INTRODUCTION [2] The appellant is a married man, aged in his mid-40s, with two children. He arrived in New Zealand in late December 2009 travelling on a false Malaysian passport. He was detained under s128 of the Immigration Act 1987 (“the Act”) because he had inappropriate documentation for immigration and identity purposes. He was transferred to the Mangere Accommodation Centre (“MAC”) where he remains released on conditions. He lodged a confirmation of claim for refugee status with the RSB in early January 2010. He was interviewed by a refugee status officer on 15 February 2010. His application for recognition was declined on 11 May 2010. He then appealed to this Authority. 2 [3] He predicts he has a real chance of being persecuted if he returns to Sri Lanka for reasons of the profile the Sri Lankan authorities will attach to him on his return. The central issues to be determined in this appeal relate firstly to his credibility and then, on the facts that are established, whether he has a well- founded fear of being persecuted should he now return to Sri Lanka.
