    COMPLAINT: COVERAGE BY “TODAY”, SINCE THE WILSON REPORT, OF THE CASE FOR THE UK TO WITHDRAW FROM THE EU. BACKGROUND The 2005 Wilson Report into the BBC’s coverage of EU affairs was the Corporation’s first published independent analysis of its output. Its committee of inquiry was chaired by Lord Wilson of Dinton, formerly Cabinet Secretary and Head of the Civil Service. This complaint is that the BBC has not delivered the improvements it promised in its response to that report, of its coverage of EU affairs. This applies particularly to the debate about the UK’s withdrawal from the EU. The Wilson Report was published in January 2005. It was critical of parts of the relevant output. It said: …we do think there is a serious problem. Although the BBC wishes to be impartial in its news coverage of the EU it is not succeeding. Whatever the intention, nobody thinks the outcome is impartial. There is strong disagreement about the net balance but all parties show remarkable unity in identifying the elements of the problem. Sometimes being attacked from all sides is a sign that an organisation is getting it right. That is not so here. It is a sign that the BBC is getting it wrong, and our main conclusion is that urgent action is required to put this right. The problem can be summarised under a number of headings which we analyse below.1 Institutional mindset. Giving the audience the information it needs to make up its own mind is a proper and important role for the BBC and one which it must carry out.

These new rights are similar to the ancillary copyright for press publishers already introduced in Germany and Spain. Neighbouring rights give publishers additional protection, entitling them to receive remuneration in the form of royalties from online services (such as search engines and news aggregators) that, for example, display snippets of news in search results. New neighbouring rights at EU level may provide additional revenue for publishers, but raise many concerns. What would the implications be for other economic actors, such as creators, small publishers, online services and users? What is the added value of the new rights over existing copyright frameworks? How can the balance best be struck between the various stakeholders' interests? How to ensure that copyright exceptions are invoked given the significant disparities between member states' provisions? While copyright is an important tool to encourage investment in the creative industries, strong evidence of a market failure is required to justify the introduction of a new right or related right provision.

It is not by chance that all BBC staff carry an identity card which proclaims as the first of the BBC’s values that they are independent, impartial and honest. Nor was it by chance that, when the BBC’s public purposes were defined in the Corporation’s new Royal Charter, the first of them was ‘sustaining citizenship and civil society’. The reach of the BBC’s services, the trust which the public places in them and the tradition of impartiality in the culture of the organisation are the keys to ensuring that the BBC delivers in this, the most important of its responsibilities. The BBC Trust is ultimately responsible to licence fee payers for ensuring that the BBC remains impartial. It will continue to monitor BBC impartiality and to be the final court of appeal in complaints about impartiality and accuracy. But this Report is different from previous subject-based reports on impartiality commissioned by the BBC Governors. Stemming from the 2005 Goodman Media Lecture by the then BBC Chairman, Michael Grade, its purpose is to consider the BBC’s impartiality at a time of great changes in the broadcasting environment and in British society more generally. It has been charged with two tasks: to ‘define a set of principles of impartiality in a forward-looking way’, and to ‘identify a list of broad implications for the BBC’.
