10.4 Director Infrastructure & Planning Report – Prepared by James Magee

Beulah Weir

Installation of the new weir and weir gates at the southern end of the Beulah Weir Pool has been completed and the weir pool is now filling.

The weir consists of four bays being 3m wide and 1.2m high. The gates will cater for all flood flows.

Warracknabeal Weir

With the creek at a lower level for footbridge works, Council has taken the opportunity to clean out excess clay from the area directly upstream of the weir. This is surplus material left from previous gate installations which could not be removed due to high water levels.

Wimmera Southern Mallee Transport Strategy

As part of the development of this plan Yarriambiack Shire Council has nominated the following priority infrastructure projects:-

Warracknabeal Regional Livestock Exchange

• Attended Exercise Odysseus conducted by the Department of Environment and Primary Industries in Horsham. Exercise Odysseus is aimed at enhancing national (government and industry) preparedness for implementation of a national livestock standstill in response to an outbreak of foot and mouth disease • Updates to Livestock Exchange software on WRLE laptop computers carried out on 8 May 2014

Risk and Safety Report – Prepared by Barry Sullivan

Audits have been completed on seven Kindergartens, five Maternal and Child Health Centres, two Playgroup Centres and three Day Care Centres. Centre Managers have been given a folder containing the Centre’s audit and items to be actioned to address risk and safety issues at each Centre. Chemicals and electrical items have been recorded at each site. Chemicals are to be recorded on Council’s Chemwatch database and electrical items are to be tested and tagged and recorded on Council’s Test and Tag database.

A risk and safety audit was conducted on raising and lowering the two flags as well as servicing the clock tower mechanism at the Warracknabeal Town Hall. The report was presented to Council Forum on 28 May 2014. Following the report to Council Forum, the access door to the tower has been locked and signposted, keys removed from the Hall and the Secretary of the Hall’s Management Committee informed. A meeting is to be scheduled on site to go through the report and discuss options.

The Preferred Contractor database has been upgraded by the Axiom Group. Letters have been sent to a small number of businesses that have not provided details of their public liability insurance details and OHS policies and procedures. Face to face meetings were held with these contractors to ask them to provide the information. If we continue to use contractors without the relevant requirements, Council will be liable for any public liability claims while they are working. Recommendations were submitted to management to address the issue.

An audit was conducted using accounts paid to contractors to determine if there were any contractors being paid by Council that weren’t registered on the Preferred Contractor database. A small amount of contractors were discovered working for Council.

I attended the Emergency Management Working Group Meeting. This meeting covered flooding information and road closures due to flooding etc.

The Personal Protective Equipment & Clothing Policy (PPE&C) has been upgraded following some minor changes by Council staff. The policy has been given over to the Human Resources Officer and will be presented to management and at the next OHS Meeting.

Attended a meeting with AFS & Associates to look at the risk management survey results conducted on Council’s Managers and Councillors and to assess what risk management procedures are in place within each Department. From the report further risk management information will be sourced from each Manager and Department to determine the current level of risk within Council.

On Wednesday, 28 May 2014 I attended the ‘Truth about Ice’ Forum at Warracknabeal as part of the Occupational Health and Safety part of my role. Looked at the effects of Ice on people and what Council’s staff will need to look for when dealing with people on Ice.

Six Incidents, two Hazards and two Near Misses have been reported over the past two months and have been recorded on Council’s Risk Register.

Incident and Hazard Report Forms have been upgraded to improve risk and safety efficiencies. Major changes are:

• Managers, Co-ordinators and Supervisors must clearly note down their immediate and final action to either minimise or eliminate the hazard/incident • OHS Representatives of the Designated Working Group must be informed when a hazard, incident or near miss occurs within their area • Supervisors/Co-ordinators must inform their Managers of the incident, hazard or near miss when it occurs • Corporate Services Manager must be informed if there is a likelihood of a claim occurring from the incident • Energy Safe Victoria to be informed of major incidents involving electricity or gas • Safety Officers to be informed immediately if a WorkSafe reportable incident occurs • All incident and hazard forms to completed and handed to the Safety Officers within 48 hours • WorkSafe incident forms to filled out and handed in immediately • Ratepayer’s complaints of hazards will only be accepted on a CRM form and not an internal hazard form • A ratepayer incident on Council owned or managed land is to be reported to Council on the incident form

WorkSafe’s Domestic Asbestos Removal Kits program commenced on 25 March 2014 and has been a great success throughout the Shire, with 43 kits being distributed to home renovators to date. Two home renovators have travelled from Horsham to pick up kits from Warracknabeal.

An agreement between Horsham Rural City Council and Yarriambiack Shire Council has allowed renovators to deliver their asbestos to the Dooen Landfill site free of charge. Kits are given to renovators free of charge as an incentive to use them, with a maximum of two kits available to each renovator.

