MINUTES OF 58th MEETING OF COMMERCIAL COMMITTEE HELD ON 7th APRIL 2011 AT LONAVALA

The 58th meeting of Commercial Committee of WRPC was held at Lonavala on 7th April 2011. The list of the participant is enclosed at Annexure-1.

th Shri R. N. Sen, CEO, NSPCL welcomed all the participants for the 58 Commercial Committee Meeting and stated that NSPCL is honoured to host this th 57 Commercial Committee Meeting of WRPC at Lonavala and hoped for support of all the constituents. Highlighting the features of NSPCL, he stated that NSPCL has achieved highest ever PLF of 103% during Oct-2010 and would keep up the performance with the support of NTPC and SAIL, with NTPC having expertise in power sector for many years and various facilities, clearances made available with the help of SAIL. He stated that NSPCL have crossed all past records and also new projects are coming up at Bokaro, Jagdishpur, Bhilai, Rourkela which would add to their strength.

Shri Manjit Singh, Member Secretary, WRPC welcomed all the participants of the meeting and thanked NSPCL and their dedicated officers and officers from NTPC for hosting this Commercial Committee Meeting at Lonavala. He briefly highlighted the various issues slated for discussion and hoped that the Committee members will discuss the issues in amicable manner and arrive at the consensus decision. He then requested Shri O. P. Singh, Superintending Engineer (Comml), WRPC to take up the agenda items.

ITEM No.1: CONFIRMATION OF THE MINUTES OF THE 57th MEETING OF COMMERCIAL COMMITTEE

SE(Comml), WRPC stated that the minutes of the 57th meeting of Commercial Committee held on 11.01.2011 at were circulated to the constituents vide WRPC letter No.WRPC/Comml-I/CCM/Min/2011-864 dated 27.01.2011 and no comments were received on the minutes.

The minutes of the 57th CCM were confirmed without any modification.

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 1 ITEM No.2: SIGNING OF PPA WITH RGPPL (FOR 5% ALLOCATED CAPACITY) AND ITS SCHEDULING

2.1 SE (Comml), WRPC stated that during TCC meeting held on 11th February

2011, RGPPL had intimated that station was put up on full load on 3rd April 2010 , thereafter, RGPPL station is not generating on full load as from May 2010 onwards station is going on unit wise cyclic plan maintenance and hoped station to be on full load on continuous basis w.e.f. July 2011. WRPC was of the opinion

that RGPPL station has attained full load on 3rd April 2010, one of the conditions i.e. the full load condition mentioned in Ministry of Power order has been fulfilled, however scheduling could commence only if other conditions such as signing of PPAs, completion of the process for obtaining necessary open access, opening of Letter of Credit by the beneficiaries of the generating station commensurate with the allocated power etc. which are yet not completed by RGPPL / beneficiaries. Therein RGPPL had intimated that the above conditions/formalities will be completed early and with that they shall be able to supply power as per MOP allocation from July 2011 onwards.

2.2 RGPPL representative stated that they would be in a position to deliver the allocated power to DD, DNH and Goa from July 2011 onwards as intimated during TCC meeting

Committee noted the same.

ITEM No. 3: ISSUES RELATED TO SHIFTING OF CONTROL AREA OF NSPCL FROM SLDC, CSPTCL TO WRLDC

3.1 SE(Comml), stated that the matter related to shifting of control area of NSPCL from SLDC, CSPTCL to WRLDC was discussed during 57th CCM where in it was decided that NSPCL would intimate the designated status identifying unit-1 or unit-2 as captive or CGS to CERC with a copy to WRLDC/WRPC. It was also decided that a separate meeting among NSPCL, SLDC, WRLDC, and BSP may be held in due course for firming up the detailed methodology for scheduling

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 2 of the generation from NSPCL and WRLDC may then commence scheduling of NSPCL accordingly.

3.2 A meeting among NSPCL, SLDC Chhattisgarh, WRLDC, BSP and WRPC was held on 9.03.2011 at WRPC office, Mumbai wherein the methodology proposed by WRLDC was discussed ( copy of minutes at Annexure-3.2) and agreeable as below subject to obtaining clarification by CSPDCL of point 3.2( c ) from CTU:-

a. CSPDCL had expressed that the proposed scheduling methodology would put extra burden on CSPDCL on account of losses & STOA charges. CSPDCL would agree to the proposed methodology only if combined schedule for CSPDCL and BSP is not considered for accounting purpose. Further, considering BSP as their embedded customer, it has been proposed to issue a composite schedule to Chhattisgarh which would consist of BSP’s long term allocation and Chhattisgarh’s allocations. CSPDCL said that Chhattisgarh has direct connectivity with NSPCL through 2x220 kV lines of Chhattisgarh with BSP and four Nos. 220 kV dedicated lines of BSP from NSPCL thus CSPDCL would agree to the proposed scheduling if their drawl point is considered the same as that of BSP (220 kV bus of NSPCL) and NSPCL-BSP dedicated lines of BSP are considered as deemed connectivity with the NSPCL for transfer of power to CSPDCL and requested WRLDC to consider this request. In this case CSPDCL would not require applying for STOA.

b. ED, WRLDC had stated that in the LTA application submitted by CSPDCL to CTU, establishment of dedicated line by CSPDCL from NSPCL for utilization of power under LTOA by CSPDCL is mentioned. LTOA is to be permitted by CTU, CSPDCL may accordingly take up matter with CTU for drawing their Long Term power through dedicated 220 kV NSPCL-BSP lines and connectivity of BSP through 2x220 kV

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 3 available line of Chhattisgarh instead of establishing dedicated line by CSPDCL from NSPCL.

c. CSPDCL representative agreed for referring the matter to CTU on urgent basis. It was decided that the date of shifting of control area will be decided after clarification on above matter referred by CSPDCL to CTU. It is intimated that CSPDCL vide letter dated 14.03.11 have requested CTU to consider the above.

d. WRPC stated that the entitlement of energy charges and capacity charges in units would be reflected in the regional Energy accounts as is being done for other ISGS stations. However, the capacity and energy charges for LTOA portion (presently 100+70+182.5 MW) will only be reflected. Balance charges will be reflected as payable by NSPCL. STOA transactions will be reflected separately under bilateral transactions. UI bills will be prepared in accordance with UI regulations, 2009 as amended from time to time.

e. Captive consumption certification to BSP will not be a liability of WRLDC or WRPC.

