What Is a Capuchin Friar? What Do They Do? Who Are They?

It was more than 400 years after Capuchin friars came into existence in 1528 that anyone tasted a cup of cappuccino (first served in 1948). As for friar’s, no, they aren’t fryers, but some of them do prefer theirs fried, rather than baked or grilled. The ‘hood’? It’s all in the name. The brotherhood is found in all kinds of neighbourhoods, hoods and all. Even if you have known Capuchin friars for a long time, it wouldn’t be surprising if you found them somewhat mysterious. The Catholic Church has many religious Orders and communities of men. So what makes Capuchins different? Aren’t they Franciscans? And how are they different from Diocesan priests? It can all be confusing even for those well versed in Catholic life. Maybe you can recognize a Capuchin because of the curious, medieval clothing he wears, but you might wonder what makes him tick on the inside. Come to think about it, why do they wear that robe? And you might ask why anyone would want to be a Capuchin friar in this day and age? Is there a point to a bunch of men living together? Why don’t they get married like other people? And then there’s the money thing? Like everyone else they need it, but they take a vow of poverty. -

CHAPTER TWELVE A HISTORICAL REVIEW AND QUANTITATIVE ANALYSIS OF INTERNATIONAL CRIMINAL JUSTICE Section 1. The Historical Stages of International Criminal Justice ICJ made its way into international practice in several stages. The first period ranges from 1268 until 1815, effectively from the first international criminal pros- ecution of Conradin von Hohenstaufen in Naples through the end of World War I. The second stage begins with the signing of the Treaty of Versailles and ranges from 1919 until 2014, when it is expected that all of the existing direct and mixed model tribunals will have closed, leaving only the International Criminal Court (ICC). The third impending stage will begin in January 2015, when the ICC will be the primary international criminal tribunal. 1.1. The Early Historic Period—Thirteenth to Nineteenth Centuries The first period, which could prosaically be called the early historic period, is characterized by three major events occurring in 1268, 1474, and 1815, respectively. In 1268, the trial of Conradin von Hohenstaufen, a German nobleman, took place in Italy when Conradin was sixteen years of age.1 He was tried and exe- cuted for transgressing the Pope’s dictates by attacking a fellow noble French ruler, wherein he pillaged and killed Italian civilians at Tagliacozzo, near Naples. The killings were deemed to constitute crimes “against the laws of God and Man.” The trial was essentially a political one. In fact, it was a perversion of ICJ and demonstrated how justice could be used for political ends. The crime— assuming it can be called that—was in the nature of a “crime against peace,” as that term came to be called in the Nuremberg Charter’s Article 6(a), later to be called aggression under the UN Charter. -

Part 1 – Church Becomes Powerful Institution Evidence of Rome’s power grab • In 2nd century we see bishops over regions; people looked to them for guidance. • Around 195AD there was dispute over which day to celebrate Passover (14th Nissan vs. Sunday) • Polycarp said 14th Nissan, but now Victor (Bishop of Rome) liked Sunday. • A council was convened to decide, and they decided on Sunday. • But bishops of Asia continued the Passover on 14th Nissan. • Eusebius wrote what happened next: “Thereupon Victor, who presided over the church at Rome, immediately attempted to cut off from the common unity the parishes of all Asia, with the churches that agreed with them, as heterodox [heretics]; and he wrote letters and declared all the brethren there wholly excommunicate.” (Eus., Hist. eccl. 5.24.9) Everyone started looking to Rome to settle disputes • Rome was always ending up on the winning side in their handling of controversial topics. 1 • So through a combination of the fact that Rome was the most important city in the ancient world and its bishop was always right doctrinally then everyone started looking to Rome. • So Rome took that power and developed it into the Roman Catholic Church by the 600s. Church granted power to rule • Constantine gave the pope power to rule over Italy, Jerusalem, Constantinople and Alexandria. -