WorkSafe distribute the kits to Local Government free of charge throughout Victoria.

Beulah Hall Kitchen Upgrade and Beulah Multi Purpose Centre Upgrade joint Project

• Adequate local funding for the hall kitchen has been donated • The final application was lodged on 7 May 2014 • RDV funding of $37,000 for this $50,850 project has been approved subject to ministerial announcement

Boolite Hall Upgrade

• An initial meeting was held with the local Hall Committee in October 2013 regarding needs for the hall • The Committee plans to arrange quotes for planned works sometime during 2014

Hopetoun RSL Building Upgrade and Patchwork Club Relocation

• This project and a high level of local support with Hopetoun Lionesses, Red Cross and Happy Helpers keen to use the upgraded building • A wide range of local donations have been received • A final funding application was submitted to RDV on 25 March 2014 • RDV funding of $30,000 for this $47,000 project was approved on 7 May 2014 subject to ministerial announcement

Hopetoun Industrial Estate

• The approved estimated cost of this four Lot subdivision is $194,000 • RDV funding of $82,500 was approved in September 2013 • The remainder of funding is from Council • The planning permit was issued in April 2014 • Purchase of the land by Council is complete • Design of road works and highway works have been completed • Electrical power works have been completed • A contract for water and sewerage infrastructure has been awarded S & C Macklin • Road and drainage works are programmed for June/July 2014

Hopetoun Mallee Bush Retreat Stage 5

• Stage 5 is the construction of another accommodation unit • RDV funding of $60,000 was announced during October 2013 • The cultural heritage assessment has given approval for the project • A planning permit for the development has been issued • A staged building permit was issued on 29 May 2014 • A builder has been appointed

Lubeck Recreation Reserve Shelter

• Shire staff met with the local committee to discuss the project in 2013 • The local committee is scoping and costing the project

Minyip Bushland Reserve Resurfacing Project

• DOT funding of $4,000; Rupanyup Community Bank funding of $1,000 and RDV funding of $7,800 have been approved • Gravelling of the walking track has been completed • Brochures are being printed • The feature sign for the reserve has been installed

Murtoa Walking and Bicycle Tracks

• Council is assisting the Murtoa Progress Association to develop this project • It is currently at the early planning stage

Patchewollock Walking Tracks

• The project involves upgrading some walking tracks and the car park • The project has been discussed on site with the Patchewollock Progress Association and DOT • The Patchewollock Progress Association has committed $5,000 to the project dependant on DOT funding • It is currently at the early planning stage

Patchewollock Railway Station Building Upgrade

• Shire staff have met with the local Progress Association and DOT to discuss and scope the project • The project involves restoring the heritage listed Railway Station building to a reasonable standard • The project needs to be costed and an application for funds made

Walking Tracks – Yarriambiack Creek, Beulah and Rabl Park, Murtoa

• An application for funding for this $29,000 project was made to DOT on 30 May 2014

Warracknabeal Town Hall Business Sustainability Plan

• RDV require the Hall Committee to prepare a long term sustainability plan for upgrading the building supported by a business case before they will consider any grants for capital works • RDV approved $7,500 in funding for the $10,000 project on 19 March 2014 • Two consultants were interviewed for this project • The consultancy was awarded to Hirst Projects on 22 May 2014

Warracknabeal Town Hall Upgrade

• The Committee is scoping and costing the project and designing a new kitchen with a design consultant • The first stage of the Committee’s priorities focuses on upgrading the kitchen and supper room

Warracknabeal Historical Society Business and Marketing Plan

• RDV require the Museum to prepare a business and marketing plan before they will consider funding any capital works • RDV approved $7,500 in funding for the $10,000 project on 19 March 2014 • Two consultants were interviewed for this project • The consultancy was awarded to Hirst Projects on 22 May 2014

Warracknabeal Wheatlands Museum Foyer Construction

• Assistance was given to the Committee in the development of working drawings and specifications • The Committee is currently obtaining quotes for the construction of the shell of the new foyer

Woomelang Cronomby Tanks Walking Track Development

• Walking tracks and the car park have been gravelled • A planning permit for the toilet has been approved • A building permit for the toilet has been issued • The outstanding works being the construction of the toilet have been ordered and should be completed by 3 June 2014 • This will complete the funded project • Additional walking tracks and signs are planned subject to additional funding

Woomelang Hall Kitchen Upgrade

• Council staff have offered assistance to the local committee in developing this project • The local committee are at an early planning stage

