Main results of the Council

The Council discussed Iran and adopted conclusions, reiterating its serious and deepening concerns over the nature of Iran's nuclear programme. In the light of these concerns, the Council strengthened the EU restrictive measures against that country and agreed to broaden existing sanctions through additional measures, in close coordination with international partners. The Council also expressed its outrage over the attack on the British Embassy in Tehran, condemning it utterly.

The Council exchanged views on the situation in the EU's Southern Neighbourhood, in the light of the latest developments in the region. It adopted conclusions on Egypt, Syria and Yemen . In view of the gravity of the situation in Syria, the Council reinforced the restrictive measures on the country's regime. The Council also took stock of the EU's response to the developments in its Southern neighbourhood.

During lunch, ministers discussed the Arab Spring, the Middle East Peace Process and relations with the Arab League with Dr. Nabil El Araby, Secretary General of the League of Arab States.

In their six-monthly meeting within the Council, EU defence ministers discussed the state of play concerning the Common security and defence policy (CSDP) and adopted conclusions. The Council also established the 2012 budget for the European Defence Agency . In addition, it approved a framework for cooperation between the European Defence Agency and the Federal Department of Defence of the Swiss Confederation, with a view to its conclusion by the EDA Steering Board.

Western Balkans

TheHighRepresentativebriefedministersaboutthelatestroundoftheEUfacilitateddialogue betweenBelgradeandPristina,heldon30November.

TheCounciltookstockofrecentdevelopmentsintheregion,focusingontheBelgradePristina dialogueaswellasonBosniaandHerzegovina,andconfirmeditscontinuedsupportfortheEU policytowardstheWesternBalkans.

TheexchangeofviewswillfeedintotheupcomingdebateonEUenlargementintheGeneral AffairsCouncilon5December,whichwilladoptconclusions.

Iran

TheCouncildiscussedthesituationconcerningIran,followingthepublicationofthenewreportby theInternationalAtomicEnergyAgencyconcerningIran'snuclearprogramme.

TheCounciladoptedthefollowingconclusions:

1. "TheCouncilreiteratesitsseriousanddeepeningconcernsoverthenatureofIran'snuclear programme,andinparticularoverthefindingsonIranianactivitiesrelatingtothe developmentofmilitarynucleartechnology,asreflectedinthelatestIAEAreport.Inthis regard,theCouncilstronglysupportstheresolutionadoptedbytheIAEABoardof Governors,whichexpressesdeepandincreasingconcernsaboutunresolvedissuesand stressesthegraveconcernposedbyIran’scontinuedrefusaltocomplywithits internationalobligationsandtofullycooperatewiththeIAEA.

2. Inthelightoftheseconcerns,theCouncilhastodaydesignatedafurther180entitiesand individualstobesubjecttorestrictivemeasures.Thesedesignationsincludeentitiesand individualsdirectlyinvolvedinIran’snuclearactivities,whichareinviolationofUNSC resolutions;entitiesandindividualsowned,controlledoractingonbehalfoftheIslamic RepublicofIranShippingLine(IRISL);andmembersof,aswellasentitiescontrolledby, theIslamicRevolutionaryGuardsCorps(IRGC).

3. InaccordancewiththeEuropeanCouncilDeclarationof23October,theCouncilfurther agreedthat,giventheseriousnessofthesituation,includingtheaccelerationofthenear 20%uraniumenrichmentactivitiesbyIran,inviolationofsixUNSCresolutionsand elevenIAEABoardresolutions,andtheinstallationofcentrifugesatapreviously undeclaredanddeeplyburiedsitenearQom,asdetailedintheIAEAreport,theEUshould extendthescopeofitsrestrictivemeasuresagainstIran.

4. Inparticular,theCouncilagreedtobroadenexistingsanctionsbyexamining,inclose coordinationwithinternationalpartners,additionalmeasuresincludingmeasuresaimedat severelyaffectingtheIranianfinancialsystem,inthetransportsector,intheenergysector, measuresagainsttheIranianRevolutionaryGuardCorps,aswellasinotherareas.The CounciltaskedpreparatoryCouncilbodiestofurtherelaboratethesemeasuresfor adoption,nolaterthanbythenextForeignAffairsCouncil.

