A country is considered a state when two major powers recognize it. Major powers are those countries that have a veto power on the Security Council: China, France, USSR/Russia, United Kingdom and the United States. Questionnaire Liberia Foreword by Researcher I deemed it practical to give a short introduction on the Liberian Judicial System as well as its constitutional framework by pointing out a few historical, structural and legal specialities. Due to its historical background1, political and military disruptions and years of civil war, the formal Liberian justice system is markedly weak. The discrepancy between the law on the books and the law in action is probably more distinct than in many other countries of West-Africa (especially Ghana and Nigeria), as the formal judicial system earns only a minimum of trust amongst the population of Liberia. A study by the United States Peace Institute2 revealed that in civil disputes of a total of 3181 cases, 59% are not taken to any forum for resolving the issue, 38% of the cases are taken to the informal /customary forum and only 3% of the civil disputes (2% of criminal disputes) are taken to the formal judicial forum of Magistrate Courts at the lowest instance. According to the International Development Law Organisation3, out of 320 Magistrate Judges, 30 can offer some kind of judicial training. Financial shortages make it extremely difficult to train judicial officers. The Judicial Training Institute (JTI) of Liberia explained that almost the entire salaries of the judiciary are paid by external donors (in the past mainly by the American Bar Association). The JTI was to a large extend financed by the GIZ, whose Programme in Liberia was terminated at the end of 2013. Most stakeholders are aware that revision and reform processes need to be expedited but they are still moving rather moderately. -
Political Parties in West Africa: the Challenge of Democratization in Fragile States
Strong and sustainable democracy is dependent on the existence of well-functioning political parties, which are crucial actors in bringing together diverse interests, recruiting and presenting candidates, and developing competing policy proposals that provide people with a choice. In a democracy there is no substitute for open competition between political parties in elections. Throughout the world, however, political parties find themselves in crisis, unpopular and increasingly distrusted. In Africa, they face challenges similar to those faced elsewhere, further exacerbated by diverse and complex political and developmental challenges. International IDEA’s series of reports on political parties in Africa is based on research and dialogue with political parties in thirty African countries. The series is expected to address a serious gap in existing knowledge regarding the external political party regulatory environment; party structures and internal organization; and policy and programmes development. The reports provide a unique overview of the challenges to and opportunities for strengthening political parties and party systems within the framework of democratic consolidation and development. Opinions of contributors to the Journal do not necessarily reflect the policy of the organizations they represent or the Liberian Studies Association, publishers of the Journal. Manuscript Requirements Manuscripts submitted for publication should not exceed 25 typewritten, double -spaced pages, with margins of one - and-a -half inches. The page limit includes graphs, references, tables and appendices. Authors may, in addition to their manuscripts, submit a computer disk of their work with information about the word processing program used, i.e., WordPerfect, Microsoft Word, etc. Notes and references should be placed at the end of the text with headings (e.g. Notes; References). Notes, if any, should precede the references. The Journal is published in June and December. Deadline for the first issue is February, and for the second, August. Manuscripts should include a title page that provides the title of the text, author's name, address, phone number, and affiliation. All research work will be reviewed by anonymous referees. Manuscripts are accepted in English and French. Manuscripts must conform to the editorial style of the latest edition of A Manual of Style (University of Chicago Press). -
