Resolution on Armenia and Azerbaijan

The European Parliament,

— having regard to its previous resolutions on Nagorno-Karabakh,

A. having regard to the efforts made by the Community and its Member States to deliver emergency and humanitarian aid to both Armenia and Azerbaijan ,

r B. whereas the Community has made repeated appeals to Turkey to allow the transport of humanitarian aid into Armenia,

i C. whereas the protracted conflict over Nagorno-Karabakh, which belongs to Azerbaijan, but whose population is predominantly Armenian, has been developing in recent months into open warfare involving growing numbers of troops and weapons ,

D. whereas this conflict between the armed forces of Nagorno-Karabakh and Azerbaijan may spread and other countries may become involved following the territorial gains made by Armenian forces in Azerbaijan ,

i E. having regard to the reports of troop movements , in Turkey and Iran respectively, towards Armenia's and Azerbaijan's borders , following offensives into Azerbaijani territory by local Armenian forces in Nagorno-Karabakh,

F. having regard to the UN condemnations and the warnings issued by neighbouring powers (Russia, Turkey , Iran) to the armed forces of Nagorno-Karabakh, which are advancing, town by town, far beyond the limits of the area they are supposed to be defending,

1 . Reaffirms its support for the territorial integrity and sovereignty of the states in the region ;

2 . Urges the Armenian authorities to stop their attacks on Azerbaijani towns and villages and to withdraw from the Azerbaijani territory which they occupy, and calls on the Azerbaijanis to refrain from renewing their attacks against Nagorno-Karabakh ;

3 . Urges the neighbouring powers to refrain from any intervention which might exacerbate the situation and draw other countries into the conflict between Armenia and Azerbaijan ;

4. Calls on all the parties concerned to support all efforts to consolidate the provisional ceasefire between Azerbaijan and the Nagorno-Karabakh authorities, as a prelude to full implementation of the relevant UN Security Council resolutions ;

i 5 . Recognizes the difficulty of reaching an agreement on a settlement, given the lack of consideration for the interests of the Armenian ethnic group of Nagorno-Karabakh in the former Soviet Republic of Azerbaijan and the hatred engendered by the use of force by both sides over many years ;

6 . Endorses all efforts to find a peaceful settlement that are geared to a lasting compromise ; I

7 . Regards efforts by the international community to mediate as a necessary element of a peaceful settlement and refers to the particular responsibility of the successor states of the former Soviet Union ;

9 . Instructs its President to forward this resolution to the Commission , the Council , EPC and the Governments of Armenia, Azerbaijan, Turkey , Iran and Russia .

2. Company relocations and employment crisis in Europe

— having regard to the decision of CPC Europe Limited and Coopers Oil Limited to transfer production to France and Italy , and of CPC International Limited to acquire the German company Pfanni Werke Otto Eckart, — having regard to the significant loss ofjobs , 345 in Paisley and 300 in Livingston, and to the decision of the workers at both plants to campaign against these proposals , — having regard to the Timex strike and subsequent closure at Dundee which has highlighted the differences which exist between the Member States in the field of workers' rights and trade union law , and to the transfer of some of the jobs to Besan?on ,

— having regard to the decision to close the Moyeuvre Roncourt iron mine in Lorraine ,

— having regard to its resolutions of 22 November 1989 on speeding up the process of implementing economic and social cohesion and the Community Charter of Fundamental Social Rights ('), 11 February 1993 on redundancies and social dumping in multinational companies (2 ) and 27 May 1993 on the Social Protocol agreed at Maastricht (3 ),

A. whereas unemployment has reached unacceptable levels in the areas concerned, B. whereas failure to take proper account of social and environmental costs in calculations of profitability distorts global competition, leading to massive relocation of activities,

C. whereas the UK government refuses to sign the Agreement on Social Policy annexed to the Maastricht Treaty,

D. whereas no employer should have the right to dismiss staff involved in a lawful trade dispute,

i 3 . Urges the Belgian Presidency and the Commission to take all possible steps to secure the passage of the European Works Council Directive using if necessary the Maastricht Social Protocol, in the event of continued UK obstruction ;

{ 4. Calls on the UK government to demonstrate its bona fides as a member of the Community and its respect for the wishes of its own citizens by signing the Maastricht Social Protocol and the 1989 Social Charter;

5 . Asks that the Moyeuvre Roncourt mine remain open and that iron mining in Lorraine continue ;

6. Calls on the governments of the Member States to ensure that, in the event of closure proposals , an independent audit is made of the social and environmental costs ;

7 . Instructs its President to forward this resolution to the Commission , the Council , the governments of the Member States, the managements of the companies concerned and the social partners .

Resolution on the serious events in Crotone

The European Parliament,

A. mindful of the serious crisis at Enichem in Crotone , which has provoked dramatic protest demonstrations involving local and church institutions and the entire population , each time paralysing the town ,

B. whereas the events m Crotone are not isolated and are repeated daily throughout the Italian Mezzogiorno and particularly in the Naples area, where the employment crisis is assuming tragic proportions,

C. whereas the town of Crotone has been paralysed for five days by a general strike ; whereas in recent days both motorways and railways have been blockaded, and whereas similar events have taken place in other areas of the Mezzogiorno, particularly in the Naples area, and further violent protests have been promised, with the result that the Italian Mezzogiorno risks becoming a powder keg posing serious dangers for the very future of democracy ,

i D. whereas these events are consistent with the economic and social situation in the Mezzogiorno ; whereas , although they are part of a more general employment crisis in the Community, in the Mezzogiorno the situation is catastrophic ,

t E. whereas the legitimate social tensions combine dramatically with the frailty of the social fabric to provide a new breeding ground and new scope for organized crime,

1 . Calls on the Commission to take urgent, practical steps to tackle the employment problem in the Community through programmes and measures targeted at those areas where the tensions are most acute and the problems most urgent, such as the Italian Mezzogiorno ;

2 . Urges the Italian Government and the southern regions to implement coherent programmes to restructure the production base of the regions of the Mezzogiorno — which have been completely destroyed by an irreversible industrial crisis — by using , if necessary by means of special measures , Community resources earmarked for the IMPs and the MGP but not yet disbursed and by speeding up procedures in connection with the funding earmarked for the period 1994 to 1999 ; 4 . 10 . 93 Official Journal of the European Communities No C 268/139

The European Parliament, A. whereas Mr Iglesias Zamora is still held by the ETA terrorist group, which kidnapped him more than two months ago, B. whereas the sole purpose of the kidnapping was to acquire funds to enable that group to continue its criminal activity ,

/ - C. mindful of the mass demonstration on 1 1 September 1993 in San Sebastian, at which more than 80 000 people demanded that the kidnapped engineer be set free , D. recalling all victims of violence and intolerance,

1 . Condemns in the strongest possible terms the kidnapping of Mr Julio Iglesias Zamora and demands that he be freed immediately and unconditionally ; 2 . Expresses its solidarity with the wife and children of Mr Iglesias Zamora, with his colleagues , on account of the efforts they are making to maintain public interest, and with pacifist organizations and the Basque people , who daily demonstrate their rejection of this kidnapping ; 3 . Instructs its President to forward this resolution to the family of Mr Iglesias Zamora, the Spanish and Basque Parliaments and San Sebastian Municipal Council .