5. TheCouncilagainreaffirmedthelongstandingcommitmentoftheEuropeanUnionto workforadiplomaticsolutionoftheIraniannuclearissueinaccordancewiththedual trackapproach.TheCouncilwelcomesandfullysupportsthecontinuingeffortsoftheEU HighRepresentativeonbehalfoftheE3+3aimedatconvincingIrantoenterinto meaningfultalksonconcreteconfidencebuildingmeasures.TheCouncilcallsuponIranto respondpositivelytotheofferofnegotiationsintheEUHighRepresentative’slatestletter bydemonstratingitsreadinesstoseriouslyaddressexistingconcernsonthenuclearissue.

6. TheCouncilreaffirmsthattheobjectiveoftheEUremainstoachieveacomprehensiveand longtermsettlementwhichwouldbuildinternationalconfidenceintheexclusively peacefulnatureoftheIraniannuclearprogramme,whilerespectingIran’slegitimaterights tothepeacefulusesofnuclearenergyundertheNPT."

TheCouncilalsoadoptedthefollowingstatementontheattackontheBritishembassyinTeheran:

"TheCouncilisoutragedbytheattackontheBritishEmbassyinTehranandutterlycondemnsit.It isaviolationoftheViennaConvention.ItalsodeploresthedecisiontoexpeltheBritish AmbassadorfromTehran.TheCouncilconsiderstheseactionsagainsttheUKasactionsagainstthe EuropeanUnionasawhole.TheEUistakingappropriatemeasuresinresponse."

TheCouncilexchangedviewsonthesituationintheEU'sSouthernneighbourhood,inthelightof thelatestdevelopmentsintheregion.

– Egypt

TheCouncildiscussedthesituationinEgyptandadoptedthefollowingconclusions:

1. "TheCouncilwelcomesthewellorganizedandpeacefulstartoftheparliamentary electionsinEgypton28Novemberandthesignificantvoterturnoutwhichprovesthe engagementoftheEgyptianpeopleinthepoliticaltransition.Ithopesthisprocesswill continueinasafeandtransparentenvironment.TheCounciltakesnoteoftheSupreme CounciloftheArmedForces'(SCAF)recentannouncementtoholdPresidentialelections beforetheendofJune2012.

2. TheCouncilunderlinesthataswiftmovetocivilianruleshouldtakeplaceassoonas possible.Inthiscontext,theSCAFhastheresponsibilityofprotectingthedemocratic rightsofthepopulationandmustensurethatpoweristransferredassoonaspossibletoa representative,inclusiveciviliangovernment,thathasallthenecessaryauthoritytolead Egyptthroughitstransitionprocess.Itencouragestheinterimauthoritiestoseekapeaceful andconstructivewayforwardbasedonaninclusiveandopendialoguewithallpolitical forcesandcivilsocietyrepresentativeswhilesafeguardingtheprinciplesofdemocracy, humanrightsandfundamentalfreedoms.

3. TheEUisdeeplyconcernedabouttheviolenceandunrestthattookplaceinEgyptpriorto thefirstroundofelections.TheCouncildeploresthelossoflifeandhighnumberof injuredpeopleinrecentclashesandexpressesitscondolencestothefamiliesofthe victims.Itcondemnstheexcessiveandunacceptableviolencecommittedbythesecurity forcesagainstthedemonstrators.TheCouncilurgesrestraintonallsidesandcallsforan independentinvestigationbringingthoseresponsibleforviolencetojustice.Italsourges theauthoritiestoupholdtheruleoflawandrespectforhumanrights.

4. TheCouncilexpressesitsdeepconcernregardingthedeteriorationoftheeconomic situationinEgypt,whichmakesitevenmoreurgenttohaverepresentativeauthoritiesable toengageinthenecessarysocialandeconomicreformsandtoallowtheeffectiveuseof availableinternationalassistance.TheEUconveysitscontinuedsupporttoEgyptinthis regard.

