The activities and presentations of the President in this regard during the previous year and related problems were all demonstrated. The controversies regarding the presidential initiative were di- vided into legal and political. Legal one is the regulation of the institution of referendum in the Constitution of 1997, the political ones result from the opinion and concepts of parties and citizens about the constitution and referendum in its case. Keywords: change of constitution, president, referendum, political science INTRODUCTION During the last year, from 3 May 2017 to 3 May 2018, we witnessed the, still incomplete, process of President Andrzej Duda’s activities regarding the referendum on the amendment to the Constitution of the Republic of Poland. The aim of the article is to present and assess the President’s activities in this area, and also to demonstrate the reactions to the President’s initiative. The research question is the justification, meaningfulness and effectiveness of the presidential initiative; the research hypothesis is the claim that the President’s actions are odd and irrational (pointless). -

Address by President of the Republic of Poland Mr Andrzej Duda on the occasion of the New Year`s meeting with the Diplomatic Corps Presidential Palace, 14 January 2019 Your Excellency, Most Reverend Sir, Dean of the Diplomatic Corps, Your Excellencies, the Ambassadors, Honourable Marshal, Honourable Prime Ministers, Excellencies, Most Reverend Bishops, Honourable Ministers, Madam Justice of the Constitutional Court, Generals, Distinguished Guests, Ladies and Gentlemen, It is my great pleasure to welcome you to our fourth joint New Year`s meeting. 2018 is over, a year rich in numerous events, out of which the most significant, truly momentous ones for us, were undoubtedly the celebrations of the centenary of regaining independence. I wish to thank you warmly for making our jubilee visible also in your home countries; it was often an occasion for grand festivities and joy. Last year we commenced our 2-year-long, non-permanent membership of the United Nations Security Council, whereas in Katowice we presided over the session of the 24th Conference of the Parties to the United Nations Framework Convention on Climate Change. Its successful outcome was reflected in the adoption of the so called Katowice Rulebook, which was possible thanks to the readiness for compromise demonstrated by all parties participating in the negotiations. I would like to thank your countries for cooperation and for expressing acknowledgment of our good and effective organization of the Katowice conference. The year 2018 was marked, once again, by high level of my international activity. Throughout the whole year I paid 26 foreign visits, and met with more than 20 international leaders who visited Poland. -

ROMANIAN JOURNAL OF EUROPEAN AFFAIRS Vol. 19, No. 2, December 2019 Common Interests and the Most Important Areas of Political Cooperation between Poland and Romania in the Context of the European Union Justyna Łapaj-Kucharska1 Abstract: The article addresses several issues that constitute the main areas of Polish-Romanian relations in the 21st century in the political dimension and in the broad sense of security. Relations between Poland and Romania have been characterized in the context of the membership of both countries in the European Union. Particular emphasis was placed on the period of the Romanian Presidency of the Council of EU, which lasted from January to the end of June 2019. The article indicates the most important common interests of both countries, the ways for their implementation, as well as potential opportunities for the development of bilateral and multilateral cooperation. The article also takes into account the key challenges that Poland and Romania must face in connection with EU membership. Introduction Polish-Romanian relations were particularly close in 1921-1939, when Romania was the only neighbour, apart from Latvia, who was Poland's ally. -

Firstly, the presidential summit of the Visegrad group organised by Slovakia, which is currently holding the reins of the regional platform. There, many themes were on the agenda. The leaders’ emphasis had been on the attitude towards the EU and migration, but also other issues gained the summit’s attention. For instance, the presidents talked about the economy, energy sector, and technological development. The summit of the Visegrad group did not bring any surprising or radical breakthrough. Rather it was a manifestation of continuity. Then, it is worth mentioning that Slovak Prime Minister Peter Pellegrini paid a visit to the summit of the European Council in Brussels, followed by the Asia-Europe Meeting (ASEM). Regarding the summit of the European Council, the states’ representatives focused on migration and internal security. Additionally, relations with Britain and Brexit were on the summit’s platter. Not surprisingly, the meeting did not conclude with any breakthrough or significant progress on the discussed issues. Besides events, the Slovak military intelligence exposed a cyber-attack on the computers of the Slovak Ministry of Foreign Affairs. Even though the authorities have not been able to point to any certain perpetrators, it is said the attack had come somewhere from abroad.1 Thus, it can be expected that cyber security will play an increasingly important role. -

