PROCEDURE FOR FULL COUNCIL BRIEFING

PRINCIPLES

The full council briefing which occurs a week prior to the Council meeting provides an opportunity for elected members to ask questions and clarify issues relevant to the specific agenda items before council. The briefing is not a decision-making forum and the Council has no power to make decisions. The briefing session will not be used, except in an emergency, as a venue or forum through which to invoke the requirements of the Local Government Act 1995 and call a special meeting of council.

In order to ensure full transparency the meetings will be open to the public to observe the process. Where matters are of a confidential nature, they will be deferred to the conclusion of the briefing and at that point the briefing session closed to the public. The reports provided are the officers’ professional opinions. While it is acknowledged that members may raise issues that have not been considered in the formulation of the report and recommendation, it is a basic principle that as part of the briefing sessions elected members cannot direct officers to change their reports or recommendations.

PROCESS

The briefing session will commence at 7.00 pm every third Tuesday. It will be chaired by the Mayor or in his/her absence the deputy mayor. In the absence of both, councillors will elect a chairperson from amongst those present. In general, Standing Orders will apply, EXCEPT THAT members may speak more than once on any item, there is no moving or seconding items, officers will address the members and the order of business will be as follows:-

Members of the public present may observe the process and there is an opportunity at the conclusion of the briefing for a public question time where members may ask questions (no statements) relating only to the business on the agenda.

Where an interest is involved in relation to an item, the same procedure which applies to Full Council meetings will apply. It is a breach of the City’s Code of Conduct for an interest to not be declared. The briefing will consider items on the agenda only and proceed to deal with each item as they appear. The process will be for the mayor to call each item number in sequence and ask for questions.

AGENDA CONTENTS

While every endeavour is made to ensure that all items to be presented to Council at the formal council meeting are included in the briefing papers, it should be noted that there will be occasions when, due to necessity, items will not be ready in time for the briefing session and will go straight to the Full Council agenda as a matter for decision. Further, there will be occasions when items are TABLED at the briefing rather than the full report being provided in advance. In these instances, staff will endeavour to include the item on the agenda as a late item, noting that a report will be tabled at the agenda briefing session.

AGENDA DISTRIBUTION

The briefing agenda will be distributed to elected members on the FRIDAY prior to the briefing session. Copies will be made available to the libraries and the Internet for interested members of the public. Spare briefing papers will be available at the briefing session for interested members of the public.

DEPUTATIONS

Deputations will generally not be heard prior to the agenda briefing session. These will be reserved for either the Policy forum sessions held the week following the Full Council meeting or as is currently the case, prior to the Full Council meeting.

RECORD OF BRIEFING

The formal record of the briefing session will be limited to notes regarding any agreed action to be taken by staff or elected members. No recommendations will be included and the notes will be retained for reference and not generally distributed to elected members or the public except on request.

LOCATION

The briefing session will take place in the Council Chamber in the new Civic Centre.

Recording of Council Meetings Policy

Objective

 To ensure that there is a process in place to outline access to the recorded proceedings of Council.

 To emphasise that the reason for tape recording of Council Meetings is to ensure the accuracy of Council Meetings.

Statement

Recoding of Proceedings

(1) Proceedings for meetings of the Council, of electors and of the Audit Committee shall be recorded, by the City, on sound recording equipment except, in the case of meetings of the Council or the Audit Committee, where the Council or the Committee, as the case may be, closes the meeting to the public.

(2) Notwithstanding sub clause (1), proceedings of a meeting of the Council or of the Audit Committee which is closed to the public shall be recorded where the Council or the Audit Committee, as the case requires, resolves to do so.

(3) No member of the public is to use any electronic, visual or vocal recording device or instrument to record the proceedings of the Council or a committee without the written permission of the Council.

Access to Recorded Tapes

(4) Members of the public may purchase a copy of the taped proceedings or alternatively listen to recorded proceedings with the supervision of a City Officer.

(5) Elected Members may listen to a recording of the Council proceedings upon request, free of charge. However, no transcript will be produced without the approval of the Chief Executive Officer.

(6) Costs of providing taped proceedings to members of the public will be the cost of the tape plus staff time to make the copy of the proceedings. The cost of supervised listening to recordings will be the cost of the staff time. The cost of staff time will be set in the City’s schedule of fees and charges each year.

Retention of Tapes

(7) Recordings pertaining to the proceedings of Council Meetings shall be retained in accordance with the Library Board of Western Australia Act (1951-83), General Disposal Authority for Local Government Records. The current requirement for the retention of recorded proceedings is thirty (30) years.

Disclosure of Policy

To consider the compulsory acquisition of land for the alignment of Hepburn Avenue and public open space where negotiations for the purchase of the land have not been successful.

Background

All of the land required for the construction of Hepburn Avenue between its present termination near Giralt Road, Marangaroo eastwards to , Alexander Heights has been acquired, except for two sections near Rangeview Road.

The two sections are in Lots 88 and 89 Goldsworthy Entrance (refer Attachment 1). These properties fall within the area of the Berkley Road Local Structure Plan (refer Attachment 2).

The owner of Lot 88, Mr. Giuseppe Ricciardo resides in Italy. The City has made several attempts to purchase the road alignment since November 1998, and has made offers based on qualified valuation advice on three occasions. Mr. Ricciardo has declined to accept any of these offers and continues to press for a price that valuation advice does not substantiate.

Lot 89 is owned by N and C M Crosara who reside in Perth. They have failed to respond to the two approaches made by the City since March 2000.

Detail

The area required for the Hepburn Avenue alignment from Lot 88 is 4900 square metres and from Lot 89 it is 4840 square metres, subject to survey. The alignment is 60 metres wide and is located along the northern boundary of the lots.

In addition to the road alignment, each property is to set aside an area of public open space for acquisition by the City. The Lot 88 public open space is 9550 square metres and the Lot 89 public open space area is 9230 square metres. Both of these areas are again subject to survey.

The acquisition of the public open space from Lots 88 and 89 is not critical at this time. It is however desirable to purchase the land at this time as it forms part of the major open space area planned for the Berkley Road precinct. This precinct has been developed to 87 per cent of its capacity, with the creation of 934 residential lots. Acquisition of the open space at the same time as the Hepburn Avenue road reserve will also reduce overall acquisition costs and save the City from the possibility of needing to separately acquire the land in the future. The City has offered to purchase the public open space along with the road alignment in each of its communications with the property owners.

The road alignment and public open space required from each of Lots 88 and 89 is shown on Attachment 3. A residual area will remain in each lot that will be available to the owners for subdivision. Each of these areas has the potential for 8 or 9 new residential lots and an internal road to service them.

Comment

The acquisition and construction of Hepburn Avenue and and the provision of integrated drainage and public open space sites were major goals of the Berkley Road Local Structure Plan, which was adopted by Council in 1992.

All of the Mirrabooka Avenue alignment within the structure plan area has been acquired and one carriageway has been constructed to link up with Maranagroo Drive in the south. Acquisition of the remaining two sections of the Hepburn Avenue alignment and the two sections of public open space will complete the land requirements of the plan. Construction of Hepburn Avenue can then be undertaken to provide for the efficient movement of through traffic between Wanneroo Road and Alexander Drive, and the public open space can be developed for the enjoyment of the residents of the locality. The portion of Hepburn Avenue between Giralt Road and Mirrabooka Avenue is scheduled for construction by October 2002. It is planned to construct the remaining portion between Mirrabooka Avenue and Alexander Drive in the 2002/3 financial year subject to budget consideration.

Statutory Compliance

Section 161 of the Land Administration Act 1997, provides that whenever a local government is to undertake or provide a public work any interest held by a person in land that is required for that work may be taken. Section 170 sets out the procedures that are to be followed when land is taken without the agreement of the owners and Part 10 of the Act deals with the entitlement to, and assessment and payment of compensation.

The definition of roads and recreation areas as public works is contained in the Land Acquisition and Public Works Act 1902.

The taking of the land under the above Acts is exempt from the land transaction provisions of the Local Government Act 1995.

The acquisition of the Hepburn Avenue alignment is to be funded jointly by the Berkley Road Local Structure Plan Overdraft Account and the East Wanneroo Cell No. 5 Overdraft Account in the proportions of 27 per cent and 73 per cent respectively. The acquisition of the public open space is to be funded wholly by the Berkley Road account. There will not be any draw on the City’s municipal fund.

The funds in each account are raised by the levying of an infrastructure cost per lot against each new lot that is produced by subdivision within the Berkley Road Local Structure Plan Area and East Wanneroo Cell No. 5.

Both the Berkley Road and Cell 5 overdraft accounts contain sufficient funds to meet their respective proportions of the total anticipated compensation claims from the property owners.

Voting Requirements

Simple Majority.

Recommendation

That Council AUTHORISES procedures being commenced for the taking of land without the agreement of the owners under the provisions of the Land Administration Act 1997, in respect to the following:

1. The alignment of Hepburn Avenue and the land identified as public open space within Lot 88 Goldsworthy Entrance, Alexander Heights on the Berkley Road Local Structure Plan; and

2. The alignment of Hepburn Avenue and the land identified as public open space within Lot 89 Goldsworthy Entrance, Alexander Heights on the Berkley Road Local Structure Plan.

2. Close of Advertising for Amendment No. 1 to District Planning Scheme No. 2: Modification to Special Rural Zone No. 17

Background

At its meeting of 14 August 2001 (item W321-08/01), Council considered an application seeking Special Rural zoning of Lot 23 Badgerup Road, Gnangara. The location of Lot 23 is shown on Attachment 1. Council resolved to support the application, but rather than create a new Special Rural zone for Lot 23, it was considered preferable to include Lot 23 within existing Special Rural Zone 17 which adjoins Lot 23 to its north. This would facilitate some minor modifications to Special Rural Zone 17 (relating to building envelope locations and sizes, and making the Development Guide Plan accord with the as constructed and surveyed subdivision) which Council had previously resolved to make.

