Liebe Kulturfreund*innen, bereits seit Ende des Zweiten Weltkriegs befasst sich das Amerikahaus München mit US- amerikanischer Kultur. Als US-amerikanische Behörde war es zunächst für seine Bibliothek und seinen Lesesaal bekannt. Doch schon bald wurde das Programm des Amerikahauses durch Konzerte, Filmvorführungen und Vorträge ergänzt. Im Jahr 1957 zog das Amerika- haus in sein heutiges charakteristisches Gebäude ein und ist dort, nach einer vierjährigen Generalsanierung, seit letztem Jahr wieder zu finden. 2014 gründete sich die Stiftung Bay- erisches Amerikahaus, deren Träger der Freistaat Bayern ist. Heute bietet das Amerikahaus der Münchner Gesellschaft und über die Stadt- und Landesgrenzen hinaus ein vielfältiges Programm zu Themen rund um die transatlantischen Beziehungen – die Vereinigten Staaten, Kanada und Lateinamerika- und dem Schwerpunkt Demokratie an. Unsere einladenden Aus- stellungräume geben uns die Möglichkeit, Werke herausragender Künstler*innen zu zeigen. Mit dem Comicfestival München verbindet das Amerikahaus eine langjährige Partnerschaft. Wir freuen uns sehr, dass wir mit der Ausstellung „60 Jahre Marvel Comics Universe“ bereits die fünfte Ausstellung im Rahmen des Comicfestivals bei uns im Haus zeigen können. In der Vergangenheit haben wir mit unseren Ausstellungen einzelne Comickünstler, wie Tom Bunk, Robert Crumb oder Denis Kitchen gewürdigt. Vor zwei Jahren freute sich unser Publikum über die Ausstellung „80 Jahre Batman“. Dieses Jahr schließen wir mit einem weiteren Jubiläum an und feiern das 60-jährige Bestehen des Marvel-Verlags. Im Mainstream sind die Marvel- Helden durch die in den letzten Jahren immer beliebter gewordenen Blockbuster bekannt geworden, doch Spider-Man & Co. gab es schon lange davor. Das Comic-Heft „Fantastic Four #1“ gab vor 60 Jahren den Startschuss des legendären Marvel-Universums. -

Extending and Visualizing Authorship in Comics Studies
AN ABSTRACT OF THE THESIS OF Nicholas A. Brown for the degree of Master of Arts in English presented on April 30, 2015 Title: Extending and Visualizing Authorship in Comics Studies. Abstract approved: ________________________________________________________________________ Tim T. Jensen Ehren H. Pflugfelder This thesis complicates the traditional associations between authorship and alphabetic composition within the comics medium and examines how the contributions of line artists and writers differ and may alter an audience's perceptions of the medium. As a fundamentally multimodal and collaborative work, the popular superhero comic muddies authorial claims and requires further investigations should we desire to describe authorship more accurately and equitably. How might our recognition of the visual author alter our understandings of the author construct within, and beyond, comics? In this pursuit, I argue that the terminology available to us determines how deeply we may understand a topic and examine instances in which scholars have attempted to develop on a discipline's body of terminology by borrowing from another. Although helpful at first, these efforts produce limited success, and discipline-specific terms become more necessary. To this end, I present the visual/alphabetic author distinction to recognize the possibility of authorial intent through the visual mode. This split explicitly recognizes the possibility of multimodal and collaborative authorships and forces us to re-examine our beliefs about authorship more generally. Examining the editors' note, an instance of visual plagiarism, and the MLA citation for graphic narratives, I argue for recognition of alternative authorships in comics and forecast how our understandings may change based on the visual/alphabetic split. -
The Adventure of the Shrinking Public Domain

ROSENBLATT* Several scholars have explored the boundaries of intellectual property protection for literary characters. Using as a case study the history of intellectual property treatment of Arthur Conan Doyle’s fictional character Sherlock Holmes, this Article builds on that scholarship, with special attention to characters that appear in multiple works over time, and to the influences of formal and informal law on the entry of literary characters into the public domain. While copyright protects works of authorship only for a limited time, copyright holders have sought to slow the entry of characters into the public domain, relying on trademark law, risk aversion, uncertainty aversion, legal ambiguity, and other formal and informal mechanisms to control the use of such characters long after copyright protection has arguably expired. This raises questions regarding the true boundaries of the public domain and the effects of non-copyright influences in restricting cultural expression. This Article addresses these questions and suggests an examination and reinterpretation of current copyright and trademark doctrine to protect the public domain from formal and informal encroachment. * Associate Professor and Director, Center for Intellectual Property Law, Whittier Law School. THE McFARLANE DEFENDANTS’ BRIEF IN OPPOSITION TO PLAINTIFF’S MOTION FOR ORDER DECLARING GAIMAN’S INTEREST IN CERTAIN COMIC BOOK CHARACTERS Defendants Todd McFarlane and Todd McFarlane Productions, Inc. (together, the “McFarlane Defendants”) submit this brief in opposition to plaintiff Gaiman’s motion for an order declaring that he has a copyright interest in the following three comic book characters: Dark Ages Spawn, Tiffany and Domina (the “Pending Accounting Motion”). INTRODUCTION As more fully discussed below, there are three distinct and fully sufficient grounds on which to deny the Pending Accounting Motion: 1. Mr. Gaiman is improperly attempting, through a post-judgment accounting procedure, to expand the judgment in this action to grant him an ownership interest in three additional copyrights despite having never asserted any such claim in the lawsuit. In particular, the three characters at issue in his motion were never raised in any fashion whatsoever—or even mentioned—in his pleadings or at trial in this case. Now, after judgment, Mr. Gaiman seeks improperly to supplement the record with hand-selected images that are misleading in their appearance. Due process requires that any adjudication of these new claims concerning additional characters be one in which the evidence can be tested, authenticated and explained to a trier of fact. A quasi-administrative, post-judgment accounting procedure is not the proper time or place, and this Court should reject Mr. Gaiman’s effort to obtain by way of motion what he has never sought by way of trial.
