109.01 DESCRIPTION. To provide for certain contingencies during construction, some contracts include Fixed Price Items for use as the work proceeds. These items only apply when included in the proposal with prices established prior to bidding. Should any of these items not be included in the proposal as described above, they shall be addressed as described elsewhere in the Specifications and, if to be paid for, as bid by the Contractor.

Only those items listed below in Table 109.1 may be treated as Fixed Price Contingent Items, and then only if and as directed by the Engineer:

109.03 CONSTRUCTION.

109.04 MEASUREMENT AND PAYMENT.

1. Test Pit Excavation (Traditional Method): Test Pit Excavation performed by conventional (non-vacuum) excavation equipment will be measured and paid for at the contract unit price per cubic yard for the material actually removed from within the limits specified. The

payment will be full compensation for all material, labor, equipment, tools, and incidentals necessary to complete the work. Tamped backfill will not be measured but the cost will be incidental to the Contract unit price per cubic yard for Test Pit Excavation / Conventional Excavation Methods. Any pavement to be replaced will be paid for as specified in Section 106.

2. Test Pit Excavation (Vacuum): Test Pit Excavation performed by vacuum excavation equipment will be measured and paid for at the contract unit price per cubic yard for the material actually removed from within the limits specified. The payment will be full compensation for all material, labor, equipment, tools, and incidentals necessary to complete the work.

3. Class 3 Excavation / Select Backfill - Proper Disposal of Unsuitable Material: Payment for class 3 excavation and furnishing suitable backfill shall be in accordance with the stipulated price per cubic yard in place and compacted. Price shall include disposal of unsuitable material. Payment shall not be made for material placed outside of specified trench widths.

5. GENERAL CONDITIONS FOR WATER OR SEWERAGECONSTRUCTION PERMIT

The structural adequacy and expected performancecharacteristics of the various components are not certified by this permit.

This permit is not transferable.

A copy ofthis permit must be posted at the work site during construction.

This permit will expire, if not specifically extended, unless the construction authorized under this permit has been initiated. The permit will then remain valid forthe remainder of construction fora period of up to five years from the start of construction.

If any provision of this permit shall be held invalid for any reason, the remaining provisions shall remain in fullforce and effect, and such invalid provision shall be considered severed and deleted from this permit.

Persons violating the requirements of this permit are subject to penalties of up to $1000 per day as set forth in Environment Article 9-268 and 9-334 through 9-342, Annotated Code of Maryland.

A copy of the plans and specifications, authorized for use under this permit, shall be made available at the work site during construction of this project. A revised construction permit in accordance with COMAR 26.03.12 is required prior to making substantive changes or material alteration to the construction authorized under this permit.

The owner shall secure all Federal, State or local permits, including approval of Sedimentation and Erosion Control Plans that may be required beforestarting the construction of the project.

The owner shall insure that this project is inspected during the progress of construction to assure substantial compliance with the approved plans and specifications. A log and construction records shall be maintained by the inspector and may be requested for review at any time by this office.

The project engineer of the Maryland Department of the Environment (the 'Department') shall be notified prior to the start of construction.

Inspectors of the Department shall be afforded access to the project site, at reasonable times and upon presentation ofcredentials:

a. to inspect construction authorized under this permit and to determine compliance with applicable regulations; b. to have access to and copy any records required to be kept by this permit and by applicable regulations; and c. to obtain any photographic documentation or evidence.

Within 60 days after completion of construction, a copy of as-built drawings and the attached construction completion certificate(page 3 of this permit) shall be submitted to the Department. Where construction was completed in accordance with the original plans approved under this permit, the submittal of as-built drawings will not be required.

Approval must be obtained from the Department beforethis project may be placed into service. Any exception allowing partial use of this project shall have the prior written approval of the Department. Approval may be obtained pursuant to the following procedure:

a. Where large political subdivisions, commissions, authorities etc. have their own inspection capabilities (satisfactoryto the Department), the attached construction completion certificate shall be completed by the director of Public Works or similar responsible person and submitted to the Department.

b. Where an acceptable local construction inspection program does not exist, the attached construction completion certification shall be completed by a Professional Engineer licensed to practice in the State of Maryland (preferablythe same engineer whose seal and signature appear on the plans approved under this permit) and submitted to the Department.

c. Upon receipt of the signed certificate, the Department shall, within (30) working days of the receipt, 1) issue an approval, 2) require further review and on-site inspection or 3) reject the construction certification. Approval shall be automatic for projects that have not received some form of written notificationf rom the Department within (30) working days of receipt of the signed certificate.