The proposed new Development Guide Plan referred to above, is shown in Attachment 2.

Detail

Following referral of the proposed Amendment to the EPA, the Department of Environmental Protection (DEP) has advised that the proposal did not require formal Environmental Review, however it has identified a number of environmental issues upon which it has provided advice. The issues related to those which had previously been identified by the EPA in relation to the creation of Special Rural Zone 17, vegetation, site contamination and groundwater. The EPA noted that these issues are satisfactorily addressed by the proposed Special Provisions associated with this Special Rural Zone.

The WA Planning Commission (WAPC), subsequently consented for the amendment to be advertised for a period of 42 days, subject to the amendment being modified prior to submission of the documents for final approval to include the adjacent portion of Badgerup Road reserve in the Special Rural zone.

Consultation

The amendment was advertised for a period of 42 days, concluding on 29 January 2002. The proposal was advertised in accordance with normal requirements, including advertisements being placed in the West Australian and Wanneroo Times newspapers.

Comment

At the conclusion of advertising, one submission on the proposed amendment was received from Western Power. The submission indicated it has no objection to the proposal, and includes advice (which has been conveyed to the applicant) regarding its requirements regarding consultation prior to excavation and Work Safe requirements.

Statutory Compliance

The advertising process has been undertaken in accordance with the requirements of the Town Planning Regulations.

Recommendation

That Council:-

1. Pursuant to Town Planning Regulation 17 (2) MODIFIES Amendment No. 1 to City of Wanneroo District Planning Scheme No. 2 to include within Special Rural Zone 17 the adjacent portion of the Badgerup Road reserve, and ADOPTS Amendment No. 1, as modified to :

a) make the following changes to the Special Provisions relating to Special Rural Zone 17 contained in Schedule 13 of the Scheme:

i) include Lot 23 Badgerup Road, Gnangara in the Description of Locality for that zone;

ii) change the building envelope figure in Special Provision No. 5 from 1,200m² to 1,600m²;

iii) include the following new Special Provision No. 12):

"12) The following additional provisions apply to Lot 23 Badgerup Road:

a) Prior to applying for subdivision approval, the subdivider shall prepare and implement to the satisfaction of the Council a Revegetation Plan for Lot 23. Subsequent owners of the subdivided lots shall maintain the vegetation planted to the satisfaction of the Council.

b) The subdivider shall establish all firebreaks required around all proposed lots to be created to the satisfaction of the Council."

b) modify the Development Guide Plan for Special Rural Zone No. 17 to:

i) include Lot 23 Badgerup Road and the proposals for that lot shown on Attachment No. 2 to this report.

ii) reflect the new subdivision pattern which has now been created over former Lots 24-28 Badgerup Road, and the new building envelope locations which were endorsed by Council at its meeting of 12 June 2001;

2. Pursuant to Town Planning Regulations 22 and 25. (l) (g), AUTHORISES the affixing of the common seal to, and endorses the signing of, the amendment documentation.

3. NOTES the submission made by Western Power.

4. REQUIRES that the legal agreement required with the applicant pursuant to Council’s resolution of 14 August 2001 be in place prior to forwarding of the amendment documents to the WA Planning Commission.

PAW Closures

3. Closure of Pedestrian Access Way between Newman Road And Smith Reserve, Yanchep

Council is required to pass a resolution to achieve the permanent closure of a pedestrian access way.

Background

Construction of a footpath from Wilkie Avenue to Newman Road, Yanchep was listed for budget consideration in January 1997 by officers of the former City of Wanneroo. Since the split of the former City, officers from the new City investigated all outstanding footpath requests and as a consequence, listed $5,000 for the footpath construction in the Capital Works Budget for 2000/2001.

A Pedestrian Access Way (PAW) exists adjacent to an existing area of public open space (POS) which fronts Wilkie Avenue (refer Attachment 1). Both the PAW and the POS are very steep and are currently covered in native vegetation. There is also a very old bitumen footpath, from Newman Road, that connects into sandy tracks within the POS. It is considered however, that the terrain is too steep to continue the footpath through the POS to connect to Wilkie Avenue.

On 1 May 2001, Council considered a report which outlined this background and suggested that on the grounds of safety, the proposed footpath not be constructed and that the PAW be formally closed (item W148-05/01 refers). After considering the report Council resolved, amongst other things, to authorise the Director, Planning and Development to commence the process of closing the PAW.

Detail

Closure of PAW’s are subject to the provisions of s52 of the Land Administration Act 1997. Under this section, Council is required to give to the Minister for Lands confirmation that it has resolved to close the PAW. It is also required to advise adjoining owners, the relevant public utilities and give statewide public notice of the proposed closure and provide copies of any submissions received to the Minister for Lands with Council’s comments on those submissions.

Consultation

The City has complied with the public notification provisions of the Land Administration Act and there were no submissions received. None of the public utilities or the Department for Planning and Infrastructure has any objection to the proposed closure. The owners of the adjoining Lot 96 have agreed to purchase the land.

Comment

Council has previously resolved to commence a formal PAW closure process. The City’s part of the process has now been undertaken and it is now in order for Council to pass a resolution to request the Minister for Lands to permanently close the PAW and amalgamate the land with the adjoining property.

The City has complied with the requirements of the Land Administration Act 1997.

Policy Implications

The closure is generally consistent with the provisions of Council’s Pedestrian Access Way Planning Policy but moreover the terrain of the land makes it impractical to build a pathway to link Wilkie Avenue and Newman Road.

The City of Wanneroo District Planning Scheme 2 (DPS2) provides Council with development approval powers which are designed to avoid conflict between different land uses on adjoining lots. It is also necessary to ensure the completed developments meet the required standards such as building setbacks, carparking and landscaping. Planning approvals are not generally required for single residential houses unless they seek to vary the requirements of the Residential Planning Codes (R Codes.)

The City of Wanneroo continues to experience very rapid growth pressures with between 80 to 130 development applications being received per month in addition to an average of 400 to 500 building license applications.

Council has delegated some of its responsibilities for decision making on development applications to Council Administration which enables the processing of applications within the required 60 day statutory period and within normal customer expectations.

Council Administration, in assessing development proposals, attempts to extract from the relevant planning documents the key policies and requirements of Council in order to make comments and recommendations on the issues raised in the assessment of each individual development application.

Development applications determined by Planning & Development between 1/1/02 and 31/1/02, acting under Delegated Authority from Council are included in the recommendation.

Determination of subdivision applications processed in the period between 1 January to 31 January 2002 under delegated authority.

Detail

The West Australian Planning Commission (WAPC) is responsible for determining all subdivision applications within the State. Applications for approval are lodged with the WAPC and are referred to local governments and affected public bodies for comment. Comments are made within 42 days of receiving the application after which the Commission determines the applications. There is a right of appeal by the applicant if aggrieved with the Commission’s decision.

Council has delegated to the Chief Executive Officer its functions relating to the provision of comments to the Commission on subdivision applications. The Chief Executive Officer has in turn delegated to the Planning and Development Division this responsibility. A Land Development Unit has been established to assist with the assessment of all applications.

Those applications considered to be either controversial in nature or contrary to Council policy, are referred to Council for consideration. All other applications are dealt with in respect to the following categories.

SCU 1 Subdivision applications received which are generally consistent with an approved or Agreed Structure Plan (including Outline Development Plan and Development Guide Plan).

SCU 2 Subdivision applications previously supported, or not supported by Council and subsequently determined by the Western Australian Planning Commission (WAPC) consistent with the Council’s recommendation.

SCU 3 Applications for extension of subdivisional approval issued by the WAPC which were previously supported by Council.

SCU 4 Applications for subdivision or amalgamation which result from conditions of development approval given by or on behalf of Council.

SCU 5 Applications for subdivision or amalgamation of lots which would allow the development of the land for uses permitted in the zone within which that land is situated including applications involving the excision of land for road widening, sump sites, school sites, etc.

6. Application to Reduce Infrastructure Contributions for East Wanneroo Cell No. 7: Proposed Transport Depot on Lot 27 (87) Windsor Road, Wangara

Background

An approval to use Lot 27 Windsor Road, Wangara for a proposed transport depot was granted by the City in July 2001. The approval included a condition requiring payment of an infrastructure contribution for East Wanneroo Cell 7 prior to the issue of a building licence. Attachment 1 shows the location of Lot 27.

Detail

Development of the land within East Wanneroo Cell 7 is subject to Part 10 of District Planning Scheme No. 2. Part 10 requires the owners to make a contribution towards the cost of providing the infrastructure works associated with the business or industrial use of their land. That contribution is calculated on the area of the land the subject of a development approval.

Whilst the subject land has a total area of 2.3724 hectares, a 6598m² portion of the land is used for residential purposes. The portion of the land subject to the transport depot approval is therefore only 1.7126 ha.

The current provisional rate of infrastructure contribution applicable to Cell 7 is $3.85 per square metre. At this rate the 1.7126 hectares the subject of this approval attracts a gross contribution of $65,935.10. The Cell draft structure plan and the valuation of the cell purpose land will be submitted to Council after adoption in the first half of this year. A final rate of infrastructure contribution can then be adopted to replace the provisional rate.

Depending on the final rate there may be a charge to the $65,935.10 gross contribution calculated at the provisional rate. The residential part of the land is exempt from the contribution for as long it is used for residential purposes.

The applicant is seeking a reduction to the level of infrastructure contribution on this development to a gross figure of $48,000.00. This application is based on the following grounds.

1. In the operation of a transport depot 50 per cent of the land is lost because of the turning and parking requirements for heavy vehicles. 2. The development will provide a location for truck operators to park their vehicles in a secure place away from residential areas. 3. The development will provide a location for local governments to store abandoned vehicles.

Comment

The developable area of Cell 7, has been determined by deducting the land required for future roads, proposed drainage sites associated with arterial roads and other land for public purposes, such as landscape buffer strips from the aggregate area of all the landholdings in the Cell.