A. shocked by the continued and systematic killing, torture , extrajudicial executions and other human rights violations in Brazil committed by members of the military police, other police forces or hired criminals with impunity ,

4 B. shocked by the killing of eight youths near the Candelaria Church in Rio de Janeiro on 23 July 1993 by members of the military police forces ,

C. deeply concerned that there have been almost 1 800 cases of murder since 1964 in land disputes , including those of hundreds of important leaders and activists , rubber tappers and indigenous people struggling to save their traditional way of life and the rainforest,

D. shocked and dismayed by the brutal murder of at least 18 Yanomami , men, women and children from the community of Haximu , probably by gold prospectors working illegally on the borders of Venezuela and Brazil in August 1 993 , declared by the UN to be the Year of the World's Indigenous People,

E. horrified by the killing of 21 people in the favela of Vigario Geral , Rio de Janeiro, on 30 August 1993 , this being the third massacre in 1 1 months attributed to the military police,

F. recalling the prison massacre in the Casade Detengao, Sao Paulo, on 2 October 1992 , where, according to Amnesty International , 1 1 1 prisoners were murdered by members of the military police as 'part of a deliberate and concerted action',

G. deeply concerned by the appointment of officials alleged to have taken part in torture or murder to important posts in the Brazilian Government, such as Mr Afonso Antonio Marcondes, who was appointed to the post of Under-Secretary for Intelligence at the Secretariat for Strategic Affairs on 7 July 1993 ,

1 . Appeals to the Brazilian authorities to bnng those responsible for torturing and killing to justice , especially those guilty of the massacres described above ;

2 . Calls on the Brazilian authorities to ensure the personal safety and physical and psychological integrity of the survivors of the massacres referred to as well as fair redress from the state , including financial compensation for the families and dependants of the victims ;

3 . Calls on the Brazilian authorities to make a fundamental review of the operation of the civil and military police forces and calls on the current democratic government and the state governments to show greater firmness in condemning , investigating and punishing these crimes and supports all the measures they may take to preserve the lives, the right to co-existence, the civic rights and the livelihood of all Brazilians ;

4 . Calls on the Brazilian authorities to consider transferring jurisdiction for common crimes committed by military police on active duty to ordinary civilian courts ;

5 . Forcefully condemns the massacre of Yanomami Indians and welcomes the strong words of the Attorney-General of Brazil in condemning the massacre , calling it 'genocide';

6 . Calls on the Brazilian authorities to ensure the removal of all gold prospectors from indigenous land and repeats its appeal for the demarcation , protection and ratification of indigenous land, which, under the 1988 Constitution, should be completed by October 1993 ;

A. whereas submitting any person to slavery , servitude or degrading treatment represents a crime against human dignity and a serious violation of human rights , B. whereas trade in human beings is largely a result of the imbalance in international economic relations and whereas this problem concerns both development policy and the policy on international cooperation with the countries of the South and the countries of Eastern Europe ,

j C. whereas some people do not resort to prostitution of their own free will, but are forced to do so by a third party or by need as a result of the economic conditions of poverty, unemployment and insecurity in which they live ; D. whereas trade in women is a form of slavery associated with serious international crime and whereas the fight against this form of slavery should be directed primarily at the illegal networks and procurers rather than the victims,

E. whereas Europol is required to exchange information on serious crime ,

F. noting that, owing to the lack of legal status, prostitution is an activity undertaken in a grey area of society ,

b G. whereas the Ministers of the Twelve, meeting as the Trevi Group, have instructed the Trevi 3 Group to consider the action taken by the police to combat trade in human beings and especially sexual exploitation through traffic in children and women , with a view to harmonizing such action , where necessary , and increasing its effectiveness,

1 . Believes that the problem of trade in women calls for international cooperation in the fight against serious crime and the drafting of international agreements on the protection of women and girls against persecution and the trade in human beings ;

2 . Calls on the authorities , and especially the European Community and the bodies which the Twelve have jointly established to ensure cooperation among their police forces and to combat serious crime, to undertake to collaborate closely and positively with organizations and NGOs which care for the victims by inter alia formulating a policy to combat illegal immigration ;

3 . Believes that this policy should respect human rights and the principles contained in Parliament's resolutions ;

4. Emphasizes that this common policy should seek to thwart those who exploit human beings and should achieve a social goal so that people who prostitute themselves may have access to the whole range of health care facilities and to education and training measures , thus enabling them to resume their place in the labour market and society ;

5 . Calls on the Commission to coordinate this policy and to arrange a meeting with all the bodies concerned, especially the Parliament;

6 . Asks to be informed and consulted by the Trevi Group, and especially its chairman , on the outcome of the Trevi 3 Group's activities and its proposals ;

7 . Calls on Europol to participate in the fight against trade in women and the networks used for the traffic in human beings ;

8 . Considers that effective coordination by the Member States is needed to combat money laundering ;

9 . Calls on the governments of the Member States to adopt, at a forthcoming Council meeting , a declaration denouncing the exploitation of enforced prostitution and trade in women and promising Community measures to combat such exploitation and penalties for trading in women and human beings in general ;

10 . Calls on the Member States to adopt legal provisions to protect the rights , dignity and safety of the victims of trade in women, and, in particular, to : (a) give migrant women the legal right to residence and protection when they are witnesses before , during and after legal proceedings against trade in human beings , (b) permit victims of this international trade to remain in their territory, especially when their repatriation might pose a threat to their personal safety or expose them to renewed exploitation ; (c) grant the victims of trade in human beings the right to bring secondary actions ;

1 . Condemns the kidnapping of people who do not even have anything to do with the conflict between the Turkish Government and the PKK; 2 . Points out that these outrages can only reduce public sympathy for the Kurds in Member States ;

The European Parliament, A. alarmed by the acts of desecration at the Christian cemetery of Neohorion (Yenikoy) in Istanbul, B. whereas acts of this kind directly undermine the tranquillity and security of the Greek Orthodox minority which remained in Istanbul following the persecutions of 1955 , C. having regard to its resolution of 18 April 1991 concerning the setting on fire of a bus carrying orthodox believers to Istanbul ('), D. having regard to the relevant provisions of the Treaty of Lausanne, the Paris Charter and of other international instruments regarding the protection of the rights of minorities in Europe,

1 . Calls on the authorities to shed light on these incidents and to prosecute those responsible and condemns strongly any act which is the result of religious fanaticism which infringes fundamental human rights ; » 2. Points out that this climate of insecunty and of flagrant violations of the fundamental rights of minorities undermines relations between Turkey and the EC ; 3 . Calls upon the Turkish authorities to take the necessary measures for the protection and peaceful existence of the Greek Orthodox minority and to repair the damage caused by the desecration of the cemetery ; 4. Requests EPC to appeal to the Turkish Government to establish the necessary security for the Greek minority of Istanbul and wishes this matter also to be referred to the EEC-Turkey Cooperation Council ;

