The House assembled at thirty minutes past Two O’clock 2. The Proceedings were opened with Prayer 3. Presiding – the Hon. Speaker 4. COMMUNICATION FROM THE CHAIR The Speaker issued the following Communication:- “Honourable Members, Standing Order 176 (Discharge of a member from a committee) provides as follows, and I quote – (1) A parliamentary party may discharge a Member from a select committee after according the Member an opportunity to be heard. (2) The parliamentary party whip of the party that nominated a Member to a select committee shall give notice in writing to the Speaker of the intention to discharge a Member from a select committee. (3) The Speaker shall, within three days of receipt of the notice under paragraph (2), inform the Member of the notice. Hon. Members, in this regard, I wish to report to the House that my Office is in receipt of a letter dated 16th June, 2020 from the Majority Party Whip, notifying that the Jubilee Party has discharged sixteen (16) of its Members from certain Select Committees as follows – (1) The Hon. Ali Haji Adan, MP stands discharged from the Departmental Committee on Agriculture & Livestock, where he has been serving as the Chairperson; (2) The Hon. Kimani Ichung’wah, CBS, MP stands discharged from the Budget & Appropriations Committee, where he has been serving as the Chairperson; (3) The Hon. Gladys Boss Shollei, MP stands discharged from the Select Committee on Delegated Legislation, where she has been serving as the Chairperson; (4) The Hon. (Dr.) Victor Munyaka, MP stands discharged from the Departmental Committee on Sports, Culture & Tourism, where he has been serving as the Chairperson; (6) The Hon. John Koyi Waluke, MP stands discharged from the Departmental Committee on Administration and National Security, where he has been serving as the Vice-Chairperson; (7) The Hon. Fred Chesebe Kapondi, MP stands discharged from the Constitutional Implementation Oversight Committee, where he has been serving as the Vice-Chairperson; (8) The Hon. (Dr.) Robert Pukose, MP stands discharged from the Departmental Committee on Energy, where he has been serving as the Vice-Chairperson; (9) The Hon. Alice Wahome, MP stands discharged from the Departmental Committee on Justice & Legal Affairs, where she has been serving as the Vice- Chairperson; (10) The Hon. Joyce Chepkorir Koech, MP stands discharged from the Departmental Committee on Labour & Social Welfare, where she has been serving as the Vice-Chairperson; (11) The Hon. Khatib Abdalla Mwashetani, MP stands discharged from the Departmental Committee on Lands, where he has been serving as the Vice- Chairperson; (12) The Hon. Catherine Waruguru, MP stands discharged from the Select Committee on Members’ Services & Facilities, where she has been serving as the Vice-Chairperson; (13) The Hon. James Lomenen Ekomwa, MP stands discharged from the Select Committee on National Cohesion & Equal Opportunities, where he has been serving as the Vice-Chairperson; (14) The Hon. Liza Chepkorir Chelule, MP stands discharged from the Select Committee on Parliamentary Broadcasting & Library, where she has been serving as the Vice-Chairperson; (15) The Hon. Cornelly Serem, MP stands discharged from the Departmental Committee on Trade, Industry Cooperatives, where he has been serving as the Vice-Chairperson; and (16) The Hon. Moses Kuria, HSC, MP stands discharged from the Departmental Committee on Transport, Public Works & Housing, where he has been serving as the Vice-Chairperson. Hon. Members, having perused the documents through which the Jubilee Party transmitted the decision to discharge the said Hon. Members, I am satisfied that the process leading to the discharge met the requirements set out in Standing Order 176. Accordingly, the discharge of the said Members takes effect immediately. Hon. Members, the House is invited to note the provisions of the following Standing Orders. One, Standing Order 179(2) provides that – (2) Whenever a vacancy occurs in the office of Chairperson or Vice-Chairperson of a select committee, the Clerk shall, within seven days of the vacancy arising, appoint a place and time for the meeting of the committee to elect the Chairperson or Vice- Chairperson. Two, Standing Order 173(3), provides that – (No.36) THURSDAY, JUNE 18, 2020 (541) (3) “A vacancy occasioned by resignation or removal of a Member from a select committee shall be filled within fourteen days of the vacancy.” Hon. Members, the affected Members, the Clerk and the House are accordingly advised. Thank you”. 