This pat- tern began with New World gold and silver in the time of Columbus; and contin- ued with the relentless acquisition of land, water and other natural resources in the United States during the 1776 to 1900 period. This massive property transfer was not limited to real estate. On the darker side of this pattern, hundreds of thousands of Native dead were taken from North American Indian graves, burial mounds and cemeteries. In addition, movable property, such as cultural objects, sacred objects and cultural patrimony, also left Indian hands by the trainload during this period, including some items which were stolen or improperly sold. When Congress passed the repatriation provisions of the National Museum of the American Indian Act of 1989 and the Native American Graves Protection and Repatriation Act of 1990, it acted, in small measure, to reverse the historic pattern of one-way property transfers. Both laws provide for the return of Native American human remains and funerary objects to proper Native parties; and NAGPRA also includes other cultural items such as sacred objects and cultural patrimony within its provisions. Like other national human rights legislation (such as the civil rights statutes which were enacted over a generation ago and are still being implemented, with increasing difficulty, today), Native American repatriation laws will take years to fully imple- ment. This is due not only to the sheer magnitude of American museum collections that have accumulated over the centuries, but also because of the time-consuming, sometimes expensive, and always complex federal repatriation processes. Thus, in the coming months and years Indian Tribes and Native leaders must tread through a myriad of complex statutes, procedures and policies in order to thoroughly accom- plish the return of Indian cultural items and the reburial of tribal relatives. The repatriation process can be complicated from the tribal perspective. It is not unusual for a tribal leader, cultural resource staff person, or traditional tribal mem- ber to receive voluminous summaries, inventories or other repatriation forms from museums located hundreds of miles away. Yet, the task of reburying relatives or reclaiming tribal property can be of far-reaching importance to present and future generations. To respond to this challenge, repatriation can require expertise in legal, technical, archival and historical, fund raising, cultural, administrative and politi- cal arenas in order to develop and implement appropriate pro grams and strategies for unique Native Tribes and communities. In recent years, museums have spent considerable time educating themselves about federal repatriation

Introduction In recent years, several Native American tribes have begun a journey into the unfamiliar terrain of intellectual property rights as a means to assert their self-determination, secure economic independence, and protect their cultural identities. Although "ideas about property have played a central role in shaping the American legal order,"2 in the prevailing legal literature of intellectual property law in the United States, the protection of Native American intellectual property rights is rarely an issue of consideration. Suzan Shown Harjo, in her article, Native Peoples' Cultural and Human Rights: An Unfinished Agenda, writes: "The cultural and intellectual property rights of Native Peoples are worthy of being addressed during this time of increased appropriation of Native national names, religious symbology, and cultural images."3 In contrast, within the realm of international law, the topic of intellectual property is a high priority, uniting the concerns for self-determination and economic independence.

The national Sacred Places Protection Coalition is most appreciative of the opportunity to develop a record on the status of Native American sacred places, how they are faring under existing laws and policies and what new law needs to be enacted for their protection. It is our hope that the Committee will continue its series of oversight hearings and, in this 25th anniversary year of enactment of the American Indian Religious Freedom Act, will begin to develop legislation that treats the subject with the seriousness it deserves. Since the Committee’s last oversight hearing, the Sacred Places Protection Coalition conducted a gathering of Native American traditional religious leaders and practitioners, as well as tribal representatives, cultural specialists and attorneys.     673 TEMPORALITY IN A TIME OF TAM, OR TOWARDS A RACIAL CHRONOPOLITICS OF INTELLECTUAL PROPERTY LAW ANJALI VATS* ABSTRACT This Article examines the intersections of race, intellectual property, and temporality from the vantage point of Critical Race Intellectual Property (“CRTIP”). More specifically, it offers one example of how trademark law operates to normalize white supremacy by and through judicial frameworks that default to Euro-American understandings of time. I advance its central argument—that achieving racial justice in the context of intellectual property law requires decolonizing Euro-American conceptions of time— by considering how the equitable defense of laches and the judicial power to raise issues sua sponte operate in trademark law. This report is the culmination of the evaluation, which included site visits ano field hearings. The largely undocumented knowledge base of Native American experience must be recorded and preserved if it is not to be lost. Ten major challenges were identified on topics such as funding support, training and technical assistance, tribal library holdings, cooperative activities, state and local partnerships, federal policy, model programs, museum and archival services, adult and family literacy programs, and newer information technology. The report contains detailed descriptions of Commission activities and incorporates a "Summary Report" (also published separately), as well as the "Long Range Action Plan" containing strategies for high quality information services to Native American peoples.