\ C. whereas the Turkish military forces and their associates are widely suspected of involvement in this incident, D. whereas Mr Sin?ar is one of the victims in a long series of unsolved political assassinations, E. having regard to the increasing number of people killed by armed forces in south-eastern Turkey , F. having regard to the increasing number of cases in which meetings have been banned and restrictions imposed on the freedom of the press and freedom of opinion by the confiscation and banning of newspapers and magazines giving a true picture of the situation in south-eastern Turkey , G. whereas respect for the most basic human rights, as defined by the European Convention for the Protection of Human Rights and Fundamental Freedoms, is an essential precondition for accession to the European Community by any country, H. having regard to its previous resolutions on the Kurds in Turkey,

1 . Deplores the death of the two DEP officials ; 2 . Demands that light be shed on these assassinations and all others which remain unsolved and that the guilty parties be brought to justice ; 3 . Condemns all forms of violence and especially terrorist acts committed by the PKK ; 4 . Calls on the Turkish authorities to put an end to the state of emergency obtaining in the provinces with Kurdish majorities and to guarantee respect for human rights in the region ; 5 . Resolution on the detention of the Tibetans Gendun Rinchen, Loosang Yontam and Damchoe Pemo and other violations of human rights in Tibet

The European Parliament, (

— having regard to the statement of concern issued by EPC on 1 June 1993 ,

— recalling its earlier resolutions and in particular that of 24 June 1993 , on repression in Tibet and the exclusion of the Dalai Lama from the World Conference on Human Rights ('),

— having regard to the statement of concern of Amnesty International,

A. aware of the deplorable violation of human rights in Tibet and the huge number of political prisoners, including 107 apparently arrested during the period April to July 1993 for taking part in demonstrations for independence or calling for the release of dissidents,

B. recalling the arrest of Gendun Rinchen and other Tibetan human rights activists before the arrival of a delegation of EC Ambassadors in Tibet last May , in an apparent attempt by the Chinese authorities to prevent contacts with the EC delegation and in particular to prevent them receiving information about political prisoners,

C. concerned about the fact that Gendun Rinchen since being arrested is being detained incommunicado and is accused of 'stealing state secrets', a charge which can carry the death sentence,

i D. gravely concerned by the reports of the arrest and maltreatment by the police of Damchoe Pemo who, when 20 weeks pregnant, miscarried, having been forced to remain standing for at least 12 hours and having been beaten with electric batons ,

t < E. gravely concerned by the reports that the village of Kymishi in Gongkar County in the Lhoka Prefecture has been surrounded by hundreds of Chinese soldiers who have set up machine gun posts and that 35 people in the village have been arrested,

F. convinced that the relations between the EC and China should not be determined only by economic interests , but should be dependent on respect for human rights and democracy ,

1 . Calls on the Chinese authorities to release forthwith all those detained solely for exercising their right to freedom of expression and to ensure that Tibetan detainees are protected from torture and ill treatment and are granted access to relatives and to a lawyer of their choice ;

2. Supports the courageous activity of Gendun Rinchen and his combatants in support of the respect of human rights and in particular the situation of the political prisoners in Tibet; S

3 . Recalls its demand to the Commission to make all future economic and commercial agreements with the People's Republic of China dependent upon respect for human rights in China and in the Tibetan region ;

The European Parliament, A. recalling the obligation of the Iraqi Government under UN Security Council resolutions to release all those arrested by the Iraqi Government during its illegal occupation of Kuwait, B. recalling the special obligations on Member States who took part in the Gulf War to ensure that the terms of the ceasefire are respected, C. drawing attention to the Amnesty International report, which identified 140 individuals , of whom 1 29 are Kuwaiti and the remainder come from Bahrain, Iran, Lebanon, Saudi Arabia and Syria or are stateless , whose fate is unknown since they were arrested by the Iraqis, D. drawing attention to the Kuwaiti Government's claim that over 650 Kuwaitis are still held prisoner in Iraq, E. recalling its previous resolutions on the human rights situation in Iraq,

1 . Demands that the Iraqi Government release without further delay all people arrested during the Iraqi Government' s illegal occupation of Kuwait; 2. B. noting also that the information dealt with the chemical, biological and nuclear arms build-up in these countries and that Pollard considered he had a moral duty to warn Israel of the developing massive threat to its security and to the lives of its people , C. whereas Pollard has expressed remorse for his action,

t D. whereas Pollard, who was not accused of treason, or of intending to harm the US , pleaded guilty under a plea bargain, and was thus convicted and sentenced, without a full trial, to life imprisonment, despite the Government's promise not to seek such a penalty, E. noting that the sentence imposed on Pollard was grossly disproportionate to those imposed on others by US courts for supplying information to a friendly power (normally from two to four years), F. shocked that most of Pollard's eight years in prison should have been spent in solitary confinement and underground, G. astonished that Defence Secretary Caspar Weinberger, described by one of his Under­ Secretaries for Defence as having had 'an almost visceral dislike of Israel', should have sent a message to the trial judge, one hour before the sentencing hearing, asking for the stiffest possible sentence commensurate with Pollard's 'treasonous' (sic) behaviour, H. noting however that Mr Weinberger stated recently that he thought it was time that Mr Pollard should be released ; aware that Christian and Jewish organizations throughout the world have pleaded for the harsh sentence of life imprisonment to be commuted and that Judge Steve Williams wrote , in a dissenting opinion to an appellate court finding, that 'the government's conduct in this case resulted in a complete miscarriage of justice',

< I. Urges the US Administration to commute Pollard's sentence to one of time served and to release him immediately ; 2 . Calls on EPC to intercede with the US government with this end in view ; 3 . B. whereas the continuing process of deterioration of the soil in arid and semi-arid areas , owing to the joint impact of various physical factors (climate, relief, type of soil, etc.) and adverse human activities, has helped to exacerbate this process of soil erosion which will slowly and inexorably lead to desertification,

C. whereas application of the rainfall threshold index of 600 millimetres per annum, below which desertification can commence, suggests that most of southern Europe could be affected,

D. whereas a large part of the land surface in the Mediterranean regions of Europe — especially large areas of South-East Spain (in the provinces of Almerfa, Granada and Murcia), the Levante , the Ebro valley , Castilla la Mancha etc., the south of the Italian peninsula, Sardinia, Sicily , the Alentejo and the Algarve in Portugal , Corsica and much of Greece — is characterized by a climate of extremes , in which long periods of drought alternate with heavy seasonal rainfall thereby accelerating the process of desertification ,

E. whereas in this area, intensive and unsuitable human occupation over thousands of years entailing ploughing , burning , deforestation, unregulated grazing, erosion, salinization, etc . has contributed to speeding up the soil erosion process and created conditions favourable to future, irreversible desertification processes,