Yarriambiack Creek Footbridge in Warracknabeal

• The project estimate is $295,000 • RDV funding of $220,000 was approved in October 2013 • DOT funding of $20,000 has been approved • The Creek Committee is supplying cash and in-kind funding • Council is providing in-kind project management and design support • A planning permit for the works has been issued • A Works on Waterway Permit has been issued • Four tenders for the works were received • Council awarded the design and construct contract to Andrew Cairns Nominees Pty Ltd trading as Cable Bridge Constructions for $250,500 plus GST on 12 February 2014 • A boardwalk to connect the suspension bridge to the east side of the creek has been designed • Detailed design of the works is currently proceeding • The creek level has been lowered to allow the works to proceed • In-kind earthworks by the Committee and Council staff and Council plant to give pile driving equipment access to the site have been completed • Construction is programmed to commence on 10 June 2014

Kindergartens

The Annual Kindergarten Committee Dinner is on 2 June 2014. This year we have the Department of Education and Early Childhood Department (DEECD) and our Cluster Management Improvement Project Consultant as our speakers.

The Hopetoun Kindergarten facilities upgrade is working well. Thanks to Mayor Andrew McLean for stepping up to do the official opening when the Member of Parliament failed to attend due to a communication mix up with his office and the Department. The Early Years Minister’s office has rung the Hopetoun Kindergarten Committee and expressed their apology.

Wimmera Uniting Care has moved into their area now and Council will work and consult with them to ensure the community can benefit from the improved facilities.

Environmental Health / Local Laws – Prepared by Tim Rose and Greg Wilson

Food premises inspections were conducted during May. Approximately nine premises were assessed against the benchmarks set by the Food Standards Code. Food proprietors have remained co-operative and generally utilised all available resources to comply with relevant food law. A premise of concern from last month has been revisited and has displayed significant signs of improvement.

A number of food samples were obtained in May. Samples were obtained from a number of different premises, including meals on wheels suppliers to ensure food is of the expected quality and safety for eligible recipients. One sample from a retail premises did not receive results that Council would consider acceptable. Council has discussed the matter with the proprietor and appropriate advice provided – a further sample will be obtained in coming weeks to ensure compliance.

A concern was raised with Council in relation to the water quality of the Yarriambiack Creek and, more specifically, if blue-green algae poses any risk to the public. Council sampled the creek water and can confirm that at the time of sampling, blue-green algae did not pose a risk to the community.

Onsite wastewater and related enquiries have remained constant, with the majority of all work during this month being a result of the CFA shed upgrade projects.

Council attended the community consultation for the Rupanyup Sewerage Scheme in early May. Works have commenced within the township, however the completion date has been extended to September 2014. The residents who attended the consultation appeared positive about the project.

Council has been successful in obtaining a $2,200 grant from the State Government to purchase data loggers to ensure that vaccines remain at acceptable temperatures while in storage and while being transported around the Shire.

This month has been fairly busy with animal issues relating to cats, dogs and horses.

There have been several more attacks on sheep in the Brim area. This investigation is ongoing as the offending dog has not been located. All efforts will be made to catch the dog so the owner can be made accountable for stock loss.

Council continue to have issues with dogs in Murtoa, one dog was seized for rushing a community member; fortunately this dog is known to Council and should be formally surrendered later this week.

Council are also working with owners to rectify other dog related issues within the Shire. These dogs are also known to Council due to problems in the past.

Council have also been working with the RSPCA in relation to complaints about horses in several locations across the Shire; this has been quite time consuming. However, the owners of the horses are now working with Council and the RSPCA to rectify the problems.

There has been an increase in wandering dogs of late, this has been a worrying trend and Council are looking at a media release to remind owners of their responsibilities.

Council have also trapped several wandering dogs this month after being informed by members of the public. All have been working dogs that have been either left unsecured when owners travel into town or unsecured at night. All parties concerned have been spoken to.

Cats are still being trapped across the Shire with a reported increase in adult cats.

Unfortunately rubbish has been dumped once again in the creek at Batchica, enquiries are continuing to track down the offender to have this cleaned up and issue infringements.

Both Rangers attended two days training in Halls Gap and were updated in all the changes being made to the Domestic Animals Act. There were also presentations from EPA Victoria; a case study on declaring dangerous dogs; and what an officer’s authorisation actually means and what powers they have.

Aged and Disability – Prepared by Lisa Dunkley

HACC (Home and Community Care)

May has been a very steady month, with the Home & Community Care Workers engaging in training, keeping them up skilled in First Aid and Foot Care.

In the next few months HACC workers will also participate in ‘Professional Boundaries’, ‘Administering Medication’ (refresher), ‘Healthy Bones and How to Prevent Osteoporosis’ Training.

Council held ‘Memory Lane’ this month at Neighbourhood House – once again only two attended which is very disappointing. Further discussions will be needed with their carers or family on how to draw people with dementia out of the community to get together and talk, share and realise they aren’t alone.