5. TheCouncilreiteratesitssupportforademocratic,pluralistandstableEgyptasakeyEU partnerintheregionsharingthegoalofbuildingstability,peaceandprosperityinthe MediterraneanandMiddleEastregion.

6. TheEUwillcontinuetostandbyEgyptanditspeopleintheirquestforfreedomanda democratictransitionbasedonthegoalsofdeepandsustainabledemocracyandinclusive economicdevelopment,inlinewiththeCouncilconclusionsontheEuropean NeighborhoodPolicyof20June2011."

– Syria

TheCouncildiscussedthesituationinSyria.

Inlightofthecontinuedrepression,theCouncilreinforcedtheEU'srestrictivemeasuresagainstthe Syrianregime,targetingitsabilitytoconductthebrutalrepression.Formoreinformation,seepress release 17895/11 .

TheCounciladoptedthefollowingconclusions:

1. "TheEuropeanUnionstronglysupportstheeffortsoftheLeagueofArabStates(LAS)to bringaboutanendtotherepressioninSyriaandprovideprotectiontotheciviliansby deployinganobservermissionontheground.TheEUwelcomesthesignificantdecisionof theArabLeaguetoimposesanctionsagainsttheSyrianregimeduetoitsrepeatedfailure todeliveronitspromisesandtoitsrefusaltoimplementtheArabPlanofAction.TheEU willcontinuetosupporttheArabLeague'seffortstorestorepeaceandwelcomesthe commitmentbytheArabLeaguetoengagewiththeUNSGtosolvethiscrisiswhich representsathreattoregionalstability.

2. TheEUreiteratesitscondemnationinthestrongesttermsofthebrutalcrackdownbythe SyriangovernmentwhichriskstakingSyriadownaverydangerouspathofviolence, sectarianclashesandmilitarization.TheEUsalutesoncemoretheunwaveringcourageof thoseinSyriawhoareprotestingandtheirwillingnesstoremaincommittedtonon violence.TheEUreaffirmsitssupportfortheSyrianpeople,intheirquestfordignityand freedom,todecidethefutureoftheircountrythroughpeaceful,democraticaswellasnon sectarianmeans.PresidentAssadmuststepasideimmediatelytoallowforapeacefuland democratictransition.

3. TheEUisextremelyworriedaboutthedeterioratinglivingconditionsoftheSyrianpeople incertainlocalitiesaffectedbytheunrest,especiallyintheregionofHoms.TheSyrian authoritiesmustimmediatelyalleviatethesufferingofthepopulationlivingintheseareas andmustallowunhinderedandsustainedaccesstohumanitarianagenciesandworkers andensurethefunctioningofbasicandhealthservices.

4. TheEUwelcomestheresolutiononhumanrightsinSyriaapprovedon22Novemberin theUNGeneralAssembly’sThirdCommitteeandwelcomesinparticulartheArabsupport foritsadoption.Theresolutionsendsastrongsignalofwideandunitedcondemnationof theSyrianregime’ssystematicabusesandunderlinesinternationalsupportfortheArab League.TheEUwelcomesthepublicationofthereportoftheindependentinternational commissionofenquiryontheviolationsofinternationalhumanrightslawinSyriasince March2011.TheupcomingSpecialSessionoftheUNHumanRightsCouncilonSyria,for whichtheEUhascalled,couldalsocontributetotheinternationaleffortstopushthe Syriangovernmenttoendtheappallingviolenceagainstitspopulation.TheEUwill continuetopressforstrongUNactiontoincreaseinternationalpressureandurgesall membersoftheUNSecurityCounciltoupholdtheirresponsibilitiestoendtheviolencein SyriaandsupporttheSyrianpeopleintheirdesireforgreaterfreedomsandpoliticalrights.

5. TheEUreiteratesitsstrongsupporttotheSyrianpeopleandencouragestheSyrian oppositiontoestablishaunitedplatformandtocontinuetoengagewiththeArabLeague towardsasuccessfultransition.TheEUwillcontinuetoactivelyengagewith representativemembersoftheSyrianoppositionwhichadheretononviolence, inclusivenessanddemocraticvalues.ItwelcomestheSyrianNationalCouncil’s commitmentsinthisregard.

