1 This Translation of Book Three of Francisco Suarez' Defense of the Catholic and Apostolic Faith Against the Errors of Anglic 1 This translation of book three of Francisco Suarez’ Defense of the Catholic and Apostolic Faith against the Errors of Anglicanism [Defensio Fidei Catholicae et Apostolicae contra Errores Anglicanae Sectae] is complete. The translation below of the first five chapters is substantially that of George Albert Moore, PhD (Colonel, US Army, Ret’d.), which he published at his own expense and through his own press in a limited mimeograph edition of 60 copies, Country Dollar Press, Chevy Chase, MD, 1950: Francisco Suarez. Extracts on Politics and Government from Defense of the Faith, Laws and God the Lawgiver, Tract on Faith, Tract on Charity. His translation of those chapters I have revised and adapted, sometimes heavily. The translation of all other chapters is my own. Col. Moore died in 1971 and the press seems to have died with him. At any rate I have not been able to find out any current information about it, nor accordingly who now holds the copyright to his translation. If anyone is able to enlighten me further on the matter I will be most grateful. In the meantime, however, and in the absence of indications to the contrary, I assume that the Colonel would not be upset if at least some fruit of his labors was now made available on this website in a more accessible form and to a wider audience. The Latin text used for this translation and revision of Moore is that of the 1872 reprint, Naples, with some supplementation and correction from the original 1613 text, reprinted in Defensa de la Fe Catolica y Apostolica contra los Errores del Anglicanismo, Instituto de Estudios Politicos, Madrid 1971, with a Spanish translation by Jose Ramon Eguillor Muniozguren, SJ. The examples which King James adduces do not prove that political principality is immediately from God. 8. Third objection. 9. Solution. Chapter 4: Whether the civil power among Christians, which Christians are held to obey, is legitimate. Summary. 1. Error of the ancient heretics. First foundation of this error. 2. Second foundation. 3. Rejection of the aforesaid heresy from Scriptures and the Fathers. 4. Rejection of the same heresy by a reason taken from St. Thomas. 5. The force of St. Thomas’ reason is made plain. It is not licit for the faithful again to create voluntarily for themselves an infidel king. 6. A pagan king seizing a Christian city in a just war also secures true dominion over it. When subjection to a prince tends to the detriment of the faith, the faithful can exempt themselves from it. 7. When matrimony between infidels can be dissolved because of the conversion of one of them to the faith. 8. Conclusion: it is de fide certain that there are true kings and princes among Christians. 9. Evasion. It is 3 rejected. 10. The assertion is proved by reason. 11. Response to a tacit evasion. 12. In what Christian liberty consists. 13. The first foundation of the first error is solved. 14. The place in Matt. 17 is expounded. 15. The second foundation is solved. Chapter 5: Whether Christian kings have supreme power in civil or temporal things, and by what right. Summary. 1.What supreme power is. 2. There is a double subjection, direct and indirect, and what each is. 3. The sense of the question is made clear. 4. First opinion for the negative. 5. First foundation. 6. The true opinion is established. 7. An emperor does not have supreme temporal power over the Church. 8. The assertion is proved from the authority of the Supreme Pontiffs. 9. Chapter 6: Whether there is in the Church of Christ a spiritual power of external and quasi political jurisdiction distinct from the temporal. Summary: 1. There is an ecclesiastical power of order and one of jurisdiction. 2. Again, ecclesiastical jurisdiction is double. Sense of the question. 3. The heresy of Marsilius of Padua and the foundation for the Anglican Schism. 4. The foundation of this sort of heresy. 5. First assertion de fide. Proof from Scripture. 6. Chapter 7: That the power of ruling the Church in spiritual or ecclesiastical matters does not exist in temporal kings or princes is proved by authority. Summary: 1. What the disposition is of the spiritual and temporal power in their order to their subject. Error of the Anglican sect about the subject of spiritual power. 2. First conclusion: to temporal kings, as such kings, no spiritual power belongs. 3. The assertion is proved from the Supreme Pontiffs. 4. The same assertion is confirmed from the emperors. Chapter 8: The same truth is confirmed by reasons. Summary: 1. First reason. 2. Second reason. Evasion of the Protestants. It is rejected. 3. Another evasion is excluded, and it is shown that the supreme head of the Church ought to be one. 4. Objection. Solution. Instance. Response. 5. A certain evasion is refuted. 6. Third reason. 7. It is rejected. 12. An evasion of this sort is repugnant to King James himself. Chapter 9: Solution to some objections against the truth proved in the previous chapters. Summary: 1. Triple question about the power of ruling the Church. 2. First objection. 3. 4 In the law of nature there was no power of a supernatural order. Nor any spiritual jurisdiction. 4. Objection. 5. Second objection. 6. Third objection from the New Testament. 7. Solution to the two first testimonies. 8. From the third testimony, in 1Timothy 2, nothing against the truth established can be collected. 9. The testimony of Matthew 22 concludes to the opposite. The testimonies also of John 18 and Luke 12 and 22 confirm the doctrine handed down. 10. Fourth objection. 11. Solution. Augustine is wrongly cited for the contrary error. 12.     CHAPTER FIVE HIPPOLYTUS AND THE 6000-YEAR CHRONOLOGY Notwithstanding being known today as one of the most important theologians of the 3rd-century Christian Church in the West, Hip- polytus ’ life and writings are not as well known as we might initially think. Most scholars explain this by referring to Hippolytus ’ schismatic activities, adding the fact that he wrote in Greek instead of Latin. It is commonly accepted that Hippolytus lived between c.170 A.D. and 236 A.D. and that he held a solid reputation among the Roman presbyters. However, little is known regarding his early life, and what we know about his later career is still under dispute. Even Eusebius is not positive about which church he led.1 Historical sources also do not allow us to confirm whether he was a disciple of Irenaeus (he probably was not), although it is commonly accepted that he attended one of Origen ’s sermons during his stay in Rome. We also know that the his- torical sources refer to him both as a bishop and as a presbyter, which reflects in a certain way that his importance was different in the West than it was in the East.2 In fact, Hippolytus appears to have been only a presbyter; however, in the Orient it was common to speak of him as a bishop. Later, Hippolytus , a man some said to be very strict in terms of orthodoxy, was convinced that Pope Callistus was a heretic, and therefore regarded Callistus as an antipope. During that period, he attacked not only Callistus but also his successors, namely, Urban and Pontianus .

