Planning and Regulatory Sub Committee 10 April 2000 Irvine, 10 April 2000 - At a Meeting of the Planning and Regulatory Sub-Committee of North Ayrshire Council at 10.00 a.m. Present David Munn, Robert Reilly, Jack Carson, David Gallagher, Elizabeth McLardy, John Moffat, Robert Rae and John Reid. Chair Mr Munn in the Chair. Apologies for Absence Ian Clarkson, Elliot Gray and Samuel Gooding. 1. Irvine/Kilwinning Local Plan Area (a) N/99/00440/PP & N/99/00442/PP: Kilwinning: Torranyard: Braemoor Holiday Village Goldmist Ltd, Braemoor Holiday Village, Torranyard, Kilwinning have applied for Planning Permission (in retrospect) for (i) alteration to boundary and erection of fence; and (ii) change of use from car park to caravan sales and car parking, landscaping works and erection of five flag poles at that address. An objection has been received from New Krishna Tandoori (Torranyard Inn), Kilwinning. Having considered the terms of the objection, the Sub-Committee agreed (A) to grant application N/99/00440/PP; and (B) to grant application N/99/00442/PP subject to the following condition:- 1 That the number of caravans to be displayed shall be limited to six in number, which caravans shall only be of the static type. (b) N/99/02100/PP: Irvine: 6A Academy Road Mr J Johannesen, 20 Harbour Street, Irvine has applied for Planning Permission for alterations and change of use of vacant barn and stables to form a dwelling house at 6A Academy Road, Irvine. An objection has been received from Bill Ure, 4 Academy Road, Irvine. Having considered the terms of the objection, the Sub-Committee agreed to grant the application subject to the following conditions:- 1 That prior to the commencement of the development, detail of (i) the wall, which is to be partly demolished to form a new access, along the Academy Road frontage to the south of the proposed dwellinghouse; and (ii) the railings to be erected on top of the existing boundary wall shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority; 2 That the south side of the roof of the garage (building A on 1:200 plan) shall be provided with guttering which shall drain to the application site and a measure to prevent loose slates dropping Page 1 into the adjoining garden, details of which shall be submitted, agreed in writing and the work carried out to the satisfaction of North Ayrshire Council as Planning Authority; 3 That the applicant shall form a footway/verge crossing to North Ayrshire Council Roads Guidelines to the satisfaction of North Ayrshire Council as Planning Authority; 4 That the first 2 metres of the access, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway; and 5 That prior to the commencement of any works details of the window/grille in the Academy Road elevation shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority. (c) N/99/02149/ADC: Irvine: 6 Glasgow Vennel Café De Vinci, 6 Glasgow Vennel, Irvine have applied for planning permission for the erection of three PVC advertisement window canopies to the front elevation at that address. An objection has been received from Samuel K Gaw, ‘Camasunary’, Kidsneuk, Irvine on behalf of the World Federation of Burns Clubs, Irvine Burns Club and the Ayrshire Association of Burns Clubs. Having considered the terms of the objection, the Sub-Committee agreed to refuse the application on the following grounds:- 1 That the proposed canopies by way of their number, design and appearance would detract from the visual appearance of the building which is located in the Glasgow Vennel Conservation Area and would have a detrimental effect on the adjoining listed building. 2. North Coast and Cumbraes Local Plan Area N/99/02123/PP: Skelmorlie: Montgomerie Terrace: Site to West of 6 Eglinton Gardens The Church of Scotland, The Manse, Eglinton Terrace, Skelmorlie has applied for Planning Permission for the erection of a dwelling house and garage at 6 Eglinton Gardens (site to west of), Montgomerie Terrace, Skelmorlie. An objection has been received from Colin F McLachlan, “Eriska”, Eglinton Gardens, Skelmorlie. Having considered the terms of the objection, the Sub-Committee agreed to grant the application, subject to the following conditions:- 1 That the proposed facing brick shall match the colour of the sandstone on the listed building to the south-east and that prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the proposed external finishes; 2 That the roofing material shall be natural or artificial slate, a sample of which shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority prior to the commencement of any works; 3 That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of the proposed fence along the south boundary of the site; 4 That no development shall take place until there has been submitted to and approved by North Ayrshire Council as Planning Authority a scheme of replacement tree planting, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development; 5 That the replacement tree planting shall be carried out in the first planting season Page 2 following the occupation of the building or the completion of the development, whichever is the sooner; and any trees which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation; 6 That prior to the occupation of the house, a footway with a vehicle access crossing to Chapter 10:8 of North Ayrshire Council’s Roads Development Guide, shall be provided along the entire Montgomerie Terrace frontage of the site, to tie in with the width and design of the adjoining footway to the north, to the satisfaction of North Ayrshire Council as Planning Authority; and 7 That notwithstanding the permission granted by Article 3 of and Classes 1 and 3 of Part 1 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (or any Order revoking or re-enacting that Order) the express approval of North Ayrshire Council as Planning Authority shall be required in respect of any development within the curtilage of the house. 3. Exclusion of Public The Sub-Committee resolved, in terms of Section 50A(4) of the Local Government (Scotland) Act 1973, to exclude from the Meeting the press and the public for the following item of business on the grounds indicated in terms of Paragraphs 6, 13 and 14 of Schedule 7A of the Act. 4. Civic Government (Scotland) Act 1982: Application for Licences Submitted report by the Assistant Chief Executive (Legal and Regulatory) (a) on applications for the grant or renewal of licences under the Civic Government (Scotland) Act 1982; and (b) in respect of a licenceholder where the issues raised may require a hearing (copies enclosed). The Sub-Committee agreed to dispose of these matters as indicated in the attached Appendix P&R1.
