I N T R O D U C T I O N

Particulars of the organisation, functions and duties

Shri Rajiv Kr. Bora, IAS, Principal Secretary is the head of the Department at the official level and is assisted by Dr. Om Prakash, IAS, Joint Secretary, Shri Naresh Ch. Misra, ACS, Joint Secretary and Shri Dipak Sarma, ACS, Joint Secretary, Shri Basanta Nath Sarma, Officer-On-Special Duty, Dr. Deepak Majumdar, ACS, Deputy Secretary, Smti. 2) Functions of the department of Personnel (A) :

This Department mainly deals with the establishment matters of ACS and IAS Officers and Policy matter relating to upper age limit for entry into Government service, Retirement Age and advises other Departments in matters of Re- employment in service after retirement, creation-up-gradation of Gazetted posts etc. Establishment matters of four Heads of the Technical Departments and Appointment of Chairman/Members of the Assam Administrative Tribunal are also dealt by this Department.

In order to implement the provisions of the Right to Information Act, 2005 of the Govt. of India, this Information Book (Manual) for the year 2011 is published with the aim to supply the information required by the other Departments and the same is to be collected from the Deputy Secretary, Personnel (A) Department. The procedure and fee structure for the information booklet is yet to be decided. RT-11 2 2.1 Personnel (A) Department is mainly the Establishment Department of the IAS and ACS Officers. It also deals with the upper age limit for entry into State Government Services, examination of retirement age and offer views in respect of creation/up-gradation of posts and re-employment matters, establishment matters of the Secretaries of four Technical Departments, appointment of Chairman and Member of the Assam Administrative Tribunal and Placement of Officers in other Departments/ Directorate/Corporation etc.

2.2 Originally Personnel Department was known as Appointment and Administrative Reforms and Training Department. Then it was bifurcated and renamed as Personnel (A) Department, Personnel (B) Department and Administrative Reforms and Training Department.

This Department deals with the Rules and Regulation relating to Establishment matters of ACS and IAS Officers and O.M. issued from time to time in respect of the subjects as mentioned in Para 2.1.

2.3. Main activities of this Department is transfer/postings and promotion etc. of the ACS and IAS Officers and all relevant service matters of ACS and IAS Officers as stated in Para 2.1.

2.5 This Department does not have any direct dealings with the members of the public.

CHAPTER – III

Procedure followed in Decision Making Process, including channels of supervision and accountability:

1. Procedure as laid down in the “Manual of Office Procedure, Secretariat”, Assam Rules of Executive Business,1968, FRs & SRs, Assam Services (Discipline and Appeal) Rules, 1964, Assam Civil Service (Conduct) Rules, All India Service Manual, Pension Rules etc. is followed for taking decision on various matters.

2. A note on a matter or a correspondence is processed and put up by an Assistant. The file is routed at different levels through Superintendent, Under Secretary, Deputy Secretary, Joint Secretary, Principal Secretary and some times the file is moved to the Chief Secretary and the Chief Minister, being the Head of the Department to arrive at a decision on an important matter.

3. A decision is communicated to the officials/others Department by Letters, Notifications and Office Memorandum. Officers at various levels whose opinion are sought for in the process of decision making are as follows :

4. Arriving at a final decision on a matter depends on the gravity of the matter. Final decision on a matter is taken by the Principal Secretary / Chief Secretary / Chief Minister / Cabinet.

5. Decision on establishment matters is taken on the basis of guidelines in the form of O.M/Rules/FRs & SRs etc. by the Officers as mentioned against Para 3 & 4.

CHAPTER –IV

Norms set by it for the discharge of its functions:

There are no activities / programmes of the Department to execute except the normal feature of establishment matter.

CHAPTER – V

Rules, regulation, instructions, manual & records held by it or under its control or used by its employees for discharging functions:

The establishment matters of ACS Officers are being dealt with as per procedure laid down in FRs & SRs, Assam Services (Discipline and Appeal) Rules, 1964 and Assam (Civil Services) Conduct Rule. As regards IAS Officers, the All India Service Manual of Government of India is being followed. As regards other matter, prevailing O.M/Notification/Instruction of the Govt. issued from time to time is being followed.

As regards functioning of the Assam Administrative Tribunal, the Assam Administrative Tribunal Act, 1977 is followed. RT-11 8 RT-11 9 CHAPTER – VI

1 Name and address of the affiliated bodies under Personnel (A) Department is Assam Administrative Tribunal (AAT).

The Assam Administrative Tribunal was established in the year, 1977 with one Chairman and two Members to look into the grievances of the State Govt. employees in respect of their service matters. It’s an Autonomous Body which is quasi-judicial in nature. Its office is at Panbazar, Guwahati-781 001.

OTHER USEFUL INFORMATION

As regards fees for obtaining information under Sub-Section (I) of Section 6 shall be accompanied by an application fee of Rs. 10/- (Rupees Ten) only by way of Cash against proper receipt or by Demand Draft or Bankers Cheque payable to the Authorized Officer of the Public Authority.

For proving information under Sub-Section (I) of Section 7, the fee shall be paid by way of Cash against proper receipt or by Demand Draft or Bankers Cheque payable to the Authorized Officer of the Public Authority at the following rates : -

(a) Rs. 2/- (Rupees Two) only for each page (in A4 or A3 size paper) created or copied. (b) Actual charge or cost price of a copy in large size paper. (c) Actual cost or price for samples or models ; and (d) For inspection of records no fees for the first hour, and a fee of Rs. 5/- (Rupees Five) only for each 15 (Fifteen) minutes (or fraction thereof) thereafter. RT-11 13 For providing the information under Sub-Section (5) of Section 7, the fees shall be charged by way of Cash against receipt or by Demand Draft or Bankers Cheque payable to the Authorized Officer of the Public Authority at the following rates : -

(a) For information provided in Diskette or Floppy Rs. 50/- per Diskette or Floppy.

(b) For information provided in printed Form at the price fixed for such publication or Rs. 2/- per page of Photocopy for extracts from the publication.

In case of denial of any information by the Information Officer there is the Principal Secretary of the Department as the First Appellate Authority to file Appeal Petition.