D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency.

Noonan, Jr.* The two marriages of Charles, Duke of Lorraine, led to one of the most fascinating canonical trials of the seventeenth century. Professor Noonan uses this trial and its attendant circumstances as a springboard from which to examine the policies, procedures, and politics of post-RenaissanceRoman Catholic law. His Article under- lines the problems faced by a legal system that attempts to regulate the relationshipbetween man and woman. In broader perspective, it analyzes the reaction of a legal system forced to compromise between abstract social values and practical necessity. Professor Noonan's analytical framework can be profitably utilized as a tool to examine the manner in which our current social policies are implemented and administered. Anthropology rightly devotes great effort to deciphering the primi- tive attempts of men to make law in the primordial patterns, for from this effort will come material to illuminate our own behavior. But just as child psychology does not exhaust the study of man, so there is need to understand critically the functions of law in a more sophisticated phase. In its developed uses we are more likely to see analogues to our present problems, more likely to gain insights into the purposes, perver- sions, characteristics, and limits of the legal way of ordering human behavior in a mature society. Especially is this true of a system far enough removed from our own to be looked at from a distance but close enough in its assumption and its methods so that comprehension is not strained.

    Ecclesiastical Judges Complaints Procedure 1. Chancellors and Deputy Chancellors in the Church of England hold judicial office, as does the Dean of Arches and Auditor. By reason of the independence of the judiciary, any complaint concerning them must relate to misconduct in the performance of their office, and not to the substance of the decision made (including case management decisions) in court proceedings. By way of example, matters of misconduct might include rude or bullying behaviour, or inordinate delay in the conduct of proceedings. 2. Any complaint about an ecclesiastical judge shall be submitted in writing to the Vicar- General of the Province concerned at the address below.1 It must be sent within three months of the matter complained of, although the Vicars-General may entertain a complaint made after that time in exceptional circumstances. 3. The complaint shall contain: • the name of the complainant and their contact details (including their postal address and email address); • the name of the person against whom the complaint is made; • the date of the matter complained about; • the nature of the proceedings involved; • full details of the complaint (ie what the person said or did or did not do that it is alleged amounts to misconduct); • details of the exceptional circumstances relied on if the complaint is outside the three month time period. 4. If the complaint on its face could not amount to misconduct, the Vicar-General shall dismiss it and shall notify the complainant and the person complained about accordingly, giving reasons. 5. If the complaint could amount to misconduct, the Vicars-General (or if either is conflicted, a duly appointed substitute who shall be a senior chancellor from the province nominated by the Dean)2 shall investigate the complaint in such manner as they deem appropriate and in accordance with the principles of natural justice.

All these things were done following the supreme law of the salvation of souls[2] insofar as the Church, as Blessed Paul VI wisely taught, is the divine plan of the Trinity, and therefore all her institutions, constantly subject to improvement, work, each according to its respective duty and mission, toward the goal of transmitting divine grace and constantly promoting the good of the Christian faithful as the Church’s essential end.[3] It is with this awareness that we decided to undertake a reform of the processes regarding the 2 nullity of marriage, and we accordingly assembled a Committee for this purpose comprised of men renowned for their knowledge of the law, their pastoral prudence, and their practical experience.
