Appendix 11 – Public Participation Appendix A – Newspaper Advert NOTICE OF A WATER USE LICENSE APPLICATION FOR THE PROPOSED MAROTOLA PRIMARY SCHOOL BOREHOLE UPGRADE AND INTERNAL INFRASTRUCTURE IN HAMMANSKRAAL, GAUTENG PROVINCE Nemai Consulting has been appointed by Malani Padayachee and Associates, on behalf of the Gauteng Department of Infrastructure Development as the independent Environmental Assessment Practitioner (EAP) to undertake the Water Use License Application (WULA) Process for the proposed borehole upgrade and construction of internal infrastructure within the Marotola Primary School in Hammanskraal in terms of the National Water Act, 1998 (Act No. 36 of 1998) (NWA). In addition, this notice serves to notify all Interested and Affected Parties (IAPs) of the 60-Day Review Period of the Draft WULA Technical Report from 25 September 2019 to 25 November 2019. The Draft WULA Technical Report is available for review at the Temba Library (Stand 4424/2, Zone 02, Municipal Offices, Temba; 25°23'11.8"S 28°15'20.7"E; 012 358 3179) and will be available on Nemai Consulting’s website for download. Appendix B – Site Notice NOTICE OF A WATER USE LICENSE APPLICATION FOR THE PROPOSED MAROTOLA PRIMARY SCHOOL BOREHOLE UPGRADE AND INTERNAL INFRASTRUCTURE IN HAMMANSKRAAL, GAUTENG PROVINCE Notice is hereby given, in terms of the National Water Act, 1998 (Act No. 36 of 1998) (NWA), of the Water Use License Application (WULA) Process for the proposed Marotola Primary School Borehole Upgrade and Internal Infrastructure in Hammanskraal, Gauteng Province. BACKGROUND A Water Use License (WUL) was granted by DWS on 23 May 2014 for the Proposed Renovation/Upgrade of Marotola Primary School at Ga-Mokone in Hammanskraal, North of Pretoria in accordance with NWA, which was subsequently amended on 19 January 2018. Gauteng Department of Infrastructure Development (GDID) proposes to upgrade the borehole which is required to abstract water to provide potable water to the school, as well as construct/install additional infrastructure that is required to ensure that the school is functional. The borehole and additional infrastructure do not fall within the ambit of the existing WUL and thus require a new WUL as the borehole is located within a delineated wetland, while the proposed additional infrastructure fall within 500m of the wetland. A new WUL is required for the borehole upgrade and for the following infrastructure: grey water tank; water pipeline; water purification plant; storage tanks; generator; and access road. WATER USE LICENSE APPLICATION The WULA Process requires authorisation from the Department of Human Settlements, Water and Sanitation (DHSWS) (formally DWS) as the borehole is located within a delineated wetland, while the proposed additional infrastructure fall within 500m of the wetland (Figure 1). The following water uses are triggered in terms of the NWA: Section 21 Description of Water Use Relevance to Project (NWA) Taking water from a water Water will be abstracted from an existing borehole, 21 (a) resource which needs to be upgraded Construction of internal infrastructure within 500m Impeding or diverting the flow of 21 (c) of a wetland. It serves to provide an overview of the proposed borehole upgrade and construction of internal infrastructure within the Marotola Primary School in Hammanskraal; 2. It provides an outline of the Water Use License Application (WULA) Process that will be undertaken for the project; and 3. It grants the opportunity to be registered as an Interested and Affected Party (IAP) and allows for comments to be made on the Draft WULA Technical Report for the proposed project (refer to attached Reply Form (Annexure 1)). The purpose of the WULA Process is to identify and evaluate potential impacts, to recommend measures to avoid or reduce negative impacts and to enhance positive impacts. 2 PROJECT OVERVIEW 2.1 Project Background The Marotola Primary School needed to be upgraded/renovated in order to establish a number of structures and infrastructure. The school was in poor condition that were deemed unsafe for children and teachers. The upgrade/renovation of the school required authorisation in terms of the National Water Act (Act 36 of 1998) (NWA). A WUL was granted by DWS on 23 May 2014 for the Proposed Renovation/Upgrade of Marotola Primary School at Ga-Mokone in Hammanskraal, North of Pretoria in accordance with NWA. An amendment to the WUL to amend the scope of work from the installation of a septic tank to the installation of a Sewer Package Plant (SPP) was submitted to DHSWS (then the Department of Water and Sanitation (DWS)) on 19 January 2018. The amended WUL was granted on 18 September 2018. GDID proposes to upgrade the borehole which is required to abstract water to provide potable water to the school, as well as construct/install additional infrastructure that is required to ensure that the school is functional. The borehole and additional infrastructure do not fall within the ambit of the existing WUL and thus require a new WUL as the borehole is located within a delineated wetland, while the proposed additional infrastructure fall within 500m of the wetland. Page 1 September 2019 Marotola Primary School Internal Infrastructure Background Information Document 2.2 Project Description A new WUL is required for the borehole upgrade and for the following infrastructure: • Grey water tank; • Water pipeline; • Water purification plant; • Storage tanks; • Generator; and • Access road. Condition 4.1 of Appendix ΙΙ of the amended WUL states the following: The package plant must have a power backup system (e.g. generator) to ensure its functionality in the event of a power failure. Despite the condition above, the generator falls within 500m of the delineated wetland and thus will be included in this application. Figure 2 provides a locality map of the proposed borehole upgrade and internal infrastructure for the Marotola Primary School. 2.3 Project Location The Marotola Primary School is situated in Ga-Mokone, Hammanskraal in the City of Tshwane Metropolitan Municipality, Gauteng Province (Figure 1). The school property is approximately 2.3 hectares. The main land use in the area is residential while the proposed development is an educational facility. The school currently falls on two properties: Portion 1 of Erf 8224 Stinkwater Extension 7 Township JR; and Erf 7862 Stinkwater Extension 7 Township JR. Currently, GDID are undertaking a consolidation process to combine the two properties into Erf 8769 Stinkwater Extension 7 Township. Page 2 September 2019 Marotola Primary School Internal Infrastructure Background Information Document Figure 1: Topographical Map Figure 2: Locality Map Page 3 September 2019 Marotola Primary School Internal Infrastructure Background Information Document 3 ENVIRONMENTAL LEGAL FRAMEWORK 3.1 Water Use License Application (WULA) NWA aims to manage national water resources in order to achieve sustainable use of water for the benefit of all water users. This requires that the qualities of water resources are protected, and that integrated management of water resources takes place. In terms of Section 21 (c) and (i) of the NWA, any development within 500m of a wetland or within the 1:100 year floodline / “Riparian Zone” (whichever is greatest) of a watercourse requires a WULA.