The total estimated cost of providing the designated cell works is divided by the aggregate area of the developable land in the cell to establish the infrastructure cost per square metre (ICPM²).

The contribution payable by each landowner is calculated by applying the ICPM² to the area Council considers to be the subject of a development approval, including all areas used for structures, carparking, storage, landscaping and set backs and other like uses. This is the only basis on which Council can estimate the ICPM² with any degree of accuracy, consistency and equity, as Council has no way of knowing in advance just what proportion of each of the 57 landholdings in the cell will be used for structures such as factories, warehouses and showrooms.

Therefore, the first of the grounds on which the applicant seeks a reduction in the infrastructure contribution runs contrary to the shared costing basis on which the achievement of the cell works is premised. As the contributions represent a pro rata allocation of the estimated cost of providing the Cell works, if Council were to allow a reduction in costs for this site, the extent of the reduction would need to be distributed amongst the remaining landholdings in the Cell. This is contrary to the equity principles that Council has sought to maintain for the East Wanneroo Infrastructure contributions scheme.

The second and third grounds of the application are not matters that relate to the level of infrastructure contribution and are more concerned with the intended use of the land.

Separate to the request for a reduction in the level of contribution, the applicant has proposed a payment by instalment arrangement with the full amount, as determined by Council, being paid over 2 years by June 2004.

Under District Planning Scheme No. 2, Council can defer payment of an infrastructure contribution subject to the payment of interest. If deferment is agreed, interest is payable only on the outstanding balance and Council may suspend or waive interest charges if it considers it fair and equitable. Given the circumstances of this proposal, and having regard for external cost impositions, notably a significant payment for the upgrading of the existing overhead power line in Windsor Road required by Western Power that could jeopardise the proposed development, it is considered reasonable to waive interest charges on the payment by instalment arrangement.

Statutory Compliance

Part 10 of District Planning Scheme No. 2 sets out the basis for the payment of Cell costs and in respect to Cell 7, does not contain provision to vary the rate of contribution. The only possible variation is in respect to deferral of payments and the waiveing of interest charges.

A bank overdraft account has been established to accommodate all financial transactions within each of the eight East Wanneroo Cells. There will not be any draw on the City’s municipal fund.

7. Claim for Compensation – Mr M Atieh

Mr Mustafa Atieh was granted a Street Traders License to sell Kebabs from a van in September 2001. The van was, in fact, substandard and the licence was subsequently revoked. Mr Atieh is now seeking compensation for his perceived loss.

Background

Mr Atieh brought an empty van into the City’s offices in May 2001 seeking advice as to the requirements for establishing a food van. He was given a booklet detailing the requirements for food premises and food vehicles, a copy of the Street Traders Local Laws and verbal advice explaining the key features of these requirements.

He subsequently presented the van for final inspection and was issued a Street Traders License on 21 September 2001. He maintained regular contact with the City’s Health Services during October, seeking changes to his approved trading times, type of food sold and trading locations.

In November 2001, complaints were received about the condition and operation of the kebab van, and it was inspected on site. It was found to be grossly substandard and Mr Atieh was advised that it would need to be reinspected and a detailed works schedule was issued. In addition to some basic health requirements not being met to the standard required, there was apparently substandard electrical work, an obvious failure to properly ventilate, an electrical generator and illegal gas fittings, none of which were directly related to the City’s local law, but could have been potentially disastrous in the event of a mishap. The Street Traders License was subsequently revoked.

Detail

Given the circumstances and as there was no entitlement for a licence to be issued, Mr Atieh was offered a refund of his Street Trader’s License fee. He declined and submitted a claim for compensation for alleged losses in the order of twelve thousand, seven hundred dollars. This amount included thousands of dollars worth of items, for which there were no receipts, lost income for which there was no substantiation and equipment that was never used in association with the food van.

After he was advised the claim could not be seriously considered, a modified claim for nine thousand eight hundred and twenty six dollars and thirty cents was presented. The standard of substantiation was no higher for the second claim.

Comment

The matter was discussed with the lawyer representing the Municipal Liability Scheme, who concluded that the only grounds on which Mr Atieh could claim a loss, was the payment of the licence fee to which he was not entitled. In respect of the other costs incurred he advised that the applicant:  made his own decisions based on complete advice;  was not given any indication to take short cuts or provide a lower standard;  in fact received a benefit (a period in which he was permitted to trade) to which he had no entitlement. Any trading losses incurred in that time were not the City’s responsibility.

Mr Atieh is still free to complete the work required to upgrade the van to a standard at which it could be licensed, in the same way he would be if the a licence had been refused in September.

This same advice will be passed on to the Municipal Liability Scheme, who will presumably refuse to fund any claim.

8. Precinct 64 Landsdale - Report of the Landsdale Land Use Planning Working Group

Consideration of the outcome of the study undertaken by the Landsdale Land Use Planning Working Group in respect of ‘Precinct 64’, Landsdale.

Background

The final Gnangara Land Use and Water Management Strategy (GLUWMS) was released by the Government in January 2001. GLUWMS divided the area which falls within the existing Underground Water Pollution Control Area into 89 Precincts, and Precinct 64 refers to the land in Landsdale which is bounded by Gnangara Road, Alexander Drive, Hepburn Avenue and the eastern boundary of the urban zoned land in Landsdale (refer Attachment 1). This Precinct has an area of approximately 300 ha and comprises roughly 60 lots. It is presently zoned Rural under the Metropolitan Region Scheme (MRS) and mostly General Rural under District Planning Scheme No. 2 (DPS2).

The GLUWMS recommendation for this Precinct was that it could possibly be downgraded from a Priority 2 to a Priority 3 groundwater protection area and could possibly be used for urban purposes, “subject to the resolution of all planning issues and constraints and the approval of an agreed Structure Plan by Government which removes identified contamination risks.”

Council’s Interim Local Rural Strategy identifies this area as “subject to continuing investigation”.

At its meeting of 3 July 2001 (item W230-07/01), Council was advised that the WA Planning Commission was establishing a Landsdale Land Use Planning Working Group comprising representatives of key stakeholders including to address the main issues involved with the Precinct and to prepare a broad Land Use Concept Plan. The intention was that following resolution of the issues and finalisation of the Land Use Concept Plan, the landowners and City could proceed with preparation of a detailed Structure Plan for the area and rezoning under the MRS and DPS2 could be initiated.

Council appointed Cr. Salpietro and the Director of Planning and Development Services (with the Manager Planning Services as deputy) to represent the City on the Working Group.

Detail

The Working Group has now completed its Brief and a report on the outcome of its study has been presented by the Department for Planning and Infrastructure (DPI) to the WA Planning Commission for consideration. The decision of the Commission has been to endorse the report of the Working Group with specific reference to the following conclusions:

1. The Land Use Concept Plan identify the land as Possible Future Urban, subject to successful lease negotiations between Telstra and the Department for Planning and Infrastructure and the resolution of all issues identified during the preparation of a Structure Plan for the area.

2. The Structure Plan be prepared in accordance with the DPI publication, Guidelines for the Preparation of Local Structure Plans for Urban Release Areas 1992, and the City of Wanneroo District Planning Scheme No. 2 (Part 9).

3. The Structure Plan includes a more detailed investigation and analysis of the issues relating to the study area, and identify any appropriate management and mitigation measures that need to be implemented.

4. Liaison occur with all relevant State Government Departments and the City of Wanneroo to discuss the issues in more detail and to identify the requirements of each organisation as to how the issues need to be addressed in the Structure Plan.

5. A detailed site assessment be undertaken to the satisfaction of the Department of Environment, Water and Catchment Protection that includes surveys of the flora, fauna and wetlands of the study area and recommends appropriate protection and management measures.

6. The land owners liaise with the Department of Environment, Water and Catchment Protection regarding any buffers required around wetlands, and the management measures that should be incorporated into the Structure Plan.

7. Lease negotiations regarding land to the east of the Perth International Telecommunications Centre be successfully concluded and the land be available for the expansion of the Centre, prior to the initiation of an amendment to the Metropolitan Region Scheme or City of Wanneroo District Planning Scheme No. 2.

8. Wherever possible and appropriate, retain and incorporate good quality native vegetation into the public open space system.

9. Liaison occur with the Department of Environment, Water and Catchment Protection regarding water sensitive urban design and other mitigation measures to protect ground water resources and incorporate these into the Structure Plan.

10. The Structure Plan should only include land uses which minimise the impacts on groundwater quality. Commercial or Industrial areas with land uses such as petrol stations, fast food outlets etc. should be excluded.

It should be noted that the lease negotiations referred to in point 1. above are those negotiations referred to in more detail in point 7. above.

Comment

The Working Group’s conclusions which have been endorsed by the WA Planning Commission as detailed above represent a significant step forward in resolving the future use of this Precinct. Once the lease negotiations between Telstra and DPI regarding the land immediately east of the existing Telstra site have been completed, the City, in consultation with the landowners, should be able to confidently proceed with the preparation of a detailed Structure Plan and developer contribution arrangement for this Precinct, in a similar manner that such plans and arrangements have been prepared for the other East Wanneroo urban cells. Amendments to the MRS and DPS2 will also be able to be proceeded with.

Statutory Compliance

The Working Group’s study has been undertaken at a strategic level. Statutory planning steps will commence with amendments to the MRS and DPS2 and preparation of Structure Plan and developer contribution arrangement under DPS2.

Strategic Implications

It is anticipated that a developer contribution arrangement for this Precinct (assuming urban development) will include construction of full earthworks and a single carriageway for the portion of Hepburn Avenue which forms the southern boundary of this Precinct. This will mean an additional funding source for the eventual linking of Hepburn Avenue from Mirrabooka Avenue to Alexander Drive (noting that Hepburn Avenue is to be constructed from its present end at the Kingsway shopping centre to Mirrabooka Avenue by October 2002). This will mean a significant improvement in the regional road system in this general area and take pressure off other east-west roads such as Kingsway.