Following allocations were intimated by NSPCL for the period 1.4.2011 to 31.3.2011 vide letter dated 23.03.2011 have intimated revised allocation of capacity from NSPCL from 01.04.2011 to 31.03.2013

3.3 SE (Comml), WRPC stated that CTU, PGCIL vide letter No. C/SEF/W/LTOA dated 5.04.2011 (copy enclosed at Annexure-3.3) in reply to CSPDCL letter dated 14.03.11 have confirmed that LTOA was granted in a meeting of WR constituents held on 30.09.2006 for transfer of 170 MW power to UT DNH (100 MW) and DD (70 MW) from NSPCL 2x250 MW generation project. No open access was sought by NSPCL for balance capacity. During this meting, it was confirmed by NSPCL that BSP and CSPDCL would draw their share on dedicated system owned by NSPCL/BSP/CSPDCL. Accordingly as discussed on 9.03.2011 the pending issue at 3.2 (c) above is settled and date of shifting of control area of NSPCL can be decided now.

3.4 GM (CP&Comml), NSPCL informed that PGCIL have installed all the SEMs and also the modalities as discussed above are already firmed up and therefore the date of shifting of transfer of control area may be decided as 1.05.2011.

WRLDC suggested 02.5.11 for date of shifting of control area which will be falling on Monday the date for next billing cycle.

ED, WRLDC requested committee members to hold a meeting amongst WRPC/WRLDC/NSPCL/BSP/CSPDCL/CSPTCL (LD)/DD/DNH to discuss the

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 5 remaining modalities for scheduling/accounting/metering etc. to effect smooth transfer of control area. Committee agreed to hold the meeting at WRPC office on 25.04.2011.

It was also suggested that a meeting amongst BSP/NSPCL/CSPDCL/CSPTCL (LD) would be held before above meeting on 25.04.2011 to clear any past issues between the parties.

Committee discussed and agreed as above and suggested the date of shifting of control area from SLDC, CSPTCL to WRLDC w.e.f. 2.5.2011.

ITEM No.4. ALLOCATION OF POWER FROM KORBA STPS-III

4.1 MOP vide letter No.5/51/2010-Th.II dated 9.12.2010 has allocated power to the Western Regional beneficiaries with effect from the date of commercial operation of Korba STPS-III. It is seen from the allocation order that 85 % power has been allocated to WR beneficiaries while 15% of power is to be sold out side long-term PPA. Scheduling & methodology of energy accounting for the same was discussed in 16th WRP committee meeting.

4.2 During 16th WRP Committee meeting NTPC representative had stated that initially power generated from this station was envisaged to be sold outside long term PPA. Accordingly, NTPC has obtained long term access (LTA) to evacuate power to be generated from Korba Stage-III to different beneficiaries as mentioned in the LTA application. NTPC has signed bulk power transmission agreement with Powergrid for evacuation of power to be generated from Korba stage-III. Govt. of , has now allocated power to the Western Region beneficiaries w.e.f. the date of commercial operation of Korba STPS Stage-III. Now, with allocation of power to the constituents of Western Region by GOI, the status of Korba STPS Stage-III has changed to a Regional Power Station. NTPC has entered into a long term power purchase agreement for supply of power from Korba Stage-III for a period of 25 years with Western Region beneficiaries. In terms of the Power Purchase Agreement signed between both the parties, the

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 6 responsibility for evacuation of power from bus bars of the station lies with beneficiaries. Accordingly, the BPTA signed between NTPC and Powergrid shall be assigned to the beneficiaries. He intimated that this was communicated to Powergrid Corp. of India, Gurgaon. It is therefore, the obligation and responsibility to make the required arrangement for evacuation of electricity from station bus bars corresponding to the share of allocated capacity lies with the DISCOMS/ Departments of respective Union Territories/ States. Since, the existing transmission system was built for the benefit of regional constituents and the cost was serviced by the beneficiaries all these years therefore, the existing beneficiaries shall have first right of use. Further, the existing Open Access Regulation, 2009 does not prohibit from granting the Long Term Access to the regional beneficiaries on existing system if, the transmission capacity is available. Therefore, the existing beneficiaries shall have first right of use. 4.3 During 16th WRPC meeting, GM (Comml), GUVNL stated that beneficiaries may not have to apply for LTOA for Korba # 7 like any other generating station generating power and in case of addition of lines in future the existing BPTA with CTU is modified with appending of additional lines approved.

4.4 CTU had explained that that LTA is signed with generator/developer whereas long term open access is long-term arrangement for transmission service. In the present case the application for long-term open access was from NTPC and not from the constituents and while signing long-term open access it was intimated to NTPC that LTOA would be possible after the commissioning of 400 kV Korba-Raipur D/c line scheduled to be implemented by June –July 2011. It was also expressed by CTU that LTOA arrangement is a planning exercise work for 25 years so that system is adequate under all probable contingencies under CEA Planning Criteria. Any other Access arrangement like Short term is for allowing power transfer keeping capacity margins on short term basis.