6. InlightofthecontinuedrepressioninSyria,theEUhasdecidedtodaytoplacefurther restrictivemeasurestargetingtheregime’sabilitytoconductitsbrutalrepression.These newmeasuresarerelatedtotheenergy,financial,bankingandtradesectorsandincludethe listingofadditionalindividualsandentitiesthatareinvolvedintheviolenceordirectly supportingtheregime.InlinewiththeEuropeanCouncilConclusionsof23October,the EUwillcontinuetoimposeadditionalandmorecomprehensivemeasuresagainstthe regime,notthecivilianpopulation,aslongastherepressioncontinues.TheEUwill continuetoconsultcloselywiththeArabLeagueonthismatterandcallsonthe internationalcommunitytojoinitseffortsandthoseoftheArabLeaguetotargetthose responsiblefororassociatedwiththeviolentrepressionandthosewhosupportorbenefit fromtheregime.

7. AssoonasPresidentAssadstepsasideandagenuinedemocratictransitionbegins,theEU isreadytodevelopanewandambitiouspartnershipwithSyriaacrossallareasofmutual interest,includingbymobilizingassistance,andstrengtheningtradeandeconomiclinks."

– Yemen

TheCouncildiscussedthesituationinYemenandadoptedthefollowingconclusions:

"TheEuropeanUnionwelcomesthesignatureon23Novemberoftheagreementforpolitical transitioninYemenanditsimplementationmechanism.TheEUcommendstheGulfCooperation Councilforitsinitiativeanditssustainedeffortstobrokerthissettlement,incloseandconstructive cooperationwithinternationalpartners.

TheEUcallsnowonallpartiestodeliveringoodfaithontheircommitmentstoapeacefuland orderlytransition,whichremainsessentialforaninclusive,Yemeniledprocessofdemocratic renewal.ThechallengesfacingYemenareimmense.Thenewtransitionalgovernmentofnational unitywillneedtoactasamatterofurgencytotacklethehumanitarian,economicandsecurity criseswhichnowconfrontYemen.

TheEUdeeplydeploresongoingviolencesincethesignatureon23Novemberandreiteratesitscall uponallactorstoimmediatelystopallviolenceandprovocationsandcommitconstructivelytothe transition.

ThesignatureoftheagreementisacriticalfirststeptowardstheimplementationofUnitedNations SecurityCouncilResolution2014,unanimouslyadoptedon21October2011.TheResolutionsets outtheseriousconcernsoftheinternationalcommunityaboutthesituationinYemenandcallsfora peacefultransferofpower.ThesubsequentreportsoftheSecretaryGeneral,startingwiththat issuedon28November,provideanimportantmeansfortheinternationalcommunitytocontinue followingactivelyandcloselytheevolutionofthesituation.

TheEUstronglyhopesthatthetransitionprocesswhichhasjustbegunwillbecomeasolidplatform fornationalreconciliationinYemen.Itshouldmeetthelegitimatedemandsandaspirationsofall YemenisfromthroughoutthecountryandallpartsofYemenisociety,includingcivic organisations,womenandyoungpeople. TheEUwilldoallitcantoassisttheYemenipeople,notablythroughurgentlyneeded humanitariananddevelopmentassistance.TheEUwillcontinuetomonitorthesituation."

TheCounciltookstockofprogressinimplementingtheEU'shorizontalapproachtothetransitions initsSouthernneighbourhoodandadoptedthefollowingconclusions:

1. "ReaffirmingthestrategicimportanceoftheEUneighbourhood,theCouncilreiteratesits commitmenttoanewpartnershipwiththeEU’sSouthernneighbours,basedonmutual accountabilityandadherencetouniversalvaluesofliberty,democracy,respectforhuman rights,genderequality,fundamentalfreedoms,theruleoflaw,goodgovernanceand democraticsecurityreforminthewakeofthehistoriceventsearlierthisyear.Inthis regard,itrecallstheEuropeanCouncilConclusionsof11Marchand23/24Juneandthe CouncilConclusionsonEuropeanNeighbourhoodPolicyof20June2011.TheEUnotes thesignificantremainingchallengesinpartnercountriesandstandsreadytouseEU mechanismsandinstrumentstocontinuesupportingthemintheireffortstowards democracyandprosperity.