President Duda stressed that they shared nearly the same opinions on all issues. "We are in agreement regarding our needs and outlook on the future, regarding the needs of our countries and regarding what we can expect as far as the situation in Europe is concerned," the Polish president said. According to the Slovak president, neighbours and politicians should meet to discuss the current political situation in the two countries, in Europe and worldwide. "I am convinced that the exchange of views leads to a situation in which we can draw conclusions making our relations better than now," he stressed. President Kiska added that he and Duda agreed that it was necessary to improve transport connections between Poland and Slovakia, including road and railway routes. "(...) the point is to consolidate contacts between people (...), there is tourism and business, more ties between our countries are needed," the Polish president said, adding that he was also thinking about common energy security. The Polish head of state stressed that his meeting with President Kiska was extremely significant with a view to the presidency of the EU, to be taken by Slovakia, and of the Visegrad Group, to be assumed by Poland. -

ideaForum Where the law ends The collapse of the rule of law in Poland – and what to do “Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law.” (Article 47, EU Charter on Fundamental Rights) Berlin – Warsaw 29 May 2018 ii Executive Summary No member state of the EU has ever gone as far in subjugating its courts to executive control as the current Polish government has done. The Polish case is a test whether it is possible to create a Soviet-style justice system, where the control of courts, prosecutors and judges lies with the executive and a single party, in an EU member state. In December 2017 the Commission proposed to the EU Council to determine that there was “a clear risk of a serious breach by the Republic of Poland of the rule of law.” It warned that in Poland the constitutionality of laws “can no longer be verified and guaranteed by an independent constitutional tribunal.” It expressed “grave concerns” over the lack of independent courts. In March 2018 an Irish High Court judge noted a “deliberate, calculated and provocative legislative dismantling by Poland of the independence of the judiciary, a key component of the rule of law.” She argued, in an extradition case involving a Polish suspect, that “the rule of law in Poland has been systematically damaged by the cumulative impact of all the legislative changes that have taken place over the last two years.” Things are about to get even worse. -

Mr Mateusz Morawiecki, Prime Minister of the Republic of Poland 8 June 2020 Excellencies, On 19 March 2020 the Bar Council of England and Wales (Bar Council) and the Bar Human Rights Committee of England and Wales (BHRC) wrote to you to express grave concern as to the motion filed by the National Prosecution Office to the Disciplinary Chamber of the Supreme Court (Disciplinary Chamber) to waive the immunity of Judge Igor Tuleya. We called upon the relevant Polish authorities to respect their obligations under the Polish Constitution, the European Convention on Human Rights, and European Union law; to comply with the judgment of the Supreme Court of 5 December 2019; to respect the resolution of the Polish Supreme Court of 23 January 2020; to refrain from actions and statements attacking and vilifying judges and prosecutors; and to take all necessary measures to suspend the operation of the Disciplinary Chamber and end the politicisation of the new National Council of the Judiciary. We called for the arbitrary motion against Judge Igor Tuleya to be withdrawn without delay. We understand that there is to be a hearing of the motion on 9 June 2020. Since 19 March there have been important developments. On 8 April 2020 the Court of Justice of European Union specified in Case C-791/19 R (Commission v Poland) that Poland must immediately suspend the application of the national provisions on the powers of the Disciplinary Chamber of the Supreme Court with regard to disciplinary cases concerning judges. -