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 7 Accordingly while deliberating LTOA proposal to NTPC it was explained to NTPC that power can be transferred through STOA till commissioning of above line. Such condition was provided in LTA.

4.5 During 16th WRPC meeting, ED, WRLDC, POSOCO had stated that LTOA was granted to Korba # 7 with certain conditions, with this LTOA can be effected on fulfilling the conditions mentioned therein. As system operator WRLDC did not foresee any bottlenecks in evacuation of this power, as by and large a margin of 800 MW exist, however short term open access may have to be applied for till the time transmission system planned for Korba-III is completed.

4.6 Chairman, WRPC during 16th WRPC meeting, had observed that power can be evacuated from Korba # 7 and the issue involves grant of Open Access based on the available margins as per the study carried out by WRLDC. However the margins available should be utilized under Open Access after COD of the station.

WRP Committee during 16th meting discussed and suggested that:- The State beneficiaries would submit a formal request letter to CTU for LTOA on the basis of their allocated shares from the Station. The State beneficiaries in view of available margins and as State beneficiaries are serving the system would request CTU to examine and convene a special meeting of Standing Committee for Western Region to consider date of LTOA from the date of COD of Korba # 7. PGCIL would do the needful at their end to review date of LTOA on above grounds.

4.7 In pursuance of the decision of 16th WRPC meeting and upon beneficiaries of the Korba Stage III submitting request to CTU for considering preponing of the LTOA to the date of commercial operation of the Korba III unit, special meeting was convened by PGCIL /CTU on 10.3.2011 at CEA office, New Delhi with WR constituents, CEA, WRPC, WRLDC, NTPC and POWERGRID. In the above meeting, the issue was discussed in detail wherein it was indicated by WRLDC

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 8 that the margin of 700-800 MW is available under normal grid conditions, however there shall be constraint under certain contingency conditions. In the meeting CTU had indicated that LTOA was granted to NTPC alongwith commissioning of Korba-Raipur 400 kV D/c line. Therefore CTU and CEA were not in agreement with permitting preponement of LTOA to the date of commercial operation of the above 500 MW unit without the availability of 400 kV Korba- Raipur D/c line. POWERGRID had informed that all efforts are being made to commission the 400 kV Korba-Raipur D/c line by end of April 2011/ first week of May 2011. It was suggested by CTU/CEA that considering the short period between availability of 400 kV Korba-Raipur D/c line and Korba stage III unit no 7, power may be scheduled through STOA basis so that power transfer can take place. Minutes of the meeting were forwarded by CTU/PGCIL vide letter No. C/SEF / W / 06 / LTOA dated 11.03.2011 (enclosed at Annexure-4.7.)

4.8 Subsequent to above, NTPC vide letter no. No.01: CD: 203 dated 11.03.2011 requested to convene a meeting for ensuring scheduling of power from Korba Stage-III. A meeting was convened on 15.03.11 wherein representatives from NTPC, WRLDC and the beneficiaries were present. The members were appraised about the position as above and in view of above the beneficiaries agreed to avail power from these stations under STOA after its COD considering the short gap between COD of 400 kV Korba-Raipur D/c line and the COD of Korba stage III unit no 7. The unit No 7 was declared under commercial operation by NTPC vide their letter dated 20.3.2011 w. e. f. 21.03.2011 and power allocation from the unit became effective after its COD as per the MOP order. On the basis of advice by CTU and CEA as above schedule had to commence on short-term basis till short duration of time left for COD of above line.

4.9 NTPC and MP vide letters dated 23.3.11 and 25.3.11 (Copies at Annexure-4.9(A) & (B) have expressed that by virtue of allocation of unit 7 of Korba stage III by Govt. of India the station has status of Long-term customer

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 9 and have requested for scheduling of power from Korba III considering WR beneficiaries as long term customers of the transmission system.

4.10 Commercial Committee discussed the matter. NTPC and beneficiaries expressed that by virtue of allocation made by GOI, MOP vide order No. 5/51/2010-Th.II dated 9.12.2010 for power from Unit 7 of Korba Stage III, the beneficiaries have the status of Long-Term customer and they expressed that scheduling power on STOA will not be in line with regulation and accordingly requested WRLDC to schedule power on Long term basis after commercial declaration of the above unit.

SE (Commercial), WRPC intimated that in response to the above observations of NTPC and beneficiary members on scheduling of power under STOA after COD of this unit, CTU vide letter no. C/SEF/W/06/OA dated 1.4.2011 (copy enclosed at Annexure- 4.10) sought advice from CEA on scheduling of power. However response to above was awaited.

NTPC further indicated that as per CERC (Grant of Connectivity, Long-Term Access and medium term Open Access in inter-state Transmission and related matters) Regulations 2009 beneficiaries of Korba STPS Stage III of NTPC which is owned and controlled by Central Govt. are Long-Term customers as they have been given allocation of power from this station by Ministry of Power, Govt. of India. Further power from this station is to be supplied to beneficiaries under Long Term PPA signed between NTPC and beneficiaries and tariff is being determined by CERC from date of Commercial operation. As per PPA, the BPTA signed on 28.4.2009 between NTPC and Powergrid shall be assigned to the beneficiaries. NTPC indicated that this was communicated to Powergrid Corp. of India, Gurgaon.