2. TheEU'sresponsetothesedevelopmentsisbasedonthenewPartnershipforDemocracy andSharedProsperityfortheSouthMediterraneanadoptedinMarch2011,andthereview oftheEuropeanNeighbourhoodPolicyinMay2011.Basedontheprinciplesof differentiation,jointownershipandmutualaccountability,theEUiscommittedtooffering moresupporttothosepartnerswhomakegreatercommitmentsandgreaterprogress towardsdemocraticreform.Inparticular,theEUisofferingitspartnerscloserpolitical association,assistanceineconomicandsocialreforms,progressiveeconomicintegration withtheEUinternalmarket,improvedmobilityofpeopleandfinancialsupport.TheEU willwithdrawsupportwhereregimeshavechosentooppresstheirpeopleratherthan followthepathofreform,andhasdonesoalready.Initsresponsetothedevelopmentsin theSouthernNeighbourhood,theEUhasworkedinclosecooperationwithkey internationalpartnersincludingtheUNandArabLeague.TheEUisreadytoexploreways ofgivingtheEUArabLeaguedialogueamorevisibleandengagedformat.TheCouncil alsowelcomestheDeauvillePartnershipandtheG8supporttothecountriesindemocratic transitionaswellasactivitiesandinitiativesoftheCommunityofDemocracies.

3. Sincethesemomentouseventsbegan,theHighRepresentativeandMemberStateshave engagedpoliticallywithawiderangeofgovernment,oppositionandparliamentary interlocutorsandwithcivilsociety,andwillcontinuetodoso.TheworkoftheEUSpecial RepresentativefortheSouthernMediterraneanwillhelpdeepentheEU'srelationshipwith thecountriesoftheSouthernMediterraneanregionandenhancethecoordinationofthe EU’sresponsetothedevelopmentsintheSouthernNeighbourhood.

4. InTunisia,theEUwelcomesthesuccessofthedemocraticelectionsof23October,which ithassupportedthroughtraining,capacitybuildingandanEUElectoralObservation Mission.On2829September,theHighRepresentative/VicePresidentandtheTunisian PrimeMinistercochairedthefirstmeetingoftheEUTunisiaTaskForcethatbrought togethergovernments,institutionsandbusinessestosupportTunisia’sdemocratic transitionprocessthroughrenewedpartnership.Thissuccessfuleventwillinspirefuture TaskForcemeetingswithothercountries,takingintoaccountthespecificityofeach partner.

5. TheEUwelcomestheholdingofparliamentaryelectionsinMoroccoon25November. Thisisanimportantstepintheongoingprocessofdemocraticreform.TheEUnotesin particularthattheelectionswereproperlyorganisedandconductedinapeaceful atmosphere.TheEUlooksforwardtoworkingwiththenewgovernmentandwillcontinue tosupportMoroccoinimplementingreformsinaccordancewiththeaspirationsofthe Moroccanpeople.

6. TheEUalsowelcomestheappointmentofaTransitionalGovernmentinLibyaandlooks toittotakeforwardaprocessofinclusive,democratictransitioninaccordancewiththe aspirationsoftheLibyanpeoplebasedonacontinuingcommitmenttoupholdhuman rights.InfullrespectoftheprincipleofLibyanownershipandincooperationwiththeUN, theEUisreadytocombineallitsinstruments,includingCSDPifappropriate,inorderto providefurtherassistancetothenewLibyaacrossarangeofsectors,asalreadysetoutin theFACConclusionsof14November.Inthiscontext,theEUhasopenedafullyfledged DelegationinTripolion12November.

7. TheEUhasstrengthenedandsubstantiallysteppedupitspartnershipwithandsupportto civilsocietyinitsneighbourhood,particularlyinTunisia,LibyaandEgypt,including throughthelaunchoftheNeighbourhoodCivilSocietyFacility.Inthisregard,theCouncil underlinestheimportanceoffreedomofexpressionandassociation.TheCouncilnotes withsatisfactiontheusefulworkoftheAnnaLindhFoundationandtheprogressachieved onmechanismsforcooperationbetweentheEUandtheCouncilofEuropetopromote democracyintheSouthernNeighbourhood.