Award statement 27.09.2018 THE RAFTO PRIZE 2018 IS AWARDED TO THE POLISH LAWYER ADAM BODNAR AND THE INSTITUTION HE LEADS, THE OFFICE OF THE COMMISSIONER FOR HUMAN RIGHTS, FOR THE IMPORTANT STANCE TAKEN IN THE FACE OF CURRENT POLITICAL DEVELOPMENTS IN POLAND. - Defender of minority rights and judicial independence in Poland A key function of the Ombudsman, the Commissioner for Human Rights, is to ensure that the public authorities secure and respect the human rights of all members of Polish society. As Commissioner, Adam Bodnar has highlighted the crucial role played by independent Ombudsman institutions in safeguarding human rights in Poland - and other countries - where such actors and institutions come under attack. To guarantee fundamental human rights for all, it is necessary to maintain the independence of the judiciary, a free press, and an active civil society. Protection of the interests of minorities is a significant democratic value. Democracy is fragile when it is reduced to the will of the majority and when human rights, minority rights and the rule of law are undermined. Since Law and Justice (PiS) won the Polish election in October 2015, the party has used its majority in the National Parliament to adopt legislation that reduces the independence of the courts and centralizes state powers. New laws grant the government control of state media and place severe limits on freedom of information and political lobbying. The rights of vulnerable groups have been repeatedly ignored. In this situation, the Commissioner for Human Rights is an important defender of judicial independence and minority rights. As an independent ombudsman, Adam Bodnar stands out as an advocate of democracy, a defender of minorities and fundamental human rights. -

It has changed from a communist state in the Soviet sphere of influence to an autonomic prosperous democracy and proud member of the EU. Paradoxically, since 2015, Poland seems to be heading rapidly in the opposite direction. It was the Polish Solidarity movement that started the peaceful revolution that subsequently triggered important democratic changes on a worldwide scale, including the demolition of the Berlin Wall, the collapse of Communism and the end of Cold War. Fighting for freedom and independence is an important part of Polish national identity, sealed with the blood of generations dying in numerous uprisings. However, participation in the democratic process is curiously limited in Poland. The right-wing, populist Law and Justice Party (PiS) won elections in Poland in 2015. Since then, Poles have given up more and more freedoms in exchange for promises of protection from different imaginary enemies, including Muslim refugees and the gay and lesbian community. More and more social groups are being marginalized and deprived of their civil rights. The COVID-19 pandemic has given the ruling party a reason to further limit the right of assembly and protest. Polish society is sinking into deeper and deeper divisions. -
Poland 2017 International Religious Freedom Report
POLAND 2017 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution provides for freedom of religion and states that religion is a personal choice, and all churches and religious organizations have equal rights. An agreement with the Holy See determines relations with the Roman Catholic Church and grants it privileges not accorded to other religious groups. Statutes adopted because of agreements between the government and other churches and religious organizations determine relations with those groups. The criminal code prohibits public speech offensive to religious sentiment. The Supreme Administrative Court dismissed an appeal that, if successful, would have led to the deregistering of the Union of Progressive Jewish Communities in Poland. The government made a final determination on 60 communal property restitution cases involving claims by religious communities during the year, out of approximately 3,600 outstanding. The leader of the governing Law and Justice Party (PiS) met with Jewish groups after they wrote to him expressing concerns over growing anti-Semitism. Parliament asked the interior minister to respond after Muslim groups wrote to the speaker of the lower house asking him to protect the Muslim minority. The interior minister ordered an investigation after Holocaust survivor groups discovered that a 1999 video of naked people laughing and playing tag in a concentration camp gas chamber had been filmed in the former Nazi Stutthof concentration camp. PiS members made statements against Muslim migrants, and one party parliamentarian tweeted an anti-Semitic comment. The PiS leader denounced anti-Semitism, and President Andrzej Duda said the country had a duty to speak out about the extermination of its Jewish population by the Nazis during WWII.