F. whereas , over the last three centuries and more intensively in recent decades , the pressure of human beings on the environment has increased owing to greater energy use and technological development, leading to such phenomena as concentration of population , intensification of agriculture, abusive use of herbicides and insecticides , employment of heavy machinery and deep ploughing, thus accelerating erosion throughout the Community, especially in southern Europe ,

G. whereas the vulnerability of the Mediterranean countries to desertification will increase with the climate changes arising from the rise in carbon dioxide levels in the atmosphere,

I H. whereas the increasing rate of soil erosion , which can cause the loss of 100-200 tonnes per hectare per annum in vulnerable areas , is a threat to agriculture insofar as it reduces the extent and productivity per inhabitant of the cultivated surface, increases liability to flooding and depletes reservoir and infiltration capacity and leads to a further reduction in water resources ,

I. whereas increasing deforestation resulting from the devastating forest fires which occur every year is another key factor in the worsening of erosion and desertification ,

i

J. whereas rainfall distribution in southern Europe — both seasonal and interannual — is highly irregular, with precipitation levels of 200 millimetres in 24 hours, on occasion reaching an intensity of 100 millimetres per hour,

♦ v K. having regard to the disturbing shortage of water for domestic and agricultural purposes in some areas of the Mediterranean and the alarming deterioration of water quality , together with hyperconsumption and uncontrolled, large-scale exploitation of underground waters, which has resulted in increased salt levels in watercourses and cultivable land, as well as the desertification of forest areas , which has led to an increase in forest fires,

L. alarmed at the fact that, owing to the above circumstances, tens of thousands of persons are being faced with the destruction of their livelihoods and forced into migration, while over a thousand plant species and more than two hundred vertebrate species are threatened with extinction,

< M. whereas the compilation and updating of land registries at national level and the compilation and revision of national land use plans are basic preconditions for controlling man's activities and maximizing the effectiveness of the different projects and are also a basic means of tackling the phenomenon of desertification ,

N. whereas the Treaty on European Union signed in Maastricht on 7 February 1992 establishes as one of its main objectives the promotion of sustainable growth respecting the environment and incorporates the requirement of environmental protection into the definition and implementation of the Community's other policies,

O. whereas the UN Conference on Environment and Development held in Brazil in June 1992 provided in Chapter XII of Agenda XXI for an international convention to be drawn up to combat desertification and drought; whereas the Community is under a moral obligation to play a pioneering role in the implementation of its conclusions and results,

1 . Calls on the Commission and Council to adopt the criteria and objectives concerning anti-desertification measures defined by the UN Conference on Environment and Development and, consequently , to pursue, on the basis of suitable funding, the following objectives : (a) preparation of a programme for data collection , information and observation on a systematic basis in respect of the regions of the Community which are vulnerable to desertification and drought, accompanied by intensified research into the economic and social aspects of the ecosystems in question ; 4. 10 . 93 Official Journal of the European Communities No C 268/ 151

(b) preparation of a Community policy for soil protection and preservation to combat soil degradation and erosion, promote soil conservation measures , plant new forests and regenerate existing ones ;

(c) encouragement of specific programmes of anti-desertification measures , to be coordinated with economic plans and national ecological planning ;

(d) promotion of training , information and participation of farmers , the public and social agents and of environmental education, with particular emphasis on anti-desertification action ;

2 . Urges the Commission and the Council , when drawing up policies on agriculture, forestry measures, transport, infrastructure , industry , energy, regional planning , etc ., to take account of the serious problem of erosion and ensure that these policies are compatible with sustainable soil management;

3 . Calls on the Commission to define a genuine strategy to combat desertification in coordination with the Member States affected, to be based on the following principles and actions :

* s (a) adequate knowledge of the magnitude and mechanisms of the phenomenon :

— mapping using various different scales , with a view to delimiting the areas most liable to and affected by water and wind erosion (to include maps of water resources);

— creation, for representative ecosystems within the areas most affected, of pilot networks of areas for surveillance of soil and water pollution and evaluation of desertification processes ;

(b) development of control techniques :

— promotion of control techniques, including implantation of new species to 'colonize' the most difficult areas, replanting with native tree species, reintroduction of slow-growing trees, mixed replanting and the preparation and experimental introduction of agricultural and stockbreeding models suited to arid and semi-arid environments ;

i (c) creation of an action plan for the affected areas :

i — a Community action plan aimed at coordinating the national plans and channelling funds to the most severely affected areas, defining them geographically and drawing up projects in terms of water catchment areas and with the appropriate practical measures ; such projects should include physical planning proposals in connection with diverse and rational soil uses in the water catchment area affected ;

i (d) supervision of national water plans :

— information on the water resources of each water catchment area, assessment of the environmental impact of possible diversions and drastic limitations on the use and consumption of water resources, by carefully regulating and ensuring proper planning of the use of underground waters ;

m (e) integration of control actions into the social and economic context :

— promotion of the above measures in the economic and social context, encouraging user participation via information programmes and economic incentives ;

(f) public relations campaign

i — to ensure that both the general public and government authorities realize the gravity of the problems to which increasing desertification may give rise in some Community regions , and the need to give real priority to programmes and measures designed for its rectification ; No C 268/ 152 Official Journal of the European Communities 4. 10. 93

4. Calls therefore, in accordance with the principle of prevention , for environmental impact assessments to take into account the quality of soil so that land of lesser quality is used for the building of new urban or industrial developments or infrastructure;

5 . Calls on the Commission to undertake an exhaustive assessment of the measures included in the Fourth Action Programme concerning anti-desertification action, and of the Community's financial participation, on the basis of Regulations (EEC) 1609/89 , 1610/89 , 3528/86, 1613/89, 3529/86 and 1614/89, in the replanting, development and optimal use of forests in rural areas and in the protection of forests against pollution and fire ;

i

6 . Calls on the Commission to carry out an up-to-date assessment of the complementary actions which, with Community support, make it possible to understand and control desertifica­ tion, including the results of the CORINE programme aimed at identifying areas at risk, the research work of the EPOCH programme and specific projects such as EFDA;

7 . Calls on the Commission to ensure that the Structural Funds in the context of Objectives 1 and 5b are used correctly in line with environmental protection requirements by ensuring the protection of the soil and natural resources and, more specifically, combating erosion and desertification ;

8 . Urges the Commission to ensure that implementation of the Fifth Action Programme attaches priority to the regeneration of plant cover and the preservation, supervision and restoration of soil in the areas of the Community most affected by desertification, as called for in its above-mentioned resolution of 17 November 1992 on this programme ;

9 . Calls for the package of anti-desertification measures to be adequately funded via increased resources for the LIFE programme (incorporating the programme for the protection of the environment in the Mediterranean — MEDSPA) and supplementary funding to aid reconversion of land to extensive , multiple and non-concentrated uses ;

