Mr. Robert Crum, HRTPO Executive Director, stated that pursuant to the declared state of emergency in the Commonwealth of Virginia and in response to the COVID-19 pandemic and to protect the health and safety of the Board members, staff, and the general public, the HRTPO meeting was being held electronically via Zoom. These electronic meetings are required to complete essential business on behalf of the region.

Per the requirements of the Code of Virginia, the meeting notice, agenda, and supporting documentation were posted on the HRTPO website for public review. HRTPO staff also provided electronic copies of this information to Board members and other interested parties. A recording of the meeting will be available on the HRTPO website. Additionally, the meeting was live-streamed and available for viewing on the Regional Connection YouTube channel.

The general public was provided an opportunity to comment on the meeting agenda via two options:

1. Members of the public were invited to submit comments to the HRTPO Board via email.

2. Members of the public were also invited to call into a dedicated phone line where comments could be recorded for the HRTPO Board.

Executive Director Report

Mr. Robert Crum, HRTPO Executive Director, referenced his monthly report and provided an update regarding the Regional Transit Advisory Panel (RTAP). Mr. Crum recounted that during the 2020 General Assembly session, the legislature passed House Bill 1726 and Senate Bill 1038 which created the Hampton Roads Regional Transit Fund (HRRTF). As part of this action, the General Assembly included a provision that the HRTPO establish an RTAP to provide ongoing advice during the planning process. Mr. Crum reported that the first RTAP meeting was held on November 18, 2020 with 67 community representatives participating.

Mr. Crum indicated that HRTPO staff prepared a Resolution of Appreciation to recognize Mayor John Rowe for his service to the HRPDC, HRTPO, HRTAC, and the region.

Chair Donnie Tuck expressed his appreciation for Mayor Rowe’s friendship and support.

Mr. Crum listed some of the many regional initiatives that the HRTPO was involved in under Mayor Rowe’s leadership. On behalf of HRTPO staff and the Board, Mr. Crum thanked Mayor Rowe for his guidance and support.

Mayor Rowe expressed his appreciation for the sentiments. He stated that he is excited about the cooperative and collaborative efforts of the region and complimented the HRPDC

Attachment 7-A and HRTPO. He said he was honored to serve the region and attributed all accomplishments to the HRTPO Board members’ efforts.

Mr. Crum asked Ms. Kelli Arledge, HRPDC Human Resources Administrator, to virtually present the Resolution of Appreciation, and the Board members applauded.

Mr. Crum indicated that HRTPO staff prepared an additional Resolution of Appreciation to recognize Mr. Mike Kimbrel, HRTPO Deputy Executive Director, for his service to the organization. Mr. Crum shared that at the end of 2020, Mr. Kimbrel planned to retire after 31 years. Mr. Kimbrel began as an HRTPO intern and spent his entire career working for the HRTPO.

Mr. Crum asked Ms. Arledge to virtually present the Resolution of Appreciation, and the Board members applauded.

Mr. Kimbrel thanked Mr. Crum and the HRTPO Board members for the recognition. He said he was honored and thankful for the opportunity to serve the Board and the people of Hampton Roads since 1989.

Public Comment Period

The public was provided an opportunity to comment in advance of the meeting by email or phone. Chair Donnie Tuck stated that HRTPO staff received no comments via either option as of 48 hours before the meeting.

Hampton Roads Regional Coordinated Transit Program Update

Mr. Robert Crum reported that during the 2020 General Assembly session, the legislature passed House Bill 1726 and Senate Bill 1038 which created the Hampton Roads Regional Transit Fund (HRRTF). One of the responsibilities of the HRTPO related to this legislation is to coordinate efforts among the three transit systems within the Hampton Roads region. To initiate this process, Mr. William Harrell, HRT President and CEO, and Mr. Josh Moore, WATA Deputy Executive Director, briefed the HRTPO Board at its meeting on October 15, 2020. As a continuation of this effort, Mr. Crum introduced Mr. LJ Hansen, Suffolk Public Works Director, to brief the Board regarding Suffolk Transit’s plans and opportunities for its transit system.

Mr. Hansen reported that Suffolk Transit is city-owned and contractor-operated by Virginia Regional Transit. Based on an efficiency study in 2011, Suffolk Transit separated from HRT in 2012 and currently serves Downtown Suffolk, Northern Suffolk, and provides a connection from Downtown Suffolk to an HRT hub in the Chesapeake Square Mall area of Chesapeake.

Attachment 7-A Mr. Hansen noted that almost 50 percent of its funding is made up of local funds; however, with the introduction of federal funding, Suffolk Transit completed a more thorough Transit Strategic Plan (TSP) consistent with those of HRT and WATA.

As part of the TSP plan, Suffolk Transit identified several priorities, including realigning routes, expanding service hours, increasing frequency of service, and introducing commuter and on-demand service.

