O R D E R Sri Mohd. Shafiuddin, Ranga Reddy District has filed 2nd appeal dated 07-02-2018 which was received by this Commission on 10-02-2018 for not getting the information sought by him from the PIO / O/o the Gram Panchayat, Chevella Village, Chevella Mandal, Ranga Reddy District and 1st Appellate Authority / O/o The Mandal Parishad Development Officer, MPP-Chevella Mandal, Ranga Reddy District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 01-08-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: The Public Information Officer / O/o The District Panchayat Officer, Ranga Reddy District, Vide Letter No.4071/2017B1(Pts), dated 07-08-2017, has Transferred the 6(1) application U/s 6(3) of RTI Act 2005 to PIO / O/o the Gram Panchayat, Chevella Village, Chevella Mandal, Ranga Reddy District, the PIO has furnished the information to the appellant dated 19-12-2017. Since the appellant did not receive the required information from the Public Information Officer, he filed 1st appeal dated 04-10-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. As per the records the 1st Appellate Authority has not taken action to hear the appeal and pass appropriate orders. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 25-3-2019. On 25-3-2019 the case is called. The appellant and the Public Information Officer, Panchayath Secretary, Chevella Village Gram Panchayath are present. The appellant submitted that he did not receive the sought information from the PIO. The Public Information Officer informed him that the records are not available. The Public Information Officer submitted that the information pertaining to the layouts i.e., copies of registrations and permissions from 22.10.1995 to 26.07.2013 were not available in the Panchayath Office. The same fact was informed to the appellant through letter dated 27.09.2017. With regard to information pertaining to the period 27.07.2013 to 31.07.2017 the appellant was informed that in three layouts constructions were carried out with the permission of HMDA and as the plan size is big, photo copies of the same are to be done in Hyderabad with a cost of about Rs.2,000/-. As such, the appellant was informed to pay an amount of Rs.2000/- and obtain the required information. Heard the parties and perused the records. The submission of the Public Information Officer that the records are not available is not acceptable. The details of layouts sanctioned will be entered in the Layout register. The Public Information Officer present came unprepared and could not say anything on the subject. The Commission observed that the information sought by the appellant is not specific and it is voluminous. The appellant is seeking information from 1995 to 2006. The Commission therefore direct the PIO to call the appellant to their office, permit him to go through the Layouts Register and thereafter furnish copies of required documents in accordance with the provisions of the RTI Act, 2005 The Public Information Officer shall comply with the directions within two weeks from the date of receipt of this order and submit compliance report to the Commission.