Policy Implications

None at present, however when future urban use of this Precinct is finally confirmed, this area will be able to be deleted from the Local Rural Strategy area.

Financial Implications

Preparation of a detailed Structure Plan and developer contribution arrangement for this Precinct will have resourcing implications for this City, however such costs should be able to be recouped through the developer contributions.

9. Request for Refund of Eating House Licence and Registration Fees

Mr Tony Priddle, on behalf of Ms Jaqueline Jones, has requested the City refund eating house licence and registration fees paid in relation to premises he sold.

Background

The City’s Health Local Law requires that:

“A person shall not occupy or use or cause, suffer, or permit to be occupied or used any premises as an eating house unless and until:

(a) the premises are registered; and (b) each of the proprietors of the premises is licensed,”

All registrations and licences apply for 12 months commencing on 1 July each year.

The Eating House Licence & Registration in question relates to a caravan which operated as a take away food premises at the Wanneroo Weekend Markets. The annual licence and registration fee, totalling $210.00 (ie $30 licence and $180 registration) was paid on 9 July 2001 and on 26 July 2001 the City was requested by Ms Jones to cancel the licence. The City was advised that the caravan had been sold and the purchaser intended to operate outside of the City of Wanneroo.

Detail

Ms Jones has been advised that the City’s Local Laws do not allow for a refund or partial refund of the normal licence and registration fees in any circumstances. This was confirmed with the City’s solicitors. On 5 February 2002, Mr Priddle attended the Council meeting where during Public Question Time he asked about this matter. The Mayor subsequently advised that a report on this matter would be forwarded to Council for its consideration.

As the sale price of a food premises or vehicle normally includes the value of registration (in the same way a motor vehicle registration affects its value) the Local Law only permits a transfer and not a refund. The transfer option, however, was not pursued by the purchaser as he now operates outside the City of Wanneroo.

The only way Ms Jones could be reimbursed her registration fee would be if the Council resolved to make a donation to the value of the unused part of the annual fee.

The licence permits the licensee to operate any food premises and is valid for the whole of the year whether a food premise is conducted or not. As indicated, the City was advised on 26 July 2001 that the food premises ceased trading. The registration for the part of the year the premises did not trade would therefore have a value of approximately $165.00.

Background

Council considered a report at its meeting on 20 March 2001, (Item W86-03/01 refers) regarding Yellagonga Regional Park – Stormwater Drainage, and resolved to accept the design report prepared by the appointed consultants and list funds to undertake works for upgrade of Outfall No 12. Council subsequently provided $280,000 in the Capital Works Budget for 2001/2002 for these works. This budget figure included a contribution of $100,000 from Main Roads WA for the drainage upgrade works in Wanneroo Road.

PPK Environment & Infrastructure Pty Ltd was appointed to undertake a detailed design and prepare specification for construction of these works. These designs and the necessary approval process was completed during the first half of the current financial year leading to the preparation of tender documents.

Detail

Tender No 02230 was advertised on 12 January 2002 and at close of tenders on 30 January 2002, eight tender submissions were received. Tenderers were invited to submit a lump sum price for the scope of works and specifications defined in the tender documents. The scope of works included three distinct components of works and the price schedule required the tenderers to submit prices for each of these components. The price schedule also included a note to tenderers advising that the Principal reserves the right to award a contract which may omit any of the three components of scope of works. Clarification was sought from Ertech Pty Ltd regarding the qualifying statements made in their tender submission and with a view to determine the impact on their tender price to include the removal of surplus material from site and import of clean fill. Ertech Pty Ltd has advised that inclusion of these items will result in the revised lump sum tender price of $237,850, however, this price is still subject to other qualifications stated in the tender submission. In accordance with the conditions of tendering, the tenderers are not permitted to amend the submitted price while clarifying the tender submission. In this instance, Ertech Pty Ltd has amended the tender price and this tender has therefore not been considered in the further tender evaluation.

The Tender Evaluation Team comprising the Co-ordinator - Engineering Operations and Co- ordinator - Civil Design has evaluated the remaining in accordance with the following assessment criteria:

The evaluation matrix has clearly rated tender submission from Densford Pty Ltd higher than other tender submissions.

The cost of the works in Wanneroo Road is the responsibility of Main Roads WA and confirmation has been received that funds are available in the current financial year, with payment on completion of these works.

The construction of works included in this tender is critical to upgrade the stormwater drainage system from Wanneroo Road to Lake Joondalup Outfall No 12 and the Ariti Avenue detention basin. The tender submitted by Densford Pty Ltd has achieved the highest rating during the evaluation process.

It is therefore recommended to accept the tender from Densford Pty Ltd to undertake all works in accordance with Tender Number 02230 at a lump sum price of $241,232.

This amount of $72,815 does not include any contingent amount or costs associated with any unforeseen items, which will be charged to MRWA at cost plus 15% administration charge.

In order to proceed with these important works during the low water table months of March and April, it will be necessary to reallocate funds from other capital projects to meet the shortfall in funding of $32,417.

Project No 1233 – Stormwater Drainage Upgrade Various, has budgeted funds of $95,000 in the City’s 2001/2002 Capital Works Budget. These funds are to be utilised for the upgrade of stormwater drainage infrastructure within the City. The reallocation of $32,417 from Project No 1233 to Project No 2171 is recommended to enable all the works associated with this project to be completed this financial year.

11. WALGA Initiative - Proposed Study to Improve the Deterioration Model Used in Australian Pavement Management Systems

The Western Australian Local Government Association (WALGA) has sought support from local governments in Western Australia for its involvement and financial support for the instigation of a Study to Improve the Deterioration Model used in Australian Pavement Management Systems.

Background

In May 2001, WALGA approached the City for financial support and involvement in its proposal to undertake a statewide study by ARRB Transport Research, for the data collection, monitoring and research into improving the current Deterioration Model used in Pavement Management Systems for Western Australia. A significant focus of this study relates to the ROMAN pavement management system used by the City and a majority of local authorities in Western Australia. In order to develop appropriate and meaningful deterioration models, it will be necessary to establish a number of monitoring sites on local roads throughout Western Australia. The sites selected would need to be representative of local road pavements and cover a range of road types, climate conditions, traffic loading, soil types, construction techniques and maintenance practices.

Due to the high costs associated with this study, WALGA is seeking financial support from local governments in Western Australia to enable a good cross section of roads to be monitored over the next five years. The results of the study will be the establishment of a specific deterioration values which is representative of Western Australia conditions and ensure that the predictive tools used by road practitioner are of the highest quality.

City Administration is also supportive of this initiative and keen for Council to be involved in the study.

Detail

As the pavement deterioration model is such a critical component in any Pavement Management System, accurate models based on Australian conditions are essential if local governments are to be able to better manage roads at both the network and project level.

A more appropriate model will bring with it greater confidence in forecasting future pavement conditions, maintenance programs, substantiating budget requirements and in gaining greater value from the funds available.

The need for a ‘local model’ is reinforced by recent experience by local government practitioners who have found that predictions based on the current deterioration model are producing results that do not accurately reflect actual pavement conditions.

The study, monitoring and testing will be carried out by ARRB transport and Research. At this stage the indicative costs per site are in the order of $1,200 per year. The study would be carried out over the next five years totalling $6,000 per site over the five year period.

It is anticipated that three sites within the City will be selected for the study which will require a commitment from the City in the order of $3,600 per year totalling $18,000 over the next five years.

Comment

In September 2001 the City indicated its support to WALGA and that it will list funds for consideration by Council in the City’s New Initiative Budget for the next five years in support of the study.

To date WALGA has received strong support from local governments in Western Australia particularly within the Metropolitan area and has contracted ARRB Transport Research to undertake the project.

It is envisaged to commence the initial monitoring of the various sites from April 2002.

12. Main Roads WA - Metropolitan Functional Road Hierarchy Update

The Metropolitan Functional Road Hierarchy maps produced by Main Road WA for the municipality of Wanneroo were last revised in August 1999 and do not reflect the changes to the road network created by the growth of the City.

Background

The Metropolitan Functional Road Hierarchy produced by Main Road WA is a document which lists the types of roads that perform designated functions required of the road network. It also provides a criteria to describe each road functional type. These roads are displayed on a colour coded map of the Metropolitan area.

All roads in the Perth Metropolitan area are designated as one of five functional types which are based on specific criteria and intended functions are summarised below:

 Primary Distributors – these provide for major regional and interregional traffic movement and carry large volumes of generally fast moving traffic. Some are strategic freight routes and all are National or State roads. They are managed by Main Roads WA.

 District Distributor A – these carry traffic between industrial, commercial and residential areas and generally connect to Primary Distributors. These are likely to be truck routes and provide only limited access to adjoining property.

 District Distributor B – Perform a similar function to type A district distributors but with reduced capacity due to flow restrictions caused by access to and roadside parking alongside adjoining property. These are often older roads with a traffic demand in excess of that originally intended.

 Local Distributors – Carry traffic within a cell and link District Distributors at the boundary to access roads.

 Access Roads – Provide access to abutting properties with amenity, safety and aesthetic aspects having priority over the vehicle movement function. These roads are bicycle and pedestrian friendly.

This document was last published in August 1999 with information gathered from each of the local government authorities in the region up to May 1999. The next update is expected to be conducted in August 2002, ie., a three year cycle.

The proper classification of all roads within each local government is important as this information is used in determining eligibility for state and federal road funding grants.

The growth of the City of Wanneroo in recent years has resulted in the 1999 Metropolitan Functional Road Hierarchy Maps being outdated, particularly in regards the local distributor functional type. It is proposed that one of the criteria to be used for assessment of roadwork submissions for funding in future Metropolitan Regional Road Programs is for roads to be designated as ‘Local Distributor Roads’ or higher. This is likely to be introduced in 2003/2004 and it is imperative that the City’s road hierarchy be updated to assist with the preparation of funding submissions..

