W świetle konstytucji Stanów Zjednoczonych kandydat na prezydenta musi być obywatelem amerykańskim urodzonym w Stanach, mieć ukończone 35 lat i mieszkać, od co najmniej 14 lat na terenie USA. Takie same wymagania dotyczą także kandydata na wiceprezydenta. Co więcej nie może on pochodzić z tego samego stanu co kandydat na prezydenta. Prezydent USA wybierany jest w wyborach pośrednich.
