The CITY OF .LOS ANGE",ES (here.Utcr referred to as the CITY), CULTURAL AFFAIRS DEPARTMENT (hereafter referred t<> as CAD) recognizes the importance of support groups as part of r.he ~ ucccssful operations of our facilities. They provide ideas, advocacy, volunteer time, crcltive energy and financial support. It is understood that funds raised by support s-roups are intended to augment r.he CAD budget, not replace it.

The purpose of this Memoran lum of Understanding (MOU) is to support and facilitate procedures which will assure a continued close collaboration and partnership between this particular private suppo!'l group, FRIENDS OF THE CROATIAN CULTURAL CENTER, INC. (he!'eafrcr refe .·red to as FCCC) and r.he CAD as it relates to the Croatian Cultural Cent<.'r of Greater Los Angeles located at 643 South Pacific Avenue, San Pedro, California 90731 (hereafter ref.,rrcd to as the FACll..ITY).

FCCC is a non-prot1t corporal on, r.he primary function of which is to provide financial support to the Croatian Cultur:J Center of Greater of Los Angeles, and is classified tax­ exempt under the Internal Rt venue Service Code, Section 501 (c)(3). FCCC's sole purpose is to help CAD establil h a cultural center in the San Pedro area.

Conforming to these guidelines will: . 1. Facilitate leg:il fund raising for r.hose support groups interested in this activity. 2. Maintain the cr.hics <•fthe CITY by acting within administrative policy. 3. Assure jurisdictiona: conflicts between support groups are minimized. 4, Insure that high quality services are provided throughout the City.

SECTION 3. FUNCTlON OF SUPPORT GROQ!! The FCCC may perfmm a vari<-ty of functions including, but not limited to the following: 1. FCCC may occupy an office within the FACILITY

2. FCCC ~hall promote ar,d encourage fund raising and other gifts to benefit CAD programs (hereafter ref:rred to as PROGRAM or PROGRAMS) and facilities including, but not limited to grants to non-profits, donations, ticket sales from fund raising events, classes, workshops and related product sales sponsored by friends, etc. All fundrai dng efforts, which effect PROGRAMS or the FACILITY, will be approved by the ;taff liaison for CAD, the DIRECTOR.

3. FCCC shall assist in panning special activities that enrich or enhance regular CAD programming at t1c FACILITY and in the community. The DIRECTOR will approve all events cl1at affect PROGRAMS at the FACILITY.

4. FCCC shall provide support to the DIRECTOR in relation to the FACILITY and its PROGRAMS.

2 5. FCCC shall support the DIRECfOR and add to the PROGRAM of classes for children and adults in '·isual and performing arts, and special events.

6. FCCC sh:>ll conduct ldditional marketing. and community outreach; stimulate community awareness interest and participation in the programs conducted by CAD and/or CAD's a::sociated activities; and a.~sist in coordination of publicity and marketing with CPD's efforts.

7. FCCC may hos.t their own events if space and scheduling permits. The DIRECTOR on bchal; · of CAD must approve these events through a written request at least two (2) weeks in advance of the event.

8. With the assistance of CAD, FCCC shall find local in-kind donations of services for maintenance and repair.

FCCC shall maintain it; status as a non-profit, tax-exempt corporation in the State of California and under applicable federal law.

10. FCCC shall give crcdi•. in all promotional materials to the City .of Los Angeles Cultural Affairs Departl)cnt, for support of all programs a~ the FACILITY.

11. All efforts made by FCCC on CAD's behalf require approval by the DIRECTOR.

SI;CTION 4. :ROLE OF CAD The City of Los Angeles Culru;·al Affairs Department will: 1. Provide direction of CAD programs and facilities.

2. Assist FCCC in achicv .ng success in their functions by helping FCCC establish and achieving goals. and recognize their accomplishments.

3. Provide a designated s:aff liaison, the DIRECTOR, employed by the CAD to manage, coordinate and supervise the PROGRAM at the FACILITY.

5. The DJRECTOR will v•ork with the FCCC to provide a minimum of forty (40) weeks of programs -after school and school break - for children and adults in the visual and performing lrts, from basic to advanced levels, concurrent with the four seasons. All classes shall be open to the public, with restrictions in enrollment limited to meeting course-level prerequisites and cla~s size.

