[email protected] Submission #55 A PAPER FOR PRESENTATION TO JOURNALISM RESEARCH IN THE PUBLIC INTEREST, NOVEMBER 19-21, ZURICH ABSTRACT Canada exhibits one of the world’s highest levels of media ownership concentration, due in part to a failure of regulation. In an attempt to ensure that a portion of the benefits from broadcasting takeovers and acquisitions accrued to the public, the broadcasting regulator Canadian Radio-Television and Telecommunications Commission established the Public Benefits program in the late 1980s. Under the program, a minimum of 10 percent of the value of acquired broadcasting licences was required to be devoted to worthwhile initiatives. In the Cdn $2.3-billion takeover of television network CTV by Bell Canada Enterprises in 2000, however, a portion of the Cdn$230 million Public Benefits package was devoted to funding a Canadian Media Research Consortium established between several universities. Mandated to “focus on the development of Canadian data for use in media planning,” the CMRC issued its first report in 2003. A Report Card on the Canadian News Media was criticized for flawed methodology and was cited as an example of “administrative” marketing research performed to the benefit of media owners rather than to the benefit of the public. The CMRC issued a five-year retrospective study titled The Credibility Gap: Canadians and their News Media in 2008 that addressed some of the earlier methodological flaws and perhaps as a result reached different conclusions. -

To help inform the discussion, please find attached a copy of a recent Phoenix Center paper entitled A Retrospective Analysis of Vertical Mergers in Multichannel Video Programming Distribution Markets: The Comcast-NBCU Merger. In this paper, Phoenix Center Chief Economist Dr. George S. Ford presents a retrospective analysis of the price effects of the Comcast-NBCU merger. In particular, Dr. Ford conducts an econometric analysis of data on the prices paid for programming by multichannel video programing distributors (“MVPDs”) before and after the transaction and finds no evidence that Comcast’s programming prices rose after the merger. The analysis covers general interest programming, news channels, and national and regional sports networks. Given these results, Dr. Ford concludes that there is either a lack of a net positive effect on incentives to raise programming prices above competitive levels following the vertical merger or that the behavioral remedies placed on the Comcast-NBCU merger were effective. -

Press release COMCAST RENEWS AND EXPANDS CAPACITY AGREEMENT WITH SES Luxembourg, 13 November 2013 – SES (NYSE Euronext Paris and Luxembourg Stock Exchange: SESG) today announced that Comcast Wholesale has renewed and expanded key agreements for nearly 650 MHz of C-band capacity to deliver a broad range of content management and delivery solutions to media companies across North America. As part of the multi-year deal, Comcast Wholesale continues to utilize 16 transponders aboard the AMC-18 satellite and one transponder on the AMC-1 spacecraft and has contracted one additional transponder on this spacecraft. The capacity enables Comcast to provide cable programmers, multiple system operators and independent cable operators access to linear and on-demand content distribution solutions, including Comcast’s HITS (Headend in the Sky) platform. The Comcast Media Center on-demand programming distribution will be transitioned from AMC-1 to the new SES-3 satellite in 2014. SES-1 at 101 degrees West, AMC-1 at 103 degrees West and AMC-18 at 105 degrees West make up SES's expanding cable video distribution neighborhood at their locations in the center of the arc over North America. AMC-18 has played an integral role supporting the HITS platform since 2007, when Comcast Wholesale moved its innovative platform from Ku-band to C-band. “This agreement marks the latest milestone in a long-term, collaborative partnership between Comcast Wholesale and SES that has always strived to meet the evolving needs and demands of the media and entertainment industry,” explained Ferdinand Kayser, Chief Commercial Officer of SES. “Comcast Wholesale has long been an engine for innovation for the cable industry with its HITS solution aimed at helping independent operators compete in a fiercely contested market. -