Request from residents to develop part of Bibbulmun Park for a play area and to consider the feasibility of a staged development without compromising bushland retention and future options for recreational use.

Background

A report was presented to Council at its meeting on 16 October 2001 (Refer TS06-10/01). It was resolved by Council to:

“1. Advise the petitioners of Singara Heights that:

(a) City Administration to undertake a review to assess whether staged development of the existing public open space site in Sinagra Heights is possible without it compromising development of the ultimate public open space area, in order to provide a safe play area for the children whilst at the same time ensuring that the preservation of the appropriate remnant bushland is not compromised. (b) A report providing costing and available options to be presented to Council for further consideration at its meeting on 18 December 2001. 2. LISTS for consideration in the Draft 2002/2003 Capital Works Budget an amount of $17,000 for the replacement and upgrading of the playground equipment at Goolema Park, Wanneroo. 3. City Administration to INVESTIGATE the feasibility of purchasing and operating mobile playground facility and report back findings for further consideration by Council. “

Administration prepared a report for Council’s consideration at the meeting of 18 December 2001. At the Council Briefing session of 10 December it was agreed that a meeting be held with the residents and costs be determined for staged irrigation and grassing of a portion of the future Park.

Detail

Staged Development of the Public Open Space

Subsequent to Council’s resolution of 16 October 2001, the petitioners were advised of Council’s resolution and the site has been investigated for development options. As outlined in report TS02-10/01, the future Bibbulmun Park spans four existing land holdings and was set aside for bushland conservation and as a second option, subject to demonstrated need, for future sports fields. Refer Attachment 1 for location details.

The land is currently largely good quality bushland of high conservation value. The intention of locating the POS in this section of the Cell 2 Structure Plan for East Wanneroo was to accommodate bushland conservation which would be a shared provision for four landowners of the 4.46 hectares of proposed public open space (POS):-

 8,374m2 is bushland given up for POS in the ‘Sinagra Heights’ development,  Approximately 9,000m2 to the north east has been developed with shade houses for nursery purposes and  The remaining 2.72 hectares is in two lots to the east and are bushland.

The land slopes to the west and at a more gentle gradient over the western half of the POS. Should there ever present a need for additional sports fields in this area, it is likely that earthworks would be accommodated on the western portion, rather than the eastern. Surrounding future road geometry and the natural slope of the land lends to accommodating a flat playing area on the west side, rather than the east side of the POS. Therefore, trees to be retained within the POS would be on the steeper slopes of the existing POS portion. Clearing of the ‘Sinagra Heights’ section may negate any future tree retention within the whole POS. Should the conservation purpose of the POS be retained, clearing of this portion will reduce the optimum minimum area of 4-6 hectares required for sustainable conservation purposes.

City Administration used the primary criteria for prioritising the development of unirrigated parks under the Draft Policy and Implementation Plan for Upgrading Distributor Roads and Unirrigated Parks (Hames Sharley 2001) and found Bibbulmun Park to be a low priority

The Co-ordinator, Landscape Design and Councillor Monks met with residents to discuss the development of a small portion of the current POS area, which currently services as a firebreak. With this option, it is proposed to remove debris, lightly grade and irrigate and grass an area of the POS of approximately 13 metres wide and 80 metres long. The development will serve to provide a ‘kick about’ area for children and upgrade the aesthetics of the area. The estimated costs for site preparation, irrigation and grassing are:

It is noted that there will be an Estimated Annual Recurrent Cost of $15,00 to cover maintenance on establishment of this play area.

Should Council resolve to consider installing a playground on this play area, then the following estimates are provided:

Goolema Park Development

As discussed in report TS02-10/01, Goolema Park is within walking distance of all residents within ‘Sinagra Heights’. Upgrade of the playing facilities at this park to the value of $17,000 is to be listed for consideration by Council in the Draft 2002/2003 Capital Works Budget.

Mobile Playground Facilities

The previous City of Wanneroo purchased two mobile playgrounds mounted on large trailers, at a cost of approximately $58,000 and $30,000. The two units were used for locations where requests for a playground pre-empted the funding of a permanent facility. They were designed and constructed by a reputable playground manufacturer to the then applicable Australian Standards. The Australian Standards for playground equipment, playgrounds and under surfacing have been amended since their purchase and these units would no longer comply with basic safety requirements. In particular, the fall distances between the edges of the equipment and any hard edge to the undersurfacing have been increased.

The has since disposed of the units and verbal advice is that they were cumbersome and costly to relocate between sites.

Consultation

Administration met with three representatives of the local community (and their young children) to discuss options for developing Bibbulmun Park. The proposed partial irrigation and grassing estimate above is an outcome of those discussions.

Comment

Staged Development of the Public Open Space

Within the future whole POS, the ideal location for future passive recreation uses is the already cleared nursery site on the north eastern Lot. It is unknown when the owner will wish to develop the landholding and therefore cede this portion of the POS for recreation. The section of firebreak to be irrigated and grassed adjoins this north east portion and would form part of the ultimate passive play area. The remainder should be preserved for conservation purposes. The option for future sports ground development would be preserved without compromising the current conservation purposes.

Mobile Playground Facilities

City Administration undertook some preliminary investigations for the feasibility of a mobile play unit and concluded that meeting current safety standards would be costly and impracticable. Manufacturers do not normally construct mobile units as there is no demand for them from Councils and short term play value is more efficiently gained from other facilities such as inflatable jumping castles.

Some of the issues considered in the review were:  High capital and service costs.  A single unit would need to be relocated several times per year to service the number of budget requests.  Equipment manufacturers normally guarantee their structures for ten years. However, this period would be substantially reduced for an unfixed unit.  Requirements of Australian Standards for vertical and horizontal safety fall distances from equipment would necessitate large and elaborately constructed under surfacing at each site.

Other Matters

14. Beach Access Way - Sceptre Court, Two Rocks

Endorsement of the design and tender process for the access way to the beach from Sovereign Drive opposite Sceptre Court in Two Rocks.

Background

Council considered a report (Item TS03-10/01 refers) at a meeting on 16 October 2001 which provided an extensive background to this issue. Currently a boarded access way terminates at the crest of a dune that falls steeply through a “blow out” area to a narrow beach. The lack of a formal beach access means that beach goers must walk up and down the face of the dune which in turn is exacerbating the recessional problems that already exist. The recommendations arising from the Council meeting of the 16 October 2001 were:

“1. APPROVES the concept design as shown on Attachment 2 for the proposed upgrade of the beach access way opposite Sceptre Court, Two Rocks and authorises the commissioning of consultants to undertake the detailed design and cost estimate.

2. On completion of the detailed design and cost estimate, City Administration, REPORTS to Council the outcome prior to proceeding to tender.”

In accordance with the Council recommendation, the Operations Unit sought quotations for the investigation, design, costing and project management for the provision of a beach access stairway. Halpern Glick Maunsell Pty Ltd (HGM) submitted the successful quotation for the provision of these services.

Detail

As detailed in Report Item No TS03-10/01, the major problems entailed in the design of this access include the recessional nature of the beach in this area and the steep grade of the dune on which the access must is to be constructed.

The recessional problem has two major implications with regard to the design.

 An allowance must be made to “over-pile”. This involves piling the supports deeper than would be normally necessary for purely structural reasons as an allowance must be made to allow for receding sand exposing the piles over a period of time.

 The foot of the stairway must be recessed into the existing beach to allow for the same recessional processes. This should potentially eliminate a severe “drop-off” that may occur from the lowest step of beach access stairways in the event of beach recession.

Attachments 1 & 2 show drawings numbered 6742-SO1 and 6742-SO2 which indicate the consultants proposed design solution to the problems posed by the recessional nature of the site.

An alternative to this solution is a structure without landings, however this would have required recessing the stairs into the existing dunal surface which may well have exacerbated the recessional problems already encountered. A further advantage of the proposed design is that the landings supply a respite for less able beach users and also limits the length of fall from any missed footing.

The location of the roofed observation deck allows for a panoramic vista with sweeping views in both the northerly and southerly directions. Not shown on the drawings is the provision of park type bench seats to be bolted to the deck structure and to be positioned adjacent to the eastern and southern rails. A gate will also be included, located at the top of the stairs which may be locked to exclude access to the beach during adverse weather or beach conditions.

In order to carry out the works for the construction of this stairway, the existing boarded walkway to the top of the dune will need to be removed and replaced with a limestone track. The current condition of the walkway has been assessed as moderate to poor with some of the treads having failed and others likely to fail. The westernmost twenty metres of the walkway is covered by sand and does not provide any formal access in its current state. The proposal is to remove the walkway, with the exception of the buried section and the southern rail, which will serve in part as a fence. This will be replaced by a limestone track 2.5 metres wide and 200 mm thick to serve as an access for construction purposes. The materials from the removal of the existing walkway will be recovered, where suitable, and used in the City’s maintenance operations. An alternative construction access for the lower sections of the stairs will be via Dame Pattie Drive through Tokyu Corporation’s property and along the beach. Tokyu’s permission for this access has been sought and granted with disclaimers regarding Tokyu’s liability for third party usage.

On completion of the works, the limestone access track will be fenced to provide access to the new stairway facility. The exposed area of the dunal crest will be treated with braches to suppress sand movement. An option will be included in the tender documents for the replacement of the limestone access track with an insitu concrete path.

The tender process for these works will be co-ordinated by HGM and it is proposed to advertise the tender early in March, subject to receipt of Development Approval for the works.

HGM has satisfied the requirements of the brief and supplied a cost estimate based on the submitted design. The total estimated cost of the works is summarised below:

This estimated cost is within the 2001/2002 Capital Works Budget allocation of $136,850 for this project.

