PREFACE

This document has been prepared to provide a convenient and authoritative historical overview of electoral activities in the Province of British Columbia during the 115 year period from 1871 to 1986. The date contained in this document was gathered from a variety of sources which among others included The British Columbia Gazette, the Journals of the Legislative Assembly and the Statement of Votes (which appeared first in 1928). The Statement of Votes is now continuously published by Elections British Columbia. The Electoral History of British Columbia provides results for all general and by-elections since 1871, based on both official and unofficial sources. Chris P. Fulker with whom the idea was first discussed and who performed much of the earlier research for the document is of the hope that — ‘‘this work will prove most revealing to future researchers and will perhaps spur them on to more detailed work by providing a suitable background and framework.’’ I suspect that this document has the full potential of helping Mr. Fulker realize his hopes. Preface

This supplement to the Electoral History of British Columbia, 1871–1986, has been compiled to meet requests from clients and researchers who enjoyed the benefits of the easy access to an overview of electoral activities in British Columbia in the original volume. The Supple- ment brings that information up to the general election of 2001.

The data in the Supplement, was, like the original volume, gathered from a variety of sources, but focused primarily on the Statement of Votes for the Province, the Journals of the Legislative Assembly and the Statutes of British Columbia. The Supplement lists the results of the general elections, by-elections and other electoral activities, such as recall and referenda initiatives from 1987 to 2001.

We hope the Supplement will be as useful to users as the original volume proved to be. Maedythe Martin undertook the task of compiling the information and the Chief Electoral Officer, Robert Patterson arranged for his staff to vet the information. For all your efforts: my thanks.

March 2002 INTRODUCTION

This volume is a supplement to the Electoral History of British Columbia, 1871 – 1986, continuing the historical record until the end of 2001. It begins with by-elections that followed the 1986 General Election and concludes with the 2001 General Election and legislative changes up to the end of 2001. A comparison of the two volumes is instructive. There are more women Members in the last 15 years than in the previous 115 and even a casual reading of the list of elected candidates shows how the growing diversity of the Province has become part of its political life. The dominance of Scottish surnames found in early provincial elections has evolved into a list of names reflecting the present population of the Province. British Columbia has a long history of independent and varied political views and this continued in the period covered by this volume: candidates representing no less than 22 political parties were nominated in the 2001 General Election. Legislative change has led to the inclusion of three new sections not found in the Electoral History of British Columbia, 1981 – 1986. These list Initiative Petitions and Recall Petitions issued under the Recall and Initiative Act and regulations issued under the revised Election Act. ELECTION RESULTS 1987–2001 PART ONE

REFERENDUM RESULTS In conjunction with the General Election of 1991, voters were asked two questions: A: Should voters be given the right, by legislation, to vote between elections for the removal of their member of the Legislative Assembly? YES 1,090,023 80.89% NO 257,522 19.11% REJECTED 135,363 B: Should voters be given the right, by legislation, to propose questions that the government of British Columbia must submit to voters by referendum? INITIATIVE PETITIONS

The Recall and Initiative Act (RSBC 1996, c. 398) permits voters in British Columbia to propose new laws or initiate changes to existing laws.

Any registered voter can apply to have a petition issued by the Chief Electoral Officer. If more than 10% of the registered voters in each of the electoral districts, who were registered to vote on the date the petition was issued, sign an initiative petition within the 90-day canvassing period, the Chief Electoral Officer sends a copy of the verified petition and draft Bill to the Select Standing Committee on Legislative Initiatives.

The Select Standing Committee must meet within 30 days of receipt of the petition and draft Bill. From their first meeting, the Committee has 90 days to consider the legislative proposal and either table a report recommending introduction of the draft Bill, or refer the initiative to the Chief Electoral Officer for an initiative vote.

The Recall and Initiative Act was brought into force on 24 February 1995.

Petition I95001: An Act to Balance the Budget and Retire Provincial Debt Proponent: Thomas McArthur Opponent: None registered Petition Issued: November 20, 1995 Outcome: The petition was not returned by the proponent by the deadline of February 19, 1996.

Petition I95002: An Act to Remove School Tax Levies from Residential Properties Proponent: Terry Milne Opponent: None registered Petition Issued: December 11, 1995 Outcome: The petition was not returned by the proponent by the deadline of March 11, 1996.

Petition IP-2000-001: Child Services Equality Act Proponent: Jim McDermott Opponent: None registered Petition Issued: May 23, 2000 Outcome: The Petition was returned on August 21, 2000 with 4,325 signatures falling short of the 202,984 signatures required.

The number of signatures required for individual petitions varies as it is based on the number of registered voters who were registered to vote on the date the petition was issued.

RECALL PETITIONS

The Recall and Initiative Act (RSBC 1996, c. 398) allows voters in British Columbia to remove a Member of the Legislative Assembly between elections.

Any individual can apply to the Chief Electoral Officer for a Petition for the recall of the Member for the electoral district in which the applicant is registered to vote. A Member cannot be recalled during the first 18 months after election.

If the application for a Petition is complete and meets the requirements of the Act, a petition is issued and the proponent has 60 days to collect signatures from 40% of the voters who were registered to vote in the Member’s electoral district at the last election and who are currently registered to vote in British Columbia.

If the petition is successful, the Member ceases to hold office and a By-Election must be called within 90 days.

British Columbia is the only jurisdiction in Canada with recall legislation. The Recall and Initiative Act was brought into force on February 24, 1995.

Royal Commission on Electoral Boundaries

Appointed: April 9, 1987 (Order-In-Council 690) under the Inquiry Act, Part II.

Commissioner: Judge Thomas Kemp Fisher sitting as sole Commissioner.

The Royal Commission was originally appointed to consider only electoral districts that returned two members to the Legislature. This mandate was amended on 17 September 1987, to a consideration of all electoral districts and their boundaries.

