Mannu Bhandari vs Kala Vikas Pictures Pvt. Ltd. And ... on 8 August, 1986 Delhi High Court Mannu Bhandari vs Kala Vikas Pictures Pvt. Ltd. And ... on 8 August, 1986 Equivalent citations: AIR 1987 Delhi 13, ILR 1986 Delhi 191 Author: S Wad Bench: S Wad JUDGMENT S.B. Wad, J. (1) How far law protects creative aesthetic expression of an artist ? Is the intellectual property of an artist governed by the same norms as commercial property ? Where does the freedom (of expression) of the author end, where does the Director begin ? What is the scope and width of Section 57 of the Copyright Act, 1957 ? These are the questions F raised in Manna Bhandari's suit against M/s. Kala Vikas Pictures (Pvt.) Ltd. and its producer and director. Kala Vikas has produced motion picture 'Samay Ki Dhara' eider assign- ment of filming rights of her novel 'Aap ka Bunty'. Her complaint is of the mutilation and distortion of the novel. She G' pleads for permanent injunction against its screening and ex- hibition. Although many .authors complain of such distortions, few have sought judicial protection. Hence, there is no precedent of any law court to guide the film industry. (2) The trial court has refused an ad-interim restraint order. H The appeal is against this order. (3) At the time of the hearing it was realised that apart from the verbal allegations made by the Plaintiff and the defendants, there was considerable common ground, which if properly explored, would bring the parties to an amicable settlement. But, the Plaintiff insisted that as a committed author she would like the Court to authoritatively resolve the question of the rights of the authors as the problem is repeatedly faced by the authors and there is no judicial decision.

It is a critical-historical account of the transitional era, roughly from 1998 to 2018, and examines practices and decisions taken ‘on the ground’ by film sound recordists, editors, designers and mixers. My work explores the histories and genealogies of the transition by analysing the individual, as well as collective, aesthetic concerns of film workers migrating from the celluloid to the digital age. My inquiry aimed to explore linkages between the digital turn and shifts in production practices, notably sound recording, sound design and sound mixing. The study probes the various ways in which these shifts shaped the aesthetics, styles, genre conventions, and norms of image-sound relationships in Indian cinema in comparison with similar practices from Euro-American film industries.

EUROPEAN ACADEMIC RESEARCH Vol. III, Issue 12/ March 2016 Impact Factor: 3.4546 (UIF) ISSN 2286-4822 DRJI Value: 5.9 (B+) www.euacademic.org Feminist discourse in Hindi Fiction Dr. SYED AFROZ ASHRAFI Assistant Professor of English Prince Sattam Bin Abdulaziz University Kingdom of Saudi Arabia Abstract: The Feminist discourse analyses the early trends in Hindi fiction to suggest the subdued undercurrents of feminist drive to break the shackles of patriarchy. Patriarchy which had dominated the literature of the East till early 20th century generally in line with the feudal order had not left much of a space to accommodate feminist point of view. The paper examines the efforts of a few women novelist and a male writer like Bhisam Sahni expressing solidarity with the feminist reactions and to suggest further the Hindi fiction had risen in consciousness to challenge the phallic structure. Key words: Feminism, Rebellion, discontent, assertions. BACKGROUND Feminist discourse what is known as Nari Vimarsh in Hindi literature has been as intense a movement as in any other literature though the first phase of Hindi fiction perhaps did not notice any voice which could have suggested its early rise. Hindi fiction took its own time right from the days of Premchand, Jainendra, Yashpal to evolve down to the parallel Nai Kahani led by the likes of Mohan Rakesh and Kamleshwar though what was new in Nai Kahani remains debatable. 12583 Syed Afroz Ashrafi- Feminist discourse in Hindi Fiction The rise of women writers in Hindi fiction was comparatively slow as even Urdu fiction had in its sphere some women writers since the days of Taraqqi pasandi or Progressive movement wherein writers like Rashid Jehan rebelled against the patriarchal hegemony by writing fiction that hoisted upon women a new consciousness to usher in and challenged the phallic authority head on.
