1 Veit Harlan and Jud Süß – Conrad Veidt and Jew Süss Veit Harlan and Conrad Veidt were both associated with the flowering of German stage and cinema in the Weimar Republic. Veidt, born in 1893, was already a major figure, starring in productions like The Cabinet of Dr.Caligari that made cinema history. Harlan, seven years younger, was beginning to make a name for himself on the stage. When Hitler came to power their paths diverged diametrically. Harlan was an opportunist, made his peace with the regime and acquired a reputation as a director of films. Later he and his second wife, Hilde Körber, became friends of Goebbels. In April 1933 Conrad Veidt, who had just married his Jewish third wife, Lily Prager, left Germany after accepting the role of the German Commandant in the British film I was a Spy . When he returned to Germany the Nazis detained him to stop him taking the lead role in the projected British Jew Süss film. He eventually got out, but his acceptance of the role made the breach with his native country irrevocable. Six years later Harlan was persuaded by Goebbels to take on the direction of Jud Süß , the most notorious but also one of the most successful of the films made under the auspices of the Nazi Propaganda Ministry. Kristina Söderbaum, then his wife, took the female lead. In the meantime Conrad Veidt had moved to Hollywood and in 1942 appeared as Major Strasser, the German officer, in Casablanca , a role for which he is probably best known in the Anglo-Saxon world. -

"The Polysemy of Privacy " considers the highly protean nature of the concept of "privacy," which extends to myriad disparate legal interests, including nondisclosure, generalized autonomy interests, and even human dignity. For a concept of such central importance to many systems of protectingfundamental rights, its precise contours are surprisingly ill defined This lack of determinate meaning is not limited to the concept of privacy in the United States; virtually all legal systems that utilize privacy (or its first cousin, "dignity") have difficulty reducing the concept into specific, carefully delineated legal interests. In some respects, privacy means everything-and nothing-at the same time. Moreover, even in those contexts where one can identify privacy at a relatively choate, rather than highly abstract, level of jurisprudentialanalysis, the right of privacy often comes into direct conflict with other fundamental rights. For example, commitments to freedom of speech and to a free press often conflict with privacy interests; these conflicts, in turn, force courts to secure one interest only at the price of undermining another. -

PROPAGANDA FILMS DURING THE THIRD REICH by ASHLEY SCHRENK (Under the Direction of Christine Haase) ABSTRACT Films produced during the Third Reich generally fall into two categories: blatant propaganda films, which this paper terms hard-core propaganda films, or subtler, soft- core propaganda films. The first category frequently features vilification of Jews, as well as glorification of the German Volk, Heimat and of Hitler. Third Reich hard-core propaganda films portray Aryan Germans in opposition to other races, resulting in the extreme exclusion of the Other. The soft-core propaganda films are a toned down version of the hard-core propaganda films. This thesis proposes an inverse relationship between the level of inherent inconsistencies and contradictions within Third Reich films and the categorization of a film as hard-core propaganda. The greater the inconsistencies in relation to Nazi ideology, the more a film becomes soft-core propaganda and vice versa. A variety of hard and soft-core propaganda films are analyzed, and the overall effectiveness of such propaganda is examined. It argues that the MHM attempts to combine two functions of the museum: the museum as forum and the museum as temple. By examining the concept underpinning the reor- ganization of the permanent exhibition of the MHM, and by bringing examples from both the permanent and temporary exhibitions, the article shows that the discourse of the MHM presents some relevant compatibilities with the principles of agonistic memory, yet does not embrace agonism to the full. -

FREE SPEECH MEETS FREE ENTERPRISE IN THE UNITED STATES AND GERMANY* Thomas Lundmark" INTRODUCriON Society finds itself in a state of fundamental transformation, of progression to a new epoch. Futurists, as they call themselves nowadays, talk of a new "paradigm" in which the institution of the nation-state is in decline.' Society is evolving. New values and new hierarchies are being ushered in. In this process, the influence of government is waning and that of private or "free" enterprise is waxing. This Article seeks to expose and analyze this process or "paradigm shift." This exposition is peppered with examples, that is, with evidence that is suggestive rather than conclusive. This is so because the process is evolutionary, not revolutionary; the victory of a society and legal order focused on enterprise, over one centered on nation-states, is not yet assured. Nevertheless, if society does indeed continue to progress as imagined in this Article, then certain values of the existing order will be pitted against those of the new. And the confrontation will make itself felt in general in every aspect of public life and in the legal order and regime in particular.2 The confrontation between the old and new hierarchies is investigated in this article by the collision between two representative core values. These Germans not only had to negotiate and respond to “victorious” Americans who judged them by standards different from those in the regime for which they fought, but also had to put into perspective their active investment in a political and social structure that had initiated and carried out global war and genocide. This study analyzes nine personal interviews conducted between 2001 and 2004 to address how German soldiers and war prisoners remember their “private” experiences of the rupture of Germany‟s defeat and their transnational relations with U.S. personnel in captivity. By employing popular memory theory, it will investigate how German veterans, sixty years after the war, compose private memories and senses of self in the persistent shadows of their National Socialist past. -

FRIEDRICH DER GROSSE Friedrich II. von Preußen – genannt »der Große« – gehört in der ersten Hälfte des 20. Jahrhunderts zu den populärsten Figuren des deutschen Kinos und der »Preußenfilm« zu den besonders erfolgrei- chen Genres. Bis zum Ende des Zweiten Weltkriegs sollen über 40 Preußenfilme entstanden sein, darunter allein 15 Produktionen, in denen der Schauspieler Otto Gebühr Friedrich den Großen verkör- perte. Wie kein zweiter Darsteller prägte Gebühr das Bild des Preu- ßenkönigs in der Öffentlichkeit.