Vera: From Papal Bull to Racial Rule: Indians of the Americas, Race, an FROM PAPAL BULL TO RACIAL RULE: INDIANS OF THE AMERICAS, RACE, AND THE FOUNDATIONS OF INTERNATIONAL LAW KIM BENITA VERA* The "discovery" and conquest of the "New World" marked the inauguration of international law,' and constituted a watershed moment in the emergence of race in European thought.2 What might the coterminous rise of formative. moments in race thinking and international law suggest? In my provisional reflections on this question that follow, I trace juridical and religio-racial conceptions of indigenous peoples of the Americas as a central thread in the evolution of international law. I will begin with a discussion of the fifteenth-century papal bulls issued in regard to the Portugal-Spain disputes over lands in Africa and the Americas. I will then proceed to follow some strands of racial and juridical thought in the accounts of Francisco de Vitoria and Hugo Grotius, two founding figures in international law. The Christian Doctrine of Discovery By Dan Whittemore, Denver, Colorado, USA For centuries, indigenous peoples around the world have suffered the disastrous impact of European colonization. As a Christian, descended from Europeans, I am remorseful and repentant because I am complicit in this problem. Undoubtedly some of my ancestors helped create the situation that has resulted in discrimination and prejudicial and derogatory concepts of the original inhabitants. Broken contracts, ignorance of native culture and spirituality, and illegitimate appropriation of lands have contributed to poverty and psychological damage that persist. We are challenged to examine the root causes and make corrections. The centuries-old Christian Doctrine of Discovery, if repudiated, could initiate justice for all indigenous people. The Doctrine of Discovery is the premise that European Christian explorers who “discovered” other lands had the authority to claim those lands and subdue, even enslave, peoples simply because they were not Christian. This concept has become embedded in the legal policies of countries throughout the world. This is an issue of greed, oppression, colonialism, and racism. The doctrine’s origins can be traced to Pope Nicholas V, who issued the papal bull1 Romanus Pontifex in 1455 CE. The bull allowed Portugal to claim and conquer lands in West Africa. After Christopher Columbus began conquering newly “found” lands in the Americas, Pope Alexander VI granted to Spain the right to claim these lands with the papal bull, Inter caetera, issued in 1493. The Treaty of Tordesillas settled competition between Spain and Portugal. It established two principles: 1) that only non-Christian lands could be taken, and 2) that potential discoveries would be allocated between Portugal and Spain by drawing a line of demarcation. -

Chapter 10 The Migration of Syrian and Palestinian Populations in the 7th Century: Movement of Individuals and Groups in the Mediterranean Panagiotis Theodoropoulos In 602, the Byzantine emperor Maurice was dethroned and executed in a mili- tary coup, leading to the takeover of Phokas. In response to that, the Sasanian Great King Khosrow ii (590–628), who had been helped by Maurice in 591 to regain his throne from the usurper Bahram, launched a war of retribution against Byzantium. In 604 taking advantage of the revolt of the patrikios Nars- es against Phokas, he captured the city of Dara. By 609, the Persians had com- pleted the conquest of Byzantine Mesopotamia with the capitulation of Edes- sa.1 A year earlier, in 608, the Exarch of Carthage Herakleios the Elder rose in revolt against Phokas. His nephew Niketas campaigned against Egypt while his son, also named Herakleios, led a fleet against Constantinople. Herakleios managed to enter the city and kill Phokas. He was crowned emperor on Octo- ber 5, 610.2 Ironically, three days later on October 8, 610, Antioch, the greatest city of the Orient, surrendered to the Persians who took full advantage of the Byzantine civil strife.3 A week later Apameia, another great city in North Syria, came to terms with the Persians. Emesa fell in 611. Despite two Byzantine counter at- tacks, one led by Niketas in 611 and another led by Herakleios himself in 613, the Persian advance seemed unstoppable. Damascus surrendered in 613 and a year later Caesarea and all other coastal towns of Palestine fell as well.