6. The DIRECTOR will pnvide a minimum of two annual special events.

3 7. The DIRECTOR will lrovide an inventory of CITY-owned equipment, furniture, and supplie~ necessary to the functioning of the FACILlTY and PROGRAM.

SECTION 5. ·GENERAL POLICY 1. FCCC will provide CAD information annually on the Annual Support Group Plan Forn1 (being revised b~ the CAD). The plan will be updated periodically, but no less than annually. Tl:e time period covered by the plan will be July 1 through June 30 of the next yeat (the CITY's fiscal year). Accompanying the plan will be a copy of FCCC' s Articles of Incorporation, Bylaws, Tax Exemption Letters from the Internal Revenue : lervice and the Franchise Tax Board, the latest al!diled Financial Statement and Mission Statement (as applicable). After the initial filing of these documcll!s, only changes or amendments need to be submitted annually.

2. CAD requests that pric r to July each year, FCCC meet with the DIRECTOR to discuss fund raising plans for the coming fiscal year. Plans should not be in violation of CITY or CAD rules and regulations. Discussed will be goals, fund raising activities and projected expenditures. The General Manager, or designee, will be invited. to join tl:.e meeting.

All required annu0!-1 tilings (Secretary of State, Attorney General and State and Federal Tax Document.;) must be filed with the proper authorities.

4. There shall be no discrimination as to race, creed, color, sexual orientation, gender or.national origin in the selection of membership in the governing bodies of CAD.

5. Gencrttlly accepted ace >Unting practices must be followed. No co-mingling of FCCC funds with CAD funds will be authorized.

6. Equipment purchased hy FCCC and donated to the FACILITY becomes the property of CAD. Equi;)ment loaned to the FACILITY by FCCC will be noted in a loan agreement.

7. A CAD Trust Fund Acc>unt forFCCC will be established for receiving funds that FCCC, at its sole discretion, donates to the CITY (Department Directive #2).

8. Tile DIRECTOR will b ~ invited to attend all general meetings and functions of FCCC as an ex-officio member.

POl ICY FOR SPECIAL EVENT FUND RAit>ING Bec;~use FCCC is raising funi~ in support of CIJ'Y programs, it is CAD policy that all fund raising special event plru,s be reviewed and approved by CAD. I. If FCCC wishes to "PI>Iy for a grant on behalf of CAD, and the activity is to take place in a CITY facili1y, or as part of the CAD's programming, FCCC is required to review the initial pr• >posal with the DIRECTOR.

FCCC shall maJ.ntain complete and accurate records of all financial transactions and activities conducted at the E I.CILITY. Re: San Pedro Parking Study-Summary of Work Completed.

As requested by CRA/lA staff, this memo provides a summary of work completed to date, along with the findings. The parking study included the downtown area of San Pedro, generally bounded by 5'h Street to the north, 8th Street to the south, Pacific Avenue to the west and Harbor Boulevard to the east, along with an additional area south of 8th Street.

Parking Survey lteris, Inc. assisted CRA/lA develop parking surveys for completion by employees and customers/visitors. After the surveys were returned, lteris summarized the surveys in tabular format. The surveys generally showed:

Customers/Visitors:

• Most surveys appeared to be from people in the area for events at Warner Grand, few from customers of local businesses and restaurants.

• 98% drove to the area, rather than taking public transit, biking or walking.

• 56% utilized on-street parking, and 22% used surface lots.

• A large majority (84%) were in the area for two or more hours.

• Only 15% said the parking was very convenient, 50% said parking was not very convenient.

• The survey asked about the price of parking, and if the price were $0.50 or $1.00 per hour, would the price influence their choice to come to Downtown San Pedro. At $0.50 per hour, 62% said it would not or somewhat influence their choice to visit. At $1.00 per hour, only 46% said it would not or somewhat influence their choice.

• Remembering that most responses were from Warner Grand visitors, there were many comments about having more convenient parking near the theater and for special events. Several comments noted the lack of handicap parking spaces; many others noted broken parking meters. There were several comments recommending a multi-level parking structure in the downtown area to provide convenient parking.

• Only 13 employee surveys were obtained, thus they may not represent a cross-section of employees.

• 87% of employees said they drove to downtown and 7% each said they took transit or walked/biked to downtown.