NTPC indicated that power from the station should be despatched and scheduled to beneficiaries on long-term basis who are long-term customers, as an ISGS as per IEGC issued under CERC regulations. However in order to ensure that transfer of power takes place from the station after COD, power had to be

Referring to discussions in meeting taken by CTU on 22.3.2010 regarding evacuation of power from LANCO Amarkantak 2x300 MW and subsequent 30th standing committee meeting held on 8.7.2010, NTPC stated that power it was agreed that in case of any transmission constraints in evacuation of power from NTPC / State generating stations due to contingency or otherwise, LANCO Amarkantak TPS (2x300 MW) will have to back down first and NTPC and other State generating units will have higher priority. NTPC indicated that position taken by CTU /WRLDC is contrary to the regulation and beneficiaries are not able to avail their share from the above station of NTPC on the basis of merit order.

Beneficiary members were of the view that they should be treated as Long-term customers of Korba III unit 7 as per the allocation order of MOP and also in view of the currently available operating margins in the corridor; WRLDC should schedule power on Long-term basis. In case of constraints the power may be restricted with higher priority treating them Long-term customers.

WRLDC were not in agreement to above and indicated that margins available are utilizable which can be permitted by WRLDC are through short-term access on non-discriminatory basis. Further the allocation order is subject to be in conformity with directives / regulations, PPAs signed with NTPC and intimated that as per the same and as per the Regulations, LTA granted by CTU is to become effective after commercial operation of the identified strengthening scheme viz. 400 kV Korba-Raipur D/c line. It would therefore be not proper to schedule power on Long-Term basis till such time or unless CTU permits the beneficiaries Long-Term Access prior to availability of line as requested by the beneficiaries.

In view of position discussed above on account of difference in opinion between beneficiaries/NTPC and PGCIL/CTU/WRLDC, Commercial Committee requested Member Secretary WRPC in this regard to seek advice of Hon’ble Commission regarding permitting the CTU/WRLDC to

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 11 schedule power on Long Term basis prior to commercial operation of the 400 kV Korba-Raipur D/c line which is expected within a short span of period from now in fulfillment of requirements under MOP allocation order and satisfying the condition for Long-Term Open Access granted by CTU to NTPC in the subject case.

In view of the current position as above, the Committee further discussed the points relating to accounting and agreed as follows:

i) Treatment of Korba –III as a seller or generator after COD for capping purpose; before COD the treatment was done as per seller category. ii) Declared capacity and entitlement table for recovering capacity charges in the REAs for two categories viz. ISGS category for 85% portion and 15% portion for power to be sold by NTPC to CSPDCL under PPA signed between NTPC and CSPDCL fro sale of power for two years. iii) Reflection of Korba-III shares in the table for transmission charges: effective date may be decided.

W.r.t. i), ii) & iii) above, WRPC Secretariat is treating Korba-III as a generator w.e.f. 21.03.2011, 100 % allocation from Korba-III have been apportioned to its beneficiaries in the REAs and would reflect Korba-III shares in the transmission charges w.e.f. start of LTA.

Committee agreed to the above points for preparation of energy accounts in view of the current position.

ITEM No.5: TRANSMISSION CHARGES FOR USE OF MSETCL TRANSMISSION SYSTEM FOR CONVEYANCE OF CENTRAL SECTOR POWER TO GOA FOR THE PERIOD 1.04.10 TO 31.03.2011

5.1 Chief General Manager (L&RA), MP Tradco vide letter dated 20.09.2010 have submitted their observations on computation of transmission charges for

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 12 conveyance of Central Sector power to Goa through MSETCL system which are briefly highlighted below :

1. Return on Equity (ROE) calculated on the basis of tax rates received from MSETCL (33.2175 %) while those should have been calculated at MAT rates of 11.33 %. 2. Interest of loan considered by WRPC as SBI PLR @12.25 as on 1.04.2009 while those should have been considered as it is claimed by PGCIL in its petition for the year 2010-11. 3. Depreciation not to be allowed after useful life of the transmission line is ended.

5.2 MPTradco representative during 57th CCM stated that they agree with the calculation done by WRPC w. r .t to “1” & “2” above but as most of the lines considered in calculation have completed useful life, depreciation should not be allowed after the useful life of the lines is completed as the same methodology is being followed by CERC while fixing up the tariff for transmission licensees.

5.3 Committee agreed with the suggestions by MPTradco and suggested that the criteria for adoption of depreciation may be taken as applied by CTU according to present CERC Tariff norms. WRPC vide letter dated 23.02.011 requested MSEDCL to convey their consent/ comments on the basis of above suggestion for deciding on above by the Committee. Further, Chief Engineer (STU), MSETCL vide letter No. MSETCL/CO/STU/T-065 /4171 dated 15.03.2011 (copy enclosed at Annexure-5.1) addressed to Member Secretary have intimated that the rate of depreciation considered for calculations of wheeling charges upto period 2004-05 (which was considered for the period upto 2009-10) was at lesser rate of 2.57 % as per methodology formalised by CEA. The full depreciation would have been recovered during useful life of the assets provided revised rate of 5.28 % were considered for previous period also.

5.4 MPPTradeco vide letter No. 05-01/646 dated 1.4.2011 (copy enclosed at Annexure-5.4 ) have requested that criteria for adoption of depreciation may be taken as applied by CTU.

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 13 Committee members discussed the matter and suggested that on the basis of suggestion by MP, the matter comprises finalizing the depreciation amount for MSETCL network used for wheeling ISTS power to Goa for the year 2010-11 for calculation of wheeling charges by WRPC in line with those computed for Gujarat network as agreed in 13th WRPC meeting.