5. PETITION The Member for Kasipul (Hon. Charles Ong’ondo Were) present a Petition regarding mapping and demarcation and de-gazetttement of land within Kodera Forest; Petition referred to the relevant Departmental Committee pursuant to Standing Order 227(2) 6. PAPERS LAID The following Papers were laid on the Table – (i) Annual Status Report on Water, Sanitation and Irrigation from the Ministry of Water, Sanitation and Irrigation (pursuant to Article 153 (4)(a) & (b)) of the Constitution)(to be referred to the Departmental Committee on Environment and Natural Resources) (The Leader of the Majority Party) (ii) Report of the Departmental Committee on Finance and National Planning on its consideration of the Finance Bill, 2020. (Chairperson of Finance and National Planning) 7. QUESTIONS The following Questions were asked – (i) Question by Private Notice No.006/2020 by the Member for Lamu County (Hon. Ruweida Obo) regarding restoration of power in Pate island of Lamu county; To be replied by the Cabinet Secretary for Energy before the Departmental Committee on Energy) (ii) Question No.59/2020 by the Member for Kasipul (Hon. Charles Were) regarding lack of an Assistant Chief in Oyugis Town Location; (To be replied by the Cabinet Secretary for Interior and Coordination of National Government before the Departmental Committee on Administration and National Security) (iii) Question No.64/2020 by the Member for Kisumu West (Hon. Olago Aluoch) was deferred to another day (iv) Question No.67/2020 by the Member for Turkana North (Hon. Christopher Doye) regarding increased cases of crocodile attacks in Kalokol, Eliye, Namukuse, Lokitoe and Nachuku areas; (No.36) THURSDAY, JUNE 18, 2020 (542) (To be replied by the Cabinet Secretary for Wildlife and Tourism before the Departmental Committee on Environment and Natural Resources) 7. STATEMENTS (i) The following Member requested for Statements - a) the Member for Nyatike (Hon. Tom Mboya Odege regarding the mismanagement and gross malpractices at the Kenya Utalii College; b) the Member for Nandi (Hon. Alfred Keter) regarding inspection and certification of animal feeds sold locally. c) Statement by the Member for Kajiado Central (Hon. Memusi Kanchory) regarding online examination was dropped in the absence of the Member (ii) The following Statements were issued - (a) By the Chairperson of the Departmental Committee on Transport, Public Works and Housing on: - i. Statement by the Hon. Nguna Ngusyia, MP(Mwingi West) construction of Kibwezi, Kitui, Migwani, Mbondoni Road; ii. Statement by the Hon. (Prof). Zadoc Ogutu (Bomachoge Borabu) on status of the construction of Mogonga – Kenyanya – Magenche – Eberege – Magena Road to bitumen standard. (b) By the Chairperson of the Departmental Committee on Labour and Social Welfare: - i. Statement by Hon. Abdulswamad Nassir, MP (Mvita) on Kazi Mtaani Programme; ii. Statement by Hon. Simon King’ara, MP (Ruiru) on disparities in Inua Jamii Programme; and iii. Statement by Hon. Andrew Mwadime, MP (Mwatate) on suspension of Mr. Kevin Safari by the Kenya Revenue Authority. 8. PROCEDURAL MOTION – EXTENSION OF SITTING TIME Motion made and Question proposed – THAT, this House resolved to extend its sitting today until the conclusion of business appearing under Order No.11 (The Leader of the Majority Party) There being no debate arising; Question put and agreed to. 9. MOTION – REPORT OF THE COMMITTEE OF SUPPLY ON BUDGET ESTIMATES FOR THE FY 2020/2021 Motion made and Question proposed - (No.36) THURSDAY, JUNE 18, 2020 (543) THAT, this House do agree with the Committee of Supply in its consideration of the Budget Estimates for the FY 2020/2021 and pursuant to the provisions of Article 221 of the Constitution, section 39 of the Public Finance Management Act, 2012 and Standing Orders 240,approves the issuance of a sum of Kshs.1,887,661,995,757from the Consolidated Fund to meet the expenditure for the National Government, Parliament and the Judiciary during the year ending 30thJune 2021 in respect of the Votes as approved in the Schedule to the Order Paper. (Chairperson, Budget and Appropriations Committee) Question put and agreed to. 10. MOTION – APPROVAL OF NOMINEES FOR APPOINTMENT TO CONSTITUENCY COMMITTEES OF THE NATIONAL GOVERNMENT CONSTITUENCY DEVELOPMENT FUND Motion made and Question proposed:- THAT, pursuant to the provisions of Section 43(4) and Regulation 5(10) of the National Government Constituency Development Fund, 2015, this House approves the list of nominees for appointment to the following Thirty Eight (38) Constituency Committees of the National Government Constituency Development Fund, laid on the Table of the House on Thursday, June 11, 2020- 1.