10 . Requests the Commission to ensure that the communication it is planning to submit to the Council in the near future on a new strategy for the forestry sector includes the role of forestry policy as a strategy for fighting and controlling the processes of erosion and desertification, and to propose, if necessary , new practical measures and the coordination and improved articulation of those which already exist ; efforts should also be made to encourage the use of traditional native species which ensure a better balarfce between agriculture, stock farming and forestry , rather than resinous and fast-growing species which are susceptible to forest fires and accelerate the process of desertification ;

1 1 . Calls on the Commission and Council to set up a European Forestry Fund, to permit the effective protection of wooded areas and their regeneration and extension with a view to environmental conservation and balance in ecosystems ;

12 . Believes that, in the marginal areas worst affected by the problems of erosion and desertification, it might be appropriate for national and Community legislation to encourage the provision of special loans, either to private individuals or to representative local bodies which undertake to participate in reafforestation and forestry management and exploitation projects ;

13 . Calls on the Commission to institute the greatest possible coordination with the Member States, the government-run specialist control bodies, in particular those attached to water catchment areas, and the regions or communities most affected by desertification, and to ensure that, once set up, the European Environment Agency undertakes , together with the national , regional or district bodies concerned, coordination of scientific research and technical control in respect of desertification ;

14 . Points out that it would be desirable for the Member States to support the implementation of pilot projects to combat desertification in certain areas , since in addition to their practical benefits they are likely to be of special interest in view of the example they set, which will encourage experiments of this kind to be extended to other areas ; 4. 10 . 93 Official Journal of the European Communities No C 268/ 153

15 . Voices its concern that reform of the CAP is leading to the gradual abandonment of marginal farmland, without any accompanying soil conservation measures , in areas where the absence of economic alternatives and measures to support subsidiary activities in the country­ side, together with the age structure of the farming population, are leading to the disappearance of human activity and to emigration ; requests the Member States accordingly to provide incentives for the implementation of measures to supplement CAP reform, for the conservation of agricultural soil, promotion of reafforestation and farming methods that are environmentally compatible, as well as the promotion of integrated rural development programmes ;

16 . Calls on the Commission to adopt, as part of the CAP, prevention and regeneration measures to alleviate the problem of desertification on the arid soils of the Mediterranean regions by setting up specific funding measures to encourage products based on the traditional agricultural and ecological systems of the Mediterranean , since these would allow a healthy balance to be maintained between agriculture , stockfarming and forestry as well as preserving the related farming methods (soil terracing , seasonal pasturing, etc.) which protect soils from erosion ;

17 . Instructs its President to forward this resolution to the Council , the Commission and the governments of the Member States .

t A. whereas the promotion of and respect for human, civil and political rights are basic elements in relations between states ; whereas such elements are fundamental to the renewal or initiation of bilateral or multilateral economic and trade relations between states ; whereas it is to be hoped that the political leaders of Cuba will take steps to ensure that all violations of human rights cease,

t B. whereas decisive action must be taken in Cuba towards a political, economic and institutional democratization process ; whereas the European Parliament has always declared itself willing to help step up political and economic cooperation with Cuba once it starts to take such action,

C. whereas the United States has been applying a total economic, trade and financial embargo on the Republic of Cuba since 1962,

D. whereas the break-up of the USSR has resulted in the total economic collapse of Cuba given that, up until 1989 , 85% of its foreign trade was with the former Comecon countries,

E. whereas , last year, the US Congress adopted the Torricelli Act to tighten up the economic embargo against Cuba with the aim of preventing firms outside the United States' jurisdiction from trading with the island ; whereas the EC and the Member States had asked President Bush to veto the Torricelli Act as it was based on the inadmissible principle of extra-territoriality and was contrary to the free exercise of the national sovereignty of states,

F. whereas the Torricelli Act, which is contrary to international law and is rejected by the international community , is having serious effects, as testified by the fact that many European firms have had to renounce profitable contracts with Cuba because of pressure from the United States ,

G. whereas , although the international legal order allows individual states to take restrictive trade measures to defend their own national interests, it does not legitimize the imposition of such measures on third countries ,

H. whereas the Latin American Parliament, together with other national parliaments , called on 2 August 1991 for the economic, trade and financial embargo against Cuba to be lifted ; whereas this call was echoed by the UN General Assembly on 24 November 1992 with only Romania, Israel and the USA voting against,

I. whereas the economic, trade and financial embargo imposed by the United States is affecting the civilian population above all, depriving them of food, medicines and basic necessities ,

J. whereas many EC Member States have normal relations with Cuba and have concluded profitable economic and trade agreements and joint venture agreements , including schemes in which the foreign companies exercise total control, as permitted by the new Cuban laws on foreign investment, and have signed bilateral agreements for the protection of foreign investments,

K. whereas Cuba is the only Caribbean and Latin American country with which the Community has not yet concluded trade or development cooperation agreements , despite the fact that there is no legislation at Community level which actively discriminates against Cuba,

L. whereas the Cuban Democratic Platform , a coalition of various political forces which have their equivalents in the European Parliament, has been making reasonable, moderate proposals for dialogue and rejecting any confrontation between Cubans other than through the ballot-box,

2 . Reiterates its strong condemnation of the Torricelli Act, which is contrary to international law and now appears to be an anachronism ; calls on the US Congress to revoke the Act and hopes that no such legislation will be passed in future (since it is also contrary to the rules of GATT);

3 . Calls on the Community and the Member States not to comply with the provisions of the Torricelli Act whose effects are nevertheless beginning to be felt; to this end, calls on the Commission to take the necessary legislative steps — following the example of Canada and the United Kingdom — to ensure that European companies and/or companies established in the Community can carry out normal trading activities with Cuba;

4 . Calls on the Cuban Government to open a constructive dialogue with democratic groupings at home and abroad which are not identified with the Cuban political regime, in order to lead peacefully and within a reasonable period of time to an electoral process which is open to all parties and whose impartiality is fully guaranteed ;

5 . Calls on Cuba and the Community , inter alia on the basis of the processes of change under way on the island, to step up political , economic and cultural dialogue in order to encourage the type of democratic development of the Cuban regime which respects the human, civil and political rights of the people and the country's independence ; expects the Cuban Government to show willingness, and put forward practical measures , to introduce a free, democratic constitutional system which allows freedom of expression and opposition and eliminates violations of human rights for good;

6 . Believes that increased cooperation between the EC and Cuba and improved free trading relations will enhance the role of Cuban society ; the Cuban Government must foster this process by establishing more dialogue in the country , which the Community can support by means of training programmes for businessmen and women aimed at opening up the Cuban economy ;

7 . Considers that it would be beneficial , in this connection, if the Republic of Cuba were included in the regional cooperation programme financed by the EC in the Caribbean and Latin American region ;

8 . Hopes that greater dialogue between the Community and Cuba may lead to the conclusion of a general economic and trade agreement at the earliest opportunity in order to give a boost to bilateral relations ;