8. TheCouncilstressesthekeyrolethatwomenhaveplayedinthesedevelopmentsinthe SouthernNeighbourhoodandunderlinesthatwomen'srights,genderequalityandwomen's participationinthepoliticalprocessareessentialcomponentsofademocraticsocietyand importantforinclusiveeconomicdevelopment.

9. AspartofthedecisionoftheEUtostepupitsfinancialengagementtowardsits Neighbourhood,theEUSPRINGpackageof€350millionhasbeenadoptedin September2011.ItprovidesadditionalfundingforSouthernneighboursundergoing transitiontostrengthentheiremergingdemocraticinstitutions,topromotedeepand sustainabledemocracyandtoimproveinclusivegrowthandjobcreation.TheCouncil welcomesthefactthattheEIBlendingmandatefortheSouthernNeighbourhoodhasbeen increasedby€1billionandthattheEBRDhasmadegoodprogresstowardsextendingthe scopeofitsoperationstosomeSouthernpartners.TheCouncilstressestheimportanceofa coordinatedandcomprehensiveapproachoftheEIB,theEBRDandotherinternational partnersinsupportingtheSouthernNeighbourhood.

10. InlinewiththeENPconclusionsof20June2011,theCouncilwelcomesthe Commission’sproposalfornegotiatingdirectivesforDeepandComprehensiveFreeTrade AreaswithEgypt,Jordan,MoroccoandTunisia,whichaimattheprogressiveintegration oftheeconomiesofthesepartnersintotheEUsinglemarketandatenhancingeconomic governanceandimprovingsubstantiallymarketaccessopportunitiesinanasymmetrical way.Itlooksforwardtothestartofthesenegotiationsassoonasthenecessarypreparatory workiscompleted.Stepshavealsobeentakentorelaunchongoingtradeliberalisation negotiations,andtheregionalconventiononPanEuromediterraneanRulesofOriginhas beenopenedforsignature,whichopensthedoortotherapidrevisionofPanEuroMed RulesofOrigin.

11. TheCouncilalsounderlinestheimportanceoffurtherstrengtheningcooperationwith partnerstoimproveemploymentthroughbettereducation,topromoteindustrial cooperation,strengtheninfrastructureconnectionsandimprovethebusinessclimate,which willhelpsmallandmediumsizedcompanies,leadingtojobcreation.Otherimportant areasofcooperationaresocialinclusion,children'srightsandgenderissues,innovation anddevelopment,educationandtraining,andenvironmental,climateandenergyissues.In thiscontext,itreaffirmsitscommitmenttoregionalcooperation,includingthrough continuedsupporttotheSecretariatoftheUnionfortheMediterraneanintherapidlaunch ofconcreteregionalprojectsbringingtangiblebenefitstothepeopleoftheregion.

12. TheCouncilwelcomesthelaunchofDialoguesonMigration,MobilityandSecuritywith TunisiaandMorocco,whichshouldleadtotheconclusionofmobilitypartnerships.Such partnershipswillfosterpeopletopeoplecontactsandfurtherpromotemutual understandingaswellasbusinesscontacts.TheCouncilreaffirmsitscommitmenttoutilise fullythepotentialoftheEUVisaCodefacilitatinglegitimatetravelandwillconsiderto launch,onacasebycasebasis,negotiationsonreadmissionandvisafacilitation agreementswithSouthernpartners.EUengagementwilldependinteraliaoneffective cooperationagainstillegalmigrationincludingonreadmissionandbordermanagement. TheCouncilalsowelcomesamajorexpansionofyouthscholarshipsandexchanges.

13. TheCouncilinvitestheHighRepresentativeandtheCommissiontocontinuetheirefforts fortheeffectiveimplementationoftheEU’sresponsetothedevelopmentsintheSouthern Neighbourhoodandlooksforwardtotheirreport,inApril2012ontheimplementationof theEuropeanNeighbourhoodPolicyin2011."