The construction of the stairway and the associated works provides a number of benefits to the ratepayers of the areas and to the beach users in general these include:

 The provision of a formal, defined access will allow the adjacent dunal vegetation to establish itself, which will, in turn, help to reduce the recessional tendency due to prevailing on-shore winds. Another major cause of the recession and development of the blow out is the regular trafficking of beach goers up and down the dunal face.  Ease of access to the beach. The current angle of repose of the dune in this area is at a two in one grade (horizontal: vertical) and poses a problem for any less abled would be beach users.  The supply of a scenic look-out and a pleasant seating area.

Statutory Compliance

As the stairway is to be constructed wholly within Crown land and Crown land vested in the City of Wanneroo, the approval of the Department of Planning and Infrastructure is necessary. An Application for Approval to Commence Development was submitted on 11 January and is currently being assessed.

15. Change in Rateable Status - Properties Owned by the Western Australian Planning Commission

To advise Council of the change in rateable status of various properties owned by the Western Australian Planning Commission.

Background

The Department for Planning and Infrastructure has written to the City advising that a number of properties owned by the Western Australian Planning Commission are not rateable under Section 41A of the Metropolitan Region Town Planning Scheme Act 1959. On the basis of the information provided by the Department, the properties in question are also not rateable under Section 6. 26 (2)(a)(i) of the Local Government Act 1995.

Detail

Each year, the City raises rates on all properties owned by the Western Australian Planning Commission (the Commission). During the year, the City is advised which properties are not rateable under Section 41A of the Metropolitan Region Town Planning Scheme Act 1959 and action is taken in the Rates Section to write back the rates concerned.

Under Section 41A of the Metropolitan Region Town Planning Scheme Act 1959, where the Commission leases out the property, the Commission shall pay from the rent received the whole or such portion of the amount of any rate, tax or assessment that would have been payable but for Section 41A, as the Commission certifies in writing.

In Attachment 1, the Department for Planning and Infrastructure has advised which properties are subject to the payment of a rate equivalent and which are not rateable. Payment for $18,022.15 for the properties leased by the Western Australian Planning Commission has been received.

In issuing the Commission with a Rates Notice for each of the properties it owns, the City is effectively requiring the Commission to review the properties concerned and make the appropriate determination.

The City is reviewing all properties owned by the Western Australian Planning Commission to ensure rates each property is treated consistently. However, it is proposed to continue raising rates on all properties owned by the Commission and reverse the rates upon receipt of the Commission’s determination.

As the land is not rateable under Section 6.26 (2)(a)(i) of the Local Government Act 1995 and Section 41A of the Metropolitan Region Town Planning Scheme Act 1959, the rates have been raised inadvertently. Consequently, it is not appropriate to seek the Council’s approval to waive the payment of the rates under Section 6.47 of the Act. Instead, reversal of the rates raised has been actioned by the Rates Section.

Section 6.26 (2)(a)(i) of the Local Government Act 1995, provides that:-

“The following land is not rateable

…Land which is the property of the Crown and is being used for a public purpose.”

16. Rate Insurance

To consider a request from the City’s Insurers, Municipal Insurance Broking Services (MIBS) in conjunction the American International Group (AIG), to trial a Rate Insurance product with a sample of 5,000 ratepayers. MIBS is requesting that the City arrange the mail out at no cost to itself. It is proposed that following the trial, the most popular product will be marketed to the remaining ratepayers via a similar mail out.

Background

MIBS has proposed to offer ratepayers rate insurance. Additional details on the proposal were sought before giving the proposal further consideration. These details have now been provided.

Detail

MIBS in conjunction with AIG are seeking the City’s agreement to assist them in marketing their new insurance products. As stated above, it is proposed that the City would send details of the two rate insurance schemes to a sample of 5,000 ratepayers, as a trial. This would assist MIBS in determining the product most likely to receive support from the Wanneroo community. On the basis of the trial results, MIBS would require the City to assist in the marketing of its more popular product by way of a similar mail out to the balance of ratepayers within the City.

MIBS state that they propose this method of distribution in view of the recent concerns regarding the sale of Rate Book information by local governments. Under this proposal the City would arrange the mail out and MIBS (through AIG) would reimburse the costs.

The products

The two products being offered by MIBS are: -

1. Cover for rates in the event of the policy holder’s death; and 2. death and capital benefits cover in the event of the policyholder’s death.

A copy of the MIBS request and product brochures are attached (Attachment 1).

Other Detail

The request by MIBS proposes that the covering letter to be sent to ratepayers in the trial and future mail outs be placed on the City’s letterhead. In addition it is proposed the scheme be referred to as the City of Wanneroo Personal Accident Rate Cover Plan.

MIBS was established by WALGA (formerly WAMA) to provide insurance services to local government in Western Australia. All City of Wanneroo insurances are arranged through MIBS.

The Rate Cover Plan is considered to offer a protection that may be sought by some ratepayers. However, it is not considered appropriate that the City should endorse third party products. For those seeking the protection available under the scheme, the distribution of information may be considered to be a valuable customer service initiative by the City. It is therefore considered inappropriate that separate mail outs be undertaken and moreover any endorsement by the City cannot be supported.

Allowing MIBS the opportunity to enclose appropriate literature in the annual Rate Notice mail out, provided that no additional costs are borne by the City and a clear statement is included stating that the City neither endorses nor underwrites the product(s), would seem to be a reasonable alternative to the request made by MIBS. This would allow MIBS to market their product to all ratepayers in Wanneroo, and allow the City to offer a service to ratepayers who seek the protection of the types of cover being provided. In addition, it would avoid inappropriate use of the City’s rating records.

Conclusion

It is recommended that the City advise MIBS that it does not accede to their request to conduct a trial of their Rate Insurance Plans as proposed but is willing to allow appropriate brochures to be included in the City’s annual rate mail out subject to: -

 Such inclusion being at no cost to the City; and  The inclusion of an appropriate statement to the effect that the products are not endorsed and nor are they underwritten by the City.

17. The Heights Community House Mural Art Project

This report seeks to gain Council approval to erect a wall mural on the western exterior wall of The Heights Community House situated at 18 Linto Way, Alexander Heights.

Background

The Heights Community House is a City of Wanneroo facility that provides a social and recreational program for people with disabilities aged between 18 and 60. The program is funded through the Department of Health’s Home and Community Care (HACC) Program.

The philosophy of The Heights Community House is dedicated to providing opportunities for interaction, integration, new experiences and creative outlets for the people who use the facility.

The Heights Mural Arts Project has been developed as a result of those who attend The Heights Community House voicing their desire to contribute something to the community through art, as well as sharing some of their happiness and enthusiasm with other members of the community.

The finished Mural will be displayed at The Heights Community House, on the western exterior wall of the building, and will depict the many cultures within the area and the local flora and fauna.

The Project will not only foster awareness of activities provided at The Heights Community House, but will also assist people of varying cultures to become involved in a community arts program. Participants will include individuals with disabilities from a range of age groups and cultural backgrounds including Aboriginal and Vietnamese people.

Detail

The Heights Mural Arts Project will be a ten-week project that will operate on Saturday mornings at The Heights Community House. The cost of the project is $3,100 and can be funded by the City’s Community Arts Program. The City’s Community Events & Arts Coordinator is able to oversee the project and a suitable coordinating artist is available should Council approve the project.

People attending The Heights Community House would take an active part in the mural art project along with the contribution of staff, family and friends, carers and interested members of the local community. Community involvement would include members of the Kookaburra Aboriginal Senior’s Group and the Vietnamese Senior’s group, who would contribute to the projects intergenerational and cultural qualities.

The Red Cross Carer Respite Program has offered to donate staff time for the duration of the weekly workshops.

The mural would consist of four marine plywood panels. The Artist would coordinate the painting of the panels with the participants at the weekly sessions. The finished mural would be permanently fixed onto the western exterior wall of The Heights Community House with the use of anchor bolts. Technical Services have been consulted regarding the project. The Mural would be coated with a protective seal to ensure that on going maintenance costs are minimal.

Consultation

Extensive consultation regarding the project has taken place with the people attending The Heights Community House, community groups who would be involved in the project, the City’s Community Arts Officer, the City’s Community Events and Art Officer, the Artist who may potentially be involved in the project and the staff, families and carers associated with The Heights Community House.

Comment

This project provides an avenue to meet the philosophies and goals of the Heights Community House program. It provides an ideal opportunity to engage the surrounding community, and to showcase the abilities of the people who attend The Heights.

Additionally, the project allows for interaction between people of different cultures, generations and backgrounds, encouraging a sharing of skills and knowledge in the preparation of the mural. It will hopefully encourage a sense of community ownership of the facility and allow relationships with the local community to develop.

18. Youth Rally Project 2002

This report seeks approval from Council to accept the offer of a transfer of assets relevant to the Youth Rally Program and to gain Council endorsement to continue running the Youth Rally Program in 2002.

Background

In 2001, a joint submission made by the City of Wanneroo (CoW) and City of Joondalup (CoJ) was successful in obtaining a tender to run the Northern Suburbs Youth Rally Program 2001, funded by the Office of Youth Affairs (OYA, now Department for Community Development - Youth Affairs). The contract included $30,000 to coordinate the project plus use of two rally cars and associated equipment. It also required the close involvement of a Project Advisory Group consisting of representatives from OYA, experienced Project Advisors, a Project Co-ordinator (employed by CoW) and staff from Youth Services of CoW and CoJ. A strong focus on Road Safety messages for young people was a required component of the program, as was a regional approach to the recruitment of young people into the program.

A draft Memorandum of Understanding (MOU) was developed to document the different roles and responsibilities of CoW and CoJ. The tender submission designated responsibility to CoW as host agency for the program and for co-ordination of the project including employment of staff and administration of funds, while CoJ took on responsibility for publicity and promotion materials.

As a result the Northern Suburbs Youth Rally Program 2001 was successfully run as a joint City of Wanneroo (CoW) and City of Joondalup (CoJ) project, co-ordinated by CoW Youth Services. The Department of Community Development – Youth Affairs (DCD – Youth Affairs) has now ceased to fund this program as a result of a change in strategic focus.

