APPLICATION NO. 07/0663/FULL

APPLICANT(S) NAME: Renegade Homes

PROPOSAL: Demolish existing rear annexes, extend existing listed buildings to form four dwellings and construct six new dwellings with on-site parking and amenity facilities LOCATION: Land At Susannah Houses Susannah Row Rhymney Tredegar

The application was presented to the Planning Committee held on the 13th February, 2008. Members agreed the Officer’s recommendation that the application be deferred to allow the applicants to enter into a Section 106 Obligation to secure the restoration of the listed buildings.

On completion of the Section 106 Agreement, officers are delegated to approve the application subject to conditions.

Members should be advised that, since that Committee date, the completion of the Section 106 Agreement has not been achieved because the original developers have been declared bankrupt. The Receivers then indicated their wish to complete the Section 106 Agreement and the matter being held on hold for several months, but no progress has been made on this matter. In this respect a report was presented to the Planning Committee held on 20th January, 2010, with a recommendation for refusal. However, the Receivers requested the matter be deferred to enable them to complete the Section 106 Agreement. To date this has not been achieved.

In the circumstances it is considered appropriate that the application should be refused.

RECOMMENDATION:

1. In the absence of the completion of a Section 106 Agreement to secure restoration of the Grade II Listed Buildings, the proposed development would be contrary to Policy HE2 of the Council Approved Unitary Development Plan which states that development affecting Listed Buildings will only be permitted where they would preserve the character and quality of the building or its sitting.