We have our Seniors Forum coming up in June where we get together and discuss what will be happening on the day and what they would like to do. Council will provide a luncheon afterwards. We have Wayne John (Healthy Ageing Project Officer, Department of Human Services) attending to give a talk on ‘How to Achieve Healthy Ageing’.

All surveys have been returned and counted and the results have shown 92 percent of clients are very happy with their Service. This is a very satisfying result.

The Department of Social Services and State Department of Health have recently run information sessions on the changes to HACC services and funding in the future.

While we will not see changes occurring in the near future in Victoria, over the next three years the way HACC is funded and managed will change. At this point we cannot clearly define what impact that will have on Local Government services but we know client will see changes more immediately. Increase from client fees of around 5% of service costs to 15% are being stated by Commonwealth. Funding will be population based and assessment will be managed independently of service provision. The discussion paper is out now and we will be looking to the Municipal Association of Victoria to assist us to understand and negotiate through the changes.

Youth

We have applied for $20,000 under the Local Government Youth Inclusion Grant 2014/15 round to assist in our goal of developing a youth leadership group across our Shire.

Volunteer Meals and Transport – Prepared by Michelle Hallam

Council have now completed surveys of all Volunteers and Meals on Wheels (MOW) customers (surveys tabled). Feedback from surveys will be relayed to MOW suppliers and used by our Volunteers co-ordinator to plan for supporting volunteers in the future.

Maternal and Child Health (MCH) – Prepared by Nanette Freckleton and Ros Barber

Council has been hosting Michelle Schilling as she does her final placement to complete her MCH training. Michelle is already employed by us as our nurse immunizer.

Nurses have recently been working with a number of families with complex needs.

Older Adults Strength Training Group

Continuing on Friday’s with Stacy Drage, growing numbers attending each week (38 this month).

Boxing

With Warracknabeal Secondary College teacher Axel Williams volunteering his time as this is a passion of his. 36 students have attended the 5 sessions this month involving students from Years 7 – 10. This program continues to operate on Tuesday & Thursday nights for 1 hour & is ongoing depending on numbers.

Fitness Circuit

We welcome Brad Wade to the Warracknabeal Leisure Centre. Brad has a lot of experience in the fitness industry and has been well supported in his first two sessions. Sessions are held on Wednesday nights 6.30pm – 7.30pm. The number of attendees on the first night was 22 and 16 on the second night. Brad is offering variety in his group fitness sessions incorporating cardio, weights & short circuit work.

19 client visits to the Gym for May + 4 group sessions on Monday afternoons. Woodbine has recently signed up for “Corporate Membership” which now allows Woodbine staff usage of the Gymnasium during the Centre’s regular opening hours. This has sparked some interest with the intentions of promoting the wellbeing of staff.

Warracknabeal Secondary College

Two sport teachers regularly make use of the Leisure Centre to conduct their sport & physical education programs - 7 group visits engaging in Badminton this month.

Mudmap to Manhood

This program is held annually by the Warracknabeal Secondary College (WSC) for Year 9 boys and focuses on personal development and building self-esteem. Conducted by Caleb Lourensz, Rural Outreach Diversion Worker Grampians Community Health. This program was delivered by Stacey Drage and is always well received.

Jump Start – Basketball Program

Involves Dale Shannon, WSC, Peter Clayton, Warracknabeal Special Developmental School and Basketball Victoria Inclusion Officer, Timothy Downes. This program has been running fortnightly since end of April 2014 and will finish at the end of the term.

Morning & afternoon Gym sessions on Thursday’s continue to be successful. 10 group visits this month & one basketball session.

St Mary’s Primary School

Held a one off tabloid style sports session this week occupying both courts with approximately 40 students & teachers attending.

Actives After School Communities Program

Started their Term 2, 7 week program. Table Tennis on Monday’s involving Years 3 – 6 students and Multiskills on Tuesday’s for Years Prep – 3. This program is delivered by Year 10 – 12 Students who have completed a sports coaching program through the Warracknabeal Secondary College & Australian Sports Commission and are recognised as Qualified Sports Coaches. These sessions cater for around 20 participants.

Warrack Eagles Netball Club

7 training sessions with a total of 211 attendees.

Warrack Hockey Club

1 training session with Juniors where 21 attended with Coaches.

Warracknabeal Table Tennis Association

Monday nights with Seniors are now in full swing having completed Round 5 of their 18 week competition with an active 10 teams & 40 members, while the Juniors are still getting warmed up following their third round with 20 players participating on Wednesday nights after school.

Netball Victoria Northern Zone

Conducted another of their training sessions at Warracknabeal on 18 May 2014. Around 30 Under 17 players travelled from , Echuca, , Horsham, Nhill, Edenhope and surrounding districts to advance their skills for the upcoming competition. They consider Warracknabeal to be the most central in their Zone.