9 . Reiterates its request, meanwhile , that the Council , the Commission and the Member States take rapid steps to increase humanitarian aid for the Cuban people through NGOs by means of health development programmes (particularly in view of the serious epidemic of optic neuritis) and rural development programmes designed to meet the vital needs of the population, whilst ensuring that an increasing number of NGOs can operate unhindered in Cuba;

10 . Reiterates its request to the Commission, as set out in Parliament's abovementioned resolution of 22 April 1993 , 'to help Cuba tackle the long-term consequences' of the violent storm 'by granting trade advantages (loans and preferential customs treatment) and by financial and technical cooperation' ;

11 . Instructs its President to forward this resolution to the Commission , the Council, the governments of the Member States , the National Assembly of the People's Republic of Cuba, the President of the Cuban Council of State, the UN Secretary-General , the Latin American Parliament, the President and Congress of the United States and the Liaison Committee of European NGOs . Resolution on the role of the Court of Justice in the development of the European Community's constitutional system

The European Parliament, — having regard to the motion for a resolution by Mr Medina Ortega, Mrs Vayssade, Mr Janssen van Raay and Mrs Salema on the role of the Court of Justice in developing the EC's institutional system (B3-21 16/90),

i — having regard to its draft Treaty (') establishing the European Union of 14 February 1984 and the specific proposals it put to the Intergovernmental Conferences on Economic and Monetary Union and Political Union held on 22 November 1990 ( 2), — having regard to the Treaty on European Union of 7 February 1992 (3), — having regard to the report of the Committee on Institutional Affairs and the opinion of the Committee on Legal Affairs and Citizens' Rights (A3-0228/93),

A. whereas the Court of Justice of the European Communities has played an important role in the process of European integration and proved its value as a constitutional court; whereas its function as a constitutional court is exercised — irrespective of the class of action — by means of decisions on legal questions in the following areas: (a) delimiting competences between the Member States and the Community or between the institutions and the Community and clarifying their respective institutional rights and obligations ; (b) determining whether secondary Community legislation and proposals for international agreements are consistent with Community law ; (c) protecting fundamental rights and developing general legal principles, B. whereas the case law on the precedence of Community law , the protection of fundamental rights, the direct applicability of Community law, the comprehensive nature of the system of legal protection , the balance between the institutions and on the duty of genuine cooperation of the Community and the Member States is very important,

i C. whereas the principles laid down in this case law must be reflected in a future constitution of the European Union , D. whereas the preliminary reference procedure is very important for ensuring uniformity in the interpretation and application of Community law, E. whereas the procedure for establishing that a Member State has failed to fulfil its obligations under the Treaty is an important Community instrument for ensuring that Community law is implemented and applied in Member States , F. whereas the continuous increase in the number of cases pending before the Court of Justice makes it increasingly difficult for this court to deliver its judgments rapidly , G. whereas the creation of the Court of First Instance by the Single European Act was a significant step towards reform of the European Communities' judicial structure, H. whereas the development of the Court of First Instance is Very important for the legal protection of individuals and undertakings, as well as for lightening the workload of the Court of Justice, which will be in a better position to devote itself to its constitutional duties,

I. whereas Parliament's opportunities to participate in proceedings before the jurisdictional bodies of the Community must be extended to reflect its role as co-legislator,

1 . Considers the following improvements to the system of legal protection and to judicial proceedings to be essential :

(a) in future, the Court of Justice should primarily settle constitutional disputes in all spheres of activity of the Union, maintain the uniformity of the law by answering fundamental questions referred for a preliminary ruling and hear appeals against judgments of the Court of First Instance ,

(b) with the constitutional system as it currently stands , references for preliminary rulings must continue to be the sole province of the Court of Justice ,

(c) the right of the national courts to refer cases for a preliminary ruling under Article 1 77 of the EC Treaty must remain unrestricted; any attempt by the Member States to limit this right to courts of last instance must be rejected,

\ (d) the European Parliament must be given the same nghts as the other institutions in the preliminary reference procedure,

(e) in order to lighten the workload of the Court of Justice

—- the preliminary reference procedure should be speeded up, particularly by consistently using of the system of chambers (Article 165 of the EC Treaty),

— the Court ofFirst Instance should, without delay , be granted the competences which may already may be conferred on it under the current version of Article 168a of the EC Treaty ,

(f) the Court of First Instance should have jurisdiction in all actions to establish a Member State's failure to fulfil its obligations under the Treaty (Article 168a of the EC Treaty), (g) the Court of First Instance should also have jurisdiction in all actions brought by natural or legal persons in so far as such actions have not been allotted to the Court of Justice , *

(h) the Court ofJustice should in future have the option of rejecting as clearly unfounded appeals against judgments of the Court of First Instance, without an oral procedure or explanatory statement, by a unanimous decision,

(i) in view of its growing importance, the Court of First Instance should in future be called 'the Court of the European Union' and be granted greater autonomy in matters concerning its organization and budget,

(j ) as regards the right of internal organization of the Community courts, general principles such as the election and composition of the courts should be regulated by the treaties , with other matters being laid down in a Community legal act adopted under the co-decision procedure,

(k) judges at the European Court ofJustice should be elected by the European Parliament and the Council, by a uniform procedure which has yet to be laid down, for a single term of office of nine years,

(1) the European Parliament should be granted the same rights in applications for annulment as the privileged applicants referred to in Article 173 , second paragraph of the EC Treaty,

(m) the European Parliament should be able to bring an action before the Court of Justice if an agreement between the Member States, e.g. in the field of the common foreign and security policy or of justice and home affairs , is incompatible with the Community treaties , (n) in order to preserve the balance between the institutions, the European Parliament should be granted the right to apply to the Court of Justice under Article 228 of the EC Treaty for an opinion as to whether an agreement is compatible with the Treaty and the Court of Justice should involve it in all proceedings of this kind, No C 268/ 158 Official Journal of the European Communities 4 . 10. 93

(o) in addition to the system of penalties laid down in the Treaty on European Union , the system of legal protection should, on the basis of the case law of the Court of Justice ('), be developed for the benefit of individuals where Member States have acted in breach of tne treaties, in order to ensure that Community law is fully effective and recognized ; (p) in the interest of compliance with their judgments in the Member States the Community's jurisdictional bodies should be staffed to ensure that their judgments are available in all the official languages within a reasonable period of being handed down, 2 . Calls on the Commission to submit to Parliament and the Council proposals for improving the system of legal protection and judicial procedures in accordance with the aims listed above ; 3 . Reserves to itself the right to draw up proposals for changes to the treaties with a view to achieving these aims and to submit the proposals to a future intergovernmental conference ; 4 . Instructs its President to forward this resolution and the report of its committee to the Court of Justice , the Court of First Instance, the Commission , the Council and the parliaments of the Member States .

(') In this connection , the European Parliament welcomes the judgment of the Court of Justice of 19 November 1991 in Joined Cases C-6/90 and C-9/90 Francovich v Italian Republic [ 1991 ] ECR 1-5357 which grants individuals a right to claim compensation from a Member State if the latter does not implement Community law that is favourable to the applicant.