In view of above, the Committee decided to form a smaller group of representatives from CSPDCL, MP Tradeco, MSETCL & GUVNL to finalise the amount for MSETCL network for the year 2010-11 as per above. The group may meet on 18.04.2011 at WRPC to discuss and finalise the detail and put up to WRPC during next meeting for approval.

5.5 SE (Comml), WRPC stated that the charges for wheeling of central sector power to Goa through MSETCL system and charges for wheeling of central sector power to DD & DNH through GETCO system were valid upto 31.03.2011 and thereafter same were agreed to be considered under POC charge under CERC regulations on sharing on transmission charges and losses Regulation 2010 in 56th CCM and approved in 15th WRPC meetings, which is now to take effect from 1.7.2011.

GETCO and MSETCL agreed to intimate the status on above.

ITEM No.6: SPECIAL ENERGY METER REQUIREMENT FOR IPPs IN WESTERN REGION

SE(Comml), WRPC stated that POSOCO, WRLDC vide letter dated 31.03.2011 (copy enclosed at Annexure-6 ) have intimated that WRLDC has worked out tentative requirement of SEMs and DCDs required to be installed at various IPPs on the basis of LTA granted by CTU. As per the requirement calculated tentatively, total number of SEMs comes to 308 Nos (including spares) and total number of DCDs comes to 30 Nos (including spares).

It was decided that PGCIL (WRTS-I and WRTS-II) would take necessary actions for procurement of SEMs without any financial implication on beneficiaries as

SE (Comml), WRPC stated that there was mistake in adjusted UI calculation in respect of DD for the period 3.5.10 to 21.02.11. The fields of UI (both payable and receivable) were calculated as payable during adjusting the UI by averaging method. Issuing of revised UI accounts for the above period is in progress.

ITEM NO. 8 : EXTENSION OF THE DATE OF OPERATION OF CERC (SHARING OF INTER-STATE TRANSMISSION CHARGES AND LOSSES) REGULATIONS, 2010.

Hon’ble Central Electricity Regulatory Commission, Regulations, 2010 on Sharing of Inter-State Transmission Charges and Losses were to take effect from 1.1.2011. CERC vide order 30.12.2010 had earlier directed that the Regulations shall come into force with effect from 1.4.2011. In order to enable the users to realign their contracts as per Transmission Service, CERC vide order dated 30.03.2011 (copy at Annexure-8) have directed that the said regulations would come into effect from 1.7.2011.

CERC also directed CTU and other inter-State transmission licensees to complete the process of realignment of their contract with the users in accordance with the Transmission Service Agreement and other related agreements within 60 days from the date of their notification.

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 16 ITEM No.9: INCLUSION OF NON-ISTS ASSETS FOR IMPLEMENTATION OF POINT CONNECTION METHOD FOR POINT OF CONNECTION CHARGES

9.1 As per CERC Regulations, 2010 on "Sharing on transmission charges and Losses" regulation 2010 the determination of transmission charges as per this Regulation is required to be limited to the network owned, operated and maintained by the ISTS Licensees or those transmission licensees / SEBs whose assets have been certified by RPCs as being used for inter-state transmission. During 15th WRP Committee meeting The WRP Committee had approved the criteria and the list of state owned Interstate / Inter-regional lines for certification as ISTS lines. It was also agreed that any other non-ISTS line that comes up and meets the criteria agreed as above, may be considered for certification as ISTS line. Accordingly list of state owned Interstate / Inter-regional lines certified as ISTS lines as approved above was forwarded to implementing agency. Also the list was sent to the concerned non- ISTS Licensees for furnishing YTC of the respective lines certified as above to NLDC duly approved by the appropriate commission.

9.2 During 3rd meeting of validation Committee held on 18.3.2011 for implementation of CERC (Sharing of Inter-State Transmission Charges and Losses) Regulations 2010 held on 18.3.2011, Chairman Validation Committee had intimated that on recommendation of Implementing Agency, the State owned transmission lines certified by RPC were excluded for the POC charges. In this connection CE (LD), MPPTCL, Member validation Committee vide letter dated 22.3.11 requested CERC to review and include RPC certified for POC. (Copy enclosed at Annexure-9.2)

9.3 This matter had also been discussed in 57th CCM and 16th WRPC meetings held on 11th January, 2011 and 12th February 2011 respectively. WR Power Committee in 16th WRPC meeting recommended that CCM may discuss / evolve additional criteria for consideration of such non-ISTS lines for POC calculation.

9.4 It is intimated that Maharashtra State vide letter dated 5.3.2011 addressed to NLDC have desired that it would be preferable to determine usage of Maharashtra system by adopting Hybrid methodology used by implementing agency to determine precisely the usage of CTU network by DICs.

9.5 Committee discussed and members were of the view that it would be preferable to identify non-ISTS lines which carry ISTS power may be done through a load flow study to determine the extent of quantum for contribution of ISTS power flow to recommend for certification of the same for inclusion in POC calculation.

9.6 GUVNL requested WRPC to determine the extent of utilization of GETCO system carrying power from Central generating stations in their state to the CTU point. WRPC suggested that such state system would get covered while considering additional lines based on the load flow study.

ITEM No.10: DECLARATION OF TRANSMISSION ELEMENTS INTO COMMERCIAL OPERATION BY PGCIL

10.1 PGCIL vide letter dated WRTS:COMM:NGP/676 dated 1.02.2011 have intimated that ICT-II at 400/220 kV at Wardha alongwith its associated bays under Sipat-II supplementary transmission scheme has been put into regular & commercial operation in Western Region w.e.f 1.02.2011. Accordingly, the monthly transmission charges of the above transmission system with associated bays will be payable by concerned WR constituents w.e.f. 1.02.2011.