Community Gardens

Rural Northwest Health is working alongside communities in Beulah, Hopetoun and Warracknabeal to establish community gardens. The working groups are currently researching potential sites and developing governance frameworks.

Caravan Park Tree Reports

The recent Caravan Park Tree Safety Audit provided by Skyrider Tower Hire for the Council managed Caravan Parks has highlighted the need for some tree removal and trimming work on existing trees. The tree audit was conducted to ensure the safety of patrons, public and staff who utilise the parks. Planning Permit applications have been submitted for the removal and trimming of some trees in the Hopetoun, Murtoa and Warracknabeal Caravan Parks.

Patchewollock Mallee Farm Sculpture Exhibition

The Exhibition is proposed to take place on Friday, 17 October 2014 as a component of the annual Patchewollock Music Festival. The Exhibition will showcase sculptures made from items typically found outdoors or around farm yards.

Wimmera Mallee Tourism

The May General Meeting was held at the Model Car Raceway in Hopetoun. The Wimmera Mallee Tourism Facebook Page currently has 1,308 ‘Likes’.

Woomelang Precinct Planning Project

An ‘Open House’ community consultation was held at the Woomelang Multi-purpose Centre on 27 May 2014 to discuss concept drawings and potential use of the proposed new building development located at 69-75 Brooke Street. Woomelang RV (Recreational Vehicle) Friendly Destination

The application submitted to the Campervan and Motorhome Club of Australia nominating Cronomby Tanks as an RV Friendly Destination was successful. The RV Friendly Destination initiative is aimed at assisting RV tourists to locate relevant facilities whilst travelling.

Yarriambiack Tourism

A Yarriambiack Fishing Trail has been created to highlight a series of freshwater fishing hotspots designed to attract travellers from across the region.

The Yarriambiack Tourism Facebook Page currently has 875 ‘Likes’. The Brim town brochure is now complete and distribution is underway.

Country Football and Netball Program 2012/2013

The Minyip Murtoa Football Netball Club oval lighting at Murtoa Recreation Reserve grant acquittal documentation is now being prepared to finalise the project.

Community Facility Funding Program 2013/2014 – Minor Facilities

The Hopetoun Cricket Club Practice Facility project is now complete and grant acquittal documentation is currently being prepared to finalise the project.

Country Football and Netball Program 2013/2014

A full application has been submitted to the above program for the Hopetoun Community Centre and Football/Umpires Facilities Upgrade project requesting a grant of $73,000 (please refer to the Putting Locals First Program section below for further details).

Putting Locals First Program

The preparation of an Expression of Interest is underway for the Hopetoun Community Centre and Football/Umpires Facilities Upgrade in conjunction with the Country Football and Netball Program. The total capital expenditure for this project is $348,000 with a grant requested from this program of $225,000.

Financial details of the project are: total of grants requested - $298,000, cash from the Hopetoun Recreation Reserve Committee of Management - $50,000 and in-kind labour and equipment to the value of $58,300, which gives a total project cost of $406,300.

Community Facility Funding Program 2014/2015 – Minor Facilities

The Activity Schedule has been received, signed and returned for the Murtoa Bowling Club Synthetic Green project. It is anticipated works will commence late September/early October, weather permitting.

Community Facility Funding Program 2015/2016 – Minor Facilities

We are waiting on the outcome of the Expression of Interest submitted for the installation of lighting to the new synthetic bowling surface at the Beulah Bowling and Croquet Club.

Should the Expression of Interest be supported a full application will then be developed.

Community Facility Funding Program 2015/2016 – Planning

We are waiting on the outcome of the Expression of Interest submitted to develop a new Shire wide Sport & Recreation Strategy, as the previous Strategy was prepared in 1997/98 and is obviously out of date.

Hopetoun Fishery

We are still waiting on a detailed plan from the Hopetoun Angling Club and GWM Water regarding fence re-location and proposed location of the cut in to the Lake prior to further investigations being undertaken. 10.8 Infrastructure Services Report – Prepared by Bernie Naylor

EPA – Transfer Stations

EPA Victoria has undertaken an inspection of the Transfer Stations located at Warracknabeal, Murtoa and Rupanyup as part of a program to ascertain how transfer stations and unlicensed landfills are being managed.

Some of the issues raised by the EPA during this inspection were:-

• Contamination of the Green Waste – Painted and treated timber, mattresses • Oil recovery facilities – require bunded and covered area • Vehicle batteries – require bunded and covered area • Contamination in Uncrushed Concrete Stacks • Access to Transfer Stations by contractors outside operating hours

In relation to the final dot point, Council has always worked in with contractors undertaking demolition works within our townships and provided them access to the transfer stations outside operating hours, generally to dispose of timber, roofing iron and clean concrete.