The Preliminary Report of Proposed Boundaries for British Columbia Electoral Districts was submitted on 24 May 1988. Following further public consultation, a Final Report was submitted in December, 1988 which recommended 75 single-member electoral districts with no more than a 25% variation from strict electoral equality.

These recommendations were brought into effect 19 September 1991 with the dissolution of the 34th Legislative Assembly.

1997

Electoral Boundaries Commission

Appointed: December 3, 1997 under the Electoral Boundaries Commission Act (RSBC 1996, c. 107 and amend- ments) to provide for an independent, non-partisan, statutory commission which would review the Province’s electoral boundaries on a regular basis.

Chair, Judge Josiah Wood, Q.C., Commissioner Rev. Katherine Hough and Commissioner Robert Patterson.

The Commission reported to the Legislature 3 December 1998 with amendments submitted 3 June 1999 after a period of public consultation. It recommended an increase from 75 to 79 electoral districts to compensate for population growth in the Lower Mainland. Several other districts were realigned.

These recommendations were implemented in a new Electoral Districts Act (SBC 1999 c. 31) which received Royal Assent on 15 July 1999 with the new electoral districts coming into effect 18 April 2001 with the dissolution of the 36th Parliament.

B.C. Legislative Assembley. Special Committee on Electoral Boundaries

A Special Committee was approved by the Legislature, 22 June 1988 to consider the recommendations of the Royal Commission on Electoral Boundaries (Fisher).

Chair, Jim Rabbitt (MLA, Yale-Lillooet), Deputy Chair, Angus Ree (MLA, North Vancouver-Capilano).

The Special Committee submitted its report to the Legislature on 29 March 1989 without making any specific recommendations.

B.C. Legislative Assembly. Special Committee to Appoint the Chief Electoral Officer

The Election Act (RSBC 1996 C.106) requires that the Chief Electoral Officer be appointed on the unanimous recommendation of a special committee of the Legislature. A committee was struck and reported on 20 December 1995. The report was accepted by the Legislature on 25 April 1996 and Robert A. Patterson was subsequently appointed as Chief Electoral Officer and an officer of the Legislature.

CANDIDATES WHO RAN IN MORE THAN ONE ELECTORAL DISTRICT

None. The last candidate to run in more than one electoral district was in 1933. The current Election Act, Section 52 (2), does not permit an individual to run in more than one electoral district.

CONTROVERTED AND VOIDED ELECTIONS

None. A voided election requires the holding of a new election. A controverted election sets aside the original election results and declares a different candidate elected.

MULTI-MEMBER DISTRICTS

None. British Columbia has a history of multiple members representing a single electoral district. In the first General Election (1871) two districts were each represented by six members. Multi-member electoral districts were discontinued following the 1986 General Election and the subsequent work of the Royal Commission on Electoral Boundaries (1987) and the coming into force of the Electoral Districts Act (1990) when the 35th Parliament was dissolved, 19 September 1991.

ELECTORAL HIGHLIGHTS 1986 – 2001

1986 First woman becomes Premier (Rita Johnson, Surrey-Newton): elected by Government Caucus follow- ing resignation of Premier William Vander Zalm.

1988 Royal Commission on Electoral Boundaries recommends the number of electoral districts be increased to 75 from 52 and the 17 multi-member member ridings be eliminated thus increasing the number of seats from 69 to 75.

1991 Royal Commission on Electoral Boundaries (Fisher) recommendations are implemented in the 1991 General Election held with 75 single-member electoral districts. This was the first British Columbia a General Election held without multi-member electoral districts.

Voters in the General Election approve a referendum providing a mechanism to recall sitting Members and to bring citizen initiatives before the Legislature or to province-wide referendum.

1992 Elections Amendment Act (SBC 1992, c. 72) lowers the voting age to 18 from 19 and eases restrictions on voting day registration.

1995 First comprehensive revision of Election Act (SBC 1995 c. 51) since 1920 is adopted.

Elections BC becomes an independent office of the Legislature.

The Recall and Initiative Act (SBC 1994 c. 56) comes into force providing a mechanism to recall sitting Members and to bring citizen initiatives before the Legislature or to province-wide referendum.

British Columbia is the only jurisdiction in Canada with recall legislation.

1996 Chief Electoral Officer is unanimously recommended by a multi-party Special Committee of the Legislature (Robert A. Patterson), and appointed as an officer of the Legislature.

1997 First petitions to recall sitting MLAs are authorized under the Recall and Initiative Act. These are ultimately unsuccessful failing to gather the required number of signatures set by the Act.

The first Commission is appointed under the Electoral Boundaries Commission Act (SBC 1989 c. 65) chaired by Josiah Wood. Subsequent Commissions to be appointed in the first Session of the Legisla- ture after every second General Election to make recommendations on electoral boundary changes.

1999 Recommendations of the Electoral Boundaries Commission are implemented by the Electoral Districts Act (SBC 1999 c. 31) increasing the number of seats from 75 to 79.

First postal enumeration replaces the door-to-door canvassing process.

2000 First Indo-Canadian becomes Premier (, Vancouver-Kensington): elected by Party con- vention following resignation of Premier .

Supreme Court of British Columbia upholds a challenge to the Election Act limits on third party spending and publication of polling data: 9 February 2000. Sections 235, 236, 237 and 238 of the Election Act are ruled to contravene the Canadian Charter of Rights and Freedoms and to be of no force and effect. Requirements for third party advertisers to register and to file financial disclosure reports remains in effect.

2001 Constitution (Fixed Election Dates) Amendment Act (SBC 2001 c. 36) — to come into force by regulation — provides for fixed dates for general elections: second Tuesday in the 4th calendar year following a General Election.
