October 10, 2019 Scott Scheele, Esq. Chief, Telecommunications and Broadband Section Antitrust Division, U.S. Department of Justice 450 Fifth Street NW, Suite 7000 Washington, DC 20530 Re: United States v. Deutsche Telekom AG, et al., No. 1:19-cv-02232-TJK TUNNEY ACT COMMENTS OF THE COMMUNICATIONS WORKERS OF AMERICA Introduction. The proposed Final Judgment (“PFJ”) violates a number of clearly articulated Antitrust Division policies on merger remedies. These policies, incorporated in current policy guidance documents and in speeches by Division officials, are aimed at ensuring that antitrust remedies are appropriate, effective and principled. The remedy here satisfies none of these goals. The Division has not articulated any reasons, let alone principled reasons, why it has turned its back on its own merger remedy policies in this case, many of which are long-standing and represent sound antitrust enforcement. The Division has recently and successfully asserted a number of its merger remedy policies in litigated cases as a basis for rejecting proposed fixes to anticompetitive mergers, including one in which the proposed divestiture package did not include the network necessary for the buyer successfully to compete. That has particular relevance here. Judged from the standpoint of the competitive harm alleged in the Complaint, the divestiture assets do not restore the competition lost by the elimination of Sprint as an independent competitor under the theories of harm alleged in the complaint and in the product market alleged in the complaint. The divestitures create a Mobile Virtual Network Operator (“MVNO”), but the theories of harm and market definition treat competition from MVNOs as de minimis.

“Consider the Source” A Resource Guide to Liberal, Conservative and Nonpartisan Periodicals 30 East Lake Street ∙ Chicago, IL 60601 HWC Library – Room 501 312.553.5760 ver heard the saying “consider the source” in response to something that was questioned? Well, the same advice applies to what you read – consider the source. When conducting research, bear in mind that periodicals (journals, magazines, newspapers) may have varying points-of-view, biases, and/or E political leanings. Here are some questions to ask when considering using a periodical source: Is there a bias in the publication or is it non-partisan? Who is the sponsor (publisher or benefactor) of the publication? What is the agenda of the sponsor – to simply share information or to influence social or political change? Some publications have specific political perspectives and outright state what they are, as in Dissent Magazine (self-described as “a magazine of the left”) or National Review’s boost of, “we give you the right view and back it up.” Still, there are other publications that do not clearly state their political leanings; but over time have been deemed as left- or right-leaning based on such factors as the points- of-view of their opinion columnists, the make-up of their editorial staff, and/or their endorsements of politicians. Many newspapers fall into this rather opaque category. A good rule of thumb to use in determining whether a publication is liberal or conservative has been provided by Media Research Center’s L. Brent Bozell III: “if the paper never met a conservative cause it didn’t like, it’s conservative, and if it never met a liberal cause it didn’t like, it’s liberal.” Outlined in the following pages is an annotated listing of publications that have been categorized as conservative, liberal, non-partisan and religious.

  • The State of the News: Texas
THE STATE OF THE NEWS: TEXAS GOOGLE’S NEGATIVE IMPACT ON THE JOURNALISM INDUSTRY #SaveJournalism #SaveJournalism EXECUTIVE SUMMARY Antitrust investigators are finally focusing on the anticompetitive practices of Google. Both the Department of Justice and a coalition of attorneys general from 48 states and the District of Columbia and Puerto Rico now have the tech behemoth squarely in their sights. Yet, while Google’s dominance of the digital advertising marketplace is certainly on the agenda of investigators, it is not clear that the needs of one of the primary victims of that dominance—the journalism industry—are being considered. That must change and change quickly because Google is destroying the business model of the journalism industry. As Google has come to dominate the digital advertising marketplace, it has siphoned off advertising revenue that used to go to news publishers. The numbers are staggering. News publishers’ advertising revenue is down by nearly 50 percent over $120B the last seven years, to $14.3 billion, $100B while Google’s has nearly tripled $80B to $116.3 billion. If ad revenue for $60B news publishers declines in the $40B next seven years at the same rate $20B as the last seven, there will be $0B practically no ad revenue left and the journalism industry will likely 2009 2010 2011 2012 2013 2014 2015 2016 2017 2018 disappear along with it. The revenue crisis has forced more than 1,700 newspapers to close or merge, the end of daily news coverage in 2,000 counties across the country, and the loss of nearly 40,000 jobs in America’s newsrooms.

  • Synthesis and Characterizations of Novel Magnetic and Plasmonic Nanoparticles
SYNTHESIS AND CHARACTERIZATIONS OF NOVEL MAGNETIC AND PLASMONIC NANOPARTICLES by NAWEEN DAHAL B.S., TRIBHUVAN UNIVERSITY, 1995 M.S., TRIBHUVAN UNIVERSITY, 1997 AN ABSTRACT OF A DISSERTATION Submitted in partial fulfillment of the requirements for the degree DOCTOR OF PHILOSOPHY DEPARTMENT OF CHEMISTRY COLLEGE OF ARTS AND SCIENCES KANSAS STATE UNIVERSITY Manhattan, Kansas 2010 Abstract This dissertation reports the colloidal synthesis of iron silicide, hafnium oxide core-gold shell and water soluble iron-gold alloy for the first time. As the first part of the experimentation, plasmonic and superparamagnetic nanoparticles of gold and iron are synthesized in the form of core-shell and alloy. The purpose of making these nanoparticles is that the core-shell and alloy nanoparticles exhibit enhanced properties and new functionality due to close proximity of two functionally different components. The synthesis of core-shell and alloy nanoparticles is of special interest for possible application towards magnetic hyperthermia, catalysis and drug delivery. The iron-gold core-shell nanoparticles prepared in the reverse micelles reflux in high boiling point solvent (diphenyl ether) in presence of oleic acid and oleyl amine results in the formation of monodisperse core-shell nanoparticles. The second part of the experimentation includes the preparation of water soluble iron- gold alloy nanoparticles. The alloy nanoparticles are prepared for the first time at relatively low temperature (110 oC). The use of hydrophilic ligand 3-mercapto-1-propane sulphonic acid ensures the aqueous solubility of the alloy nanoparticles. Next, hafnium oxide core-gold shell nanoparticles are prepared for the first time using high temperature reduction method. These nanoparticles are potentially important as a high κ material in semiconductor industry.

Ford Attorney General State of Nevada 100 North Carson Street Carson City, NV 89701 Re: Request for investigation of potential Nevada open public meeting violation and election irregularities Dear Attorney General Ford: Nevadans rightly prize honest and fair elections, as well as transparency in governmental decision making. Unfortunately, recent deeply troubling events in Clark County have placed both of those interests under attack. On behalf of the Republican National Committee and the Nevada Republican Party, I ask you to investigate under NRS 241.039 whether those events violated Nevada’s open public meeting law, and to investigate under NRS 293.840 whether the consequences of Clark County’s decisions have violated Nevada’s election laws. I. Background In response to the COVID-19 pandemic, Secretary of State Barbara Cegavske announced in March 2020 that the June 9 primary would be an all-mail election. As you know, the Democratic National Committee and the Nevada State Democratic Party—together with a handful of related entities and individual plaintiffs—were not content with the Secretary’s plan. They sued her; the head elections officials in Clark, Washoe, and Elko Counties; and you in the First Judicial District Court in Carson City. See Corona et al. v. Cegavske et al., No. CV 20-OC- 00064-1B. 1 The Republican National Committee and Nevada Republican Party intervened as defendants because the plaintiffs there challenged long-standing, common-sense Nevada laws expressly designed to further Nevada’s constitutional interest in “preserv[ing] the purity of elections.” Nev.