Unfortunately materials that should go to the Dooen Landfill and not our facilities have been disposed of at the Transfer Stations.

Council is now reviewing our practises in allowing contractors access outside the operating hours and may need to only allow access when the transfer station is open to the public.

Council is still waiting on the full report to be completed and forwarded to us.

Murtoa Swimming Pool Change Rooms

Following discussions Council has had with the Murtoa community, a request has been made to investigate the possibility of upgrading the change rooms at the Murtoa swimming pool, including the adjoining public toilets and also incorporating a facility for people with disabilities.

I have since met with a representative of the Swimming Pool Committee, Richard Bales from RDV and Rohan Fry from Grampians i-Design.

As Council would be aware a similar project was undertaken at Hopetoun swimming pool, which incorporated public toilets and BBQ areas.

Draft drawings and an engineering assessment will be undertaken and when completed Council will then present these to the Swimming Pool Committee as well as the Lake Committee.

Resale Centres

Works on the construction of the three (3) “Resale Centres” located at Murtoa, Warracknabeal and Hopetoun have commenced.

The concrete slabs have been poured and construction will now be undertaken of the Sheds.

These works have been funded through the Grampians Regional Waste Management Group’s infrastructure grants.

It is anticipated that the works will be completed by the end of June 2014.

Domestic Asbestos Removal Kit – Pilot program

The Domestic Asbestos Removal kit program which commenced on Tuesday, 25 March 2014 has proven very popular with 40 kits being distributed to residents within the municipality.

We have been able to secure another 50 kits from WorkSafe at no cost to Council and Horsham Rural City Council has agreed to accept these kits at their landfill free of charge.

Bituminous Sealing Contract

Tenders have been called from suitably qualified contractors for the design and delivery of works to complete the bituminous resealing programs for the five participating Councils, being Northern Grampians, Hindmarsh, Horsham, West Wimmera and Yarriambiack.

A pre-tender meeting has been conducted to inform interested contractors of the tender and address any issues that they may have.

The contract will be for three years from the date of acceptance of the tender with the option for two extensions of one year each.

Tenders will close on Wednesday, 19 June 2014 and then be evaluated by a committee consisting of two representatives from each Council.

11.3 Town Planning Report TP03-14 – Prepared by David Young

Proposal

The applicant has applied to develop the land within a reduced setback, from a Road Zone 1 (RDZ1) by constructing two (2) grain storage silos and altering an entrance way from the RDZ1 (see Appendix 1.0 Development Plans).

Background

Council received a complaint in relation to a neighbour constructing silos within close proximity to their house. An investigation was carried out and a meeting occurred on site with the owner of the land. A summary of this meeting is set out below:-

1. Mr Ross Johns confirmed that he carried out the works on the land without the required Planning and Building Permits being obtained; 2. Mr Johns and Mr Fry (Consultant), were advised there would be a two step approach to the illegal works. Firstly they would be required to apply for planning permits and these would be assessed through the regular process (which would include advertising, referral and assessment). Secondly, Council would consider what legal action (if any) will be taken for the illegal building and works; 3. Mr Johns and Mr Fry were advised of the potential outcomes of a planning application and the rights of appeal; 4. The works are approximately 93 metres from a dwelling not in the same ownership; 5. That the following had been constructed without a permit:-

• A concrete pad 1 metre off the front boundary – the pad is approximately 52 metres long and 5 metres wide • 6 small silos fixed to the concrete pad • 1 large silo fixed to a concrete base • 1 large concrete pad ready for a second large silo • 1 new access off the highway reserve

The applicant has submitted an application which removes the silos from within the setback trigger from a dwelling not in the same ownership.

Site and Surrounding Locality

The subject land forms part of a large farm holding mainly used for cereal production. The area designated for the large silos is relatively flat and contains no vegetation. There is existing vegetation to the south of the subject area. A CFA shed is located to the west as well as an existing house. Access is via an existing entranceway that has been upgraded (see Appendix 2.0 Location Plans).

Planning Scheme Definition

The development of land for 2 x grain storage silos within a reduced setback from Road Zone 1 (RDZ1) and the alteration to a property access way from a RDZ1.

Why is a planning permit required?

Clause 35.07-4 Buildings and Works A permit is required to construct or carry out any of the following:

Clause 52.29 Land Adjacent To a Road Zone, Category 1 A permit is required to create or alter access to a road in a Road Zone, Category 1.

Referral

The application was referred to VicRoads. They did not object to the application but requested conditions be placed on the planning permit if issued.

Advertising

The application was advertised for public comment in accordance with Section 52 of the Planning and Environment Act. This was done through letters to adjoining owners and a sign on site.