10.2 PGCIL vide letter No. WRTS:COMM:NGP/675 dated 1.02.2011 have intimated that following elements at Solapur under WRSS-II Set-B transmission

Accordingly, the monthly transmission charges of the above transmission assets will be payable by concerned WR constituents w.e.f. 1.02.2011

10.3 PGCIL vide letter No. WR-II/VDR/COML/1438 dated 1.03.2011 have intimated that following components under WRSSS-VI have been charges and put into regular and commercial operation w.e.f. 1.03.2011 : i) 400 kV Dehgam(Guj)-Pirana(Guj) Ckt-I & II transmission lines alongwith its associated bays at both ends ii) 400/220 kV, 315 MVA, ICT-I at Pirana Substation(Gujarat) alongwith its associated bays and 2 nos 220 kV line bays

Accordingly, the monthly transmission charges of the above transmission assets will be payable by concerned WR constituents w.e.f. 1.03.2011

10.4 PGCIL vide letter No. WR-II/VDR/COML/1439 dated 1.03.2011 have intimated that 400 kV Birsinghpur(MP)-Damoh(MP) Ckt-3 & 4 transmission lines alongwith its associated bays at both ends under WRSSS-II, Set –D have been charged and put into regular & commercial operation w.e.f. 1.03.2011 :

Accordingly, the monthly transmission charges of the above transmission assets will be payable by concerned WR constituents w.e.f. 1.03.2011

10.5 PGCIL vide letter No. WR-II/O&M/250/317/2009 dated 17.03.2011 have notified that 400/220 kV ICT-I, 315 MVA at 400 kV Dehgam Substation of PGCIL was not in use from 10.07.2010 to 16.12.2010 due to failure of ICT on lightning stoke and this transformer was not in commercial operation w.e.f. 10.07.2010 to 16.12.2010 and taken out of capital cost for the aforesaid period.

Minutes of 58th Commercial Committee Meeting held on7.04.2011 at Lonavala 19 PGCIL further notified that ICT-I at Dehgam is in regular & commercial operation w.e.f. 17.12.2010 (FN).

Accordingly, the monthly transmission charges of the above transmission assets will be continued to be payable by concerned WR constituents w.e.f. 17.12.2010.

10.6 Western Region Transmission (Maharashtra) Pvt. Ltd. vide letter No.RPTL/IA/100/2011 dated 4.03.2011 have intimated LILO of Solapur-karad, 400 kV D/c inter-State transmission line under project B of WRSSS-II has been charged and commissioned by WRTML on 21.01.2011. Accordingly, the monthly transmission service charges as approved by CERC of the above transmission line will be payable by concerned WR constituents w.e.f. 21.01.2011.

10.7 AGM(Comml), PGCIL, WRTS-I informed that following transmission elements have been put into commercial operation and accordingly the monthly transmission charges of the above transmission assets will be payable by concerned WR constituents w.e.f. 1.04.2011. i) 315 MVA, 400/220 kV ICT-II at Solapur under WRSS-II, Set-B ii) FSC on 400 kV Raigarh-Raipur line under East-West transmission corridor strengthening scheme. iii) 315 MVA, 400/220 kV ICT-II alongwith its associated 400/220 kV bays at Pirana under WRSS-VI iv) 315 MVA, 400/220 kV ICT-III alongwith its associated 400/220 kV bays at Gwalior under WRSS-VI

RECORD NOTES OF DISCUSSION OF THE MEETING HELD ON 9.3.2011 AT WRPC MUMBAI TO DISCUSS VARIOUS ISSUES RELATED TO SHIFTING OF CONTROL AREA OF NSPCL TO WRLDC

A meeting was convened on 9.3.2011 at WRPC office, Mumbai to discuss various issues related to shifting of control area of NSPCL from CSPTCL, Chhattisgarh to WRLDC, Mumbai. List of participants is enclosed at Annexure-1.

Member Secretary, WRPC welcomed participants from CSPDCL, SLDC, CSPTCL, NSPCL, SAIL, DD & DNH and WRLDC in the meeting.

He stated that the matter was discussed during 57th CCM where in it was decided that NSPCL would intimate the designated status identifying unit-1 or unit-2 as captive or CGS to CERC with a copy to WRLDC/WRPC. It was also decided that a separate meeting among NSPCL, SLDC, WRLDC, and BSP may be held in due course for firming up the detailed methodology for scheduling of the generation from NSPCL and WRLDC may then commence scheduling of NSPCL accordingly.

He further intimated that BSP vide their letter dated 20.11.09 had decided to identify Unit-1 of NSPCL as captive as per Section -3, clause (ii) b of the Electricity Rules, 2005

ED, WRLDC stated that shifting of control area of NSPCL is a settled issue, however NSPCL have some special features viz. central generating station having captive status, tariff of this station is as a whole but unit wise scheduling is done, dynamic allocations are done by NSPCL etc. He added that WRLDC has proposed a Scheduling Methodology for NSPCL which is circulated in the meeting and may be discussed.

