Accordingtotheindictment,between1August1991andJune1992,Serbforces,comprisingJNAunits, localTOunits,TOunitsfromSerbiaandMontenegro,localandSerbianMUPunitsandparamilitaryunits, attacked and took controlof towns,villages and settlements in the territories listed above. After the takeover, the Serb forces, in cooperation with the local Serb authorities, established a regime of persecutions designed todrive the Croat and other nonSerbcivilian population from theseterritories. This regime included the extermination or murder of hundreds of Croat and other nonSerb civilians, includingwomenandelderlypersons,thedeportationorforcibletransferofatleast170,000Croatand othernonSerbciviliansandtheconfinementorimprisonmentunderinhumaneconditionsofthousandsof CroatandothernonSerbcivilians.Furthermore,publicandprivatepropertyinalltherelevantareaswas intentionally and wantonly destroyed and plundered, including homes, and religious, historical and culturalbuildings. BOSNIAANDHERZEGOVINA The initial indictment against Milošević concerning crimes committed in Bosnia and Herzegovina was confirmed on 22 November 2001 and made public on 23 November 2001. On 22 November 2002, the Prosecutionfiledanamendedversionoftheindictment.On21April2004,theamendedversionofthe indictmentbecametheoperativeindictment. Milošević was the President of the Republic of Serbia during the relevant period, and as such, it was alleged,exercisedeffectivecontrolorsubstantialinfluenceoverparticipantsintheJCE,and,eitheralone or acting in concert with them and additional known and unknown persons, effectively controlled or substantiallyinfluencedtheactionsoftheFederalPresidencyoftheSFRYandlatertheFRY,theMUP,the JNAandlatertheVJ,theBosnianSerbArmy(VRS),aswellasSerbparamilitarygroups. Itwasallegedthat,fromonorabout1March1992until31December1995,Milošević,actingaloneorin concertwithothermembersoftheJCE,planned,instigated,ordered,committedorotherwiseaidedand abettedtheplanning,preparationandexecutionofthewidespreadkillingofthousandsofBosnianMuslims duringandafterthetakeoverofterritorieswithinBosniaandHerzegovinaandthedetentionofthousands of Bosnian Muslims in detention facilities within Bosnia and Herzegovina, under conditions of life calculated to bringabout thepartialphysical destructionofthose groups. During their confinement in detentionfacilities,thousandsofBosnianMuslimswerekilledorcausedseriousbodilyandmentalharm. AMICI CURIAE ,ASSIGNEDCOUNSELANDLEGAL ASSOCIATES MiloševićelectedtorepresenthimselfbeforetheTribunal.InabsenceoftrainedDefenceCounselandin ordertosecureafairtrial,theTrialChamberissued,on30August2001,anordertotheRegistrarto designate counsel to appear before the Chamber as socalled amici curiae (friendsof the Court). On6 September 2001,the Registrarassigned Steven Kay, Branislav Tapušković and Michail Wladimiroff. The amici curiae wereappointednottorepresenttheaccusedbuttoassistintheproperdeterminationofthe case. Upon the accused’s request to receive legal advice from Ramsey Clark and John Livingston, the Trial Chamberissuedanorderon15November2001providingthemwiththestatusoflegaladvisors.Assuch, RamseyClarkandJohnLivingstonweregrantedprivilegedaccesstotheaccused,whichmeantthattheir communication with the accused, whether in meetings or on the telephone, was not monitored by Tribunalauthorities. THETRIAL Thetrialcommencedon12February2002beforeJudgeRichardMay(presiding,until31May2004),Judge PatrickRobinson(presiding,from1June2004onwards)andJudgeOGonKwon,withevidencerelevant only to the charges relating to Kosovo. The Prosecution concluded its case regarding Kosovo on 11 September2002.On26September2002,theProsecutionstartedthepresentationofitscaseregarding CroatiaandBosniaandHerzegovina.TheProsecutionconcludedthepresentationofitscaseinchiefon25 February2004. On 12 April 2004, the UN SecretaryGeneral appointedLordIain Bonomy as a judge of the ICTY. Lord Bonomy,whoseappointmentwaseffectiveasof1June2004,replacedJudgeRichardMaywhohadretired duetoillhealth. TheDefencecasecommencedon31August2004. RULE98 bis PROCEEDINGS AftertheProsecutionconcludesthepresentationofitsevidence,theDefencecanaskforthedismissalof the case if it believes that the presented evidence was insufficient to prove the charges. On16June2004,followingthecompletionofthepresentationoftheProsecutioncase,theTrialChamber foundthattherewassufficientevidencetosupporteachcountinthethreeindictments. However, the Trial Chamber also found that there was insufficient/no evidence to support certain allegationsrelevanttosomeofthechargesinthe“Croatia”and“BosniaandHerzegovina”indictments. Theallegationsinquestionincluded: • The existence of, conditions in, organisation of, and possible crimes committed at the detention facilitiesdescribedintheparagraphs64(b),64(f),64(h)and64(p)ofthe“Croatia”indictment. • AnumberofallegationsfromScheduleA(killingsnotassociatedwithdetentionfacilities);ScheduleB (killings associated with detention facilities); Schedule C (existence of detention facilities); and ScheduleD(forcibletransfersofnonSerbcivilians)ofthe“Bosnia”indictment. • Allbutoneofthe44allegedsniperincidentsinSarajevo. • Allbutoneofthe26allegedshellingincidentsinSarajevo. TERMINATIONOFPROCEEDINGS SlobodanMiloševićpassedawayon11March2006. On14March2006,theTrialChamberterminatedproceedingsagainsttheaccused.