Objection

G & J Pearson have objected to the application, the objection is based on:

Relevant Planning Scheme Provision

35.07-6 Decision Guidelines

Before deciding on an application to use or subdivide land, construct a building or construct or carry out works, in addition to the decision guidelines in Clause 65, the responsible authority must consider, as appropriate:

General Issues

• The State Planning Policy Framework and the Local Planning Policy Framework, including the Municipal Strategic Statement and local planning policies • Any Regional Catchment Strategy and associated plan applying to the land • The capability of the land to accommodate the proposed use or development, including the disposal of effluent • How the use or development relates to sustainable land management • Whether the site is suitable for the use or development and whether the proposal is compatible with adjoining and nearby land uses • How the use and development makes use of existing infrastructure and services.

Design and Siting Issues

• The need to locate buildings in one area to avoid any adverse impacts on surrounding agricultural uses and to minimise the loss of productive agricultural land • The impact of the siting, design, height, bulk, colours and materials to be used on the natural environment, major roads, vistas and water features and the measures to be undertaken to minimise any adverse impacts • The impact on the character and appearance of the area or features of architectural, historic or scientific significance, or of natural scenic beauty or importance • The location and design of existing and proposed infrastructure including roads, gas, water, drainage, telecommunications and sewerage facilities • Whether the use and development will require traffic management measures

Officer Comments

A planning application is required due to the reduced setback and to alter an access from a RDZ1. A permit is not required in this case for a reduced set back from a dwelling not in the same ownership.

Council needs to consider the reason for the permit trigger. The purpose is the impact on the road from a reduced setback of a development and altered access. The reason behind the reduced setback trigger is for Council and VicRoads to consider matters in relation to road safety, design and siting. VicRoads have considered the application against their road safety standards and have not objected to the application, VicRoads is the land manager for the road.

Vehicles travelling away from Warracknabeal in a north-west direction would not see the bulk of the silos due to the adjoining land being vegetated with mature trees. Vehicles travelling in a south-east direction would be able to see the proposed silos. However, there is an existing CFA Station within 3 metres of the road reserve that would pose a more potential issue than the proposed silos. There are a number of other structures within close proximity built closer to the road than what the proposed silos will be.

The subject land is part of a large farm holding. The land is capable of supporting the proposed development. The land is not restricted through any natural or man made restraints and is clear and easily accessible. Surrounding land is all used for farming purposes and the proposed development will be used to meet current and future farming requirements.

The subject silos and subsequent vehicle movements are not what would be deemed unacceptable in a farming area. Dwellings are considered to be of a second consideration to that of farming. The subject land and all of the surrounding land is zoned for farming purposes and part of this is the views will be related to farming infrastructure and uses (land and surrounding land for farming activities not for rural living).

Privacy and lifestyle is always a consideration, however the area is zoned farming and has been used for that purpose for a significant number of years. Anyone living in a farming area has to expect that development and uses associated with farming will come first.

Noise is a constant in a farming area no matter what the process that is occurring. Noise associated with the proposed development would not be considered unreasonable or unexpected in a farming area.

The prevailing wind conditions for the Wimmera-Mallee are from the north-west. The subject silos and entrance ways are located to the south-east of the dwelling involved in the objection. The majority of dust, odour and noise will be emitted away from the dwelling.

Even though the applicant primarily meets the provisions of the Yarriambiack Planning Scheme, it is unfortunate that he did not choose another location (given the size of his land holdings), to locate the silos. There would have been more than just this location that would have been appropriate to build on, which would have been well away from the objectors’ house.

Planning needs to consider orderly planning and the primary purpose of the zone, even though this application meets the provisions of the zone, approval may not foster good neighbourly relationships.

Conclusion

Council needs to consider the reason for the permit trigger. The purpose is the impact on the road from a reduced setback of the structure and altered access. A permit is not required in this case for a reduced set back from a dwelling not in the same ownership.

Surrounding land is all used for farming purposes and the proposed development will be used to meet the needs of farming requirements. The subject silos and subsequent vehicle movements are not what would be deemed unacceptable in a farming area. VicRoads have considered the application against their road safety standards and have not objected to the application.

Anyone living in a farming area has to expect that development and uses associated with farming will come first. Noise is a constant in a farming area no matter what the process that is occurring. However the noise associated with the proposed development would not be considered unreasonable in a farming area.

Based on the assessment against the Yarriambiack Planning Scheme the application should be supported by Council.

Recommendation

Notice of Decision to Grant a Permit

That Council having caused notice of Planning Application No TP03-14 to be given under Section 52 of the Planning and Environment Act 1987 and having considered all the matters required decides to Grant a Notice of Decision to Grant a Permit in respect of the land known and described as Lot 1,2 & 3 on TP218795D being Volume 09714 Folio 143, for the development of land for 2 x grain storage silos within a reduced setback from a Road Zone 1 and the alteration to a property access way from a Road Zone 1, in accordance with the endorsed plans and subject to the following conditions:

Conditions

1. The development as shown on the endorsed plans must not be altered without the written consent of the responsible authority.