CSPDCL representative stated that the proposed scheduling methodology would put extra burden on CSPDCL on account of losses & STOA charges. CSPDCL would agree to the proposed methodology only if combined schedule for CSPDCL and BSP is not considered for accounting purpose. Further, considering BSP as their embedded customer, it has been proposed to issue a composite schedule to Chhattisgarh which would consist of BSP’s long term allocation and Chhattisgarh’s allocations. He said that Chhattisgarh has direct connectivity with NSPCL through 2x220 kV line of Chhattisgarh with BSP and four Nos. 220 kV dedicated lines of BSP from NSPCL. He further stated that CSPDCL would agree to the proposed scheduling if their drawl point is considered the same as that of BSP (220 kV bus of NSPCL) and NSPCL-BSP dedicated lines of BSP are considered as deemed connectivity with the NSPCL for transfer of power to CSPDCL and requested WRLDC to consider this request. In this case CSPDCL would not require to apply for STOA.

ED, WRLDC stated that in the LTA application submitted by CSPDCL to CTU, mentioned establishment of dedicated line by CSPDCL from NSPCL for utilization of power under LTOA by CSPDCL. He added that as LTOA is to be permitted by CTU, CSPDCL may accordingly take up matter with CTU for drawing their Long Term power through dedicated 220 kV NSPCL-BSP lines and connectivity of BSP available through 2x220 kV line of Chhattisgarh instead of establishing dedicated line by CSPDCL from NSPCL.

CSPDCL representative agreed for referring the above matter to CTU on urgent basis. It was decided that the date of shifting of control area will be decided upon getting necessary clarification from CTU.

The methodology proposed by WRLDC was discussed as below and was agreeable subject to accommodation of views expressed by CSPDCL representative and review accordingly:

A. NSPCL and its beneficiaries will forward the following data to WRLDC on daily basis: 1) Station wise DC in MW for all 96 time blocks and entitlement of long term beneficiaries in MW for each time block (all ex-power plant) by 0800 Hrs. for the next day. Entitlement limited to the long term access of respective beneficiaries. 2) WRLDC will issue the entitlements to its beneficiaries in accordance with the entitlement details given by NSPCL as per sl.no.1 3) D&D, DNH will give their requisition as per the entitlement limited to their Long Term Access (70MW for D&D and 100MW for DNH) ex-power plant by 1500 Hrs. 4) NSPCL shall provide the requisition of BSP for all 96 time blocks ex-power plant by 1500 Hrs. 5) WRLDC would be separately having details of STOA approvals from NSPCL to D&D, DNH, Chhattisgarh and/or other players.

B. WRLDC would work out the net injection schedule of NSPCL ex-pp by adding A- (3), (4) & (5). C. In case of tripping or revival of Unit/Units, the revised DC along with entitlements and the mutually agreed / revised long term requisition by D&D, DNH and BSP will be provided by NSPCL. Such revisions will be effective from the 6th time block. D. In case of tripping Unit/Units, STOA schedules will be revised as per the revised application received from the applicant and in accordance with the STOA regulations and as per clause 6.5.19 of IEGC 2010. E. WRLDC issues a composite schedule to Chhattisgarh which consist of BSP’s long term allocation and Chhattisgarh’s STOA. Both the BSP’s and Chhattisgarhs’s allocations will be shown separately by WRLDC. F. Injection schedule of NSPCL at Ex-Power Plant = {Long term requisition by ( D&D +DNH) at ex-pp)} +{Requisition by BSP at ex- pp) }+ {STOA by (D&D +DNH +Chhattisgarh) at ex-pp} +{Any other STOA at ex- pp) G. Change in calculation of drawal by Chhattisgarh Presently drawal by Chattisgarh at Raipur = (2nos of SEMs at 400kV side of ICT 1&2 ) – ( 2Nos of SEMs on 400kV NSPCL D/C at Raipur) After the shifting of control area to WRLDC, 1.Drawal by Chhattisgarh at Raipur = (2nos of SEMs at 400kV side of ICT 1&2 ) 2.Drawal by BSP deemed to be drawn by Chhattisgarh at NSPCL bus= ( 4Nos of SEMs on 200kV BSP lines) L. There is no change in calculation of drawal by D&D and DNH M. Pre requisites for taking over the control area Special Energy Meters (SEMs) having CTU specification are to be installed at the following locations.

WRLDC agreed to intimate the PGCIL to install the above meters at specified locations.

N. Accounting and Pool settlement: Weekly UI accounting and UI Pool settlement will be done as per CERC’s Notification on “Unscheduled Inter change charges and related matters (Amendment) Regulation 2010.” WRLDC has made necessary arrangement with IDBI bank for implementation of RTGS system for quick transfer of UI receivable/payable amount for beneficiaries without any additional charges.

O. Registering with WRLDC as a User NSPCL may have to register with WRLDC as an User as per the following regulation from CERC. Hon’ble CERC has notified the Central Electricity Regulatory Commission Regulation, 2009 on “Fees and Charges of Regional Load Despatch Centre “ on 18th September 2009 for the control period of 2009-2014. As per Clause-23 of Chapter-4 of the said Regulation, Quote “24. Registration fees. - (1) All users whose scheduling, metering and energy accounting is to be coordinated by Regional Load Despatch Centre shall register themselves with the Regional Load Despatch Centre concerned by filing application in the format prescribed as Appendix-IV to these regulations. (2) The application for registration shall be accompanied by a one time fees of Rs 10 lakh. Unquote Following were noted while arriving above decisions

I. Status of LTA/MTOA/STOA

a. Long Term Access for 170MW only from CTU (100MW to DNH and 70MW to D&D)

b. For Chhattisgarh’s long term PPA of 50MW, the CSPCL shall take necessary clarification from CTU regarding dedicated line from NSPCL for availing this Long-Term power as discussed above, else in the absence of permission to avail Long Term Open Access from CTU, CSPDCL shall have to go for STOA.

c. Any temporary allocation from Unit-I and Unit-2 to D&D, DNH and Chhattisgarh shall require to be through STOA/MTOA.

d. As BSP shall draw its captive share through its dedicated 4nos. of 220kV transmission lines from NSPCL to BSP, would therefore not require LTA/MTOA/STOA.

