I decided on leaving them to be dealt with through the slow process of the law, as being in the end more severe than a summary infliction." L INTRODUCTION IT IS CONVENTIONAL TO SEEK THE HISTORICAL ROOTS of British Columbia labour in the colonial era, that is to say, beginning in 1849 or thereabouts. That was when Britain established Vancouver Island, its first colony on the North Pacific coast, and granted the Hudson's 1991 CanLIIDocs 164 Bay Company fee simple title on the condition that they bring out settlers.' It is a good place to begin, because the first batch of colonists were not primarily gentlemen farmers or officials but coal miners and agricultural labourers, and neither the Company nor Vancouver Island lived up to their expectations.' The miners were Scots, brought in to help the Hudson's Bay Company diversify and exploit new resources in the face of declining fur trade profits, but * Hamar Foster is an Associate Professor at the Faculty of Law, University of Victoria, teaching a variety of subjects, including legal history. ' In what follows the Hudson's Bay Company ("IHC') will be referred to as "they," etc., rather than "it". Whether the Crown had the legal capacity to grant the fee may be doubted: see generally K. Belshaw, `The Standard of Living of British Miners on Vancouver Island, 1848-1900" (1989-90) 84 BC Studies 37. 16 MANITOBA LAW JOURNAL REVUE DE DROIT MANITOBAIN they had been inadequately prepared for life and work on the Northwest coast. In 1850 they downed tools at Fort Rupert (near what is now Port Hardy) to protest working conditions, and the Company's local representatives were furious. The officer in charge confined the men on bread and water, putting two of them in irons.' The subse- quent departure of most of them for the gold fields of California only added injury to insult, and this incident is often regarded as marking the beginning of British Columbia's troubled labour relations. To James Douglas, Chief Factor at Fort Victoria, the miners were not simply men who had breached their contracts, but "mutineers" who had deserted their posts and, although it was illegal, the treatment they had received was "highly necessary." As he put it, "the spirit of Mutiny is contagious, and unless examples are made of the evil disposed there will be an end to all subordination...."4 But it was neither the end of subordination, nor the beginning of British Columbia's labour history. The latter dates from the fur trade 1991 CanLIIDocs 164 era before colonialization, and the intensity of Douglas' reaction needs to be put in that context.' There were of course no collective agree- ments in either period: master/servant relations were concerned primarily with individual contracts of service.' All the talk about "desertion and mutiny is utter nonsense, and the people know it," he wrote. "[Tlhey are offences that can only be committed under articles of war, and in some instances under ships articles..." (Letter from Blanshard to Dr. J.S. Helmcken (6 August 1850) quoted in M. Mutiny on the Beaver 17 code of discipline of the Hudson's Bay Company is proof that, in common with most large-scale nineteenth century employers, they had always worried about "combinations," especially in the more remote regions. While one or two troublesome employees were to be expected, a number of them acting in concert might pose a real threat, not only to corporate profits but to security as well. It is this concern, and his own experience in the fur trade, that account for Douglas' intemperate description of events at Fort Rupert.' After all, he had experienced "combinations" before. In 1842, a number of the men at Stikine had conspired to murder the clerk in charge of the fort, and in 1838 there had been a "mutiny" aboard the Company's steamer Beaver.' It is the latter, not the strike at Fort Rupert, that must be viewed as the first collective job action west of the Rockies. II. DISCIPLINE IN THE HUDSON'S BAY COMPANY 1991 CanLIIDocs 164 IT IS REMARKABLE HOW OFTEN employees and former employees, when asked to describe life in the service of the Hudson's Bay Company west of the Rockies, resorted to maritime analogies. Clerk Charles Beardmore, for example, described the discipline as rather like what one might find on a British warship. "Knocking down and giving a man what is called a pounding, and pumping upon him is very common," he said.' Another former Company man, George Roberts, said that. the two most senior officers in the western fur trade were stern disciplinarians, and recommended that anyone seeking a picture of life in New Caledonia should read Dana's Two Years Before the ' And, a few months later, at Fort Victoria. According to Blanshard, Douglas had told him that he "no longer dared to speak to any of [his] men," and that he (Douglas) lived in "daily fear of seeing the Establishment [at Victoria] burnt down" and violence that would "end in bloodshed." Moresby aboard HMS Portland at Honolulu (23 July 1851) PABC, GR 322, vol. 1 at 348. Beardmore con- cluded that "no man in his right senses" would work for the HBC. "'Twas worse than transportation." 18 MANITOBA LAW JOURNAL REVUE DE DROIT MANITOBAIN Mast.10 According to him, Douglas - whom Beardmore described as a "great hand at flogging" - was "dreaded by the Canadians.' Although Roberts and Beardmore both had grievances against the Company, their views are corroborated to a significant degree by other sources, notably post journals and correspondence. Perhaps the bleakest assessment of all is that of John Tod, who retired from the service in 1852 and was a member of the colony of Vancouver Island's first Council. New Caledonia, he recorded years later, was "looked on in the light of another Botany Bay." He was referring more to the remoteness and hardships of the place than to the discipline, but he stressed that he and his friends east of the Rockies were careful not to offend their superiors, lest they should be sent west as punishment.' Evidently, Tod was among those who did not take sufficient care. In 1823 he found himself transferred to McLeod Lake, where he languished in solitude, and on one occasion very nearly starved.' He ended up serving most of his career on 1991 CanLIIDocs 164 what, by most accounts, was the wrong side of the mountains, wishing for a promotion to chief trader that eventually came, and one to chief factor that did not. The quasi-military atmosphere surrounding the Company on the coast was well grounded in its legal structure. Simpson decided to offer young John, along with several other trouble-making “half-breeds” like him, positions in the company rather than have them unemployed and directionless within HBC trading territory. Young John was made chief trader of Fort Stikine during the spring of 1841. He was murdered there in April 1842. Simpson discovered the death of young John while on a tour of the Columbia Department’s coastal operations. Although his letter to McLoughlin was brief, Simpson’s depiction of the murder as “justifiable homicide” enraged the bereaved father.