Resolution on the steel industry

The European Parliament, — having regard to its resolutions of 29 October 1992 on the situation in the European steel industry (') and 12 March 1993 on the European steel industry (2),

t — having regard to the statements made by the Council of Ministers on 25 February 1993 , — having regard to the Commission's statement of 16 September 1993 ,

A. having noted , on the basis of the provisional programme for the second half of 1 993 , that the situation on the steel market, despite a slight price increase , has worsened and in any event does not offer prospects of improvement in the short term, B. whereas the serious social and economi*? consequences of this crisis have been made all the more dramatic by the persisting economic recession in Europe, particularly in certain areas of the Community , C. aware that there are plans to lay off more than 60 000 workers in the sector in the next two years and that there may be a 10% reduction in jobs by the end of 1993 , D. whereas the Commission's chosen strategy to tackle the crisis consists in coordinating voluntary redundancies and activating a programme of aid to cover the social costs of the reductions in capacity ,

< % E. noting that all the deadlines set are not destined to be respected, as demonstrated by the fact that the meeting of the Council on 26 July 1993 was cancelled, that there is considerable uncertainty about the actual possibility of a decision being taken at the next meeting of the Council on cases of state aid to steel companies or of agreements being drawn up between companies by 30 September 1993 to reduce production capacity ,

F. whereas contrary to the Commission's expectations, reductions m surplus production capacity on the basis of voluntary closures have not yet been carried out, and having regard to the difficulties encountered so far in financing voluntary redundancies ,

» G. whereas the levying of import duties by the United States discnminates against European industry interested in the US market,

1 . Expresses its alarm at a situation which is continuing to worsen, especially in social terms , and calls on the Commission to step up action, since only a Community strategy can prevent the clash of conflicting interests and a purely national approach to the crisis ; therefore calls on the Council to find as soon as possible a solution to the cases of public aid to steel companies;

i 2 . Calls on the Commission

(a) to ensure that any reduction in capacity actually results in reduced production, (b) to ensure that all the restructuring measures accompanied by aid from the Member States are in accordance with the Aids Code , (c) to ensure, by means of a strict application of Articles 91 and 92 of the Treaty , that all aid is linked to reductions in production ;

3 . Considers that, in any event, rapid and incisive Community action in the social sphere is a matter of priority and calls on the Commission and the Member States to allow those firms which want to reduce production capacity or have already done so, to have access to the social aid plan drawn up by the Commission, without being bound by the global restructuring plan ;

4 . Calls for the rapid preparation of a plan for the conversion of production which gives priority to the reemployment of steel workers who lose their jobs , with the aid of the existing resources provided for under the ECSC Treaty and the Structural Funds ;

5 . Calls for clarification of the current situation of the ECSC budget and its real ability to tackle the measures demanded by the crisis ;

6 . Desires that the financial reserve set up by the ECSC over the years be used to allow the restructuring of the steel industry ;

7 . Calls for help for the application of technological innovation in order to ensure that the output ofthe EC's steel industries is increasingly of the highest quality, as is being done in the US (where European technology is naturally being applied);

8 . Calls for guarantees to ensure that ECSC loans and EC help to the countnes of Central and Eastern Europe do not contribute to an increase in capacity which will subsequently be destined for the Community market before the cost structure of companies in those countries is reformed;

9 . Reiterates the demand, already expressed in the above-mentioned resolution of 12 March 1993 , regarding the dispute with the United States , since it is still convinced that the customs duties levied by the US authorities are arbitrary and unfairly penalize the Community steel industry ; welcomes the Commission's approach to the problem and the partial results already achieved and calls on it to continue its action , in collaboration with the European Parliament, to settle the continuing dispute ;

Is alarmed that several EFTA countries have taken advantage of competitive devaluations to export to the EC steel in such quantities as to exacerbate a market situation that is already very depressed ; 1 1 . The European Parliament, A. having regard to the failure of both the international community and the European Council to ensure that the principles and conditions set out by them on many occasions and by the European Parliament are implemented and guaranteed with a view to finding a solution to the conflict in the former Yugoslavia; B. having regard to the continuing fighting in Bosnia-Herzegovina and expressing its indignation at the failure of international decision-making structures to achieve a peaceful settlement to this conflict,

V C. aware of the grave risk that the conflicts now raging in Bosnia-Herzegovina and parts of Croatia will spread to other parts of Europe,

D. having regard to the statements made by Parliament, the Commission and the Council that any agreement on the future of Bosnia-Herzegovina must be agreed by all parties to the conflict and that territorial gains secured through violations of internationally recognized borders or through the use of force cannot be accepted, E. having regard to the continuing blockade of international aid convoys to the people in need in Bosnia-Herzegovina, F. having regard to the reports by the UN rapporteur on the violation of human rights in Bosnia-Herzegovina and by the International Committee of the Red Cross on the atrocious treatment of detainees by Serb and Croat forces,

Considers that an acceptable solution is necessary to bring an immediate end to the barbaric conflict in Bosnia-Herzegovina ; therefore supports the demands made by the Government of Bosnia-Herzegovina for changes in the proposals — such as access to the sea and the establishment of a territorial corridor between central Bosnia and the Muslim enclaves in the east — which are a necessary condition for guaranteeing the right of existence of the Muslim population in Bosnia-Herzegovina;

3 . Urges the UN Security Council, the Community and its Member States to exert the necessary pressure on the Serb and Croat authorities to allow for an immediate resumption of the negotiations and the rapid conclusion of an agreement that is acceptable to all parties concerned ;

5 . Calls on the Community and its Member States to implement the decisions of the Atlantic Council of 9 August 1993 concerning further action to be taken on the basis of a resolution of the UN Security Council if no acceptable agreement can be reached in the Geneva negotiations ;

6 . Calls on the Community to ensure the continuation and stepping up of humanitarian aid to the population of Bosnia-Herzegovina and the protection of civilians in the besieged towns ;

7 . Calls for a plan for the reconstruction of the country , and for basic reconstruction activities to be begun with absolute priority for the besieged towns and those areas where the original population can return in peace and dignity ;

8 . Pays tnbute to the courage of all EC and UN troops , monitors and aid workers who are — often at great risk to their own lives and safety — making every effort to provide some relief for the suffering people of Bosnia-Herzegovina, as was demonstrated again recently in the town of Mostar ;

Stresses , in view of the confusion which exists at the scene of conflict, the importance of defining clearly the responsibilities of the various international organizations for promoting peace and security in the Balkans and the responsibilities of each of the Member States in these matters , so as to stop the sterile disputes over competence between these organizations and states ;

10 . Urges the Community and its Member States to take all measures necessary to secure the immediate release of people detained by Croat and Serb forces ; calls on the UN Security Council and particularly on EC Member States sitting on it to consider sanctions against Croatia because of its continuing support for the aggression against the people of Bosnia-Herzegovina;