II. Applicability of Transmission Losses and Chargess

a. WR loss will be applied to long term allocation of D&D and DNH like any other ISGS schedules.

b. Since temporary allocation to D&D and DNH is through bilateral STOA, WR loss will be applied to these transactions.

c. Regarding scheduling of Chhattisgarh’s long term PPA, in the absence of Long Term Open Access permission from CTU, the transaction shall be scheduled through STOA and WR loss will be applied on the transaction.

d. In view of 1(d) above loss (WR loss and STU loss) shall not require to be applied to BSP’s schedule.

III. Transmission charges

a. For LTA of 170 MW (100+70) D&D and DNH will pay WR transmission charges as per the BPTA signed by them with CTU, POWERGRID.

b. For all the STOA transactions by D&D, DNH and Chhattisgarh, will be according to CERC’s STOA Regulations-2009.

c. In view of 1(d) above, transmission charges to CTU and STU by BSP shall not be applicable.

IV. Certification of BSP’s consumption on yearly basis

It was clarified by WRPC that captive consumption certification to BSP will not be a liability of WRLDC or WRPC.

V. Applicability of Various Regulations

a) CERC’s Notification dated 28th April 2010 on Indian Electricity Grid Code - 2010 (IEGC-2010).

b) Declared Capability, Entitlement etc required for calculation of Capacity charge including incentive, Energy charge will be in accordance with the CERC’s Terms and Conditions of Tariff Regulation 2009.

c) Long term Access and Medium Term Access will be in accordance with CERC’s Regulation on “Grant of Connectivity, Long Term Access and Medium term Open Access in inter state transmission and related matters Regulation 2009”.

d) Short Term Open Access will be granted in accordance with Open access regulation 2009.

e) CERC’s Notification dated 28th April 2010 on “Unscheduled Inter change charges and related matters (Amendment) Regulation 2010.” f) CERC’s Notification dated 22nd December 2009 on “Measures to relieve congestion in real time operation Regulation 2009. g) CERC’s Notification dated 18th September on “ Fees and Charges of Regional Load Despatch Centre and other related matters Regulation 2009” h) Any other Regulations/Orders/Notifications issued by CERC from time to time.

VI. Allocation of Capacity from NSPCL from 01.02.2011(0000hrs.) to 31.03.2011(2400Hrs)

GM, NSPCL intimated that the w.e.f. 1.04.2011 the 23 MW temporary allocation to DNH (as in (ii) During Outage of Unit 2) will be cancelled and same would be allocated to BSP.

VII. It was agreed that the entitlement of energy charges and capacity charges in units would be reflected in the regional Energy accounts as is being done for other ISGS stations. However, the entitlement of capacity and energy charges for LTOA portion (presently 100+70+182.5 MW) will only be reflected. Balance charges will be reflected as payable by NSPCL. STOA transactions will be reflected separately under bilateral transactions. UI bills will be prepared in accordance with UI regulations, 2009 as amended from time to time.

Item No.1: Special Energy Meter requirement for IPPs in Western Region As per clause 6.4.21 of IEGC- 2010. CTU shall install special energy meters on all inter connections between the regional entities and the other identified points.

WRLDC has worked out the tentative requirement of Special Energy Meters(SEMs) and Data Collecting Devices(DCDs) required to be installed at various IPPs on the basis of LTA granted by CTU. Since WRLDC is not having single line diagram (SLD) of each IPP, the requirement of SEMs arrived is purely on a tentative basis.

As per the requirement calculated tentatively, total number of SEMs required comes to 308 Nos.(including spares) and total number of DCs required comes to 30 Nos (including spares). The detailed station wise and feeder wise details are enclosed at Annexure-I.

POWERGRID WRTS-I and WRTS-2 may take necessary actions for procurement of SEMs as per the details given above.

ORDER

Central Electricity Regulatory Commission (Sharing of Inter-State Transmission

Charges and Losses) Regulations, 2010 (hereinafter referred to as "transmission charges regulations") was notified in the Extraordinary (Part-III,

Section-IV No. 162) on 16.6.2010. As per Regulation 1(3), the date of coming into effect of the transmission charges regulation has been notified to be 1.1.2011 as certain mechanism and procedures are to be put in place by the Implementing Agency viz.

National Load Despatch Centre and the Central Transmission Utility before the regulations are made operational.

2. Since various procedures and mechanisms were required to be put in place before the regulations are made operational, the Commission in exercise of its power under Regulation 21(3) of the transmission charges regulations decided that the Central

Losses) Regulations, 2010 would come into force with effect from 1.4.2011.

3. The Transmission Service Agreement and other related agreements are in the process of finalization. Regulation 14 of transmission charges regulations requires all existing users of ISTS and the transmission licensees to realign their existing contracts to the regulation within a period of 60 days from the date of notification of Transmission

Service Agreement. In order to enable the users to realign their contracts as per the

Transmission Service Agreement, difficulties have arisen to give effect to the regulation from 1.4.2011. In exercise of our power under Regulation 21 (3) of the transmission charges regulations, we direct that the regulations shall come into effect from 1.7.2011.

We direct the Secretary 'of the Commission to issue a notification to that effect in the

Official Gazette for the information of all concerned.

4. We also direct the Central Transmission Utility and other inter-State transmission licensees to complete the process of realignment of their contracts with the users in accordance with the Transmission Service Agreement and other related agreements within 60 days from the date of their notification.