He appears to have returned to settle in the Willamette Valley and had an association with the HBC until 1852. Aiken's family life or subsequent activities have not been traced.

    Great Bear Rainforest The Fur Trade Era, 1770s–1849 The Fur Trade Era, 1770s–1849 The lives of First Nations people were irrevocably changed from the time the first European visitors came to their shores. The arrival of Captain Cook heralded the era of the fur trade and the first wave of newcomers into the future British Columbia who came from two directions in search of lucrative pelts. First came the sailors by ship across the Pacific Ocean in pursuit of sea otter, then soon after came the fort builders who crossed the continent from the east by canoe. These traders initiated an intense period of interaction between First Nations and European newcomers, lasting from the 1780s to the formation of the colony of Vancouver Island in 1849, when the business of trade was the main concern of both parties. During this era, the newcomers depended on First Nations communities not only for furs, but also for services such as guiding, carrying mail, and most importantly, supplying much of the food they required for daily survival. First Nations communities incorporated the newcomers into the fabric of their lives, utilizing the new trade goods in ways which enhanced their societies, such as using iron to replace stone axes and guns to augment the bow and arrow. These enhancements, however, came at a terrible cost, for while the fur traders brought iron and guns, they also brought unknown diseases which resulted in massive depopulation of First Nations communities. European Expansion The northwest region of North America was one of the last areas of the globe to feel the advance of European colonialism.

    Fuel as a Factor in Canadian Transport: Energy Capital and Communication Theory Matthew Greaves Simon Fraser University ABSTRACT Background Established in 1849, the Fort Rupert coal settlement represented a departure in the Hudson’s Bay Company’s mode of colonial wealth accumulation on Vancouver Island. Company officials failed, however, to appreciate basic differences in the new mode of accu - mulation, including the importance of transportation to capitalist mineral extraction. Analysis This article accomplishes three things: it retrieves foundational theories of trans - portation and commodity circulation once popular in communication studies, provides a doc - umentary account of coal mining and the coal trade in the mid-nineteenth-century eastern Pacific, and articulates a theory of capitalist energy consumption. Conclusion and implications The culminating theory of energy capital positions the ex - traction and circulation of fuel within Canadian communication studies through a trans - portation-focused approach to communication.     MEASLES, 1847-1850 The First Modern Epidemic in British Columbia R. M. GALOIS ITH THE ARRIVAL OF the steamer Beaver in 1836, the Hudson's Bay Company (HBC) brought modern industrial Wtechnology to the Northwest Coast. An unintended conse­ quence of this innovation was the enhanced mobility of Old- World diseases. In this instance, a combination of the Beaver; other HBC transportation systems and Native trading patterns produced the first epidemic to affect much of the area that is now British Columbia — the measles epidemic of 1847-1850. Similar interactions of disease, technology and culture have been described elsewhere.1 Here, I draw upon and expand the picture presented in a recent article by the American anthropologist Robert Boyd2 in order to argue that this measles epidemic, and not the smallpox epidemic of 1862-1863, was the first "modern" epidemic in British Columbia. Beginning in 1846, measles spread from the American Plains north­ wards to the Canadian Prairies and westwards across the Cordillera. Boyd demonstrates that the epidemic entered British Columbia from the Columbia River watershed via coastal and interior routes in the winter of 1847/48. I begin with the latter. INTERIOR ROUTES From Ft Colvile in December 1847, Boyd describes the spread of the measles to Kamloops and Ft Alexandria by early January 1848 (see Figures 1 and 2). Biographical Sketch Born in Calgary in 1913, George Philip Vernon Akrigg received a B.A. (1937) and M.A. (1940) from the University of British Columbia and his Ph.D. from the University of California (1944). He began his UBC teaching career in the Dept. of English in 1941. The author of many scholarly articles and books, Akrigg continued his research in the field of British Columbia history after his retirement in 1978. He died in 2001. Helen Brown Akrigg (nee Manning) was born in British Columbia in 1921. She received a B.A. from UBC (1943). After raising a family she returned to academic life and in 1964 earned an M.A. in history from UBC. She subsequently served as part-time instructor in the Dept. of Geography and later, with husband Philip continued her research into British Columbia history and place names. Scope and Content Fonds consists of essays, articles, offprints, reviews, contracts, correspondence, a CV, a scrapbook, photocopies, maps, plans, notes, microfilm, and photographs pertaining to the personal lives and research of Philip and Helen Akrigg.
