the intangible cultural heritage concerned; 6. The societal functions and relationship of the intangible cu ltural heritage concerned; 7. Sa feguarding measures for the intangible cultural heritage concerned. 3) Th e Administrator of the Cultural Herita ge Administration shall make endeavors to encourage participation of various individuals an d groups at diverse levels including concerned individuals, groups, communities an d res earch organizations in the process of a survey under Paragraph 1. 4) In case the survey is entrusted pursuant to Para graph 1, Articles 12, 13 and 14 of the Regulations on the Comm ission and Entrustment of Administrative Authority shall apply mutatis mutandis to the procedure for selecting the organization. Article 4 (Selection of the preliminary list) 1) The Administrator of the Cultural Heritage Administration may select items recognized invaluable for the Intangible Cultural Heritage of Humanity for the preliminary list ba sed on the survey results conducted pursuant to Article 3, after deliberation by the Cultural Heritage Committee under Article 8 of the Act (hereinafter referred as the Cultural Heritage Co mmittee). 2) The Administrator of the Cultural Heritage Ad ministration may add, cha nge or cancel the preliminary list after the proced ure pursuant to Para graph 1. Article 5 (Procl amation of the state inventory) 1) The Administrator of the Cultu ral Heritage Administration shall notify the information involved with the state inventory to the public through the Cultural Heritage Administration website, etc. 2) The Administrator of the Cultural Heritage Administration shall renew the information involved with the state inventory on a reg ular basis to maintain and manage the list up to date at all times. Article 6 (Se lection of th e nomination list for the Intangible Cultural Heritage of Humanity) 1) From the state inven tory, the Admin istrator of the Cultural Heritage Administration may select the nomination list deemed highly necessary to nominate to the Intangible Cultural Herita ge of Humanity after deliberation by the Intangible Cultural Heritag e Subcommittee and World Heritage Subcommittee of the Cultural Heritage Co mmittee. 2) The Administrator of the Cul tural Heritage Administration sha ll ma ke endeavors to encourage participation of various individuals and groups at diverse levels including individuals, groups, co mmunities or research organization s, etc in the process of preparing the nomination. Article 7 (Period of reexa mination) Pursuant to the Regulation on Proclamation and Managem ent of the Directives an d Ru les (Pres idential Directive No. 248), th e period during which this regulation is to be abolish ed and revised sh all be before or on March 31, 2015, after reexamining the laws and reality conditions havi ng ch anged upon the proclamation. ADDENDA Article 1 (Enforcement date) This regulation shall enter into force upon proclamation.