1 1 . Calls on the Member States of the Community to press for the early establishment of the international war crimes tribunal as proposed in Security Council Resolution 827 ;

12 . Insists that it is the duty and in the interests of the Community and its Member States to take steps, if necessary by the deployment of military forces , to prevent the war spreading to countries neighbouring Bosnia-Herzegovina;

Deplores the failure by the Council, the Commission and the national monetary authorities to take firm action in response to the crisis , a failure which is prolonging the uncertainty surrounding the financial markets , thereby exacerbating the economic crisis and adding to unemployment; 2. Calls upon the Council and the Commission to maintain and continue to support strongly all steps towards Economic and Monetary Union as agreed in the Maastricht Treaty ; 3 . Considers that there is no satisfactory economic and monetary explanation for the recent monetary crisis and is concerned at the disastrous impact which this situation may have on economic cohesion in Europe and the smooth functioning of the internal market; 4. Notes that a system of fluctuating exchange rates is already increasing the cost ofborrowing and of foreign exchange transactions , thereby creating two further handicaps to the Community's competitiveness ;

5 . Calls on Member States to contribute to greater credibility of national and European monetary policies and not deliberately to devalue their currencies to achieve greater competi­ tiveness versus other Member States, because this would not even be in their own interest in the medium term ;

6. Considers that this second monetary crisis affecting the EMS , following that of September 1992, has exceptional political implications , because it has highlighted the lack of political will in the Community and its inability to resolve the problem, and because it threatens to lead to the economic, political and institutional disintegration of the Community ;

7 . Is concerned at the consequences , whether economic (functioning of the internal market, economic uncertainty , higher financial costs, disruption of agricultural policy , Community budget, implementation of Community policies) or social (employment, public expenditure), of the decisions taken by the Council of Finance Ministers ;

8 . Is concerned, from the point of view of economic and social cohesion, at the measures taken without any European cooperation and the consequences of the economic and monetary crisis for workers and social protection, and reiterates its proposal for a European soqal pact for employment;

9. Urges that immediate measures should be taken to reduce the impact of waves of speculation on exchange rate stability and proposes that measures be adopted to increase the transparency of the financial markets ; calls in particular on the Committee of the Governors of the Central Banks of the Member States to undertake forthwith a detailed analysis of, and monitor, the operations on the capital market and to report back regularly on this matter to the Commission , the Council , the European Parliament and the Member States ;

1 0 . Calls for more urgent consideration to be given to medium-term measures which should enable central banks to defend more effectively exchange rate levels which are consistent with the overall economic situation ;

1 1 . Urges the Council, the Commission and Member States to do everything for political and monetary credibility by more coordination and cooperation and by accelerating the introduction of the common European currency ;

v 1 2 . Notes that the recent monetary crisis bears all the hallmarks of a crisis affecting exchange rates and the monetary system as a whole, and calls on the Commission and Council, therefore, in their respective areas of responsibility , to propose and implement measures which go beyond simply reviving the EMS , with a view to achieving monetary stability in line with the provisions of the Maastricht Treaty ;

13 . Calls for the Community institutions to be strengthened, in particular through the establishment of the European Monetary Institute , which the Member States should provide, from its inception , with the instruments it needs to coordinate monetary policy effectively, in line with the Maastricht Treaty and according to the timetable set out therein ;

14 . Instructs its committee responsible to submit to it for the October 1993 part-session conclusions on the lessons to be drawn from the crisis for the implementation of EMU ;

15 . Calls on the European Council meeting in October 1993 to reaffirm clearly its strong commitment to attaining full EMU , so necessary to the competitive position of the EC and the strengthening of the internal market, and to this end calls on it to instruct the Commission and the Belgian Presidency as a matter of urgency to present proposals aimed at the restoration of monetary order and stability within the EMS at the earliest opportunity ;

The European Parliament, — having regard to the package of positive measures for the Community fleet submitted by the Commission to Parliament and the Council (CC)M(89)0266) ('), — having regard to its opinions of 26 October 1990 ( 2) on the proposals for I. a Regulation establishing a Community shipping register and providing for the flying of the Community flag by seagoing vessels ; II . a Regulation on a common definition of a Community shipowner; III. a Regulation applying the principle of freedom to provide services to maritime transport within Member States and 20 November 1992 (3 ) on a proposal for a Regulation applying the principle of freedom to provide services to maritime transport within Member States (maritime cabotage), — having regard to its resolution of 12 June 1992 (4) on the liberalization of maritime cabotage and its economic and social consequences and Council Regulation (EEC) No 3577/92 (5 ) on the freedom to provide services to maritime transport within the Member States (cabotage),

A. whereas m the conclusions of the Edinburgh European Council of 1 1 / 1 2 December 1992 the Council contested the proposed definition of a Community shipowner on the basis of the principle of subsidiarity , B. having regard to the serious economic and social crisis which Community sea transport has been facing for many years , aggravated by the growing trend for Community shipowners to shift towards registration under flags of convenience , C. having regard to the importance of sea transport for trade with the rest of the world ; whereas the growing demand for the movement of goods in intra-Community trade and in trade between the EC and third countries will be satisfied only by ever greater use of this type of transport; whereas this should bring about a reduction in the obstacles hampering sea transport, D. whereas sea transport is also important for the development of the internal market and for the future of an integrated and sustainable Community transport policy , as outlined in the Commission's White Paper, E. whereas , in the light of the recent adverse developments affecting Community shipping, the measures in favour of the Community fleet contained in its aforementioned opinion of 26 October 1990 are not sufficient, and whereas there is a need, therefore , to extend the scope of such measures and to adopt additional measures,

1 . Deplores the Council s failure to react to the proposals concerning the package of positive measures and calls on it, therefore , to approve as a matter of urgency that package designed to support the Community fleet, supplementing it with an aid plan, including fiscal aid, which will stimulate activity in the sector without delay , bearing in mind that the definition of a Community shipowner and the creation of the Euros register are essential for the success of a common sea transport policy and cannot therefore be dissociated from it ; 2 . Calls on the Commission and the Council to continue as a matter of urgency their work to establish a Community policy on port infrastructures , which is essential for the development of sea transport, in particular in relation to the intermodal network ;

3 . Points out that the liberalization of cabotage can not be tackled without a legislative framework for the Community fleet and calls once again on the Commission and the Council to authorize access to maritime cabotage only for vessels in the Euros register when it is established, and prohibit access to cabotage to all vessels practising social dumping ;

i 4 . Considers that the opening up of European maritime cabotage to third countries should be governed by the principles of reciprocity and fair competition, with the flags complying with current Community social standards ; 5 . Stresses the importance of passenger and crew safety and the protection of the environment and calls on the Council to make good the delays in this field and work towards guaranteeing the uniform application of international standards at Member State level and ensuring observance of these standards by all vessels working in Community waters ;

i ' 6 . Instructs its President to forward this resolution to the Council , the Commission , the governments of the Member States and the economic and social organizations in the sector.
