MINUTES of the 1976 Spring Meeting and the meeting held April 1, 1976, were approved. • (A-1301) TAX ON UNRELATED INCOME--REPORT APPROVED

On December 24, 1975, approval was given to the plan for holding seminar workshops for Seventh-day Adventist educational institutions to study uniform compliance with the current regulations of the Tax Reform Act. (See GCC 75-460).

VOTED, To approve the following consolidated report which sets forth the opinion of the above-mentioned seminars which considered the relation- ship of the Church and its dependencies to the tax law on unrelated business.

1. Seventh-day Adventist institutions and conferences in the United States shall comply with the provisions and current regulations of the Tax Reform Act of 1969 (Public Law 91-172) which became effective January 1, 1976.

2. Every union shall secure the services of a qualified tax consultant.

3. All operations of an academy or institution of higher education in- cluding auxiliary enterprises and independent operations shall be accounted for in one corporate structure or entity and necessary legal and accounting steps shall be taken before the beginning of the 1976-77 fiscal year. (Radio stations which have separate boards in order to satisfy FCC regulations, • may be permitted exceptions). 76-36 April 8, 1976 (Tax on Unrelated Income - contd) • 4. With reference to depreciation factors, the understanding shall be:

a. Depreciation rates for the independent operations, whether related or unrelated, shall be consistent with and not exceed the guideline parameters of the IRS. (Depreciation rates for other school operations will still be those recommended by denominational policy as in the past.)

b. Tax counsel shall be obtained in setting up the depreciation policies and schedules for each institution. In most cases the straight line method of depreciation is best, but in some cases this might not be desirable. This would apply to both buildings and equipment.

c. Variance from denominational policy shall be permitted by allowing depreciation of new buildings and equipment in the year of acquisition. This may be done monthly by institutions which use computers, or by the use of half- year conventions by those which do not have computer facilities.

5. All copies of IRS form 990T for tax on unrelated income shall be forwarded to the Legal Office of the General Conference for approval prior to filing with the IRS and in 1977 all colleges shall file Form 7004 requesting an extension. (Any delay beyond the regular filing date is subject to 9% interest on the tax, if estimated tax is not paid at time of filing.)

6. Other accounting procedures shall be accepted in harmony with recom- mendations of the seminars, but similar principles shall be applied regardless • of whether or not an educational institution or other type of organization is involved.

1. The appropriation is to assist with the salary and expense of two French workers to help with the French television interest follow-up.

2. The funds are to be released annually as Quebec reports the employ- ment of these additional workers.

3. Budget provision shall be made for the continued employment of the two new workers.
