When CDs became publicly available in 1982,2 the music industry experienced an un- precedented boost in sales as consumers, en masse, traded in their vinyl records and cassette tapes for sleek new compact discs.3 However, the intro- duction of MP3 players and digital music files had the opposite effect and the recording industry has struggled to monetize and profit from the digital revolution.4 The birth of the file sharing website Napster5 in 1999 was the start of a sharp downhill turn for record labels and artists.6 Rather than pay * J.D. ERA’s exclusive Entertainment Chart combines sales of music, video and games to provide a definitive ranking of the UK’s most successful entertainment products. Star Wars: The Force Awakens leads a Top 40 for the first half of 2016 dominated by video, accounting for 19 of the 40, followed by music albums (12) and games (nine). The seventh episode in the Star Wars franchise sold 1,818,949 DVDs and Blu-ray discs between January and June, more than 20% ahead of second-placed Bond movie Spectre and with more than double the number of sales of third-placed Now That’s What I Call Music 93. In total the Top 40 most popular entertainment titles sold 15.8m units. Overall games accounted for 16.6% of the unit sales of the Top 40 titles and music accounted for 25.2%, while video sales accounted for 58.2% of the total. The top six titles and nine of the Top 10 were titles released in 2016, although in what was a quiet first half for major music releases eight of the 12 best-selling music titles were released in 2015 or in the case of David Bowie’s Best of Bowie as long ago as 2008.

RONNIE ABRAMS, United States District Judge: Plaintiff Structured Asset Sales, LLC, as a beneficial owner of the copyright to the 1973 hit song “Let’s Get It On,” brings this action against Defendants Edward Christopher Sheeran, Atlantic Recording Corporation, BDi Music Ltd., Bucks Music Group Ltd, The Royalty Network, Inc., David Platz Music (USA) Inc., Amy Wadge, Jake Gosling, Mark “Spike” Stent, Chewietours LP, and Messina Touring Group, LLC (collectively, the “Sheeran Defendants”), principally alleging that the release and commercial exploitation of a substantially similar song, 2014’s “Thinking Out Loud,” violates its rights under federal copyright law. Plaintiff also alleges that the failure of Defendants Sony Corporation of America, Sony/ATV Music Publishing, EMI Music Publication, and Stone Diamond Music Corporation (collectively, the “Sony Defendants”) to adequately protect its copyright constitutes a breach of administration and songwriting agreements to which it claims to be a third-party beneficiary.