He stated that there are many regional opportunities for Suffolk Transit, such as:

• Increasing connections to other communities • Creating intelligent transportation solutions • Providing service between or beyond service areas

Chair Donnie Tuck thanked Mr. Hansen for his presentation and invited questions or discussion.

Vice-Chair Rick West asked for clarification regarding the specific location of Suffolk Transit service in Chesapeake.

Mr. Hansen responded that Suffolk Transit services extend into Chesapeake stopping at Chesapeake Square Mall. He stated that there is an additional transfer point in the northern part of Suffolk where HRT services extend to the HRT and Suffolk Transit joint operations facility.

Mr. Crum thanked Mr. Hansen for the overview and asked him to provide additional information regarding Suffolk Transit’s coordination with Portsmouth.

Mr. Hansen indicated that the workforce in and beyond Suffolk is an essential element for Suffolk businesses. However, the Great Dismal Swamp acts as a large geographic barrier cutting off easy transit transportation. Suffolk Transit hopes to establish an express system from the HRT Victory Crossing hub to the industrial center located to the west of downtown Suffolk. He also indicated that HRT, Suffolk Transit, and industrial partners are examining how to make connections for the northern part of Suffolk, which includes two Amazon facilities.

Regional Proclamation – Impact of Tolls on the Downtown and Midtown

Chair Donnie Tuck indicated that Mr. Robert Crum and Mayor John Rowe, ERC Task Force Chair, would brief the Board on the recommended Regional Proclamation.

Mr. Robert Crum began with some background information. He recounted that over the past several years, there has been significant discussion across the region about the impact that the tolls at the Downtown and Midtown Tunnels have on residents and businesses in the Hampton Roads region. The current Elizabeth River Crossings (ERC) Toll Agreement, signed by the Commonwealth of Virginia and the current ERC concessionaire, extends to 2070 and allows for an annual toll increase of 3.5 percent or higher based on the Consumer Price Index.

The agreement also defined certain transportation projects in Hampton Roads as potential competing facilities, and if documentation proved that those facilities moved traffic away from ERC assets, the Commonwealth of Virginia could be required to pay a compensation event. Competing facilities may include regional priority projects, including the Hampton Roads Bridge- (HRBT) and High-Rise Bridge. Concerns about the current agreement led to the HRTPO Board forming an ERC Task Force.

Mr. Crum commended the efforts of the ERC Task Force, which included many HRTPO Board members. Mr. Crum recognized Delegate Stephen Heretick, a member of the ERC Task Force, and thanked him for his leadership. He also credited Secretary of Transportation Shannon Valentine, Deputy Secretary of Transportation Nick Donohue, Deputy Secretary of Transportation John Lawson, and Commissioner of Transportation Stephen Brich for engaging in conversations on the topic.

Mr. Crum reported that the operator of the Downtown and Midtown tunnels, ERC, had been sold to Abertis, a Spanish toll road company, and Manulife Investment Management, which did so on behalf of John Hancock Life Insurance Company. The contract with the Virginia Department of Transportation (VDOT), that allows the company to levy tolls, transfers with the sale. Mr. Crum stated that neither HRTAC nor the Commonwealth of Virginia was in a financial position to purchase the asset.

Attachment 7-A Based on comments expressed at ERC Task Force meetings and throughout the region, guiding principles were prepared that express potential goals for the region to work towards. These guiding principles and goals are included in a Regional Proclamation to be considered by the HRTPO, HRPDC, and HRTAC as a unified regional statement regarding this issue.

Mr. Crum referenced the Regional Proclamation included in the agenda packet for Board consideration. The document titled “A Proclamation of the Hampton Roads Region Supporting Efforts to Mitigate the Impact of the Downtown and Midtown Tunnel Tolls on our Region’s Residents” includes the following guiding principles:

• Toll Mitigation/Relief for Hampton Roads Residents

• Reduce Regional Impact of Compensation Events

• Regionally Integrated Network

• State Commitment to Continue to Explore Options

Chair Tuck thanked Mr. Crum for the background information and status update. Chair Tuck recounted an op-ed in The Virginian-Pilot last year regarding the impact of the Downtown and Midtown Tunnel tolls on the residents of Portsmouth in particular. He said that the editorial stated that the region had let down the City of Portsmouth by not rallying around the residents and trying to advocate on their behalf with the General Assembly. He commented that since then, the ERC Task Force had made great progress and this proclamation would expand upon those efforts.

Mayor John Rowe echoed Mr. Crum’s sentiments and recognized Delegate Heretick for including language in a budget amendment bill that the Governor, through the Secretary of Transportation, would study this matter. He added that the region cannot have a truly integrated transportation network with an external private operator of the Downtown and Midtown tunnels.