However, it has offered to transfer assets such as cars and equipment associated with the project, to the City of Wanneroo provided the project continues in a similar format to that of 2001.

A Lotteries Commission WA funding grant of $16,135 was received in mid 2001 for purchase of new equipment for the Rally Project.

Council provided $10,000 in 2001/02 for operational project costs and this has been expended.

Detail

The program was seen as a great success in 2001. The project came in under budget, was well run and achieved positive outcomes for the young participants. Driver safety training, team- building and organisational skills and developing new technical knowledge were all positive outcomes of the program. Additionally, the program provided a vehicle for the road safety message, allowing issues in this area to be explored in a meaningful and positive way.

With some fluctuation in numbers, 24 young people participated throughout the year in a program of rally events, driver safety training and Telstra Rally Australia in November 2001, in which the team came second in its class of competition. There is potential for 30 young people to be involved and this is open to young people in both Wanneroo and Joondalup regions.

DCD - Youth Affairs has offered the equipment and rally cars to the CoW as host organisation on condition that the program continues in 2002, with an emphasis on the road safety message and retaining its regional approach to recruitment of participants. The balance of unexpended funds of approximately $15,000 from the tender agreement would stay with CoW as the host organisation and DCD - Youth Affairs would require a brief report and evaluation on the project plus an inventory of cars and equipment at the time of hand-over. Due to Lotteries Commission WA funding received in mid 2001, the cars and equipment are in very good repair.

It is important to note that there are no other requirements beyond operating a program in 2002 attached to the offer of a transfer of assets.

DCD - Youth Affairs would like some indication as to whether CoJ will continue to participate in the program in order to retain the regional focus on recruitment. Unfortunately, CoJ is unable at this stage to indicate what resources are available in their 2002/03 budget, apart from some continuing commitment of staff hours in regard to supervision of the project, in-kind support with regard to recruitment and a possible financial commitment in the 2002/03 budget, currently $10,000.00. Given the availability of current funds, and the opportunities to seek other streams of income, this is not seen as a major issue. In essence, the City of Joondalup would act as a sponsor like any other.

Consultation

A meeting on 17 December 2001with a representative from DCD – Youth Affairs has indicated its willingness to see the program continue albeit without the department’s funding. It acknowledges the high standard CoW achieved for the 2001 project and has indicated a willingness to provide some in-kind support such as advocating for free entry to Telstra Rally Australia on behalf of the CoW Rally Project.

Further offers of voluntary support and training for youth members by the Light Car Club of Australia, the Southwest Touring Car Club and the West Australian Car Club have been discussed with the CoW Project Co-ordinator.

Comment

A current overview of the project is as follows:

1. The equipment and Rally vehicles are currently in very good condition. 2. Ongoing accommodation of the Rally Project is available at the Ashby Depot. 3. The 2001 Project Coordinator (employed under a fixed term contract) is keen to continue his role and utilise experience and skills gained in last tear’s program. 4. The project has demonstrated positive outcomes for young people and has the potential to promote road safety and driver training for young people. 5. Approximately $15,000 is unexpended from the DCD – Youth Affairs funding for the project and can be carried forward to an operational budget for the project in 2002/03. 6. There is a strong probability that the project can attract sponsorship and alternative funding to offset costs. 7. The project adds to the variety of youth programs provided by CoW. 8. CoJ will continue staff support until the end of the 2001/2002 financial year and possibly commit to a financial contribution in 2002/03. 9. Regardless of CoJ involvement or otherwise, young people from the Joondalup and Wanneroo regions can participate in the project.

Given the great success of last year’s program, and given the numerous offers of support that have been given should the program continue in 2002, it is felt that the opportunity to accept the transfer of assets and continue the program in 2002 is one that should not be missed.

It is expected that the program would cost between $25,000.00 and $30,000.00 to run for approximately twelve months, until the end of 2002, including participation in Telstra Rally Australia. Community Services is confident that alternative funding sources, such as sponsorship, will be available to ensure that income targets are met, and that Council contribution can be kept to a minimum.

Should the City be unsuccessful in obtaining any further income, which is highly unlikely, the program could be modified so that it could operate within the resources available, as many of the required resources are already in place due to the program being operational for twelve months already. Alternatively, $10,000 can be listed for consideration in budget papers for the 2002/2003 financial year should it become apparent that no sponsorship money will be forthcoming.

The Lotteries Commission and Museums Australia (WA) Inc provide a Specific Purpose Grants for Museums Program. A grant application was made for funding for the production of a transportable museum display based on the theme “Celebrating Wanneroo’s 100 years” for the Gloucester Lodge Museum Open Day to be held on 6 October 2002 and for use elsewhere afterwards.

Detail

The City was successful in receiving a grant of $3,500 to employ a professional historian to research and write the text and source photographs for the display panels.

The Open Day is a standing item on the Gloucester Lodge Museum Advisory Committee meeting agenda.

Comment

20. Accommodation for the Yanchep Rose Arts & Crafts Group in the Yanchep National Park

To provide a further report on the possible options to provide retail sales space for the Yanchep Rose Arts & Crafts Group within the Yanchep National Park, as previously requested. (MN01-09/01 and CD03-11/01 refer).

Background

At the Council Meeting of 4 September 2001, the following recommendations from a Motion on Notice (from Cr Loftus), were passed;

“That Council:- 1. PREPARE a report containing all the options possible to accommodate the Yanchep Rose Arts and Crafts Group within the Yanchep National Park. 2. That the report be PROVIDED to Council by Tuesday, 6 November 2001.”

A report was presented to the 6 November 2001 Council meeting where a procedural motion, moved by Cr Loftus, was carried to refer the item back to Council Administration for further information. In subsequent discussions with Cr Loftus he indicated he believed the possibilities of utilising the storage shed adjacent to the Gloucester Lodge had not been fully investigated.

Detail

As previously reported the Yanchep Rose Arts and Crafts Group is a non profit community group. The Group has 15 members who create various arts and crafts and then offer them for sale to cover their expenses, and contribute towards the organisation’s operational costs. The Group is not an Incorporated Association.

The Group has a shop at the Two Rocks Shopping Centre complex and until last year operated a shop in a leased area of McNess House in the main tourist precinct of the Yanchep National Park. The Department of Conservation and Land Management (CALM) did not renew the lease as it required the space for its visitor services staff. CALM has purchased some stock to sell in McNess House and items are also on display in the Chawn Mia Tearooms, near McNess House and the Yanchep Inn.

Members of the Group have discussed their need for a retail sales facility in the Yanchep National Park with CALM; with the local State Member of Parliament; with Councillors, including the Mayor and Cr Loftus; and with Administration staff, including the former CEO and the former Director - Community Development.

CALM controls the National Park and the usage of the buildings in the Park. The City leases Gloucester Lodge from CALM to operate as the Gloucester Lodge Museum and owns a metal storage shed sited on leased ground near the building. The shed is used to house museum flammable liquids and some artefacts as the lease of Gloucester Lodge stipulates that flammable liquids cannot be stored in the building.

The Gloucester Lodge Museum Advisory Committee has discussed the issue of providing retail space for the Group on several occasions. These discussions included the practicalities of the lack of a separate entrance or separate area within the Gloucester Lodge building that could be used by the Group outside the Museum opening times of Tuesday, Wednesday, Saturday and Sunday, 11.30am to 4.30pm. The Group had operated a seven day per week sales operation in the leased area of McNess House. At the meeting of 12 December 2001 the CALM representative also indicated other community arts groups had sought retail sales space in the National Park like the Yanchep Rose Group had enjoyed at McNess House.

Gloucester Lodge

Gloucester Lodge options considered were: a. Make the rooms used for art exhibitions available during current Museum hours; b. Make the museum foyer area available during current Museum hours; and c. Allow the Group to operate on a seven day per week basis, collecting the Museum admission fees on behalf of the City. The Museum staff, except for the Curator, would become museum guides and conduct regular tours of the building and its collections.

The options were discussed with the Gloucester Lodge Museum Advisory Committee at their meetings of 12 September and 10 October. Some members of the Committee believed the art exhibition area should be available to all artists and not to one special group and locating the Group in the Museum foyer could compromise the security of the collections and access to and control of the rest of the building. Some members were also concerned that the positions of the museum staff could be threatened if the Group became responsible for opening the building and collecting the admission fees. One member believed that locating the Yanchep Rose Group in Gloucester Lodge would be an attraction.

Most members of the Advisory Committee agreed it would not be possible to provide retail space within the building.

Storage Shed

Adjacent to the building is a Council owned standard metal storage shed. The shed faces away from the building, is unlined, has power but no water supply and the only access is via the roller door at the front. This shed is used for the storage of some artefacts and museum flammable supplies.

At the Advisory Committee meeting of 10 October it was considered the shed could be used if it was feasible. Following further discussion at the 12 December meeting it was agreed that the storage shed would not be an appropriate place for the Group as it would be needed for Museum purposes and for any future maintenance and development that the Council may have for Gloucester Lodge. Members of the Advisory Committee also believed there could be issues with occupational safety and health given the fact that the shed was not designed for a retail sales role.

Tram

Adjacent to the building is one of the original Perth trams that were converted into accommodation units in the 1930’s. The tram is owned by CALM but forms part of the Museum exhibits and is used in the Ghostly Tours. It is located behind the Museum fenced area. It has been previously suggested as a possible location, though there is no power or water connected to the Tram.

Consultation

This issue has been discussed with the Gloucester Lodge Museum Advisory Committee at a number of meetings.

Comment

As has been indicated, members of the Yanchep Rose Group lobbied extensively from the time CALM advised their lease would not be extended. In the face of the lobbying, CALM has consistently maintained that the space is needed for its own Park operations and is no longer available to the Yanchep Rose Group or any other group for retail sales space.

As the buildings in the National Park are owned and controlled by the State Government, Council has few options in providing sales space to the Group. Any use of the Gloucester Lodge building or the storage shed would have to be agreed by CALM as the building and land owner.