A pre-bid conference for the Old Court Road 12-inch Water Main Replacement Project was held on February 14, 2018 at 10:00 am EST in Room 300B of the County Office Building, 111 W Chesapeake Avenue, Towson MD 21204-4604. See the attached sign-in sheet for a list of the people in attendance.

Mrs. Erin McKenna-Streyle from Baltimore County’s Water Design Section began the meeting by welcoming those attending. She noted that items discussed during that meeting were intended to provide clarification, but do not change the Bid Documents. She reminded everyone to review the published addenda for official answers to questions.

Mrs. McKenna-Streyle proceeded by pointing out the following pertinent items on the contract documents:

1. The County requires that the utility work detailed in the Contract Documents to be carried out by a pre-qualified F2 contractor. Contractor(s) must be pre-qualified for work with Baltimore County at least ten (10) days before bid opening. 2. The pre-qualification requirement for this Contract should not imply any preference for the type of pre-qualified contractor that could act as the prime contractor. 3. This Contract has two hundred and seventy (270) working days for completion. Not calendar days. 4. Liquidated damages are in the amount five hundred dollars ($500.00) per day. 5. Contract is Cost Group “D” ($1.0M to $2.5M) 6. A 30% WBE/MBE overall goal has been established for the project. 7. A construction site sign is required. 8. An Engineer’s Office is NOT required due to the small size of the project. 9. The MDE General Construction Permit has been issued and will be provided in an Addendum. 10. Questions and/or issues pertaining to the contract will only be accepted by email to Barbara Wentworth ([email protected]), Tony Crews ([email protected]) and Erin McKenna-Streyle (emckenna- [email protected]). Please copy all three of us with questions. 11. The deadline for questions is close of business (5:00 pm EST) on Friday, February 16, 2018. 12. There will be an addendum issued: and it will include, as a minimum, the Pre-Bid meeting minutes.

Mrs. McKenna-Streyle continued by giving an overview of scope of work for the contract, mentioning the following:

1. The proposed work includes but is not limited to the following: the construction of approximately 2,000 linear feet of 16-inch water main; 100 linear feet of 12-inch water main; 45 linear feet of 8-inch water main; 86 linear feet of 6-inch water main; four 6-inch fire hydrants; 6- inch thru 16-inch valves and fittings, and the reinstallation/relocation of twenty-three (23) water service connections.

Contract #18001 WX0 Addendum No. 1 February 20, 2018 2. All new water mains shall be installed in the same trench. The Contractor shall remove the existing water main, valves, and fittings, as the new water mains are being installed. 3. Temporary bypass piping will be required and cannot be in place during freezing conditions. 4. Work also includes but is not limited to traffic control, temporary bypass piping and services, tapping DIP piping in W Joppa Road, pavement and waterline cutting, excavation and access pits, dewatering, replacement of necessary piping, valves or valve parts, replacement of hydrants, and chlorination and disinfection. 5. All piping will have bonded coatings and full cathodic protection. The project requires insulating flanges when connecting old and new pipe and insulating corporation stops for all service connections ¾-inch to 2-inches in diameter. 6. A church has been identified with a water service that may be affected by the construction activities for this project. The Church is Hunt’s Memorial United Methodist. Water service may not be suspended during operational hours and/or events and must be coordinated with the County and Church. 7. Tie-ins shall be scheduled during weekends and/or at night with hours to be coordinated with CCA. The work along Old Court Road shall be done between 9:00am and 3:00pm and a single lane of traffic is required to be maintained at all times. 8. The maintenance of traffic for this project requires the foreman to serve as the Traffic Manager. 9. The County will not be providing any staging area for use by the Contractor. 10. There is an error on the Bid Form on Page 321. Item 022 Calcium Chloride was identified as a Fixed Price Contingent Item which is incorrect. This is not a fixed price contingent item and Contractors should bid accordingly. The Bid Form/Page 321 will be revised in an Addendum. No quantities are being revised. 11. The Fixed Price items for Test Pit Excavation were revised by the County on December 13, 2017. While the quantities and descriptions are correct on the Bid Form for Items 35 & 36 (page 322), the Special Provisions will be revised on pages 168-170 to reflect the revised items. Items 37 & 38 are not affected by this change.

(Q1) When will the Addendum be issued?

(A1) Addendum No. 1 is planned to be issued by COB on Tuesday, February 20, 2018.

(Q2) Will items 35 & 36 be revised?

(A2) Bid Items 35 & 36 will be revised in the Special Provisions, but not on the Bid Form. (Q3) When do you expect Notice to Proceed (NTP) to be issued?

(A3) NTP is generally issued 2-3 months after awarding the Contract.

(Q4) The MBE/WBE goal is 30%?

(A4) That is correct; the MBE/WBE goal for this project is 30%.