2. The development must be managed so that the amenity of the area is not detrimentally affected, through the:

a. transport of materials, goods or commodities to or from the land b. appearance of any building, works or materials c. emission of noise, artificial light, vibration, smell, fumes, smoke, vapour, steam, soot, ash, dust, waste water, waste products, grit or oil d. presence of vermin

3. Provision must be made on the land for the storage and collection of garbage and other solid waste by-products created from the construction of the silos. This area must be graded and drained and screened from public view to the satisfaction of the responsible authority.

4. Soil erosion control measures must be employed throughout the construction stage of the development to the satisfaction of the responsible authority.

5. Any contaminated soils or products removed from the site must be disposed of in accordance with the relevant State Environmental Protection polices and to the satisfaction of the responsible authority.

6. Any fill proposed to be moved onto the site must be free from contamination and other matter. All fill is to be to the satisfaction of the responsible authority.

7. Before the development starts, a landscape plan to the satisfaction of the responsible authority must be submitted to and approved by the responsible authority. When approved, the plan will be endorsed and will then form part of the permit. The plan must be drawn to scale with dimensions and three copies must be provided. The plan must show:

• A landscaping strip no less than 100 metres long and five metres wide commencing at the entrance way to the property and heading in a north-west direction along the inside of the property boundary • The landscaping must be designed to form a visual barrier between the silos and the adjoining dwelling

• A planting schedule of all proposed trees, shrubs and ground covers, including botanical names, common names, pot sizes, sizes at maturity and quantities of each plant. Preference is given for native species. All species selected must be to the satisfaction of the responsible authority

8. Before the use of the development starts or by such later date as is approved by the responsible authority in writing, the landscaping works shown on the endorsed plans must be carried out and completed to the satisfaction of the responsible authority.

9. The landscaping shown on the endorsed plans must be maintained to the satisfaction of the responsible authority, including that any dead, diseased or damaged plants are to be replaced.

10. The loading and unloading of goods from vehicles must only be carried out on the land subject to this permit.

VicRoads

11. Proposed access from the Warracknabeal Rainbow Road to the subject land must be located where it meets Safe Sight Intersection Distance (SISD) as per AUSTROADS publication “Guide to Road Design, Part 4A – Un-signalised and Signalised Intersections”.

12. Access must be designed so that all vehicles can be driven in a forward direction when entering or leaving the subject land.

13. Work on the Warracknabeal Rainbow Road access must be in accordance with the VicRoads design SD 2065 “Truck Access to Rural Properties - Type B”.

14. The table drain must be crossed by a culvert of minimum size 300 mm to VicRoads standards. The culvert must have 'driveable' end walls fitted in accordance with Standard Drawing SD 1991.

15. This permit will expire if one of the following circumstances applies:

• the development is not started within two years form the date of this permit • the development is not completed within four years of the date of this permit

The responsible authority may extend the periods referred to if a request is made in writing before the permit expires, or within six months afterwards.

Note:

It is your responsibility to ensure all other authorisations are obtained prior to any works commencing. This may include Building, Engineering and Local Laws Permits. You are also required to abide by any State and Federal Legislation in relation to your approved proposal.

The people who deliver are lovely and happy to have a quick chat – Murtoa - I am nearly 81 and my husband nearly 82 and we have looked forward to the MOW days and a chat with the deliveries to brighten our day – Beulah - Staff and Volunteers are excellent – Beulah - It is a wonderful service for us at home. Further comments about your experience that could help our Shire improve the volunteer experience for yourself and others?  I feel most clients show great appreciation for what we do .... more so than the Shire?? - Warracknabeal  Transport Driving is a very worthwhile thing to do and is appreciated very much by those who use it. I hope it continues always. - Warracknabeal  I think we need more MOW and Transport volunteers. A big ‘drive’ in local newsletter or maybe a letter drop. Mainly due to our aging population. - Beulah  I don’t believe you can be taught to be a volunteer. If you have to be taught, undertake classes, in my book you are not a volunteer. - Murtoa  Could not attend MOW information day on 24th April due to unforseen circumstances - Beulah  A great experience to be able to help those who need help – Beulah  Shire could perhaps advertise for more Meals On Wheels volunteers, as it is rewarding but comes around often especially if you are involved in more than one group – Murtoa  Encourage younger people to join the Meals On Wheels group. Most of us are too old for many rounds.  Shire lapsed when a yearly form was not supplied to Beulah Volunteers on MOW. This has now been rectified and is most necessary as we need to know who we can change dates with ie. Allocated dates is not suitable. - Beulah