The recommendation from the Gloucester Lodge Museum Advisory Committee is that it would not be possible to provide a retail sales space in the Gloucester Lodge building or the adjacent storage shed.

A major refurbishment of the Gloucester Lodge building is shortly to be undertaken by Council and this will impact in the short term as exhibits are moved to allow painting and repairs to be completed.

If Council agrees to allow the Group to use a space in the Gloucester Lodge building or the storage shed, it would need to agree on a suitable lease fee for the area so that discussions could be held with CALM to prepare a sublease.

If Council agrees to allow the Group to use the storage shed, the flammables and any artefacts would have to be removed and an alternative storage place found.

It should be noted that in the 11 October issue of the North Coast Times Community newspaper, the Group reported it was coping well since the closure of the retail outlet in the Yanchep National Park with increased stock for sale at the Two Rocks shop.

Background

In 2001, The City of Wanneroo held its first annual Art Award titled “Icons and Identities.” The exhibition was very successful with over 100 entries and approximately 400 people viewing the exhibition. It is envisaged that the City’s annual Art Awards will become established as a quality visual arts event in the Wanneroo area.

Detail

The proposed 2002 Art Awards are scheduled to be held from the 6th May to the 18th May 2002 in the Banksia Function Rooms of the New Civic Centre, as per the 2001 event. The timing of the event has been chosen so that it does not coincide with any other known Art Award in the northern suburbs.

Entries are open to all residents of Western Australia. Artists will be in the running to win prizes totalling $8,000. The City of Wanneroo Open Prize is the drawcard, valued at $3,000. As this is an acquisitive prize, the winning artwork will become part of the City of Wanneroo Art Collection.

The proposed categories are:

City of Wanneroo Open Prize $3,000 Painting Award $1,000 Works on Paper Award $1,000 Three Dimensional Works $1,000 Secondary Student Award $ 500 Tertiary Student Award $ 500 Peoples Choice Award $ 500 Best Entrant – City of Wanneroo Resident $ 500

The categories and prizes are the same as last years event except for changes to the Student Awards (expanded into two categories to ensure fair competition for artists of similar ability) and the introduction of the Best Entrant – Wanneroo Resident, to reward the best local talent, with the City having first option to purchase.

All works entered in the Art Awards will be for sale with a 10% commission payable to the City on all sales. It is proposed that the exhibition theme be “Moments in Time.”

An entry fee of $10 per entry is charged to offset the administrative costs of holding the event and to ensure that only quality artists enter. Each person is restricted to a maximum of two entrants.

All works entered must be less than 12 months old and shall be the original work of the artist. Each work is only to be entered in one category. City of Wanneroo residents are also eligible to win the Best Wanneroo Resident Category (not open to winner of Open Prize) and all entrants are eligible to win the People’s Choice Award.

The City of Wanneroo Art Award and Exhibition has the following objectives:  To encourage and support local Artists  To promote the City of Wanneroo  To develop an Annual Event to be recognised as a competition of high standard and promoting excellence in cultural pursuits  To provide Artists with the exposure needed to earn recognition and reward  To provide the Community the opportunity to access a high quality cultural activity

Due to the success of the inaugural City of Wanneroo Art Awards the proposed 2002 Art Awards will follow a similar format. It is an event that will attract great interest from residents and promote the cultural qualities of The City of Wanneroo. It is envisaged that the City of Wanneroo Annual Art Awards will become a major cultural event that the community will look forward to each year.

Background

Councillor Dot Newton has submitted her resignation from the above Committee as detailed in below:

“It is with regret that I am writing to tender my resignation from the Safer W.A.N.W. Metro Committee forthwith.

The reason for my resignation is as follows. Due to the scheduling of these meetings I find that I am unable to attend as they conflict with Council meetings which are also held on a Tuesday.

During the meeting held on February 5th an item on the agenda to change the day that the group meets was overwhelmingly defeated. Although the Safer WA constitution would allow me to remain a member without attending meetings providing my apology was given, I feel this defeats the purpose of nominating and being voted onto this committee by my fellow Councillors. I had hoped to become a contributing member of this committee.

I fully intend to remain on the Wanneroo Branch of Safer WA whose meetings are held on a Monday and therefore do not conflict with my elected responsibility of attending Council Briefings, Policy Forum and Full Council Meetings.”

Discussions at the Ordinary Council Meeting on the 5th February 2002 highlighted the problem that Elected Members from both the City of Wanneroo and Joondalup were experiencing in attending these meetings due to the meeting date clashing with Council’s Ordinary Council Meetings.

Despite a request being made by Councillor Newton to have the meeting day changed the Committee have not agreed to a change in meeting day

Local government is becoming one of the key stakeholders in community safety and security, with the provision of safety related services and the ability to collect information regarding community issues in this area. With this in mind it is unfortunate that local government decision makers (elected member representatives) .are unable to attend this District level meeting due to its current meeting dates.

Background

In order to promote the community involvement in the Council decision making process it has become a tradition of the City of Wanneroo to hold two Council Meetings on tour each year.

Last year Council went on tour to the following venues for the Ordinary Council Meetings in October and November 2001.

 Gumblossom Hall, Quinns Rocks.  Alexander Heights

Detail

Arrangements have been made by Cr Steffens in consultation with the Mayor to hold the Ordinary Council Meeting on the 9th April 2002 at the RAAFA Retirement Village. It is suggested that the Ordinary Council Meeting on the 21st May 2002 be held under the stars on the street verge – Bellport Parade, Mindarie.

Comment

Both Ordinary Council Meetings held on tour last year were very successful with many members of the local community taking part in the meeting through public question time.

24. Compliance Audit Return for Local Government- 2001 Program

Consideration and adoption of the City of Wanneroo Compliance Audit Return for the period between the 1st January to the 31st December 2001.

Background

Each local government is to carry out a compliance audit for the period 1 January to 31 December 2001 against the requirements included in the 2001 Compliance Audit Return.

For the similar period for 2000 Council adopted the Compliance Return without qualification at its Ordinary Council Meeting on the March 2000.

Detail

Detailed in the Officers Recommendation is the completed Local Government Compliance Audit Return for 2001.

This year three areas of non-compliance were identified in the Audit and are explained below:

12.4 Expenditure that the local government incurred from its municipal fund, which was not included in its annual budget, was:

a) authorised in advance on all occasions by absolute majority resolution; or

On one occasion Council incurred expenditure prior to authorisation. Authorisation by an Absolute Majority occurred at the first opportunity after expenditure had been incurred (Ordinary Council Meeting 18 December 2001) as detailed below:-

13.1 Financial reports, other than the annual financial report, and where Council made a resolution as per question 13.2, as prescribed, have been prepared in accordance with the (FM) regulations, presented to Council and recorded in the minutes of the meetings where submitted.

13.2 Council resolved, by absolute majority, not to prepare a quarterly or triannual report for the period ending 30 June 2001.

Compliance in this area was achieved in 2001 due to large turnover of Senior staff in Corporate Services. This has now been ratified.

16.1 Inspections of known private swimming pools either have been, or are proposed to be, carried out as required by section 245A(5)(aa) of the Local Government (Miscellaneous Provisions) Act 1960.

Inspections of all swimming pools requiring inspection were attempted within the due dates however access was not possible for a number and approximately 7 swimming pools had not been inspected as at 31st December 2001. All swimming pools have now been inspected.

Comment

All items of non-compliance were identified by the City’s Administration during the compliance year and remedial measured established to resolve the matter.

The Compliance Return has been audited by Council’s Internal Auditors who have provided the following statement.

The Local Government (Audit) Amendment Regulations 1999, Regulation15 states:

“14 (3) A compliance audit return is to be-

(a) presented to the council at a meeting of the council;

(b) adopted by the council; and

(c) recorded in the minutes of the meeting at which it is adopted.”

Regulation 15 further requires that the Compliance Return together with a copy of the relevant section of the minutes is to be provided to the Executive Director by 31 March next, following the period to which the return relates.

A strategy under the Strategic Goal – Corporate Management and Development is a strategy pertaining to establishing an organisation that is open, accountable and committed to customer service.

The Annual Compliance Return is a useful tool in assessing how well Council addresses its legal obligations under the Local Government Act 1995.

Over the past few months the frequency of antisocial behaviour in the Wanneroo Townsite and the surrounding area has increased significantly. I have approached Dianne Guise MLA for Wanneroo and have been advised that she has held discussions with the Chief Superintendent of Police in relation to this issue and has requested that urgent consideration be given to the upgrading of the Wanneroo Townsite Police Station.

26. Cr Rudi Steffens - Relocation of Playground Equipment - Ormiston Park

To seek Council approval to immediately relocate the playground equipment in Ormiston Park, Clarkson from its current location within the park to the top end of the park (Trephina Mews)

Background

At the Council meeting of 20th March 2001, a petition of 197 signatures was received from residents requesting that the City refurbish and grass Ormiston Park. Council resolved at this meeting as follows:

“That Council CONSIDERS the redevelopment of Ormiston Park, Clarkson in accordance with the final adopted report and recommendations for the Policy and Information Plan for Upgrading Distributor Roads and Unirrigated Parks (Hames Sharley 2001).”

Contained within the Officers report were details of costs relating to the relocation of the playground equipment to another site within the park. The cost associated with this relocation is estimated to be $5,000.

Detail

I have been contacted by a resident of the area with a young family complaining about the dangerous condition of the playground area and requesting that the playground be relocated to a safer position within the park.

Comment

On Saturday, 02 February 2002 I inspected the park and found the playground equipment full of graffiti. Broken glass and empty bottles were also prevalent blackboys have also been destroyed.

Can Council at least relocate the playground equipment to the top end of the park (Trephina Mews). The estimated cost in May 2001 reports was around $5,000. I would ask Council to allocate funds from the current financial year budget to relocate the playground equipment so the children can play safely.