• 83% parked in private lots, 17% parked in surface lots.

• 83% did not pay for parking, probably those who use private lots. The 17% that parked in surface lots did not state how they paid for parking or the amount they paid.

• No employees said parking was not very convenient, while 77% said parking was very convenient.

• 73% of employees would not be willing to park outside the downtown area and use a shuttle to their worksite.

Parking Inventory

The number of parking spaces in and near the study area were inventoried. This inventory identified:

• 1,932 private parking spaces

• 433 spaces in City metered lots

• On-street parking consisting of 448 metered curbside spaces, and 479 unmetered, curbside spaces.

Parking Utilization and Duration

Parking utilization and duration surveys were conducted during a weekday and a Saturday. Due to construction occurring in the area at that time, not all blocks were counted. The occupancy surveys noted the number of parking spaces that were occupied each hour, The duration surveys noted license plates, to determine the length of time that the vehicles were parked in a particular parking spot.

The Data showed:

Weekday on-street parking occupancy reached a maximum overall occupancy of 57% at 1:00PM. The parking was about 50% occupied during the day, and dropped at 5:00 PM to approximately 31% occupancy, which is typical for an area with offices and business that are generally busy during the day. There was a slight increase in occupancy in the early evening during the time restaurants would be busy with dinner service. The maximum of 57% occupancy indicated that during a typical weekday, on-street parking is generally available. The blocks with highest occupancy were, as expected, in the blocks between 5th Street and 7'h Street.

The weekend on-street occupancy counts were conducted during a Saturday. This data showed a fairly consistent occupancy of 40% during the day, with a slight peak at noon. Occupancy later grew to approximately just over 50% in the evening; this is when restaurants would be busiest on a weekend. Note

Page 12 that there were no events at the Warner Grand when these counts were taken. Occupancy was highest in the blocks between 5'h Street and 7'h Street.

Weekend occupancy counts were also obtained at five off-street public lots that had a total of 244 parking spaces. Similar to on-street results, parking occupancy was highest in the evening, beginning at 7:00 PM. Parking averaged approximately 30% occupancy during the day, and up to 60% in the evening.

The weekend analysis shows that parking is generally available in the downtown San Pedro area.

Parking duration surveys were collected during a Saturday, and included areas that had parking meters, and other areas that did not have parking meters. Data was calculated showing the length of stay in a particular parking space.

Parking spaces on streets that had parking meters showed the following:

• 6'h Street from Pacific to Mesa (2-hour meters)

North Side: 64% 1-hour, 19% 2-hours South Side: 56% 1-hour, 27% 2-hours 11 vehicles parked 4 or more hours

• 6'h Street from Mesa to Centre (2-hour meters)

North Side: 56% 1-hour, 25% 2-hours South Side: 62% 1-hour, 25% 2-hours 10 vehicles parked 4 or more hours

Parking spaces on streets that did not have parking meters showed the following:

• g'h Street from Gaffey to Grand (no meters)

North Side: 17% 1-hour, 15% 2-hours South Side: 52% 1-hour, 6% 2-hours 28 cars parked 5 or more hours

• g'h Street from Grand to Pacific (no meters)

North Side: 63% 1-hour, 22% 2-hours South Side: 65% 1-hour, 13% 2-hours 1 car parked 5 or more hours

The data shows that in areas with parking meters, some spaces are occupied for longer than the two-hour limit, which limits use by new visitors to the area. Previous studies have shown that when on-street meters are being used for extended time periods, they are usually being used by local employees.

Current and Future Parking Needs lteris began work on creating the inventory of land uses for each block within the study area. Data was provided by CRA staff, and additional work was needed to determine the number of bedrooms for residential units, since parking is generally related to the number of bedrooms.

The next step would be to calculate theoretical parking rates based on City code, and compare to the actual parking demand, which is obtained from the parking surveys. This is used to validate the model, which then will take into account some of the shared parking uses currently occurring in the study area.

Due to the project being place on hold, full parking occupancy surveys were not completed in June 2010. Thus, the parking model has not been fully completed.

Once the parking model is complete, future parking needs would be calculated using proposed land use changes. These new land uses would be input into the model, and additional parking needs would be identified. This information can then be used to help develop parking management strategies and implementation plans.