Ms. Terry Danaher, a member of the ERC Task Force and Chair of the Community Advisory Committee (CAC) indicated that the CAC was very interested in this topic. Ms. Danaher commented that in the most recent ERC Task Force meeting, specific items were identified that Secretary of Transportation Valentine and her staff were going to research. She added that as the Commonwealth still needs to approve the contract, there may be an opportunity for the Commonwealth to emphasize to the buyers the importance of mitigating the toll impacts upon the region’s residents.

Mr. Phillip Bazzani asked if the General Assembly included Gloucester County as part of the toll study. He indicated that the Coleman Bridge tolls present an economic hindrance to the county’s growth.

Mayor Rowe responded that when the ERC Task Force was created, the impact of the current tolls was considered for the entire region, but the focus was on the Downtown and Midtown Tunnels tolls due to the non-compete clause. He commented that discussions with the General Assembly in 2021 could be expanded to include the Coleman Bridge.

Chesapeake Bay Bridge Tunnel Parallel Thimble Shoal Tunnel Update

Mr. Robert Crum introduced Mr. Michael Crist, Deputy Executive Director of the Bridge and Tunnel District (CBBTD) to present on CBBTD Executive Director Jeffrey Holland’s behalf.

Mr. Crist provided the HRTPO Board with an update on the Parallel Thimble Shoal Tunnel (PTST) project. He reported that the PTST is currently under construction by the CBBTD to provide a second tunnel under Thimble Shoal Channel. When complete, the second tunnel will carry two lanes of traffic southbound and the existing tunnel will be converted from bi- directional traffic to two northbound lanes, thereby improving the safety of the traveling public.

Additionally, CBBTD has been working with the Army Corps of Engineers (USACE) as well as the Virginia Port Authority (VPA) to deepen the existing channel over the tunnel to 55 feet, which is scheduled to be completed in the next few years.

The design-build contract value of the PTST project is $756 million and was awarded to a joint venture of Dragados USA and Schiavone Construction Co. LLC. The tunnel will be 6,525 feet long portal-to-portal, 43 feet in outside diameter, and constructed using a tunnel-boring machine (TBM). A tunnel-boring project, as opposed to an immersed tube project, erects the tunnel as it excavates using precast tunnel segments.

The contractor subcontracted to a company that constructed a specially-built manufacturing plant in Chesapeake to create and assemble the PTST project’s 9,900 tunnel segments. One of the innovations used in this project is that the tunnel segments are made of steel fiber reinforced concrete, rather than conventional reinforcement such as rebar, making this the first roadway project of its type completed in the United States.

Mr. Crist also provided an update on the Parallel Chesapeake Tunnel project, which is located north of the PTST project. He reported that the Chesapeake Tunnel project is in a preliminary engineering planning stage. The PTST project is completely funded by the toll facility utilizing bond sales and a Transportation Infrastructure Finance and Innovation Act (TIFIA) loan for financing. The initial financial planning estimated that the Chesapeake Tunnel project would not be completed until the late 2030s or even 2040. However, based on current interest rates, refinancing the TIFIA loan could save $50 to $100 million

Attachment 7-A allowing the acceleration of the Chesapeake Tunnel project to the 2024 to 2029 timeframe. In conclusion, Mr. Crist offered to answer questions.

Chair Donnie Tuck thanked Mr. Crist for his presentations and invited questions and discussion.

Mr. Crum thanked Mr. Crist for his presentation and asked him to clarify the timeframe for the PTST project completion.

Mr. Crist reported that the contractor has encountered some rocks in the bottom of the bay where the TBM will need to drive through between the current immersed-tube tunnel and a temporary pier constructed for the project. The contractor believes the obstruction presents a changed geotechnical condition, and CBBTD is working with the contractor to create a design solution. Determining the appropriate technical solution may take a few months and has put the project behind schedule. Early on in the project, the contractor experienced permitting delays as well as a subcontractor termination which also put the project behind schedule. Due to the delays, the original project completion of 2022 is now forecasted for 2024. Mr. Crist indicated that project progress continues and that schedule challenges on large projects are not unusual.

Old/New Business

Chair Donnie Tuck invited Old or New Business items.

Mr. W. Sheppard Miller, Commonwealth Transportation Board (CTB) member, stated that in 2013, the 0.7 cents sales tax increase was well-received and has proven to be an effective funding source. He commented that if the increase had been 1.0 cent instead of 0.7 cents, he believed there would have been available funding to purchase the ERC contract. He stated that financing through tolling was regressive and inefficient; although, he shared that he was encouraged by the efforts of the HRTPO Board in this regard and by the Regional Proclamation.

Mr. Miller also expressed his concern that the HRBT expansion project design does not account for the current issue of westbound over-height trucks that must be turned around.

Chair Tuck stated that he was encouraged that members of the legislature are more amenable than in the past to potential sales tax increases as a funding source for transportation improvements.
